the middle of the National high/a4 crossing to ride the tric4cle, he /as suddenl4
bumped b4 a motorc4cle dri)en b4 the accused $gustin Luna%

for medical treatment% Later, she learned that Rhal Magallanes died% $s-ed to
identif4 the accused, /itness pinpointed to $gustin Luna in open court%

"n)estigator at the Mondragon police station% !e testified that he conducted an
in)estigation and identified the s-etch he made of the incident% !e /ent to San
Roque /here he met the accused and the o/ner of the motorc4cle%
:elia Magallanes, mother of the )ictim testified that on april 6, 8227
she /as informed through te.t message b4 Sal)acion $gunod that her son /as
bumped b4 a motorc4cle, so she immediatel4 /ent to the place in Sitio :i4o,
;rg4% "melda, Mondragon and /as informed there that her son, Rhal /as alread4
brought to the hospital% She /ent to the #atarman +eneral !ospital /here she
found her son )er4 /ea- and /ho informed her that he is not feeling /ell and his
head /as painful% he4 thereafter /ent to acloban for further medical treatment
at the :i)ine /orld !ospital% !er son /as brought to ;ettan4 !ospital, later for

$fter the results, the doctor told them that Rhal needs an operation
as he /as still feeling pain on his head% he4 sta4ed for eight>&? da4s at the
hospital but later /ent bac- to #atarman as the4 decided to go to Manila% <hen
the4 arri)ed in #atarman, ho/e)er, her son /as immediatel4 brought again to
#atarman +eneral !ospital /here he died on $pril 0(, 1227% !e testified that she
incurred e.penses for her son9s confinement at :i)ine <orld !ospital in the

PRELIMINARY INVESTIGATION REPORT
On Aanuar4 06, 1206, Lolito L% $nterio of Poblacion 0, Sil)ino Lubos, Northern
Samar filed a letter-complaint before the Office of the Schools :i)ision Superintendent,
#atarman, Northern Northern Samar a letter-complaint against $hmed Lucban, a Public School
eacher of Sil)ino Bocational !igh School, Sil)ino Lubos, Northern Samar for alleged $cts of
Emotional $buse through !umiliating $ct in Biolation of R$ 7'02%
he said letter-complaint upon receipt of the School !ead referred to the
Regional :irector, :epEd and in turn referred bac- to the School Superintendent /hich
resulted to the creation of a :i)ision Fact Finding #ommittee to act on this matter%
#omplainant in his complaint alleged that his son Aohn ;% $nterio, a +rade &
student of Sil)ino Lubos national !igh School% hat the incident happened at about &*22
o9cloc- in the morning of Aanuar4 7, 1206 at the class of the respondent $hmed Lucban% he
complainant further alleged that the respondent uttered defamator4 /ords against his son and as
a result his son has been traumatiEed and has de)elop no interest in pursuing his studies%
$ttached to the complaint are the police blotter, e.cuse letter and medical report%
Prior to the commencement of formal in)estigation, the #ommittee requires the
herein complainant to submit pieces of e)idence to support his complaint that is to include the

characteristics of the person /ho holds a particular -e4 pair%
>d? +o"puter7 refers to an4 single or interconnected de)ice or
apparatus, /hich, b4 electronic, electro-mechanical or magnetic impulse, or b4
other means /ith the same function, can recei)e, record, transmit, store, process,

andDor sound in electronic form% Representing the identit4 of a person and
attached to or logicall4 associated /ith the electronic data message or electronic
document or an4 methodolog4 or procedure emplo4ed or adopted b4 a person and
e.ecuted or adopted b4 such person /ith the intention of authenticating, signing
or appro)ing an electronic data message or electronic document% For such
purposes of these Rules, an electronic signature includes digital signatures%

con)ersations , te.t messages, chatroom sessions, streaming )ideo, and other

parties in obtaining a =ust, e.peditious, and e.pensi)e determination of cases%

RULE 3
ELECTRONIC DOCUMENTS
Secti'# 1. Electr'#ic /'c-6e#t& *& (-#cti'#*l e7-i"*le#t '( 4*4er5,*&e/
/'c-6e#t&. 5 <hene)er a rule of e)idence refers to the term of /riting,
document, record, instrument, memorandum or an4 other form of /riting, such
term shall be deemed to include an electronic document as defined in these Rules%
Secti'# 2. A/6i&&i,ilit0. 5 $n electronic document is admissible in e)idence if it
complies /ith the rules on admissibilit4 prescribed b4 the Rules of #ourt and
related la/s and is authenticated in the manner prescribed b4 these Rules%
Secti'# 3. Pri"ile$e/ c'66-#ic*ti'#. 5 he confidential character of a
pri)ileged communications is not solel4 on the ground that it is in the form of an
electronic document%
RULE 8
1EST EVIDECE RULE
Secti'# 1. Ori$i#*l '( *# electr'#ic /'c-6e#t. 5 $n electronic document shall
be regarded as the equi)alent of an original document under the ;est E)idence
Rule if it is a printout of output readable b4 sight or other means, sho/n to reflect
the date accuratel4%
Secti'# 2. C'4ie& *& e7-i"*le#t t' 'ri$i#*l&.5 <hen a document is in t/o or
more copies e.ecuted at or about the same time /ith identical contents, or is a
counterpart produced b4 the same impression as the original, or from the same
matri., or b4 mechanical or electronic re-recording, or b4 chemical reproduction,
or b4 other equi)alent techniques /hich is accuratel4 reproduces the original,
such copies or duplicates shall be regarded as the equi)alent of the original%
Not/ithstanding the foregoing, copies or duplicates shall not be admissible to the

