Trademark Policy

Version 1.0 — Effective April 2026

This policy explains how the names and product marks associated with this repository may be used.

1. DataDrivenConstruction marks (the "DDC Marks")

The following are trademarks or service marks of Artem Boiko / DataDrivenConstruction.io ("Licensor"), whether or not registered in any particular jurisdiction:

Registration status: some marks are registered with the EUIPO and with national trademark offices. Unregistered marks are asserted under German trademark law (§ 4 Nr. 2 MarkenG, prior-use acquisition) and under U.S. common-law trademark rights. References in this policy to "the DDC Marks" cover both registered and unregistered marks of Licensor.

2. Permitted uses (nominative fair use)

You may use the DDC Marks without prior written permission only for factual, descriptive reference - for example:

  • "data sourced from DDC CWICR"
  • "uses OpenConstructionEstimate"
  • academic citation of the dataset (see CITATION.cff and NOTICE for the preferred format).

Such use must:

  • not alter, abbreviate, translate, or stylise the marks beyond Licensor's published logo-usage guidelines;
  • not suggest sponsorship, endorsement, affiliation, or partnership with Licensor where none exists;
  • include a disclaimer where your product or service is not produced by Licensor: "This product is not affiliated with, endorsed by, or sponsored by DataDrivenConstruction."

3. CC BY 4.0 attribution ≠ trademark licence

The Creative Commons Attribution 4.0 International licence that covers the Data (see LICENSE and LICENSE-DATA.txt) requires you to give attribution to Licensor when you redistribute or build upon the Data. That attribution requirement is satisfied by the factual nominative use described in Section 2 above.

However, CC BY 4.0 does not grant trademark rights (clause 2(b)(2) of the licence expressly reserves them to the licensor). You therefore must not use the DDC Marks to distinguish your product or service beyond the factual "data sourced from DDC CWICR" and similar references.

4. Prohibited uses

Without prior written permission from Licensor you may NOT:

(a) use the DDC Marks in a product name, company name, or domain name (e.g. cwicr-pro.io, openconstructionestimate-cloud, ddc-data.net); (b) reproduce, modify, or stylise DDC logos or wordmarks; (c) sell, licence, or monetise derivative data products under a name that is confusingly similar to a DDC Mark; (d) register DDC Marks as trademarks, service marks, domain names, or social-media handles in any jurisdiction; (e) use DDC Marks to imply that your derivative dataset is authoritative, complete, or endorsed by Licensor when it is not; (f) strip attribution from the Data and replace it with your own branding as if you had compiled the Data yourself.

Use that crosses the line between permitted nominative fair use and prohibited use is a trademark infringement under §§ 14-15 MarkenG (Germany), 15 U.S.C. §§ 1114, 1125 (United States), and EU Regulation 2017/1001 Art. 9 (EU).

5. Third-party classification-standard marks

The dataset references classification codes whose names and codes are trademarks of their respective owners:

  • DIN and DIN 276 - DIN Deutsches Institut für Normung e.V.
  • GAEB - Gemeinsamer Ausschuss Elektronik im Bauwesen
  • NRM - Royal Institution of Chartered Surveyors (RICS)
  • MasterFormat®, UniFormat - Construction Specifications Institute (CSI)
  • OmniClass - OmniClass Construction Classification System
  • ISO - International Organization for Standardization

These codes are used as factual references; no standard's copyrighted descriptive text is reproduced in the Data without permission. Licensor is not affiliated with, endorsed by, or sponsored by any of these standards bodies. See NOTICE for the full attributions.

6. Forks and derivative datasets

Derivatives of the Data redistributed under CC BY 4.0 must:

  • provide the required attribution in the format shown in LICENSE Section 1;
  • change the product name if the derivative is distributed or marketed as a separate product or service (do not publish a derivative dataset as "CWICR-<anything>" or "OpenConstructionEstimate-<anything>" on data platforms);
  • indicate clearly what has been changed from the original;
  • not imply endorsement by Licensor.

7. Enforcement

Suspected trademark misuse: [email protected].

Licensor reserves the right to pursue takedown notices (Markengesetz § 14(5), Lanham Act § 32) and domain-name transfers (UDRP, .eu ADR).

8. Future assignment

This policy survives the assignment of trademark rights to a successor legal entity - including a German Unternehmer- gesellschaft (haftungsbeschränkt) (UG) or Gesellschaft mit beschränkter Haftung (GmbH) formed by Artem Boiko - on the same terms.
