MOST RESPECTFULLY SHOWETH:
1. That the captioned case is listed for adjudication before this
Hon’ble Court and the same is fixed for 06.05.2020 for Plaintiff
Evidence.
2. That the Plaintiff is a senior citizen aged about 65 years and is
suffering from various old age diseases that has made the
Plaintiff bedridden. That the Plaintiff is partly paralysed and
spends majority of his time in bed which has made it difficult
for the Plaintiff to carry out the day to day activities of life.
3. That the Plaintiff is so severely ill that the whole life of the
Plaintiff is passing in uncertainty of the future and that the
Plaintiff may even become terminally ill in the near future. The
copy of the medical report of the Plaintiff is annexed and
marked herewith as ANNEXURE-A/1.
4. That the Plaintiff is the most important Plaintiff Witness and the
whole of the Plaintiff’s case would fail in absence of the
evidence of the Plaintiff.
5. That the present application has been moved bonafidely in the
higher interest of justice and allowing the present application
will not prejudice the rights of the Defendant.
6. That in view of the above circumstances, the Applicant/Plaintiff
humbly prays this Hon’ble Court to kindly prepone the next date
fixed for the matter i.e. 06.05.2020 and fix the matter for any
shortest date possible as this Court deems fit.
PRAYER
In light of the facts and circumstances as submitted and
contented above, the Applicant/Plaintiff most humbly and respectfully
prays to this Hon’ble court to kindly prepone the next date fixed for
the matter i.e. 06.05.2020 and fix the matter for any shortest date
possible as this Hon’ble Court deems fit.

I, XXXXXXXXX, aged about 65 years, S/O XXXXXXXXXX do
hereby solemnly affirm and declare as under:
1. That I am the Applicant in the present case and I am well
conversant with the facts and circumstances of the present
case and hence competent to swear the present affidavit.
2. That I have gone through the contents of the present
Application drafted by my Counsel under my instructions
and the facts stated therein are true and correct to my
knowledge and be read as part and parcel of this affidavit
and are not being repeated here for the sake of brevity.
3. That the contents of the Application have been read over to
me and understood by me in my vernacular and I endorse
the same. That the contents of para 1 to 3 are true and
correct to my knowledge and belief and contents of para 4
to 6 are based on legal advice.
