FACTS OF THE CASE:

10:00 PM of September 23, 2020 at District 2, Brgy. Sabuanan, Sta. Lucia, Ilocos Sur, a
23 years old was Rape by Ace T. Jimenez, 23years old, single, delivery boy and a resident of
Vical Sta. Lucia Ilocos Sur. The victim assisted by Pat. Jack B. Bustillos together with his
companion and the witness arrive at the police station to report a rape incident. The victim
alleged that she was forcibly taken to an abandoned place, upon reaching to the abandoned
place the suspect rape the victim. They went back to the place where she was allegedly raped
but they did not find the suspect.

2. Please be informed that on or about 10:00 in the evening of September 23, 2020 a
telephone call was received from a concerned citizen of Barangay Sabuanan, Sta. Lucia Ilocos
Sur informing them that there was a rape incident transpired.
3. Initial investigation revealed that the victim identified as JASMINE BITOGON y
SANCHEZ, 23 years old, single and a resident of said place, was heading to her home from her
work at the JNt Express Office located at Sabuanan Sta. Lucia Ilocos Sur, when Jasmine
Bitogon notice a guy following her on the dark part of the road and he was holding a knife when
she was about to run the guy held her in her neck and said “huwag kang sisigaw kundi
sasaksakin kita, sumama ka sakin” and she was brought in an abandoned place at District 2,
Sabuanan, Sta. Lucia, Ilocos Sur and raped her. The guy was identified and named by the
victim ACE JIMENEZ y TORIO, 23 years old, alyas “Usong” he is classified as person in
interest in the accident.

AFFIDAVIT OF WITNESS
I, Servio Ducay y Palacat, 30 years old, Married, resident of Sabuanan, Sta.
Lucia, Ilocos sur, after having sworn in accordance with law, do hereby depose and state
that:
1. That I am a concerned citizen of Sabuanan, Sta Lucia, Ilocos Sur
2. That I know the victim Jasmine Bitogon actually and personally, as she is a resident
of Sabuanan, Sta. Lucia. Ilocos Sur
3. That on September 23, 2020, at 10:00 in the evening, when I was about to go to the
sari-sari store near my house when I saw a girl crying while lying on the ground with
no undergarments.
4. I immediately approached her and asked if she is okay at first she did not talk and look
shock but in a couple of minutes the girl told me what really happened to her.
5. After knowing what happened to her I immediately called the Police Station to report
that there is rape incident.

I executed this affidavit to attest the truthfulness of the foregoing facts and to support the
filing of Criminal Case against Ace T. Jimenez for violation of RAPE Under Article 8353 of the
Revised Penal Code.

I, JASMINE BITOGON y SANCHEZ, 23 years old, single and a resident of

District 2, Barangay Sabuanan, Sta. Lucia, Ilocos Sur after having duly sworn in accordance
with the law, hereby depose and state:

1. I am the same person who is the complainant in the instant case;

2. This complaint-affidavit is being filed to charge Ace T. Jimenez, Filipino of
legal age, and with residence at Vical Sta. Lucia Ilocos Sur of the crime of
Rape under Article 266 of the Revised Penal Code committed as follows:
a. I was working at JnT Express as a Finance manager I was heading home when I
notices a guy following me on the dark part of the road and he was holding a
knife and told her “huwag kang sisigaw kundi sasaksakin kita, sumama ka
sakin” and was brought in an abandoned place at District 2, Sabuanan, Sta.
Lucia, Ilocos Sur and raped her.
b. After satisfying his carnal desires Ace T. Jimenez fled and I was lying on
the ground shocked.
3. After the incident Mr. SERVIO DUCAY y PALACAT saw me and immediately
called the police station.
4. The police took my sworn statement; a copy of which is hereto attached as
“Annex A”. Thereafter I was examined by their medico-legal officer. A copy of
the Medico- Legal is likewise hereto attached and made an integral part
hereof as “Annex B”;
5. The elements of rape are carnal knowledge, force or intimidation, and the
commission of the act without the consent or against the will of the woman.
6. Based on the foregoing, it is beyond cavil that respondent Ace T. Jimenez
committed the crime of rape punishable under Article 266 of the Revised
Penal Code.
7. Further. Whenever the crime of rape committed with the use of a deadly
weapon or by two or more persons, the penalty shall be Reclusion Perpetua
to death.

DATE, TIME, PLACE OF ACCURRENCE (DTPO): The incident was transpired

on or about 10:00 in the evening of September 23, 2020, at District 2, Barangay
Sabuanan, Sta. Lucia, Ilocos Sur.

