4. Period of Agreement and Time Schedule

The Consultant will carry out all the works assigned to him
according to the conditions of this Agreement and as per the ‫ﻴﻘﻭﻡ ﺍﻻﺴﺘﺸﺎﺭﻱ ﺒﺈﻨﻬﺎﺀ ﺍﻷﻋﻤﺎل ﺍﻟﻤﻭﻜﻠﺔ ﺇﻟﻴﻪ ﺤﺴﺏ ﺸﺭﻭﻁ ﻫﺫﻩ ﺍﻻﺘﻔﺎﻗﻴﺔ‬
periods shown herewithin, also he has to obtain the ‫ ﻜﻤﺎ ﺃﻥ ﻋﻠﻴﻪ ﺍﻟﺤﺼﻭل ﻋﻠﻰ ﻤﻭﺍﻓﻘﺔ ﺍﻟﻤﻬﻨﺩﺱ‬، ‫ﺒﺎﻟﻤﺩﺩ ﺍﻟﻤﻭﻀﺤﺔ ﻓﻴﻤﺎ ﻴﻠﻰ‬
Engineer‘s approval on the detailed work programe for each . ‫ﻋﻠﻰ ﺒﺭﻨﺎﻤﺞ ﺍﻟﻌﻤل ﺍﻟﺘﻔﺼﻴﻠﻲ ﻟﻜل ﻁﻭﺭ ﻗﺒل ﺍﻟﺒﺩﺀ ﺒﻪ‬

If the consultant failed to provide the supervision staff as per ‫ﺇﻨﺫﺍﺭ ﺃﻭ ﺍﺘﺨﺎﺫ ﺃﻴﺔ ﺇﺠﺭﺍﺀﺍﺕ ﻗﻀﺎﺌﻴﺔ ﻭﺒـﺩﻭﻥ ﺤﺎﺠـﺔ ﻹﺜﺒـﺎﺕ ﺤﺼـﻭل‬
the Ministry‘s request or any of the staff members was absent . ‫ﺍﻟﻀﺭﺭ ﺃﻭ ﺍﻟﺨﺴﺎﺭﺓ ﺍﻟﺫﻱ ﻴﻌﺘﺒﺭ ﻓﻲ ﺠﻤﻴﻊ ﺍﻷﺤﻭﺍل ﻤﺘﺤﻘﻘﹰﺎ‬

the Ministry has the right to charge the following penalties :-

If the Ministry assigns the works of this stage to the

Priority in the Government purchase should be given to the

national products or those incorporating products of national ‫ﺇﻋﻁﺎﺀ ﺍﻷﻭﻟﻭﻴﺔ ﻓﻲ ﺍﻟﻤﺸﺘﺭﻴﺎﺕ ﺍﻟﺤﻜﻭﻤﻴﺔ ﻟﻠﻤﻨﺘﺠﺎﺕ ﺍﻟﻭﻁﻨﻴﺔ ﻭﺍﻟﻤﻨﺘﺠـﺎﺕ‬

‫ﺍﺘﻔﺎﻗﻴﺔ ﺭﻗﻡ ‪ ........................‬ﻷﺠل ﺩﺭﺍﺴﺔ ﻭﺘﺼﻤﻴﻡ ﻭﺍﻹﺸـﺭﺍﻑ ﻋﻠـﻰ‬

‫‪Those products where the added value, resulting from its‬‬ ‫‪ 1/1/9‬ﺘﻌﺭﻴﻔﺎﺕ‬
‫‪production, in one of the member countries is not less‬‬
‫‪than 40% of its final value at completion of production ,‬‬ ‫ﺃ ( ﺍﻟﻤﻨﺘﺞ ﺍﻟﻭﻁﻨﻲ‪:‬‬

‫ﻫﻲ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻟﺘﻲ ﻻ ﺘﻘل ﻨﺴﺒﺔ ﺍﻟﻘﻴﻤﺔ ﺍﻟﻤﻀﺎﻓﺔ ﺍﻟﻨﺎﺸﺌﺔ ﻋﻥ ﺇﻨﺘﺎﺠﻬﺎ‬

