Who Controls the National Academic Promotion System: An Analysis of Power Distribution in Poland

In studying the performance of academic systems, one often tries to find out—by inspecting some w... more In studying the performance of academic systems, one often tries to find out—by inspecting some well-defined parameters—how specific changes in the legal system influence the volume and quality of desired outputs, such as publications, patents, or alumni. This mechanistic approach neglects the fact that the main actors in this spectacle are not passive, but have their own priorities, and actively self-organize in response to any changes in their professional environment. In this contribution, we investigate such collective social behavior using the data for academic promotions in Poland in the years 2011 to 2020. Focusing on degrees higher than the PhD, we analyzed over 12,500 habilitation (= higher doctorate) and over 3,000 professorship applications, extracting personal data on academic promotion panel membership along with official roles on the panels. These details were then linked with data on the personal make-up of three consecutive terms of the central body overseeing academic promotions in Poland, Centralna Komisja do Spraw Stopni i Tytułów (“Central Board for Degrees and Titles”). As a result, we were able to identify a privileged group of individuals who controlled a substantial majority of academic promotions beyond the PhD degree by virtue of being part of the Central Board. We found that this relatively small group of academics held dominant control over academic promotions by repeatedly serving on promotion panels. Thus, despite the well-meaning intentions of the reformists who had designed it, the Polish system of academic promotions in the past decade can hardly be regarded as based on pure merit.

Według przepisów dotychczasowych odpowiedzialność sprzedawcy była zróżnicowana w zależności od tego, czy nabywcą był konsument (niezgodność towaru konsumpcyjnego z umową), czy też inny podmiot (rękojmia). W wyniku nowelizacji Kodeksu cywilnego oba reżimy odpowiedzialności zostały połączone, co należy uznać za rozwiązanie trafne, ułatwiające rozstrzyganie spraw dotyczących falsyfikatów. Nowelizacja przepisów Kodeksu cywilnego i ustawy o ochronie zabytków i opiece nad zabytkami wywarła jednak nieoczekiwany skutek, jeśli chodzi o odpowiedzialność za wady prawne. W wyniku wprowadzenia przepisów służących zwalczaniu przestępczości przeciwko zabytkom wielu nabywców zostanie pozbawionych możliwości skutecznego podnoszenia roszczeń z tego tytułu.

Obok typowych dla kla sycznego prawa własności intelektualnej problemów pojawiają się nowe, związane z dziedzinami prawa nie kojarzonymi dotychczas z dobrami niema terialnymi. Coraz częściej, zwłaszcza w przypadku firm prowadzących dzia łalność gospodarczą w obszarze nowych technologii, własność intelektualna staje się cennym, jeśli nie najistotniejszym, składnikiem przedsiębiorstwa. To ona decyduje o sukcesie rynkowym przedsiębiorcy, to na niej coraz częściej ustanawiane są zabezpieczenia rzeczowe. Wreszcie, w przypadku upadłości przedsiębiorcy, to właśnie jej los może mieć kluczowe znaczenie dla możli wości jego dalszego funkcjonowania w trakcie trwania postępowania i ewen tualnie po zawarciu układu. Będzie to szczególne istotne w przypadku umów mających za przedmiot dobra niematerialne, a zawartych przed ogłoszeniem upadłości przez upadłego i jego kontrahentów. Pomimo niewątpliwej ważkości analizowanych tu kwestii nie doczekały się one szerszego potraktowania w literaturze. Ich znaczenie dostrzegł nato miast ustawodawca, wprowadzając do prawa upadłościowego i naprawczego1 przepisy odnoszące się do praw na dobrach niematerialnych. Celem niniej szego artykułu jest przedstawienie podstawowych problemów mogących wy łonić się podczas ich stosowania. Directive 93/7/EEC created a legal framework for the return of cultural goods illegally removed f... more Directive 93/7/EEC created a legal framework for the return of cultural goods illegally removed from the territory of a Member State. The procedure for the return of cultural goods proved to be ineffective for numerous reasons, including a very narrow definition of a cultural good, flawed instruments of administrative cooperation, or risky court proceedings connected with the indemnification of the possessor. Directive 2015/60/EU is a new step towards the creation of an effective European system of return of cultural goods. Pursuant to the new directive each Member State can now define which cultural goods constitute national treasures. The directive has also provided for the creation of new, electronic means of fostering administrative cooperation, while court proceedings have been amended to minimize the aforementioned legal risks. Thus, once the new directive has been implemented by Member States, the result may be a greater number of returns of illegally exported cultural goods, based on adherence to its provisions.