AUTHENTICATION OF ELECTRONIC DOCUMENTS
Secti'# 1. 1-r/e# '( 4r'"i#$ *-the#ticit0. 5 he person see-ing to introduce an
electronic document in an4 legal proceeding has the burden of pro)ing its
authenticit4 in the manner pro)ided in this Rule%
Secti'# 2. M*##er '( *-the#tic*ti'#. 5 ;efore an4 pri)ate electronic document
offered as authentic is recei)ed in e)idence, its authenticit4 must be pro)ed b4
an4 of the follo/ing means*
>a? b4 e)idence that it had been digitall4 signed b4 the person purported to
ha)e signed the same@
>b? b4 e)idence that other appropriate securit4 procedures or de)ices as

authenticate the manner prescribed hereunder is admissible in e)idence as the
functional equi)alent of the signature of a person on a /ritten document%

ma4 be authenticate in an4 of the follo/ing manner*

the authentication of an electronic signature, it shall be presumed that*

indicate such person9s consent to the transaction embodied therein@ and

authentication of a digital signature, it shall be presumed, in addition to those
mentioned in the immediatel4 preceding section, that*

stored or communicated, including but not limited to input and output procedures,
controls, tests and chec-s for accurac4 and reliabilit4 of the electronic data
message or document, in the light of all the circumstances as /ell as an4 rele)ant

>b? he reliabilit4 of the manner in /hich its originator /as identified%
>c? he integrit4 of the information and communication s4stem in /hich it
is recorded or stored, including but not limited to the hard/are and computer
programs or soft/are used as /ell as programming errors@

/hich an electronic document or electronic data message is recorded or stored,
the court ma4 consider, among others, the follo/ing factors*

de)ice /as operated in a manner that did not affect the integrit4 of the electronic
document, and there are no other reasonable grounds to doubt the integrit4 of the
information and communication s4stem@
>b? <hether the electronic document /as recorded or stored b4 a part4 to
the proceedings /ith interest ad)erse to that of the part4 using it@ or
>c? <hether the electronic document /as recorded or stored in the usual or

Secti'# 1. I#*44lic*,ilit0 '( the he*r&*0 r-le. 5 $ memorandum, report, record
or data compilation of acts, e)ents, conditions, opinions, or diagnoses, made b4
b4 electronic, optical or other similar means at or near the time of or from
transmission or suppl4 of information b4 a person /ith -no/ledge thereof, and
-ept in the regular course or conduct of a business acti)it4, and such /as the
regular practice to ma-e the memorandum, report, record, or data compilation b4
electronic, optical or similar means, all of /hich are sho/n b4 the testimon4 of
the custodian or other qualified /itnesses, is e.pected from the rule on hearsa4
e)idence%
Secti'# 2. O"erc'6i#$ the 4re&-64ti'#. 5 he presumption pro)ided for in
section 0 of this Rule ma4 be o)ercome b4 e)idence of the untrust/orthiness of
the source of information of the method or circumstances of the preparation,
transmission or storage thereof%

stating facts of direct personal -no/ledge of the affiant or based on authentic
records% he affida)it must affirmati)el4 sho/ the competence of the affiant to
testif4 on the matters contained therein%
Secti'# 2. Cr'&&5e%*6i#*ti'# '( /e4'#e#t. 5 he affiant shall be made to affirm
the contents of the affida)it in open court and ma4 be cross-e.amined as a matter
of right b4 the ad)erse part4%
RULE 1.
E=AMINATION OF ;ITNESSES
Secti'# 1. Electr'#ic te&ti6'#0. 5 $fter summaril4 hearing the parties pursuant
to Rule 3 of these Rules, the court ma4 authoriEe the presentation of testimonial
e)idence b4 electronic means% ;efore so authoriEing, the court shall determine the
necessit4 for such presentation and prescribe terms and conditions as ma4 be
necessar4 under the circumstance, including the protection of the rights of the
parties and /itnesses concerned%
Secti'# 2. Tr*#&cri4t '( electr'#ic te&ti6'#0. 5 <hen e.amination of a /itness
is done electronicall4, the entire proceedings, including the questions and
ans/ers, shall be transcribed b4 a stenographer, stenot4pes or other recorder
authoriEed for the purpose, /ho shall certif4 as correct the transcript done b4 him%
he transcript should reflect the fact that the proceedings, either in /hole or in
part, had been electronicall4 recorded%
Secti'# 3. St'r*$e '( electr'#ic e"i/e#ce. 5 he electronic e)idence and
recording thereof as /ell as the stenographic notes shall form part of the record of
the case% Such transcript and recording shall be deemed prima facie e)idence of
such proceedings%
RULE 11
AUDIO> PHOTOGRAPHIC> VIDEO AND EPHEMERAL EVIDENCE
Secti'# 1. A-/i'> "i/e' *#/ &i6il*r e"i/e#ce. 5 $udio, photographic and )ideo
e)idence of e)ents, acts or transactions shall be admissible pro)ided it shall be
sho/n, presented or displa4ed to the court and shall be identified, e.plained or
authenticated b4 the person /ho made the recording or b4 some other person
competent to testif4 on the accurac4 thereof%
