Schedule of Delivery
SELLER guarantees that the commodity for the shipment will be ready for
loading at the point of loading within 20 (twenty) days after SELLER
receives the ETA nomination of vessel from BUYER.
BUYER shall arrange the utilization of a bulk carrier suitable for the
carriage of the carriage of the coal and suitable for unload from barge at
the loading port. Vessel shall be equipped with 4 sets of hydraulic system
crane with minimum capacity of 25 MT and fitted with 4 sets of grabs.
Each grab has a minimum capacity of 10 cbm to achieve the loading rate
of 8,000 MT PWWP SHINC. The loading rate shall be determined further
and confirmed by both parties upon receiving the ship details.
In the event the loading is only from one side of the vessel due to bad
weather (rough sea, high swell, etc) then the loading rate will be
calculated on pro-rate basis depending on how many cranes are working.
Jadwal Pengiriman
PENJUAL menjamin bahwa komoditas untuk pengiriman akan siap untuk
dimuat dalam waktu 20 (dua puluh hari) hari setelah PENJUAL menerima
nominasi ETA kapal dari PEMBELI.
PEMBELI akan menyiapkan fasilitas peralatan yang memadai dari kapal
curah untuk pemanfaatan pemuatan batubara dari tongkang keatas kapal
di tempat kapal berlabuh. Kapal akan dilengkapi dengan 4 set crane
dengan system hidrolik dengan kapasitas minimum 25MT dan terpasang
4 set grabs, masing-masing dengan kapasitas minimum 10 cbm untuk
mencapai pemuatan 8000 MT PWWP SHINC. Tingkat pemuatan akan
ditentukan lebih lanjut dan akan ditetapkan oleh kedua belah pihak ketika
menerima spesifikasi kapal.
Pada peristiwa dimana pemuatan hanya dapat dilakukan pada satu sisi
kapal dalam kaitan dengan cuaca tidak baik (ombak besar, gelombang
laut tinggi, dll) kemudian tingkat pemuatan akan dihitung atas dasar prorata basis tergantung pada berapa banyak crane yang sedang bekerja.
BUYERS shall nominate a vessel for each shipment to SELLER, 20
(twenty) days prior to the ETA of the vessel. Otherwise, SELLER has the
right to refuse the agreed laycan and SELLER will reply within one day
regarding the acceptance of the nominated vessel, which shall not be
unduly withheld. The vessel age must not less than 10 years old, ISM
certified and meets the classification of high class vessel, e.g., Lloyd or
ABS or equivalent.
PEMBELI akan memberitahukan kepada PENJUAL nominasi kapal untuk
setiap pengapalan 20 (dua puluh) hari sebelum jadwal perkiraan
kedatangan kapal. Jika tidak, PENJUAL berhak untuk menolak tanggal
laycan dan PENJUAL harus memberikan jawaban kepada PEMBELI tentang
diterimanya nominasi kapal dalam waktu satu hari. Umur kapal harus
tidak melebihi 10 tahun dan memenuhi klasifikasi kapal kelas tinggi
Pelayaran (Lloyds) atau ABS atau yang setara.
BUYER shall notify SELLER every 12 days, 10 days, 7 days, 3 days, 48
hours and 24 hours on the vessels estimated time of arrival at the loading
port.