BREIF FACTS OF THE CASE:

Initial investigation disclosed that on or about 10:00 PM of September 23, 2020
at District 2, Brgy. Sabuanan, Sta. Lucia, Ilocos Sur, a 20years old was Rape by Ace T.
Jimenez y Sy, 23years old, single, delivery boy and a resident of Vical Sta. Lucia Ilocos
Sur. The victim assisted by Pat. Jack B. Bustillos together with his companion and the
witness arrive at the police station to report a rape incident. The victim alleged that she
was forcibly taken to an abandoned place, upon reaching to the abandoned place the
suspect rape the victim. They went back to the place where she was allegedly raped but
they did not find the suspect.

We, the UNDERSIGNED Police Officers, PO1 JACK BUSTILLOS and PO1 DENNIS
GAMALOG both members of the Philippine National Police, presently assigned at the Sta.
Lucia Police Station, Barangobong, Sta. Lucia, Ilocos Sur, do hereby depose and state THAT:

01. That on or about 10:00PM of September 22, 2023 a cellphone call received by
personnel of Barangobong Police Station from a witness named Servio Ducay y Palacat, a
resident of Sabuanan Sta. Lucia, Ilocos Sur that Ace T. Jimenez. 23 years old, single presently
residing at District 4 Vical Sta. Lucia Ilocos Sur raped Jasmine Bitogon y Sanchez at the
abandoned place of District 2, Sabuanan, Sta. Lucia, Ilocos Sur. Upon the received of the
report, team led by COP proceeded at the said place and upon arrival thereat, said team
together with the witness saw Ace T. Jimenez hiding on the tree near the crime scene.

02. That we (PO1 Jack B. Bustillos and PO1 Dennis V. Gamalog) immediately arrested the
suspect and thereafter informed him of his Constitutional Rights in language and dialect known
by him the presence of residents of Barangay and the Barangay Officials.

03. That we brought the suspect to the Police Station for further investigation and proper
disposition;

04. That we are executing this affidavit/statement to attest the veracity of the
aforementioned facts and support the filing of appropriate charge/s in Court against the arrested
person.

FACTS OF THE CASE

Sabuanan Sta. Lucia, Ilocos Sur that Ace T. Jimenez. 23 years old, single presently residing at
District 4 Barangay Vical Sta. Lucia Ilocos Sur raped Jasmine Bitogon y Sanchez at the
abandoned place of District 2, Sabuanan, Sta. Lucia, Ilocos Sur. Upon the received of the
report, team led by COP proceeded at the said place and upon arrival thereat, said team
together with the witness saw Ace T. Jimenez hiding on the tree near the crime scene.
Recovered from the crime scene was a knife that has a length of 6 to 8 inches (15 to 20 cm)
with a fingerprint. Said suspect together with the recovered items was brought at Sta. Lucia
Police Station.

On account of the foregoing, a case of RAPE is being referred against the suspect
for proper disposition. Further, your advice/recommendation on the matter shall be highly
appreciated.

2. On or about 10:00 in the evening of September 23, 2020 a rape incident was
reported at the Sta. Lucia Police Station by SERVIO DUCAY y PALACAT, a
concerned citizen of Sabuanan, Sta. Lucia, Ilocos Sur. According to him, he is about
to go to a sari-sari store near to their house when he saw a girl crying while lying
naked the concern citizen immediately approached and asked if she’s okay at first
she can’t talk and look shock but after a couple of minutes the victim already tell
what really happened to her.

3. According to the victim, she is working at JnT Express as a Finance manager named
JASMINE BITOGON her duty last until 10H, when she notice a guy following her on
the dark part of the road and he was holding a knife when she was about to run the
guy held her in her neck and told her “huwag kang sisigaw kundi sasaksakin kita,
sumama ka sakin” and she was brought in an abandoned place at District 2,
Sabuanan, Sta. Lucia, Ilocos Sur and raped her. The victim was shocked and
couldn’t moved until she remember that the guy who raped her is their delivery rider
who is also working at JNT Express. The guy was identified and named by the victim
ACE JIMENEZ y TORIO, 23 years old, alyas “Usong” he is classified as person in
interest in the accident.

2 In relation to a case of Rape that transpired on or about 10:00 in the evening of

Bitogon y Sanchez, 22 years old and resident of said place was rape by his colleague
identified as Ace Jimenez y Torio alyas “Usong”, 23 years old resident of Vical, Sta.

3. Upon the received of the report, team led by COP proceeded at the said place and upon
arrival thereat, said team together with the witness saw Ace T. Jimenez hiding on the

4. The team immediately arrested the suspect and thereafter informed him of his
Constitutional Rights in language and dialect known by him the presence of residents of
Barangay and the Barangay Officials. Suspect Ace T. Jimenez was brought
subsequently to the police station for proper case disposition.

5. A case for Rape under Article 8353 of article 266 paragraph b of the Revised penal Code
has already been filed at the City Prosecutor Office against the suspect Ace Jimenez y
Torio under I.S NO. XII-IXVIVE-123456 and subsequently filed at Regional Trial Court,
Ninth Judicial Region, Branch 20, Candon City under Criminal Case No.: 123-45-67
dated September 24, 2020
