CONTRACT OF LEASE

This CONTRACT OF LEASE is made and entered into the 29 th day of


June 29, 2020 by and between:

_____________________________, hereinafter referred to as the LESSOR;

- and-

____________, of legal age, single/married, Chinese citizen and a resident


of ______________________________ and email address at
[email protected] and hereinafter referred to as the LESSEE;

WITNESSETH; THAT

Whereas the LESSOR is the owner of __________________________________


Angeles City, Pampanga ;

Whereas, the LESSEE desires to lease the said apartment unit


hereinafter referred to as “PREMISES” and the LESSOR has agreed to lease the
same unto and in favor of the LESSEE, subject to the terms and conditions
herein set forth;

NOW, THEREFORE, for and in consideration of the foregoing premises,


the LESSOR hereby leases unto the LESSEE the PREMISES and the LESSEE
hereby accepts the same, subject to the following terms and conditions agreed
upon, to wits:

1. LEASED PREMISES – The subject matter of this Contract of Lease are


____________________ Angeles City, Pampanga Angeles City,
Pampanga. The LESSEE acknowledges that she/he receives the
PREMISES in good and tenantable condition free from any and all
damages whatsoever.

2. LEASED PERIOD – This Contract shall be for a period of ONE (1)


years commencing on June 29th , 2020 to expire automatically on the
midnight of June 28th , 2021 hereinafter referred to as the “Leased
Period”.

Upon the expiration of the Leased Period, this Contract may be


renewed at the option of the LESSOR subject to the terms and
conditions acceptable to him.

In case the LESSEE desire to renew the lease, it shall formally notify
the LESSOR at least Two (2) months prior to the expiration of the
lease contract.
3. RENTALS – the rent for the Leased Property shall be Two Hundred
Seventy Thousand Pesos (P270,000.00) and shall be paid on or before
the Twenty Eighty (28th) day of every month;

4. DEPOSIT AND ADVANCE RENTAL AND SECURITY DEPOSIT /


MANNER OF PAYMENT- Upon the execution of this contract, the
LESSEE shall pay the following sum to the LESSOR;

a. The sum of Two Hundred Seventy Thousand Pesos (P270,


000.00) as security deposit equivalent to three (3) months’
rents.

b. a. The sum of Eight Hundred Ten Thousand Pesos


(P810,000.00) as advanced payment equivalent to three (3)
months’ rents

The sum given as security deposit and/or utility deposit shall not be
applied to the monthly rent but may be reimbursed within Thirty (30)
days from the expiration of period or termination of lease; however,
upon such termination of the lease the LESSOR shall inspect the
premises and in the event that damages is sustained by the premises,
except ordinary wear and tear, and/or unpaid utility bills is due, the
LESSOR can undertake necessary repairs/restoration or payment of
the unpaid utility bills at his own initiative and the LESSEE shall be
liable for repairs/restoration expenses and unpaid bills thereof, and
except those which are caused by ordinary wear and tear, the security
deposit shall be answerable for this damages; in the event that the
amount of security deposit and/or utility deposit is less than the
amount of restoration/repairs of damages or unpaid bills in the
premises then the LESSEE shall pay to the LESSOR the balance or
difference thereof. Furthermore, the said security and utility deposits
will be forfeited in favor of the LESSOR in case the LESSEE decides to
pre- terminate this contract of lease, without justifiable cause.

All rental payments shall be payable to the LESSOR.

5. HOUSE RULES – LESSEE shall faithfully comply with and abide by


the House Rules promulgated, updated, or revised by the LESSOR
from time to time. The House Rules shall form an integral part of this
Contract such that any violation thereof will constitute a breach of
this Contract.

a. The LESSEE will refrain from conducting activities that will disturb
the other neighbors outside of normal hours listed below.

b. The LESSEE will observe quiet hours from Monday thru Thursday
from 10PM to 6AM and Friday thru Sunday from 1AM to 6AM.
After quiet hours all noise shall be maintained at a reasonable
decibel level not to disturb the other neighbors. (such as but not
limited to: karaoke machines, music, etc.).

c. Passageways and fire exits will be free from obstruction.


d. The LESSEE will not conduct any illegal activity (such as, but not
limited to: illegal gambling, illegal drug use, illegal internet
webcasting, underage drinking, etc.).

e. That the Tennant agrees that all the terms and agreements herein
contained shall be deemed conditions, as well as covenants, and
that if default or breech is made, then the lease may be terminated
and cancelled forthwith by the Landlord and the Tenant shall be
liable for any and all damages, actual consequential resulting from
such default and termination.

6. PUBLIC UTILITIES – the LESSEE shall pay for its own electricity,
telephone, water and other public utilities, security, internet and
other services. The LESSEE upon receipt of the utilities bills, if within
a month the bills is not paid the LESSOR may request for
disconnection of the utilities or may apply the utility deposit to pay
the current utility and or internet bills.

7. EXTRA ELECTRICAL OUTLETS – the installation of and usage of any


additional electric, water, telephone and teletype connection in the
Leased PREMISES shall be for the sole account and expense of the
LESSEE, who is hereby authorized to make same only after prior
written consent by the LESSOR.