PEMBELI akan memberitahukan kepada PENJUAL setiap 12 hari, 10 hari, 7
hari, 3 hari, 48 jam dan 24 jam tentang perkiraan ketibaan kapal di lokasi
pemuatan/pelabuhan muat.
Based on vessel ETA schedules provided by BUYER; SELLER, prior the
arrival of the vessel, shall prepare the loading of coal.
Berdasarkan jadwal kedatangan kapal yang diberikan oleh PEMBELI,
PENJUAL sebelum kedatangan kapal sudah harus mempersiapkan
batubara secara menyeluruh untuk dimuatkan.
All carrying vessels under this contract shall be chartered and allocated
by BUYER.
All carrying barge from Jetty/Loading port to the Vessel in this contract
shall be chartered and allocated by SELLER.
Semua kapal yang mengangkut batubara didalam kontrak ini disewa dan
dialokasikan oleh PEMBELI.
Semua tongkang yang mengangkut batubara curah dari Jetty/Pelabuhan
muat ke Kapal besar didalam kontrak ini disewa dan dialokasikan oleh
PENJUAL.
If analysis report shows deviation that require BUYER to reject the cargo
as the provision made under Clause 2 (two), then BUYER will take care of
the entire cargo delivery to the SELLER. SELLER shall bear the cost of
transportation of the cargo from the BUYERs warehouse and reimburse
the cost of transportation of the cargo from the unloading port to the
BUYERs warehouse.
Apabila laporan analisa menunjukan penyimpangan yang mengharuskan
PEMBELI menolak muatan, sesuai ketentuan Pasal 2 (dua), maka PEMBELI
akan mengurus penyerahan seluruh muatan ke PENJUAL. PENJUAL akan
menanggung biaya pengangkutan muatan dari gudang PEMBELI serta
mengganti biaya pengangkutan muatan dari pelabuhan bongkar ke
gudang PEMBELI sebelumnya.
CLAUSE 5
PRICE AND METHOD OF PAYMENT
HARGA DAN TATACARA PEMBAYARAN
Unit price for the coal with the specifications as in Clause 2 is:
1. The Total Shipment is 72,000 MT and US$ ./MT free on Board
Mother Vessel at Taboneo South Kalimantan anchorage.
2. The Total Value of this Agreement is US$ /Cash Basis
with a tolerance level of 10%.
3. Price stated above will be reviewed and adjusted every 2 (two)
months.
Harga Satuan dari batubara yang sesuai dengan spesifikasi adalah:
1. Pengapalan pertama total 72,000 MT dengan harga US $ ./ MT
terima diatas Kapal Besar yang berlabuh di Tanjung Pemancingan
atau Taboneo Kalimantan Selatan.
2. Nilai Total Perjanjian ini adalah US$ ../ Cash dengan
toleransi sebesar 10%.

3. Harga tersebut diatas setiap 2 (Dua) bulan akan ditinjau kembali
dan menyesuaikan harga pada umumnya

expenses required for the export of coal from Indonesian.

At loading Port, SELLER shall appoint SURVEYOR INDEPENDENT (SI or SGS)
acceptable to buyer to determine the weight of the shipment of the cargo
in accordance to ASTM Standard Acceptable to buyer. Weight of the
shipment of the product shall be determined by draft survey. Such weight
certification at loading port shall be deemed as final and binding on both
parties and shall be used for invoicing purposes. The cost of such
weighing and draft survey shall be for SELLERS account. The loading
weight certificate shall the be faxed and 1 (one) copy airmailed to the
BUYER within 4 (four) working days of completion of loading of the vessel.
Di Pelabuhan Muat, PENJUAL akan menunjuk SURVEYOR INDEPENDENT (SI
or SGS) yang disetujui oleh PEMBELI untuk menetapkan jumlah muatan
batubara diatas kapal dengan menurut Standard ASTM yang bisa diterima
PEMBELI. Jumlah muatan diatas kapal akan ditetapkan dari draft survey.
Sertifikat Jumlah muatan di tempat pemuatan akan dianggap sebagai
hasil akhir dan mengikat KEDUA PIHAK dan akan dipergunakan untuk
perhitungan di Faktur. Semua biaya survey jumlah muatan dan survey
draft ditanggung oleh PENJUAL.
Sertifikat jumlah muatan dan Sertifikat draft akan dikirim ke PEMBELI
melalui faksimil atau POS dalam 4 (empat) hari kerja sesudah selesai
pengapalan di kapal curah.
At loading port, seller shall appoint SURVEYOR INDEPENDENT (Seller
Option) for Sampling & Analysis of the product in accordance with ASTM
Standards acceptable to BUYER. At the time of loading of shipment,
mutually agreed independent load port inspector shall take representative
samples in accordance with ASTM Standards acceptable to buyer, the
report done at loading port to be treated as final result. The cost of such
sampling and analysis shall be for SELLERS account.
Pada pelabuhan muat, PENJUAL akan menunjuk SURVEYOR INDEPENDENT
(Seller Option) untuk mengambil sampling dan analisa dari produk
dengan standar ASTM yang bisa diterima PEMBELI. Pada saat pemuatan di
kapal Independent Inspector akan mengambil contoh batubara menurut
standar ASTM yang disetujui PEMBELI dan hasil dari pada laporan ini akan
disetujui KEDUA PIHAK sebagai hasil akhir. Semua biaya sampling dan
analisa ditanggung oleh PENJUAL.
CLAUSE 6
LOADING TERMS
KETENTUAN PEMUATAN
Notice of Readiness (NOR) shall be tendered by the vessel after arrival at
designated load port at any day time day or night, on any day, Saturday,
Sundays and Holidays included, provided the vessel is in all respect ready
to load, Sellers guarantee one safe port/anchorage where vessel shall
always be afloat at the loading port.

