MOTION TO FIX BAIL AND ALLOW ACCUSED TO POST BAIL

COMES NOW, accused, DANILO MATIAS, by himself, unto this Honorable


Court, most respectfully manifests that:

1. The accused was arrested on June 28, 2010 by virtue of the Bench Warrant of Arrest
issued by this Honorable Court on 24 May 2010. He is presently detained at Navotas
City PNP Detention;
2. However, the aforesaid Bench Warrant of Arrest did not fix the bail for the cases filed
against him in order to enjoy provisional liberty during the pendency of the trial of the
instant cases;
3. Bail is a matter of right before and after conviction by MeTC, MTC and MCTC;
4. In view thereof, the accused prays for the compassion of the Honorable Court the bail
for his provisional liberty be fixed in the amount of five hundred pesos (P 500.00) for
each case and to allow him to enjoy provisional liberty while the instant cases are still
pending.

WHEREFORE, IN THE LIGHT OF THE FOREGOING, it is most respectfully


prayed of this Honorable Court that the bail for his provisional liberty be fixed, preferably in
the amount of five hundred pesos (P 500.00) for each case, and to allow him to enjoy
provisional liberty while the instant case is still pending. Other reliefs and remedies just and
equitable under the premises are likewise prayed for.