Council of Europe Cultural Heritage and Education Policy: Preserving Identity and Searching for a Common Core?

This article presents the Council of Europe's educational policy, indicating its major milestones... more This article presents the Council of Europe's educational policy, indicating its major milestones and characteristics when it comes to issues of cultural heritage. First it offers an analysis of the strategic documents (i.e. recommendation No. R (98) 5 of the committee of ministers to member states concerning heritage education and conventions, with emphasis on the Council of Europe Framework Convention on the Value of Cultural Heritage for Society (Faro Convention). The notion of a common European Cultural Heritage as a shared and non-renewable resource is presented in the human rights approach to cultural heritage. The article pays special attention to intercultural dialogue and how it is supposed to support the European cultural identity. The second part explores existing links between the Council of Europe (CoE) and EU policies. The EU joint programmes regarding Cultural Routes of the Council of Europe (Joint Programme with the European Commission [DG GROW] and Joint Programme with the European Commission [DG-REGIO] (Routes4U) are presented. Additionally, the authors point out the links between the UNESCO cultural conventions and the Council of Europe policy framework. Finally, the article delivers conclusions as to whether a synergy exists between the European Union's and the CoE's policies, and answers the question why this is so important in cultural heritage education.

Regardless of the fact that not all legal systems have a clearly outlined taxonomy of processes l... more Regardless of the fact that not all legal systems have a clearly outlined taxonomy of processes leading to the mutual exchange of promises and to the creation of a contract, there is a consensus that a contract can be formed by offer and acceptance, by negotiations, at an auction, or by a public tender. Thus, the starting point for further analysis will be offer and acceptance as the primary and most often used methods of forming a contract. An offer is a binding proposal to enter into a contract. This proposition is nonnegotiable, i.e., the other party is proposed a contract complete with all essential elements, and may choose either to accept it or refuse it, as the case may be. Therefore, an offer has to be sufficiently precise so that a simple 'yes' or 'no' from the other party will suffice to create a contract. There are legal systems that define the notion of offer in their civil codes, with definitions varying in their scope and content, but the slightly (over)simplified definition above can be understood as part of the common core of civil law systems. The details, like the need to present a complete contract or only its relevant elements, under the assumption that the rest will be implied by the provisions of the codes, are not irrelevant, but can be set aside at this point. For now, we will focus on distinguishing between an offer and other, non-binding proposals. An offer has to be proposed, with the offeror's intent to be bound by its wording if accepted. The first test then will be 'was there a will to contract'? Standard schoolbook examples like a professor using the keys to her car to demonstrate brevi manu traditio or that of an actor writing his last will on stage apply. But that is where the easy part ends. The next test is applied to more complex factual situations, like documents containing all the required elements of a binding offer but without a clear indication that there is an intention to be bound by its contents. Classical examples are price lists, advertisements, catalogues, and simple information like 'Lemonade-1 EUR per cup.' There is no rule of the thumb as to the nature of such declarations. Some legal systems have the tendency to treat them as non-binding information, while others see them rather as offers unless proven otherwise. Finally, there are systems where some sort of guidance rules is provided-'when in doubt whether it is or is not an offer, but only an invitation to treat.' A good example is the rule in the PolCC stating that if you display a price on an object placed in public view at a vendor's place of business, this constitutes an offer unless proven otherwise. Other promises, especially regarding information on the quality of a product, may also be considered legally binding. This is particularly so in advertising, where the distinction between a mere 'puff' and a contractual promise may decide the fate of a business in case of a lawsuit. Traditionally, advertisements were considered nonbinding commercial exaggerations unless the intent to create a binding contract was ostensible, like in the famous case of Carlile v Carbolic Smoke