Laytime to cease on completion of loading.
Shifting time from anchorage (at the time the pilot is onboard) to the
loading anchorage shall not count towards Laytime, or, if the vessel is
already on Demurrage, towards Demurrage.
Notice of Readiness (NOR) akan diterbitkan oleh kapal sesudah tiba pada
tempat berlabuh pada waktu kapan saja, siang hari, malam hari, Sabtu,
Minggu dan Hari Libur termasuk, dimana kesediaan kapal untuk dimuat.
PENJUAL akan menentukan tempat yang aman untuk berlabuh kapal dan
dapas dilakukan pemuatan di pelabuhan muat.
Laytime dihitung berakhir pada saat selesai pemuatan.
Waktu olah gerak kapal pada saat berlabuh (pada saat Pilot diatas kapal)
untuk pemuatan tidak akan dihitung sebagai Laytime atau kecuali telah
terjadi Demurrage.
In the event of the Sellers failure to load full cargo on the arrival of the
vessel at load port, including dead freight, demurrage incurred shall be for
Sellers account.
In case the loading of the vessel is interrupted for more than 72
consecutive hours for reason of cargo shortage and / or non readiness of
Sellers customs/port/governmental documentation formalities, buyer has
the right to sail the vessel with cargo on board and Seller shall be
responsible for direct and consequential losses on account of the same.
The agreed laytime shall be maximum 10 (ten) days. The Buyer will be
charged for demurrage of mother vessel at USD 30,000.00 each day from
the agreed duration, which is on the seven day onward.
Dispatch bonus of mother vessel is 50% from demurrage.
Dimana pada saat PENJUAL gagal memenuhi pemuatan batubara pada
kapal, tidak tercapai jumlah pemuatan Dead Freight, Demurrage yang
timbul, semua kerugian akan menjadi tanggungan PENJUAL.
Dimana pada saat pemuatan kapal terganggu selama 72 jam yang
diakibatkan kargo terputus (kurang) dan atau ketidaksiapan PENJUAL,
masalah kepabean, pelabuhan muat, dokumen formal untuk pemuatan,
PEMBELI berhak memerintahkan kapal untuk berlayar dengan jumlah
kargo seadanya diatas kapal dan PENJUAL harus menanggung semua
kerugian yang langsung dan kerugian yang tak langsung. Masa pemuatan
yang disepakati adalah 10 (sepuluh) hari. PEMBELI menetapkan
Demurrage kapal senilai USD 30.000,00 per hari selama waktu yang
diberikan. Maksimum 7 (tujuh)hari. Bonus Dispatch kapal adalah 50% dari
Demurrage.
The Seller shall be liable to pay to the Buyer all Demurrage charges
calculated in accordance with the terms of this agreement. Demurrage
charges shall be paid in respect of time required to load the vessel in
excess of laytime at the rate of the relevant charter party per day
(prorate) for all time in excess of laytime.
The buyer shall be laible to pay to the Seller Despatch in respect of time
of laytime saved in loading the vessel, at the rate of relevant charter party
per day (pro rate ) for laytime saved.
Demurrage and dispatch money, under this agreement shall be settled
directly between Buyer and Seller through the Payment cash, after