8. USE OF LEASED PROPERTY – the Leased Property shall be used


exclusively by the LESSEE, and the latter shall not sublease or
divert the Leased PREMISES to other use without prior written
consent by the LESSOR.

9. INSPECTION OF AND REPAIRS OF THE LEASED PROPERTY/


SUBMISSION OF PLANS – the LESSOR or his authorized agent shall,
by previous arrangement with the LESSEE, have the right to enter the
Leased PREMISES at any time to examine the same or for any purpose
which it may deem necessary. The LESSEE shall be solely responsible
for the proper operation or maintenance of the PREMISES or its
installations therein.

10. ALTERATIONS, ADDITIONS, IMPROVEMENTS – the LESSEE may


not introduce alterations, additions or improvements in or upon the
Leased PREMISES without prior written consent of the LESSOR. Any
alterations, additions or improvements on the Leased Property shall,
upon expiration or termination of Contract, shall automatically belong
to the LESSOR, except those personal and movable property that
belongs to the LESSEE, which could be removed without damage to
the Leased PREMISES.

11. CARE OF THE LEASED PROPERTY- the LESSEE shall at its sole
expense maintain the Leased PREMISES or its appurtenances as well
as any occupation, usurpation or untoward act being committed or
threatened to be committed upon the Leased PREMISES.

It is understood that the leased premises shall be devoted for dwelling


purposes only and not for any other business, such as illegal or
immoral activities.

12. BUILDING REGULATIONS – the LESSEE expressly agrees to strictly


abide by all the regulations, which may be given by the LESSOR from
time to time.
13. THEFTS – The LESSOR shall not be held accountable or liable for
any loss or damage that may be suffered by the LESSEE by reason of
thefts, robbery and other crimes.

14. DAMAGE TO THE LEASED PROPERTY – All repairs on the Leased


PREMISES, fair wear and tear and acts beyond the control of LESSEE
excepted, whether minor or major, arising from the improper use
thereof by the LESSEE, his employees, agents, representatives, clients
or guests shall be for account of the LESSOR. The LESSOR shall not
be liable for any damage done or occasioned by nor for any damages
arising from acts or negligence of the LESSEE or its agents, employees,
representatives as also of all other persons.

15. TERMINATION OF LEASE – the LESSEE agrees to return and


surrender the Leased PREMISES upon expiration of this Contract in
good and tenantable condition, fair wear and tear and acts beyond the
control of LESSEE excepted, together with the alterations,
improvements or additions introduced thereon, at the expiration of the
Leased Period without any delay whatsoever, devoid of all occupants,
furniture, articles and effects of any kind.

16. RIGHT TO TERMINATE - This Contract shall be considered


automatically terminated and cancelled without need of demand by the
LESSOR should the LESSEE violate any of the provisions of this
contract or fail to pay any RENTALS due herein or where the premises
is abandoned by the LESSEE by deserting or allowing the Leased
PREMISES to remain unoccupied for a continuous period of TWO (2)
MONTHS coupled with non-payment of Monthly rentals.

The LESSEE hereby agrees and undertakes to pay religiously the


monthly rentals on the leased premises upon due date and without
need of demand and failure or delay on his/ her part to pay rent on
due date after the lapsed of five (5) days shall cancel the lease and the
deposit is deemed forfeited and allows the LESSOR to enter and take
possession of the leased premises, without resorting to any court
action.

17. RIGTH TO ENTER AND RECOVER ACTUAL POSSESSION OF


LEASED PREMISES WITHOUT COURT ACTION – Upon failure of the
LESSEE to comply with any of the terms and conditions of this
contract of lease or its failure to vacate and return the premises as
provided herein, the LESSOR or his duly authorized representative/s
shall have the right, upon the expiration of the five (5) days written
notice to vacate to the LESSEE thru email or text message or demand
letter or upon written notice posted at the entrance of the leased
premises, to enter and take possession of the leased premises, without
resorting to any court action, holding, taking custody and impounding
such possession and belongings of the LESSEE found therein after
conducting inventory of the same in the presence of witnesses, until
such time that all unpaid rentals, damages and utilities bills has been
fully settled by the LESSEE. All these acts being hereby mutually
agreed upon by the LESSEE and the LESSOR as tantamount to
LESSEE’S voluntary vacation and surrender of the leased premises by
the LESSEE without necessity of suit in curt and authorizing the
LESSOR to use all necessary and reasonable force to break open doors
and to enter the leased premises and take actual possession thereof,
and such entry and use of reasonable force to break open doors should
not be regarded as trespass, nor be sued as such, or in any wise be
considered as unlawful.

18. NON WAIVER – the failure of the LESSOR to insist upon a strict
performance of any of the terms and conditions and covenants hereof
agreed upon shall not be deemed a relinquishment or waiver of any of
the rights or remedies that the LESSOR may have, nor shall it be
construed as a waiver of any subsequent breach or default by the
LESSOR of its rights under this Contract of Lease.

19. In the event the LESSEE violates the conditions of this contract, the
LESSOR shall be entitled to recover damages computed from the time
the causes of action accrues up to the actual vacation and payment of
damages, and Attorney’s fee and cost of suit.

IN WITNESS WHEREOF, the parties hereto have caused this instrument


to be duly executed on the date and place mentioned above their respective
names.