2-a. The National Products are given the preference in prices over
the similar ones of the foreign products, by a percentage not
less than 10 % and the similar products of National Origin by
a percentage not more than 5 %. In case of non-availability of ( 9 ) ‫ﺘﺎﺒﻊ ﺍﻟﻭﺜﻴﻘﺔ ﺭﻗﻡ‬
national Product, the products of the National Origin will be
given preference of 10 % over foreign similar products. ‫ ﻷﺠل ﺩﺭﺍﺴﺔ ﻭﺘﺼﻤﻴﻡ ﻭﺍﻹﺸـﺭﺍﻑ ﻋﻠـﻰ‬........................ ‫ﺍﺘﻔﺎﻗﻴﺔ ﺭﻗﻡ‬

2-b. In case of shortage of National Products to satisfy
requirements of Governmental Departments from a certain
product, then such departments shall cover the rest of their ‫ﺘﻌﻁﻰ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻟﻭﻁﻨﻴﺔ ﺃﻓﻀﻠﻴﺔ ﻓﻲ ﺍﻷﺴﻌﺎﺭ ﻋﻠﻰ ﻤﺜﻴﻼﺘﻬﺎ ﻤﻥ ﺍﻟﻤﻨﺘﺠﺎﺕ‬ ‫ﺃ‬-2
requirements from the products of the National Origin, and ‫ ﻭﻋﻠﻰ ﻤﺜﻴﻼﺘﻬﺎ ﻤـﻥ ﺍﻟﻤﻨﺘﺠـﺎﺕ ﺫﺍﺕ‬% 10 ‫ﺍﻷﺠﻨﺒﻴﺔ ﺒﻨﺴﺒﺔ ﻻ ﺘﻘل ﻋﻥ‬
after that from the foreign products, taking into consideration ‫ ﻓﻲ ﺤﺎﻟﺔ ﻋـﺩﻡ ﺘـﻭﻓﺭ ﺍﻟﻤﻨـﺘﺞ‬% 5 ‫ﺍﻟﻤﻨﺸﺄ ﺍﻟﻭﻁﻨﻲ ﺒﻨﺴﺒﺔ ﻻ ﺘﺯﻴﺩ ﻋﻠﻰ‬
the above item (2.a) and the conditions of quality and ‫ ﻋﻠـﻰ‬% 10 ‫ﺍﻟﻭﻁﻨﻲ ﺘﻌﻁﻰ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺫﺍﺕ ﺍﻟﻤﻨﺸﺄ ﺍﻟـﻭﻁﻨﻲ ﺃﻓﻀـﻠﻴﺔ‬
delivery. . ‫ﻤﺜﻴﻼﺘﻬﺎ ﻤﻥ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻷﺠﻨﺒﻴﺔ‬

‫ﺏ ﻓﻲ ﺤﺎﻟﺔ ﻋﺩﻡ ﻜﻔﺎﻴﺔ ﻜﻤﻴﺔ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻟﻭﻁﻨﻴﺔ ﻟﺘﻠﺒﻴﺔ ﺍﺤﺘﻴﺎﺠـﺎﺕ ﺍﻷﺠﻬـﺯﺓ‬-2

‫ ﺘﻘﻭﻡ ﻫﺫﻩ ﺍﻷﺠﻬﺯﺓ ﺒﺘﻠﺒﻴﺔ ﺒﺎﻗﻲ ﺍﺤﺘﻴﺎﺠﺎﺘﻬﺎ‬،‫ﺍﻟﺤﻜﻭﻤﻴﺔ ﻜﺎﻤﻠﺔ ﻤﻥ ﻤﻨﺘﺞ ﻤﻌﻴﻥ‬

prices of delivery at buyers stores. In cases where the foreign
products are exempted from custom’s charger or any other. The