completion of loading and issuance of the Statement of Facts and Time
Sheet.
Demurrage/Dispatch calculations shall be made on the basis of
Statement of Fact and Time Sheet signed by the master/Owners agent
at loading port.
PENJUAL akan dikenakan untuk membayar kepada PEMBELI semua biaya
Demurrage yang terhitung waktu muat daripada laytime yang diberikan
dan disepakati.
PEMBELI akan dikenakan untuk membayar kepada PENJUAL Bonus
Dispatch yang terhitung menghemat hari daripada Laytime yang
diberikan dan disepakati.
PENJUAL melalui pembayaran cash sesudah selesai pemuatan dan
terbitnya Statement of Fact dan Time Sheet.
Perhitungan Demurrage/Dispatch akan dihitung berdasarkan Statement
of Fact dan Time Sheet yang diterbitkan oleh Agen kapal di Pelabuhan
muat dan ditanda tangani kapten kapal/Pemilik kapal.
CLAUSE 7
GENERAL TERM AND CONDITIONS
KETENTUAN UMUM
By this agreement, the Seller agrees to sell and the Buyer agrees to buy
the commodity specified in this agreement.
Melalui kesepakatan ini, PENJUAL setuju untuk menjual dan PEMBELI
setuju untuk membeli komoditas yang disebut dalam kesepakatan ini.
The parties hereby agree that the term of this agreement shall commence
from the date of signing of this agreement until the sale and delivery of
the contracted quantity under this agreement has been fully performed by
the parties.
Para pihak dengan ini setuju bahwa ketentuan kesempatan ini akan mulai
berlaku sejak tanggal penandatanganan kesepakatan ini hingga penjualan
dan penyerahan kuantitas yang disepakati telah sepenuhnya dilakukan
oleh para pihak.
CLAUSE 8
DEFINATIONS
DEFINISI
In this Agreement, unless the context otherwise requires, the following
terms shall respectively have the following meanings:
Dalam kesepakatan ini, kecuali diartikan lain, masing-masing terminology
berikut ini akan memiliki arti sebagai berikut:
A fraction of a cent any calculation shall be rounded up to the
nearest cent if such fraction is one half of a cent or more, and shall
be rounded down when otherwise.
Pecahan dari satu sen dalam setiap perhitungan akan dibulatkan
keatas hingga nilai sen terdekat apabila pecahan tersebut bernilai

setengah sen atau lebih, dan akan dibulatkan kebawah apabila

bernilai sebaliknya.
A fraction of a tonne in any calculation shall be rounded up to the
nearest tonne if such fraction is one half of a tonne or more, and
shall be rounded down when otherwise.
Pecahan dan satu ton dalam setiap perhitungan akan dibulatkan
keatas hingga nilai tonase terdekat apabila pecahan tersebut
bernilai setengah ton atau lebih, dan akan dibulatkan kebawah
apabila bernilai sebaliknya.
ASTM means the American Standard for Testing and Materials and
ISO means International Organization for Standardization.
ASTM berarti American Standard for Testing and Materials dan
ISO berarti International Organization for Standardization.
Coal shall mean steam coal in bulk (non cooking coal)produced
from south Kalimantan, Indonesia.
Coal atau Batubara adalah pembakaran (yang bukan cooking)
yang dihasilkan dari Kalimantan Selatan, Indonesia.
Dollar US, cents where used refer to the currency of the United
state of Amerika, Dollar USCent adalah mata uang United state of
Amerika.
FOB means delivery Free on Board in accordance with Incoterms
2000.
FOB berarti harga hingga barang diterima diatas kapal angkut,
sesuai dengan ketentuan Incoterms 2000
Kcal means Kilocalorie(s) as defined in the International System
of Units.
Kcal berarti kilocalorie sebagaimana didefinisikan dalam Sistem
Unit Internasional.
Kg means kilogram (s) as defined in International System of
Units.
Kg berarti kilogram sebagaimana didefinisikan dalam Sistem Unit
International.
Major Indonesia Holidays means 2 days of Idul Fitri, 1 day of Idul
Adha, Independence Day and Christmas Day
Hari Libur Besar Indonesia berarti 2 hari Idul Fitri, 1 hari Idul Adha,
hari Kemerdekaan dan hari Natal.
mm means Milimeter as defined in International System of
Units
mm berarti Milimeter sebagaimana didefinisikan dalam Sistem
Unit Internasional.
Point of Loading means the port or off-shore coordinate in
Indonesia at which the coal is to be loaded.
Posisi Pemuatan berarti pelabuhan atau koordinat lepas pantai
dalam wilayah Indonesia dimana batubara akan dimuat.
Dispatch means the charge payable in the event the seller
completes loading the ship before the end of laytime.
Dispatch berarti tagihan pembayaran dimana PENJUAL selesai
pemuatan ke kapal sebelum berakhirnya masa pemuatan.
Pratique means permission to do business at a port by a ship that
has complied with all applicable local health regulations.

