My dear Urmila

Thank you very much for contacting me for seeking legal opinion regarding
your case pertaining to filing rape case against Heeralal. I have read the facts of
your case.

Accordingly, in my opinion, you can file a Zero FIR under Section 154 of
Criminal Procedure Code, 1973 in Kanpur and as the offense is of cognizable
nature, the Police is bound by law to register your FIR. If the police officer
refuses to register your FIR, you can file an FIR and complaint against him
with a superior officer. There is a provision of punishment against the
aforementioned officer under Section 166A of the Indian Penal Code, 1860.
Further, the Kanpur Police is duty bound to forward it to Samastipur Police
Station.

My opinion is supported by the Justice Verma Committee Report and further


by rulings of the court in Kirti Vashisht v State Date of Decision 29.11.2019
and Lalita Kumari v State of UP (2014) 2 SCC 1.