specifications used in that country, if any, otherwise
‫ﺃﻋﻼﻩ ﻋﻠﻰ ﺃﺴﺎﺱ ﺃﺴﻌﺎﺭ ﺘﺴﻠﻴﻡ ﻤﺴﺘﻭﺩﻋﺎﺕ ﺍﻟﻤﺸﺘﺭﻱ ﻭﻓﻲ ﺍﻟﺤـﺎﻻﺕ ﺍﻟﺘـﻲ‬
international specifications should be followed .
‫ﺘﻌﻔﻰ ﻓﻴﻬﺎ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻷﺠﻨﺒﻴﺔ ﺍﻟﻤﺴﺘﻭﺭﺩﺓ ﻤﻥ ﺍﻟﺭﺴﻭﻡ ﺍﻟﺠﻤﺭﻜﻴﺔ ﺃﻭ ﻏﻴﺭﻫـﺎ‬
2-e. All governmental agencies should insure that the contractor or . ‫ﺘﻀﺎﻑ ﻗﻴﻤﺘﻬﺎ ﻋﻨﺩ ﺍﺤﺘﺴﺎﺏ ﺍﻷﺴﻌﺎﺭ ﻟﻐﺭﺽ ﺍﻟﻤﻘﺎﺭﻨﺔ‬
supplier have strict himself to the ministerial decree no.6 for
1987 mentioned above. the contractor should complies, when
‫ﺩ ﻴﺸﺘﺭﻁ ﻓﻲ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻟﻭﻁﻨﻴﺔ ﻭﺍﻟﻤﻨﺘﺠﺎﺕ ﺫﺍﺕ ﺍﻟﻤﻨﺸﺄ ﺍﻟﻭﻁﻨﻲ ﻭﺍﻟﻤﻨﺘﺠـﺎﺕ‬-2
qualifying the products, between those considered national
‫ﺍﻷﺠﻨﺒﻴﺔ ﻤﻁﺎﺒﻘﺘﻬﺎ ﻟﻤﻭﺍﺼﻔﺎﺕ ﻫﻴﺌﺔ ﺍﻟﻤﻭﺍﺼﻔﺎﺕ ﻭﺍﻟﻤﻘﺎﻴﻴﺱ ﻟـﺩﻭل ﻤﺠﻠـﺱ‬
products and those products of national origin with the
conditions mentioned in the concerned decree. ‫ﺍﻟﺘﻌﺎﻭﻥ ﺍﻟﻤﻌﺘﻤﺩﺓ ﻤﻥ ﻗﺒل ﺍﻟﺩﻭﻟﺔ ﺍﻟﻤﺸﺘﺭﻴﺔ ﺃﻭ ﺍﻟﻤﻭﺍﺼﻔﺎﺕ ﺍﻟﻤﻌﻤﻭل ﺒﻬﺎ ﻓـﻲ‬
The governmental agencies should insure that the prices of the . ‫ﺍﻟﺩﻭﻟﺔ ﺇﻥ ﻭﺠﺩﺕ ﻓﺈﻥ ﻟﻡ ﻴﻭﺠﺩ ﺃﻱ ﻤﻨﻬﺎ ﻴﻌﻤل ﺒﺎﻟﻤﻭﺍﺼﻔﺎﺕ ﺍﻟﻌﺎﻟﻤﻴﺔ‬
