Dear Sir/ Madam,

Greetings!
The MVN University (MVN), Palwal is gearing up to organize First Justice P.N. Bhagwati
National Moot Court Competition, 2019.

It gives me colossal pleasure in most genially inviting your revered institution to participate
in National Moot Court Competition, 2019 being tabulated by School of Law, MVN
University, in its campus, Palwal, Haryana on 11th and 12th of October (Friday &
Saturday), 2019.
The Competition seeks to promote interest in the area of Law by especially focusing on Right
to Life, Gender Discrimination, Writ petition and convergence of the same into civil and
criminal law and other laws.
The competition will indeed be an ideal forum to bring together some of the most stimulating
and ingenious young minds, and thus we will together witness their mastery of advocacy and
research to be adjudged by oracle in the Law field. We, therefore, expect the teams from

MOOT PROPOSITION

“I am what I am, so take me as I am”


Can we escape from our own individuality? Denial of self-expression is as good as inviting
death. One defines oneself!
Cairoli is a Country whose social, legal, cultural, economic conditions and systems are
similar to that of India. It recognizes the Right to life, liberty & freedom as its fundamental
rights.
Vicky is a 21st-century girl and is currently employed. While in college she was a very
dominating person and has manly demeanor. She was always alone and isolated from the
other classmates as her interests are different and her friends thought she did not belong with
them. They always mocked at her for her manly attributes and made her the subject of jokes
and mimicry.
After college, she had applied for a job & fared exceptionally well in the interview. She was
offered a handsome package & respectable position in the company based on her capability.
Everything was a "dream come true scenario". With high hopes, she joined the office & it
was the perfect place for her to be at.
The first 6 months went by smooth & she delivered more than expected from her job role.
Slowly, she starting opening up & getting close to her colleagues. Now, they were going out
to office parties, etc. together. She confessed to one of her close colleagues that she had a
different sexual orientation and she was interested in females, not males.
This news got spread into the office like wildfire. Everyone started looking at her differently.
She was getting all kinds of weird stares and comments. Now, she was being cornered and
targeted by everyone including her colleagues and the manager.
She got depressed. She started missing from office on some pretext or the other for the fear of
facing the constant discrimination she was going through at work. She was unable to focus at
work & this affected her productivity badly. Eventually, she lost her job.
Finally, after going through all the social & emotional abuse, alienation & discrimination,
Vicky decided to knock the doors of the court for justice for her kind of people.

Examine the above case in light of the following questions:


1. The natural identity of an individual should be treated to be essential to his being.
2. Correlation between Sexual orientation & Gender identity. How is this natural corollary
protected under Article 21 of the Constitution?
3. Emphasize the need for an individual's freedom to conduct his sex life and personal
relationships as he wishes. Are any attempts to interfere with this an attempt to violate
their Right to Privacy?
4. Sexual orientation and privacy lie at the core of the fundamental rights which are
guaranteed under Articles 14, 19 and 21 of the Constitution. Discuss.
5. How does the concept of Discrimination on the grounds of “sex” under Articles 15 & 16
includes discrimination on the ground of gender identity?
6. Gender identity conforms and connects with Human Rights and the constitutionally
guaranteed rights. Elaborate

The apex court admitted the said Writ Petition and the matter is now posted for final
arguments.
RULES GOVERNING JUSTICE P.N.BHAGWATI NATIONAL
MOOT COURT COMPETITION, 2019

The rules will be titled as ‘Rules for the Justice P.N. Bhagwati National Moot Court
Competition - 2019
In case of any discrepancy/doubt, the decision reached by Moot Court Committee shall
be final. The Committee reserves all rights to prescribe/ modify rules, procedures, and
overall layout of competition in such manner as will be proper to conduct the
competition in a better and more efficient manner.

