FR/SR Part-III – Leave Rules

General principles:

Grant of leaves is governed under Central Civil


Services (Leave) Rules, 1972.

Leave is a not matter of right - Rule 7(1)

The leave sanctioning authority may refuse or revoke


leave of any kind; but cannot alter the kind of leave
due and applied for by the employee - Rule 7(2)

Leave of one kind taken earlier may be converted


into leave of a different kind at a later date if the
request is received within 30 days of return from
leave. No such conversion is possible after
retirement. However, this is not a matter of right. –
Rule 10.

No leave can be granted for a continuous period of 5


years.
An official remaining absent for a continuous period
of 5 years without valid reason shall be deemed to
have resigned from service. – Rule 12.
During leave, no service or employment can be taken
up by an employee. – Rule 13.

Leave on medical ground shall be supported by


CGHS doctor or AMA (All Govt. doctors are AMA) as
applicable. – Rule 19

The leave sanctioning authority may, at its


discretion, seek second medical opinion from
Medical Board.

An official on leave on medical ground shall be


allowed to join duty only with submission of a
medical fitness certificate. – Rule 24(3)

An absence, unless regularized by grant of leave, not


in continuation of authorized leave will constitute
break in service. – Rule 25(1)

Authority competent to grant leave may commute


retrospectively periods of absence without leave, into
extra-ordinary leave. – Rule 32(6).
Earned Leave should not ordinarily be denied during
the last 10 years of service of an employee before
superannuation. (DoPT OM No.14028/19/86-Estt.
(Leave) dated 29-09-1986).
Holidays at the beginning and at the end of leave
period can be prefixed or suffixed as the case may be.
Intervening holidays shall be counted with leave.

Type of Leaves:

Earned Leave: 15 days advance credit of EL is made


on January 1 (Jan-Jun) and July 1 (Jul-Dec) of every
year.

10% of EOL availed by an employee subject to a


maximum of 15 days is deducted from advance credit
of EL.

For period less than 6 months, due to joining newly


or cessation of service, every completed month will
fetch 2.5 days of EL and EL account will be credited
with nearest whole number.

Maximum of 300 days of EL can be accumulated in


leave account, beyond which leave will lapse.
Advance credit of 15 days is kept separately over 300
days of leave during the relevant half yearly period.

Earned Leave can not granted more than 180 days at


a time.

Un-availed joining time, upon transfer on public


interest can be credited to EL account, if the
employee is ordered to join duty without availing
joining time or if the employee leaves behind family
for joining and then brings the family to the new
station within the permission time.

During the period of EL, leave salary equivalent to


the last drawn salary will be paid.

Transport Allowance is not payable in on leave


during the whole month.

Maximum 300 days of EL can be encashed at the


time of retirement etc.

10 days of EL can be encashed at the time of availing


leave travel concession for a maximum of 6 times
during the service.
Half Pay Leave: 15 days advance credit of HPL is
made on January 1 (Jan-Jun) and July 1 (Jul-Dec) of
every year.

Deduction HPL on dies-non period is 1/18.

For period less than 6 months, due to joining newly


or cessation of service, pro-rata leave for every
completed month will be credited rounded to nearest
whole number.

There is no upper limit of leave balance.

Half salary will be paid during HPL.

Half Pay Leave can be commuted into full pay leave


under medical ground (supported by medical
certificate) and full salary can be drawn by deducting
double HPL from the leave account.

Commuted Leave can be taken without medical


certificate up to maximum of 90 days for an
approved course of study allowed in public interest.
For female Govt. servant, commuted leave up to 60
days can be granted without medical certificate in
continuation of maternity leave.

HPL can also be encashed for a period covering the


shortfall of EL, in case EL at credit falls short of 300
days.

Leave Not Due:

May be granted by Head of Office when no HPL is at


credit. Salary will be paid as of HPL.

HPL earned in future shall be adjusted. Head of


Office is vested with the responsibility to ensure
earning the HPL for adjusting grant of Leave Not
Due.

If the employee retires or resigns before earning


match HPL, he/she shall refund leave salary paid
and remaining un-adjusted.

Leave Not Due is limited to 360 days during the


entire service of an employee.
Extra-Ordinary Leave: EOL is granted to a Govt.
servant when no other leave is admissible or when
an employee applies in writing for grant of EOL
when other leaves are admissible.

No leave salary is paid.

EOL with medical certificate will count as service for


pensionary benefit.

EOL without medical certificate will not count as


service for any purpose.

EOL may be granted to regularize absence without


leave retrospectively.

Maternity Leave: Female Govt. employees are


granted maternity leave of 180 days. Admissible to
employees with less than 2 surviving children.

45 days of leave is granted in entire service of a


female employee for miscarriage or abortion.

Child Adoption Leave: Female Govt. employees are


granted Child adoption leave of 180 days for
adoption
of child below one year. Admissible to female
employees with less than 2 surviving children.

Paternity Leave: Male Govt. servants with less than


2 surviving children are granted 15 days of Paternity
Leave during wife’s confinement i.e. up to 15 days
before or up to 6 months of delivery of child.

Child Care Leave: Female employees as also single


male parent (unmarried or widower or divorcee)
may be granted child care leave up to 750 days
during their entire service for taking care of child
below 18 years – purpose being rearing or looking
after the child’s needs like examination, sickness etc.

Full leave salary (100%) for the first 365 days of


child care leave and for the remaining period 80% of
leave salary shall be paid.

CCL to be granted 5 days at the minimum. To be


granted not more than 3 spells in a year. (Single
mother can avail up to 6 spells in a year)

If child is disabled, no upper age of limit of 18 years.


Study Leave: Up to 36 months for Central Health
Services officers and 24 months for others during the
entire service.

Granted by Ministry/Department

Should be certified to be of definite advantage to


Govt. in public interest.

Requisite bond in the prescribed format is required


to be executed.

Casual Leave:

Not a recognized form of leave under Leave Rules. 8


days in a year is allowed. Intervening holidays are
not counted for CL.

Can not be combined with any kind of leave except


Restricted Holiday.

½ day CL can be availed (Forenoon or Afternoon).

Normally 5 days can be granted at a time.

LTC can be availed along with casual leave.


Special Casual Leave: Granted under certain
circumstance.

Sport events: for coaching or training – maximum


30 days.

Family Planning: Maximum 5 days for vasectomy


operation.

Maximum 3 days if wife of Govt. servant undergoes


tubectomy.

Maximum 10 days if female employee undergoes


tubectomy.

15 days under certain circumstances due to Covid-19.
