POSITION PAPER
for Nova Princes E. Parojinog
Respondent, through ATTY. Aldrin Christian Lusoc acting as Counsel
hereof, unto the honorable body registers this Position Paper. Copy of the
Order to submit Position Paper within thirty days (10) was received on
October 23, 2020, thus submission of the same today is within the
reglementary period, having the 2nd day of November fall on a Holiday. In
support of this Position Paper, Complainant hereby states –
On October 7, 2020, A Complaint affidavit was filed by the Complainant for
the alleged Jigger Sidamon Noceda for Attempted Rape, Acts of
Lasciviousness, Unjust Vexation, and violation of RA 1131 as indicated in
the Annex A.
The Respondent Jigger Sidamon Noceda, Filipino, of legal age, Married, is
in face a chief of the PNP Custodial Unit in Camp Crame, Cubao, Quezon,
City Philippines, and have been in the service for 25 years. Service record
indicated in Annex B.
The information provided in the petition paper paragraphs B, C, D, E, and F
to wit;
D. Then after learning that my daughter is waiting, I opt to leave the
office to see my Daughter, but Noceda stopped me and said
“Mag-selfie muna tayo”. After that, Noceda quickly pushed me to a
part of the wall where we weren't seen by anyone and he
suddenly kissed me.” Then I walked out of the office in shock to
see my daughter, I told my daughter what happened and
instructed to call our lawyers.
E. On September 7, I requested to speak to Noceda, through the
police guards, to ask if there are were any court orders. I was
again brought to his office to discuss this question.
F. During that conversation, I was able to speak to Noceda without
Incident but before I left the office, Noceda grabbed me, pushed
me to the wall, and grabbed my private parts. While Noceda was
doing these to me, He said that nobody will hear me even if I
scream. He added that even if I filed a complaint, he will not be
fired. He also asks me if I could still be impregnated. By saying
that someone that someone had spotted us from the window, I
was able to pull myself from Noceda. While on my way out, I saw
him laughing and he said that he would dream of me that night.
Above factual statements indicates grave and unbecoming traits of police
officer which is a direct violation of Section 8(D) of R.A. 6713 which states:
(D) Prohibited acts. - It shall be unlawful for any person to obtain or
use any statement filed under this Act for:
(a) Any purpose contrary to morals or public policy;
Section 11 of the same Law specifically states the penalties there in which
states;
****Violations of Sections 7, 8 or 9 of this Act shall be punishable with
imprisonment not exceeding five (5) years, or a fine not exceeding
five thousand pesos (P5,000), or both, and, in the discretion of the
court of competent jurisdiction, disqualification to hold public office.
(b) Any violation hereof proven in a proper administrative
proceeding shall be sufficient cause for removal or dismissal of
a public official or employee, even if no criminal prosecution is
instituted against him.
WHEREFORE, premises considered, it is respectfully prayed that judgment
be issued declaring that the Respondent, Jigger Sidamon Noceda to be
dismissed from service as member of National Police Commission and
disqualified of any benefits and privileges upon such declaration.
FINALLY, the complainant respectfully pays for such and other reliefs as
may be deemed just and equitable in the premises.

COMPLAINT AFFIDAVIT
I, Nova Princess E. Parojinog, of legal age, single, and Resident of Brgy
Kinoman, Ozamiz City, Philippines after having been duly sworn to in
accordance with the law, hereby depose and state that:
1. This complaint-affidavit is being to charge Jigger Sidamon Noceda,
Filipino, of legal age, Married, and a chief of the PNP Custodial Unit
in Camp Crame, Cubao, Quezon, City Philippines of the crime of
Attempted Rape under RA 8353, Acts of Lasciviousness, Unjust
Vexation, and Violation of RA 11313, commit as follows:
G. Noceda was chief of the PNP Custodial Service Unit supervising
the Camp Crame custodial center, the high-profile detention center
inside Camp Crame, Quezon City. My Custody was entrusted to
this Unit pursuant to the alleged cases filed against me.
H. On June 9, 2020, I sent out a request letter to Noceda, though one
of the guards, asking Noceda when visits would be allowed after
the government loosened coronavirus restrictions in Metro Manila
to general community quarantine.
I. On the Same Day, I was summoned into his office. The time I got
into his office, he immediately ordered everyone, except me, to
leave the room. Noceda informed me that visitations are already
allowed that day. Right after Noceda told me that visitations are
already allowed. One of the guards informed us that my Daughter,
Sophia, was visiting that moment.
J. Then after learning that my daughter is waiting, I opt to leave the