Article 1: Aim and Objectives


The Competition seeks to promote interest in the area of Law focusing especially over
Constitution, Human Rights and Writs and convergence of the same into General Law of the
land.
Article 2: Definition Clause
The following terms shall have the corresponding meanings unless otherwise specified:
1. “Applicant” means the side of the team which argues on behalf of the applicant at any
given point of the competition.
2. “Memorandum" means the memorandum of the laws and authorities concerning the
competition problems.
3. “Case clarification & Correction” (hereinafter referred to as clarifications) means the
official clarifications and corrections as communicated officially to the competition.
4. “Competition” means and includes the total sum of activities arising out of or
consequential upon the National Moot Court Competition, 2019.
5. “Memorials" means the written submissions framed and submitted by a team according
to the rules and admitted by Moot Court Committee.
6. “Moot Court Committee" (to be read hereinafter as MCC) for this Moot Court
Competition means the Committee as constituted for proper organization and fair conduct
of the competition including any other person authorized to deal with all events,
consequential upon or incidental to the competition.
7. “Official Team Contact Person" means the individual identified by the team during the
registration process to acknowledge the receipt of official correspondence relating to the
competition.
8. “Oral Pleading” means the pleading before a panel as explained under Evaluation
criteria for evaluation of Written Submissions.
9. “Jury Panel” means the adjudicators so appointed/ nominated by MCC for judging the
performance of participants during oral pleading sessions of the Competition.
10. “Participant" means a person authorized by referring Institution and approved by MVN
University as eligible to participate in Competition including the Moot Court Researcher.
11. “Penalty” means the consequence of a violation of any rule whether by way of deduction
of point or declaring disqualified and such a person would be referred to as panelized.
12. “Rebuttal” refer to the set of arguments/challenges that the applicant shall raise at the
end of the main pleadings of all the orators. This shall be replied to appropriately by the
respondent.
13. “Team Code” means the code allotted to a team through a draw of lots.
14. “Team” means the total of all registered as participants representing any university or
college allowed to participate in the competition excluding dummy /observer/ escort/
coach.
15. “Moot Court Observer" means a person entitled to witness proceedings of moot
sessions, inaugural and valedictory function and who is expected to use gained
information/ knowledge only for his knowledge pursuits.
Article 3: Organisation
The organization of the competition will take place under the overall supervision and control
of the School of Law, MVN University. For this purpose, The School of Law has constituted
the Moot Court Committee which has been authorized to conduct/ carry on all activities
having a direct or indirect bearing upon fair conduct of the Justice P.N. Bhagwati National
Moot Court Competition 2019.
Article 4: Eligibility for Participation
1) The competition is open to all students enrolled in bona fide regularly as full-time
learners in Undergraduate Law Programme (3 Year/ 5 Year) or its equivalent Law degree
conducted by any recognized institution / College/ University operative in/outside India.
2) Eligibility for becoming a team member-
Any person may become a team member
i. If he/she is pursuing a Law Graduation Degree Course.
ii. If he/she has formally applied to compete on behalf of the institution under which
he/ she is enrolled as a full-time regular student.
3) Each team shall comprise of three members. A team comprising of only two members,
both of them to be designated as speakers, may be allowed by Moot Court Committee
(MCC) if there exists an exceptional situation. A team comprising of three members, at
least one member must be designated as a Moot Researcher.
4) Any additional person accompanied by team/team Coach / Escort shall not formally be
admitted except under any extraordinary situation provided that his presence was
previously informed and duly approved by MCC. Each so approved person has to deposit
Rs 1000 per day for accommodation and hospitality costs.
Article 5: Clarification or Queries
With a purpose to sort out any complication or doubt, teams may request for clarifications by
writing an email at [email protected] or may telephonically contact the persons
designated as Coordinator and conveners for Justice P.N. Bhagwati Moot Court Competition
2019.
Article 6: Place and Date Clause
The JUSTICE P.N. BHAGWAT NATIONAL MOOT COURT COMPETITION, 2019 shall be
held on 11thand 12th October 2019 (Friday and Saturday) at the Academic Block -3, MVN
UNIVERSITY, Palwal, India.
Article 7: Dress Code
i. Female(s): White Salwar and Kurta or White Shirt and Black pants along with Black
Coat and Black Shoes.

ii. Male(s): White Shirt, Black Trousers, Black Tie along with Black Coat and Black
shoes.

Article 8: Language:
The medium of oral pleading and script to write memorials during competition shall be
English Language only.

Article 9: Team Composition


i) Each team shall comprise of 3 members.
ii) There shall be 2 speakers and 1 researcher designated in each team. Teams shall declare
all speakers and researcher at the time when they file nominations for registration.
iii) Each team will be assigned a specific code and each participant shall be given an
individual code.
iv) Teams shall not disclose their identity nor of their institution. Any disclosure in nature
mentioned above may invite penalties including disqualification. It stands within the
competence of MCC to initiate any disciplinary action against any participant or to do
anything to redress any grievance related to competition and participation therein.

Article 10: Rounds


i. There shall be four rounds of argument(s) namely a preliminary, quarter-final, semi-final,
and final round. The Quarterfinals and Semi-Finals shall be knockout round(s). Lots
picked by the teams will decide the side of the arguments in Preliminary, Quarter-finals,
Semi-finals & Final Rounds.
ii. Orientation & draw of lots shall take place on 11th October 2019.
iii. Preliminary round(s) will be held on 11th October 2019.
iv. The top eight teams will qualify for the Quarter Finals, and the same shall be held on11th
October 2019.
v. The qualification to the knockout stage (Quarterfinals) will be based on Win Points. In
the case of a tie, teams with the highest aggregate of scores in the preliminaries (inclusive
of memorial marks).
vi. The top four teams will qualify for the Semi-finals that would be held on 12th
October2019.
vii. The Finals will be held on 12th October 2019.
viii. A written test of 1-hour duration to assess the mooting research skills of Moot
Researcher will be conducted on 12th October 2019.
Article 11: Memorials
The following requirements for memorials must be strictly followed. Any non-compliance
shall attract penalties.
1) Each team must prepare memorials for both sides to the dispute (Appellant and
Respondent).
2) The briefs shall be consistent with the Supreme Court Rules, 1966.
3) Once the memorials have been submitted, no revisions, supplements, or additions will be
allowed.
4) Six (6) hard prints of each of the memorial for Applicant & Respondent along with their
soft copy in a CD must reach to:

5) No submission shall be accepted for evaluation after 27 September 2019.
6) Late submissions beyond the stipulated date will attract 1-point penalty for each day of
Delay.
7) It is the responsibility of the respective teams to ensure that the correct numbers of copies
of the memorial(s) are submitted to the organizers.

Format of Memorials
Cover Page: The cover page of the memorial must state the following:
i. The cause title
ii. The color of the cover page must be Blue in case of Petitioner/Applicant & Red in case
of Defendant/Respondent.
iii. The table of contents.
iv. The index of authorities.
v. The statement of jurisdiction.
vi. The statement of facts.
vii. The statement of issues.
viii. The following parts of the memorial shall not exceed 30 typed A4 size pages.
ix. The summary of arguments.
x. The arguments advanced/detailed arguments.
xi. The prayer
Font Size
 Font: The font of the body of the memorial shall be Times New Roman, size 12.
 Font: The font of the footnotes shall be Times New Roman, size 10.
 Memorials must be suitably bound.
 Memorials must have a one-inch margin on all sides of each page.
 Page numbering should be at the bottom middle of each page
NOTE:
i) The memorial must not contain any photographs, sketches, schedules, graphs, and maps.
ii) The identity of the institution shall not be revealed anywhere in the memorial. Violation
of this provision shall result in penalties including disqualification. The Administrator's
decision shall be final.
Article 12: Evaluation of Memorial
i. Every memorial will be marked on a total of 100 marks and the team memorial marks
will be the average of the total of both sides.
ii. The following shall be the marking scheme:

 Performance of Moot Researchers shall be evaluated based on


Written Test scheduled to be held on 12.10.2019.
Article 13: Oral Rounds
In each oral round, a team will be represented by two speakers who present arguments. The
researcher will not participate in the arguments but will be seated along with the speakers.
I. Preliminary and Quarter- Final Round
 Each team will get a total of 30 minutes to present its case. The time includes
questioning by judges.
 The division of time is at the discretion of the team members, subject to a maximum of
18 minutes per speaker. The division of time should be informed to the Court Assistants
/ Clerks before the beginning of the rounds.
 The oral arguments need not be confined to the issues presented in the memorials.
 Passing notes to the speakers by the researcher during the rounds are allowed.
 A maximum of 5 minutes may be reserved for rebuttal or sur-rebutal.
 Judges may at their discretion, extend the time allotted for the oral arguments up to a
maximum of 10 minutes.
 All teams are expected to carry with themselves any case law and authorities which they
intend to refer to.
II. Semi-final & Final Rounds
 Each team will get a total of 45 minutes to present their case.
 The division of time is at the discretion of the team members, subject to a maximum of
25 minutes per speaker. The division of time should be informed to the Court Assistants
/ Clerks before the beginning of the rounds.
 The oral arguments need not be confined to the issues presented in the memorials.
ARTICLE 14: Scouting – Teams will not be allowed to observe the orals of any other
teams. Scouting is strictly prohibited.
 Scouting by any of the teams will result in disqualification.
 Any team can file a written complaint with the Administrator, regarding a case of
scouting. The Administrator‟s decision will be final.
 The researchers shall sit with the speakers at the time of the orals and shall not attend
the court sessions of any other team participating in the competition.

Article 15: Scoring-The Marking scheme for the evaluation of the oral arguments shall
be the following-

Article 16: Awards, Prizes, and Certifications:
i. Best Team Award: Rs 31000/- in cash, trophy and certificate

ii. Second Best Team Award: Rs.21000/- in cash, trophy and certificate

iii. Best Mooter Award: Rs. 11000 in cash and Trophy and certificate

v. Best Memorial Award: Rs. 11000 in cash and Trophy and certificate

vi. Best Researcher Award: Rs. 11000 in cash and Trophy and certificate

Note: In addition to Awards under categories as mentioned above, Certificates, as a