Pratique berarti ijin untuk melakukan kegiatan disebuah
pelabuhan oleh sebuah kapal yang telah lolos peraturan kesehatan
setempat.
Time Sheet means a document which records all daily particulars
relating to the loading or discharging of cargo as well as the
duration of and reason for any stoppage of work and is used as a
basis for the calculation of demurrage/dispatch money.
Time Sheet berarti sebuah dokumen yang mencatat semua
kejadian sehari-hari sehubungan dengan proses pemuatan dan
pembongkaran muatan termasuk waktu yang digunakan dan alasan
untuk setiap halangan pekerjaan sebagai dasar perhitungan uang
demurrage/dispatch.
Ton (s), Tonne(s), and MT means metric tonne of 1000 kgs as
defined in International System of Units.
Ton (s), Tonne(s), dan MT berarti metric ton atau 1.000 kg
sebagaimana didefinisikan dalam Sistem Unit Internasional.
CBM means cubic meter or m3 as defined in International System
of Units.
CBM berarti meter kubik atau m3 sebagaimana didefinisikan
dalam Sistem Unit Internasional
.working day means a day upon which business is regularly
transacted and unless expressly stated, the term day shall be
deemed to mean calendar day.
Working day berarti sebuah hari dimana kegiatan usaha dilakukan
sebagaimana biasanya dan kecuali dikatakan lain, istilah day
berarti hari dlam kelender masehi.
CLAUSE 9
INDEPENDENT SURVEYOR, WEIGHT AND QUALITY
DETERMINATION
SURVEYOR INDEPENDEN DAN PENENTUAN MUTU
Both SELLER and BUYER have agreed to appoint SURVEYOR
INDEPENDENT (SGS or
CCIC) as an independent surveyor for quality and quantity of the coal.
The cost of independent surveyor will be on SELLER account.
Baik PENJUAL dan PEMBELI telah setuju untuk menunjuk SURVEYOR
INDEPENDENT (SGS or CCIC) sebagai surveyor independen untuk mutu
dan jumlah batubara. Biaya pekerjaan surveyor independen
ditanggung oleh PENJUAL.
The coal quantity of each shipment shall be calculated to the nearest
metric ton using barges draft surveys at the loading port. The

weight which is binding upon SELLER and BUYER, and shall form the

satuan metric ton terdekat dengan menggunakan survey draft
tongkang di pelabuhan muat. Surveyor independent akan menerbitkan

Sertifikat Berat yang mengikat PENJUAL dan PEMBELI, dan digunakan
sebagai dasar perhitungan pembayaran.
Coal samples for each shipment shall be taken and analyzed using
ASTM Standards and procedures. The sampling and analysis of the coal
shipment shall be conducted at the Loading Port by the independent
surveyor. The independent surveyor shall provide the corresponding
Certificate of Quality which is binding upon SELLER and BUYER for the
purpose of this contract, and shall form the basis of settlement.
Sample batubara untuk setiap pengiriman akan diambil dan dianalisa
dengan menggunakan standard dan tatacara ASTM. Pengambilan
sample dan analisa batubara akan dilakukan di Pelabuhan Muat oleh
Surveyor Independent. Surveyor Independent akan menerbitkan
Sertifikat Mutu yang mengikat PENJUAL dan PEMBELI, dan digunakan
sebagai dasar perhitungan pembayaran.

CLAUSE 10
INSURANCE, TITTLE AND RISK OF LOSS
ASURANSI, KEPEMILIKAN DAN RESIKO KEHILANGAN
The insurance of the cargo on barge is on SELLERs responsibility.
All risk of loss and damage with respect to the coal shall pass from
SELLER to BUYERs as the coal passes over the rail of the vessel
designated by BUYER at the loading port for vessel.
Asuransi atas komoditas selama diatas tongkang adalah tanggung
jawab PENJUAL.
Tanggungan atas semua resiko atas kehilangan atau kerusakan
batubara akan berpindah dari PENJUAL ke PEMBELI pada saat batubara
telah melewati pagar kapal curah (Vessel) yang disiapkan oleh
PEMBELI pada Pelabuhan muat kapal curah (Vessel).

