CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:
This Contract of Lease made and entered into by and between:
AGUSTINA T. ABOL, of legal age, Filipino, married, and a resident of Poblacion, Zone 3,
Sta. Cruz, Davao del Sur, Philippines, (hereinafter referred to as the "LESSOR");

_______________________________________, of legal age, Filipino, single/married, and a
resident of _____________________________________, Philippines, (hereinafter referred to as the
"LESSEE");
WITNESSETH That:
WHEREAS, the First party LESSOR is the lawful owner of parcel of land with
RESIDENTIAL BUILDING/HOUSE/APARTMENT known as Lot 99-A-5-F-11, Psd-11-114564
located at Poblacion, Sta. Cruz, Davao del sur with a portion of Five Hundred Fifty Seven (557)
Square meters virtue of a document known as DEED OF SALE OF A PORTION OF A PARCEL
OF LAND denominated as Doc. No. ___, Page No. ____, Book No. ____, Series of 2014 of the
Notarial Register of Atty. Engelbert R. Calgas, dated _____________, 2014.
WHEREAS, the LESSOR agrees to lease-out several rooms of RESIDENTIAL
BUILDING/HOUSE/APARTMENT located at the above-described property to prospective
LESSEES;
WHEREAS, LESSEE agrees to rent one (1) unit/room of the apartment for use as a private
residence only. For purposes of the non-monetary obligations under this Contract, the term “Lessee”
shall include all residents or occupants of the apartment and LESSEE’s invitees and guests;
NOW THEREFORE, for and in consideration of the foregoing premises, the
LESSOR leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED
premises, subject to the following:
1. OCCUPANTS: Maximum occupancy for one (1) unit/room of the apartment shall be two (2)
persons. The apartment will only be occupied by the LESSEE and/or the following individuals:

No one else may occupy the apartment. Persons not listed above must not stay in the
Apartment for more than two (2) consecutive days and no more than twice that many days in any one
calendar month.
2. TERM: That the term of this lease shall be for a period of ONE (1) YEAR to commence upon the
signing of this Contract and shall be renewable for another ONE (1) YEAR at the option of the
LESSEE, and thereafter renewable upon mutual agreement of the parties;
3. RENTAL RATE: That the monthly rentals on the leased premises above-mentioned shall be
_________________________ PESOS (Php__,000.00), Philippine Currency for the FIRST YEAR
of this agreement, which may be increased by Php500.00 every year thereafter. The rentals shall be
paid by the LESSEE to the LESSOR on a monthly basis payable on or before the ___th day of every
month;

In case of delay in the payment of the monthly rental for more than Ten (10) days, the
LESSEE shall be liable for every day of delay in the amount of Php100.00 per day;
4. CONDITION OF THE PREMISES AND ALTERATIONS: The LESSEE hereby
acknowledges to have received the Apartment, fixtures and furniture as-is in a clean, safe, and good
working condition. LESSEE must use customary diligence in maintaining the apartment and not
damaging or littering the common areas.
5. DEPOSIT: SECURITY DEPOSIT: Upon the execution of this Contract, LESSEE agrees to pay a
security deposit in an amount equivalent to two (2) months’ rent, as security for the faithful
compliance by the LESSEE of all terms and conditions of this Contract and for the return of the
Apartment in good and proper condition, and to answer for any and all repairs or damages to the
apartment and other liabilities of the LESSEE under this contract. This security deposit cannot be
applied by the LESSEE to any unpaid rental(s) or to any other liability of the LESSEE to the
LESSOR. The security deposit shall, unless the same is subject to forfeiture under this Contract, be
refunded to the LESSEE, without any interest thereon, after the LESSEE settles all related expenses
of the rent, like electricity and water and after the LESSEE has moved-out of and vacated the
apartment.
6. DEFAULT OF PAYMENT: In case of default by the LESSEE in the payment of the rent, the
LESSOR at its option may terminate this contract and eject the LESSEE. The LESSOR has the right
to padlock the premises when the LESSEE is in default of payment for Two (2) months and may
forfeit whatever rental deposit or advances have been given by the LESSEE.
7. ABANDONMENT: Abandonment of the apartment constitutes a violation of the terms and
conditions of this Contract. The LESSEE is deemed to have abandoned the apartment when all of the
following have occurred: (1) all occupants appears to have moved out from the apartment in
LESSOR’s reasonable judgment; (2) clothes, furniture, and personal belongings have been
substantially removed in LESSOR’s reasonable judgment; (3) LESSEE has been in default in
payment of rent for tow (2) months from due date, or water or electric service for the apartment has
been terminated by the service providers; and (4) LESSEE has not responded for Fifteen (15) days to
LESSOR’s notice left on the inside of the main entry door or notifying him/her via text message
stating that LESSOR considers the apartment abandoned.
8. HOUSE RULES: LESSEE shall faithfully comply with and abide by the House Rules
promulgated, updated, or revised by the LESSOR from time to time like no smoking inside the unit,
no excessive noise after 10:00 in the evening, the prohibited use of butane gas stove, etc.. The House
Rules shall form an integral part of this Contract such that any violation thereof will constitute a
breach of this Contract.
9. PUBLIC UTILITIES: All charges for electricity, water, and other utility services to the
Apartment shall be for the sole account of the LESSEE. LESSEE shall promptly pay all utility
charges directly to the utility company concerned. The LESSOR will not be liable for the
discontinuance of or interruptions in utility services to the LESSEE due to any cause or reason
whatsoever.
10. LOSS: The LESSOR is not liable to any resident, guest, or occupant for injury, damage, or loss
to person or property, from any cause including fire, smoke, rain, flood, water leaks, lightning, wind,
explosions, interruption of utilities, pipe leaks, theft, negligent or intentional acts of resident,
occupants, guests, or criminal conduct of other persons including theft, burglary, assault, vandalism
or other crimes.
11. FIX IMPROVEMENTS: The LESSEE shall not make any structural changes, alterations,
additions or improvements on the Leased Premises without the prior written consent of the LESSOR.
Any alterations or improvements made or introduced by the LESSEE on the Leased Premises with
the written consent of the LESSOR shall, upon the termination of this Lease Agreement,
automatically be owned by the LESSOR without any obligation on the part of the LESSOR to pay or
refund its value or cost to the LESSEE.