token of appreciation, shall be distributed to all members of participating teams and all
the volunteers.
Article 17: Announcements of Results
i) The results of the Preliminary rounds shall be announced shortly after the completion of
both the rounds.
ii) The results of the Semi-Final Round(s) shall be announced shortly after the completion
of each of the rounds.
iii) The winners of the competition will be finalized immediately after the Final round and
their names will be announced during the Awards distribution Ceremony on 12th
October 2019 (Saturday).
Article18: Registration and Fee
I. General
Teams must confirm their participation latest by 20th September 2019. Registration is a two-step
process comprising of filling up the registration form and payment of the registration fee.
Request for the registration must be sent on the separate „Registration Form‟ (annexed
herewith under part B, Annexure I) filled in and duly signed by the Head of the Institution/
College/ University sponsoring the teams.
i) Prior information regarding the change in the composition of the team must be
communicated in advance via mail before or on 28th September 2019.
ii) The Teams are required to send a bona fide Authority Letter(enclosed under part A,
Annex. I) issued by the appropriate dealing authority of their college /University along
with duly filled in the application form.
II. Registration Fee & Procedure
i) The Fee prescribed for registration of each team is INR 3000/.
ii) Teams may confirm their participation by applying and submitting prescribed fee Rs
3000/- online on www.mvn.edu.in or by sending a demand draft of Rs. 3000/- in favor
of MVN University and payable at N.I.T. Faridabad Branch of Punjab National
Bank mentioning the following details—

before-mentioned documents in the original are received by the MVN.

demand draft, Authority Letter (Enclosed under part A, Annex. I) and request letter for
accommodation and travel Plan (Appended under Part A, Annex II) must reach to “Dr. Annu Bahl
Mehra, School of Law, MVN University, 74th Km stone NH-2 Delhi Agra Highway Palwal,
Haryana 121105” by speed post/ registered post on or before 27th September 2019.

Soft print of all the above- mentioned documents including Demand Draft shall also be sent to
[email protected] marked with subject JUSTICE P.N.BHAGWATINATIONAL MOOT
COURT COMPETITION 2019on or before 20th September 2019.
Article 19: Transportation, Hospitality, and Accommodation
 The University will provide all arrangements for accommodation and hospitality for
Participants. Rs.1500/- (only one-night stay) shall be charged from each Team. The
amount is inclusive of costs for accommodation and hospitality. For additional stay
request separately with charges Rs. 1500/-
 Regular free of cost bus trips from Campus to nearby Delhi -NCR Locations falling upon
the fixed route of our University Bus/Cab will be provided by the university during days
of the moot court competition.
 Cash payable by each observer and Team Escort shall be INR. 500/- per day per person
for hospitality. (Rs500 /- extra for accommodation)
 Accommodation and hospitality facilities are voluntary. If any person decides to arrange
it personally, he/ she is free to do so.
Article 20: Anonymity
 Student Teams shall not disclose their names and the identity of their respective
institution/college/university at any time before the award ceremony.
The team shall be issued individual codes, at the time of the registration and the same
shall be the sole source of identity of the respective teams throughout the competition.

Note: All team members, coaches, and observers shall refrain from wearing, using or
carrying in any form, any identifying items, such as badges, blazers, pins or any other
identifying material(s) such as a books/bags with a college/university/library logo or seal.

Article 21: Disputes


(a) The participants in the competition shall feel themselves abided by the spirit of the
competition and shall Endeavour to conduct activity according to the best of their ability and
cooperation.
(b) In case of any dispute or difficulty arising out of or during the competition, the Moot
Court Society shall have the sole and absolute authority to remove such difficulty and resolve
the dispute.
(c) The marks given by the judges will be final and binding to both the teams for which the
society is not answerable.

Article 22: Disclaimer


The Moot Court Competition is based on a purely fictitious problem, whereby the characters
& the incidents or the course of events in the problem are completely imaginary and the same
has no relation to any person living or dead or any past/present real-life incident. The Moot
Court problem is made solely for the purpose to train the law students of India for the Bar.
Article 23: Copyright
i. The copyright over the memorials submitted for participation in the competition is
assigned by participants and shall also vest completely in School of Law, MVN
University, Palwal (Haryana), India. The participants shall certify in writing the
originality of materials contained therein and shall be responsible for any claim or dispute
arising out of the further use and exhibition of these materials.
ii. Further use and exhibition of these materials, electronically or otherwise, shall be the
exclusive right of School of Law, MVNUNIVERSITY, Palwal, Haryana 121105,
India and they shall not be responsible for any liability to any person for any loss caused
by errors or omissions in this collection of information, or for the accuracy, completeness,
or adequacy of the information contained in these materials.
NOTE:
I. All the rules are only inclusive and not exhaustive for the competition.
II. Rules should be strictly adhered to. Any deviation would take seriously and may
tantamount to the disqualification/ deduction of points.
III. In case of any discrepancy/doubt, the decision reached by MCC shall be final. MCC
reserves all rights to prescribe/ modify rules, procedures, and overall layout of
competition in such a manner as will be proper to conduct the competition in a better
and more efficient manner.
IV. The imposition of penalties including disqualification rests solely with the organizers
in case of failure to comply with the rule(s) and deadline(s)