Co. Thus, for instance, no one could reasonably expect that a washing powder advertised with the slogan 'RADION cleans clothes all by itself' (a Polish slogan from 1930s) would actually require no input on the buyer's side. Regardless of the fact that not all legal systems have a clearly outlined taxonomy of processes l... more Regardless of the fact that not all legal systems have a clearly outlined taxonomy of processes leading to the mutual exchange of promises and to the creation of a contract, there is a consensus that a contract can be formed by offer and acceptance, by negotiations, at an auction, or by a public tender. Thus, the starting point for further analysis will be offer and acceptance as the primary and most often used methods of forming a contract. An offer is a binding proposal to enter into a contract. This proposition is nonnegotiable, i.e., the other party is proposed a contract complete with all essential elements, and may choose either to accept it or refuse it, as the case may be. Therefore, an offer has to be sufficiently precise so that a simple 'yes' or 'no' from the other party will suffice to create a contract. There are legal systems that define the notion of offer in their civil codes, with definitions varying in their scope and content, but the slightly (over)simplified definition above can be understood as part of the common core of civil law systems. The details, like the need to present a complete contract or only its relevant elements, under the assumption that the rest will be implied by the provisions of the codes, are not irrelevant, but can be set aside at this point. For now, we will focus on distinguishing between an offer and other, non-binding proposals. An offer has to be proposed, with the offeror's intent to be bound by its wording if accepted. The first test then will be 'was there a will to contract'? Standard schoolbook examples like a professor using the keys to her car to demonstrate brevi manu traditio or that of an actor writing his last will on stage apply. But that is where the easy part ends. The next test is applied to more complex factual situations, like documents containing all the required elements of a binding offer but without a clear indication that there is an intention to be bound by its contents. Classical examples are price lists, advertisements, catalogues, and simple information like 'Lemonade-1 EUR per cup.' There is no rule of the thumb as to the nature of such declarations. Some legal systems have the tendency to treat them as non-binding information, while others see them rather as offers unless proven otherwise. Finally, there are systems where some sort of guidance rules is provided-'when in doubt whether it is or is not an offer, but only an invitation to treat.' A good example is the rule in the PolCC stating that if you display a price on an object placed in public view at a vendor's place of business, this constitutes an offer unless proven otherwise. Other promises, especially regarding information on the quality of a product, may also be considered legally binding. This is particularly so in advertising, where the distinction between a mere 'puff' and a contractual promise may decide the fate of a business in case of a lawsuit. Traditionally, advertisements were considered nonbinding commercial exaggerations unless the intent to create a binding contract was ostensible, like in the famous case of Carlile v Carbolic Smoke Co. Thus, for instance, no one could reasonably expect that a washing powder advertised with the slogan 'RADION cleans clothes all by itself' (a Polish slogan from 1930s) would actually require no input on the buyer's side. not been analyzed thoroughly by both canon and civil lawyers. Nontheless it is an interesting and important, yet underappreciated field of research. In this paper, an attempt to show future poles of research, namely: separation of church and state and protection of religious cultural patrimony, protection of cultural goods of the churches in canon law and comparative legal research on the subject has been made. Any future research should focus in particular on Central and Eastern Europe – the region whose cultural property laws have not yet been analyzed in this respect.

This chapter therefore analyses the transposition and implementation of the requirements of the SD into the national (administrative) law system of Poland. The chapter treats all relevant requirements of the SD, such as the Point of Single Contact (POSC), the screening of national law according to the requirements of the SD, the adaption of authorisation schemes for service provision, the requirement of ‘tacit authorisation’, and the need for new rules on administrative cooperation. Finally an assessment of the impact of the SD on the national (administrative) law system is provided.