qualified selected products is accurate and real in anyway they
find suitable.
Statement (9) Cont. ‫ﻫـ ﻴﺘﻌﻴﻥ ﻋﻠﻰ ﺍﻟﺠﻬﺔ ﺍﻟﺤﻜﻭﻤﻴﺔ ﺍﻟﻤﺘﻌﺎﻗﺩ ﻤﻌﻬﺎ ﺍﻟﺘﺤﻘﻕ ﻤـﻥ ﺃﻥ ﺍﻟﻤﻘـﺎﻭل ﺃﻭ‬-2
To insure that the contractor and the supplier has to strict himself ‫ﻡ‬1987 ‫ ﻟﺴـﻨﺔ‬6 ‫ﺍﻟﻤﻭﺭﺩ ﺃﻭ ﺍﻟﻤﺘﻌﻬﺩ ﻗﺩ ﺘﻘﻴﺩ ﺒﺄﺤﻜﺎﻡ ﺍﻟﻘﺭﺍﺭ ﺍﻟﻭﺯﺍﺭﻱ ﺭﻗـﻡ‬
to the conditions of the ministerial decree # 6, He should present ‫ﺍﻟﻤﺸﺎﺭ ﺃﻟﻴﻪ ﻭﺍﻨﻪ ﻗﺩ ﺍﻟﺘﺯﻡ ﻓﻲ ﺇﺠﺭﺍﺀ ﺍﻟﻤﻔﺎﻀﻠﺔ ﺒـﻴﻥ ﺍﻟﻤﻨﺘﺠـﺎﺕ ﺍﻟﻭﻁﻨﻴـﺔ‬
to the governmental agencies an evidence of the products final ‫ﻭﺍﻟﻤﻨﺘﺠﺎﺕ ﺫﺍﺕ ﺍﻟﻤﻨﺸﺄ ﺍﻟﻭﻁﻨﻲ ﻭﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻻﺠﻨﺒﻴﺔ ﺒﺎﻟﺸﺭﻭﻁ ﻭﺍﻻﻭﻀـﺎﻉ‬
 ‫‪price supported by technical specifications approving that it‬‬ ‫ﺍﻟﻤﺒﻴﻨﻪ ﻓﻲ ﺍﻟﻘﺭﺍﺭ ﺍﻟﻤﺫﻜﻭﺭ ﻭﻋﻠﻴﻬﺎ ﺍﻟﺘﺜﺒﺕ ﻤﻥ ﺃﻥ ﺍﻻﺴﻌﺎﺭ ﺍﻟﺘﻲ ﺠﺭﺕ ﻋﻠﻰ‬
‫‪satisfy the required technical specifications‬‬ ‫ﺍﺴﺎﺴﻬﺎ ﺍﻟﻤﻔﺎﻀﻠﻪ ﻤﻁﺎﺒﻘﺔ ﻟﻠﻭﺍﻗﻊ ﻭﻟﻼﺴﻌﺎﺭ ﺍﻟﺴﺎﺌﺩﺓ ﻭﺫﻟﻙ ﺒﺄﻴﺔ ﻁﺭﻴﻘﺔ ﺘﺭﺍﻫﺎ‬
‫‪The contractor is subjected , if proven not in compliance with‬‬ ‫ﻤﻨﺎﺴﺒﺔ ‪.‬‬
‫‪the above article (2-e), to requitals dictated in ministerial decree‬‬
‫‪No (6), for the year 1987. And the governmental authority‬‬