12. GENERAL MAINTENANCE, SANITATION, REPAIRS AND SAFETY: The cost of
general maintenance and upkeep of the Leased Premises shall be for the account of the LESSEE. The
LESSEE shall keep the Leased Premises in a clean, safe and sanitary condition maintaining peace
and order. The LESSEE shall dispose all its garbage, waste, and other pollutants in accordance with
the rules promulgated by the national or local government.
All major repairs resulting from damages not attributable to the LESSEE's negligence shall be for the
account of the LESSOR
13. GROUNDS FOR CANCELLATION: The LESSOR may cancel or terminate this Lease
Agreement, upon the happening of any of the following events:
12.1. The LESSEE fails to pay its monthly rent for two (2) consecutive months when the
same falls due.
12.2. The LESSEE violates any of the other terms and conditions of this Lease Agreement.
14. INSPECTION OF PREMISES: The LESSOR reserves the right to enter and inspect the Leased
Premises at reasonable times during business hours and with prior notice. The LESSEE agrees to
cooperate with the LESSOR in keeping the Leased Premises in good and tenantable condition.
15. SUB-LEASE and ASSIGNMENT: Sub-letting of the Apartment or any portion or space therein
is prohibited. This Contract or any leasehold rights or interest therein cannot be assigned by the
LESSEE.
16. RETURN OF PREMISES: Upon the termination of this Lease Agreement for any reason
whatsoever, the LESSEE shall peacefully and immediately vacate the Leased Properties and return
possession thereof to the LESSOR in good and tenantable condition, devoid of all occupants,
equipment and effects of any kind. Failure of the LESSEE to return the Leased Properties as
provided herein shall make it liable to pay liquidated damages to the LESSOR in an amount
equivalent to Two (2) months rent without prejudice to such other amounts as may be due
LESSOR and/or such other remedies available to the LESSOR under this Lease Agreement and/or
under the law.
17. LITIGATION: In the event the LESSOR is compelled to seek judicial relief against the
LESSEE in order to enforce any or all of its rights under this Contract, the LESSEE, in addition to
any other damages that may be awarded by the Court, hereby agrees to pay an amount equivalent to
twenty-five (25%) percent of the amount claimed but in no case less than P20,000.00, as and by way
of attorney’s fees, aside from the costs of litigation, and other expenses which the law entitles the
offended party to recover from the offending party. The parties hereby agree to submit any action
arising from or incident to this Contract to the jurisdiction of the proper courts of Davao del Sur, to
the exclusion of all other venues.
This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.
That the parties herein shall comply the terms and conditions of this contract in good faith.
