EXECUTIVE ORDER NO. 12

AN ORDER CREATING THE DEVOLUTION TRANSITION
COMMITTEE OF BARANGAY CAMPOSANTO 1 NORTE, MONCADA,
TARLAC
WHEREAS, Section 6, Article X of the Constitution provides that local government units
(LGUs) shall have a just share, as determined by law, in the national taxes which shall be
automatically released to them;
WHEREAS, in Mandanas, et al. vs. Executive Secretary, et al. (GR Nos. 199802 and
208488) (“Mandanas”), the Supreme Court held that all collections of national taxes, except
those accruing to special purpose funds and special allotments for the utilization and
development of the national wealth, should be included in the computation of the base of the
just share of LGUs;
WHEREAS, considering the prospective character of the Mandanas ruling, and in keeping
with Section 284 of RA 7160 or the Local Government Code, which states that the share of
LGUs in national taxes is based on the collections in the third year preceding the current
fiscal year, the adjusted national tax allocations of LGUs shall only start in Fiscal year (FY)
2022;
WHEREAS, given the revenue collections of the National Government in FY 2019, the total
shares of the LGUs from the national taxes is expected to significantly increase starting FY
2022 in line with the implementation of the Mandanas ruling;
WHEREAS, the substantial increase in the shares of the LGUs from the national taxes will
empower LGUs in providing basic services and facilities to their constituents, and aid them in
the effective discharge of other duties and functions devolved to them under Section 17 of
RA 7160;
WHEREAS, with the FULL DEVOLUTION of the provision of basic services and facilities
to the LGUs, national government agencies can assume more strategic and steering functions
to address persistent development issues;
WHEREAS, for the efficient and effective implementation of the Mandanas ruling,
President Rodrigo R. Duterte issued Executive Order (EO) No. 138, Series of 2021 dated
June 1, 2021 effecting the FULL DEVOLUTION of certain functions of the Executive
Branch to Local Governments and creation of a committee on devolution and for other
purposes;
WHEREAS, aforesaid EO directs LGUs to formulate their respective Devolution Transition
Plan (DTP) consistent with Section 5 thereof (EO 138) and in close coordination with the
NGAs concerned, especially with regard to devolved functions and services critical to them;
NOW, THEREFORE, I, HON. AGAPITO G. BENITEZ, by virtue of the authority vested
in me by law as PUNONG BARANGAY of CAMPOSANTO 1 NORTE, MONCADA,
TARLAC, do hereby order and decree the creation of THE DEVOLUTION
TRANSITION COMMITTEE OF BARANGAY CAMPOSANTO 1 NORTE to wit:

SEC. 2. ROLES AND FUNCTIONS
a. Formulation of the Devolution Transition Plan of the LGU which shall be used as a
guide in the monitoring and performance assessment of the LGU by the DBM, DILG
and NGAs concerned.
b. Preparation of Capacity Development Agenda based on the assessment framework
and guidelines to be issued by the DILG – Local Government Academy (LGA).
c. Formulation of communication plans and strategies which are aligned and
complementary to the communications plan formulated and approved by the National
Committee on Devolution (ComDev).
d. Ensure that local programs and policies are integrated and coordinated towards a
common national goal and compliant with the policies, standards, and strategies
which the national government may establish pursuant to laws and relevant issuances
apropos to Mandanas ruling.
SEC. 3. EFFECTIVITY. This Order shall take effect immediately.