‫‪governmental authorities without the need of any prior notice or‬‬ ‫ﺒﺎﺤﻜﺎﻡ ﺍﻟﻘﺭﺍﺭ ﺍﻟﻤﺫﻜﻭﺭ ﺃﻥ ﻴﺒﺭﺯ ﻟﻠﺠﻬﺔ ﺍﻟﺤﻜﻭﻤﻴﺔ ﺍﻟﻤﺘﻌﺎﻗـﺩ ﻤﻌﻬﺎ ﻤﺎ ﻟﺩﻴـﻪ‬

for supply or public works or maintenance or operation or any

the supplier or the Contractor will be bound to buy his

If the consultant or the Contractor fails to comply with that, it ‫ﺘﺄﻤﻴﻥ ﻜﺎﻓﺔ ﺍﻟﻤﺴﺘﻠﺯﻤﺎﺕ ﻤﻥ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺍﻟﻭﻁﻨﻴﺔ ﺃﻭ ﺍﻟﻤﻨﺘﺠـﺎﺕ ﺫﺍﺕ ﺍﻟﻤﻨﺸـﺄ‬

6- It is not allowed for any foreign Contractor constructing

Governmental Project whether main or Sub-contractor, to
construct any producing unit to supply the constructional ( 9 ) ‫ﺘﺎﺒﻊ ﺍﻟﻭﺜﻴﻘﺔ ﺭﻗﻡ‬
requirements of the projects. He is bound to buy such
requirements from the National Products or from the Products ‫ ﻷﺠل ﺩﺭﺍﺴﺔ ﻭﺘﺼﻤﻴﻡ ﻭﺍﻹﺸـﺭﺍﻑ ﻋﻠـﻰ‬........................ ‫ﺍﺘﻔﺎﻗﻴﺔ ﺭﻗﻡ‬

7- The Governmental Departments shall state in the ‫ ﻭﻴﻠﺘﺯﻡ ﺒﺸﺭﺍﺀ ﻜﺎﻓﺔ ﺍﻟﻤﺴـﺘﻠﺯﻤﺎﺕ ﻤـﻥ ﺍﻟﻤﻨﺘﺠـﺎﺕ‬،‫ﺍﻹﻨﺸﺎﺌﻴﺔ ﻟﻠﻤﺸﺭﻭﻋﺎﺕ‬
advertisements of supply or purchasing tenders or projects or ‫ ﻭﻴﻨﺹ ﻋﻠـﻰ ﻫـﺫﺍ‬.‫ﺍﻟﻭﻁﻨﻴﺔ ﺃﻭ ﺍﻟﻤﻨﺘﺠﺎﺕ ﺫﺍﺕ ﺍﻟﻤﻨﺸﺄ ﺍﻟﻭﻁﻨﻲ ﺍﻥ ﻭﺠﺩﺕ‬
maintenance works or operation and in contract forms for ‫ ﻭﺘﻁﺒﻕ ﻓﻲ ﺤﺎﻟﺔ‬، ‫ﺍﻟﺸﺭﻁ ﻓﻲ ﻨﻤﺎﺫﺝ ﺍﻟﻌﻘﻭﺩ ﺍﻟﺘﻲ ﺘﺒﺭﻤﻬﺎ ﺍﻷﺠﻬﺯﺓ ﺍﻟﺤﻜﻭﻤﻴﺔ‬

8- Without breaching to any other ruling punishment , it is

possible to cancel the contract with the supplier or the
Contractor and preventing him from dealing with any other
Governmental Department, for a period of two years, in case of ( 9 ) ‫ﺘﺎﺒﻊ ﺍﻟﻭﺜﻴﻘﺔ ﺭﻗﻡ‬
being dishonest or have provide false in formations concerning
products including fixing tags of National Products or Products ‫ ﻷﺠل ﺩﺭﺍﺴﺔ ﻭﺘﺼﻤﻴﻡ‬........................ ‫ﺍﺘﻔﺎﻗﻴﺔ ﺭﻗﻡ‬

Now it is, therefore, agreed between the two parties here to as

1- The proceeding preamble shall be considered as an integral ‫ﺤﻴﺙ ﺃﻥ ﺍﻟﻭﺯﺍﺭﺓ ﺘﺭﻏﺏ ﻓﻲ ﺍﻟﺘﻌﺎﻗﺩ ﻤﻊ ﺍﻻﺴﺘﺸﺎﺭﻱ ﻟﺩﺭﺍﺴﺔ ﻭﺘﺼﻤﻴﻡ ﻭﺍﻹﺸـﺭﺍﻑ‬

2- In this agreement, the following words and expressions shall ‫ﺃﺠﻠﻪ ﺘﻨﻭﻱ ﺍﻟﻭﺯﺍﺭﺓ ﺍﻟﺩﺨﻭل ﻓﻲ ﺍﺘﻔﺎﻗﻴﺔ ﻤﻊ " ﺍﻻﺴﺘﺸـﺎﺭﻱ " ﻟﻠﻘﻴـﺎﻡ ﺒﺎﻟﻤﺘﻁﻠﺒـﺎﺕ‬

all the works as per the conditions of this agreement.