CLAUSE 11
TAXES, DUTIES, ETC
PAJAK, CUKAI DAN LAIN-LAIN
All duties, levies, dues etc. on the coal if any at discharge port shall be
to BUYERs account. All taxes, duties etc. in the loading port to be at
SELLERs
Semua pajak, cukai dan lainnya sehubungan atas batubara pada
pelabuhan bongkar adalah tanggungan PEMBELI. Semua pajak, cukai
dan lainnya atas batubara pada pelabuhan pemuatan adalah
tanggungan PENJUAL.

FORCE MAJEURE

KEADAAN DARURAT
Neither party shall not be held responsible for failure or delay to
perform all or any parts of this contract due to flood, fire, earthquake,
snowstorm, drought, explosion, strike, war or any other Force Majeure
cases as per International practice. However, the party whose
performance is affected by the event of Force Majeure shall give a
notice to the other party of its occurrence as soon as possible and a
certificate or a document of the occurrence of the force Majeure event
issued by the relative authority or a neutral independent third party
shall be sent to the other party not later than 30 (thirty) days after its
occurrence. If the event of Force Majeure continues for more than 30
(thirty ) days both parties shall renegotiate the performance or the
termination of this contract.
Semua pihak tidak akan mempertanggung jawabkan kegagalan atau
keterlambatan untuk melaksanakan seluruh bagian dari kontrak ini
yang disebabkan bencana banjir, kebakaran, gempa bumi, badai salju,
kekeringan, peledakan, mogok kerja, perang atau keadaan darurat
lainnya yang diakui secara internasional. Namun, pihak yang terkena
dampak dari keadaan darurat ini akan memberikan pemberitahuan
kepada pihak lainnya atas kejadian sesegera mungkin beserta sebuah
sertifikat atau dokumen lainnya yang menjelaskan kejadian darurat
yang dikeluarkan oleh pihak berwenang atau pihak ketiga yang netral
serta independen tidak lebih dari 30 hari (tiga puluh) hari setelah
kejadian. Apabila kejadian darurat berlanjut melampaui 30 (tiga puluh)
hari, maka semua pihak akan menegosiasikan kembali pelaksanaan
kontrak, atau membatalkan kontrak ini.
CLAUSE 13
ARBITRATION
ARBITRASI
All disputes arising between BUYER and SELLER in relation to this
contract or the interpretation or performance here of, shall be settled
by arbitration conducted in accordance with the rules of arbitration of
the international Chamber of Commerce, effective at the time, by three
arbitrators appointed in accordance with such rules.
Arbitration shall be held in Indonesia in the Indonesia Languange,
unless another location is selected by mutual agreement of the parties
concerned.
The award rendered by the arbitration shall be final and binding upon
the parties concerned.
Segala perselisihan yang timbul antara PEMBELI dan PENJUAL
sehubungan dengan kontrak ini atau terjemahan atau tanggung jawab
yang timbul darinya, akan diselesaikan melalui jalur arbitrasi yang
dilakukan sesuai dengan peraturan arbitrasi dari internasional
Chamber of Commerce, yang berlaku saat itu, oleh tiga orang
arbitrators yang ditunjuk sesuai dengan peraturan itu.

Arbitrase akan dilakukan di Indonesia dalam bahasa Indonesia, kecuali
apabila lokasi lain dipilih berdasarkan kesepakatan semua pihak yang
berkepentingan.
Keputusan oleh para arbitrators akan menjadi keputusan final dan
mengikat para pihak yang berkepentingan.
CLAUSE 14
AMENDEMENTS
PERUBAHAN KONTRAK
Any amendments or modifications to this contract shall be made in
writing and subject to confirmation by the contracting parties.
Segala perubahan atau modifikasi atas kontrak ini akan dibuat secara
dan menunggu konfirmasi dari para pihak dalam kontrak ini.
CLAUSE 15
ASSIGNMENT
PENUGASAN
Either party may assign any rights or obligations under this agreement
with prior written consent of the other party.
Masing masing pihak dapat mengalihkan segala hak maupun
kewajibannya dibawah kesepakatan ini dengan ijin tertulis dari pihak
lainnya terlebih dahulu.
CLAUSE 16
LANGUANGE
BAHASA
This contract is written in English and Bahasa Indonesia if there are any
misinterpretations in understanding the terms of this contract, then the
English version shall prevail.
Kontrak ini ditulis dalam bahasa Inggris dan bahasa Indonesia. Apabila
terjadi kesalahan dalam memahami ketentuan kontrak ini, maka versi
bahasa Indonesia akan berlaku.
