STATEMENT OF CLAIM
1. The Plaintiff is the widow and executrix of the estate of Mr Audrey, who is hereinafter referred
to as ‘the deceased’, and brings this action for the benefit of the dependants of the deceased
under the provisions of the Civil Law Act 1956 section 7 and for the benefit of the estate of the
deceased under the provisions of the Civil Law Act 1956 section 8. Probate was extracted from
the High Court of Malaya at Shah Alam on 10 May 2019 whereby Ms Jennifer was appointed as
executrix of the estate of Mr Audrey.
i. Mdm Koh, the deceased’s mother aged 75 years who resided in the matrimonial
home for a number of years prior to the death of the deceased
ii. Amanda, a child of the deceased and Ms Jennifer now aged 27 years.
a) The nature of the claim is that the deceased who was aged 52 years at the time of the death
was a strong health man who had worked as an account manager with a salary of RM 30,000
per month, a substantial part of which was spent for the benefit of the dependants and this
would have continued had he remained alive.
Then:
a) The funeral expenses were RM 2,500.00
PARTICULARS OF CLAIMS
i. Medical bill from Avisena Medical Centre RM 50,000.00
ii. Damage to the deceased’s motorcar RM 100,000.00
iii. Loss of earning (for 2 weeks) RM 15,000.00
iv. Dependency claims RM 360,000.00
v. Funeral expenses RM 2,500.00
Total RM 527,500.00
2. AND the Plaintiff claims:
a) General damages
b) Special damages in the sum of RM 527,500.00
c) Interest thereon; and
d) Cost of his action
