Executive Procedure/Instructions/Guidelines/Terms & Conditions


for setting up of Wind / Wind-Solar Hybrid / Solar Projects under
Gujarat Renewable Energy Policy – 2023.
Energy & Petrochemicals Department, Government of Gujarat vide G.R. No. REN/e-
file/20/2023/0476/B1 dated 04/10/2023 declared the Gujarat Renewable Energy Policy – 2023.
As per the clause No. 25.3 of the aforesaid RE Policy, the modalities, procedures, terms, and
conditions, etc. for the registration of projects to be formulated by the SNA. To facilitate the RE
Project Developers following is the Executive Procedure/Instructions/Guidelines/Terms &
Conditions for application submitted to Gujarat Energy Development Agency (SNA) for setting
up of Wind / Wind-Solar Hybrid / Solar Projects under the provisions of the Gujarat Renewable
Energy Policy – 2023 and the relevant GERC order and any subsequent amendments regarding
the same from time to time.

1. To avail the access of the RE Portal by RE Project Developer:


RE Project Developer i.e. Wind / Wind-Solar Hybrid / Solar Project Developer shall get the
credentials for availing the access to use of RE Portal upon onetime payment of Rs. 10,000/- plus
GST for enable to get the facility of online process from Provisional Registration to
Commissioning of RE projects.

2. Provisional Registration of Wind / Wind-Solar Hybrid / Solar Projects


(online):
Wind / Wind-Solar Hybrid / Solar Project Developer shall apply on RE Portal (online) to Gujarat
Energy Development Agency (GEDA) along with the following documents for availing the
Provisional Registration of respective project.

List of requisite documents to be uploaded on RE Portal for Provisional Registration.

1. Company Registration Certificate (self-certified copy of MOA/ROC/ROF/AOA/COI/


Partnership Deed/LLP etc.)
2. Copy of Board Resolution authorizing the signatory for the proposed project.
3. Copy of PAN Card
4. Copy of GST Certificate
5. Project Details showing the Capacity of the Project, Name of the proposed GETCO /
CTU (PGCL) substation, Project site, Village, Taluka and District etc.
6. If end use of power is for sale to DISCOM, copy of LOI / PPA with GUVNL / DISCOM
for purchase of power generated from proposed project as the case may be.

7. Provisional Registration Fees of Rs. 50,000/- plus GST for Wind and Hybrid Power
Projects and Rs. 10,000/- plus GST for Solar Power Projects, which will be adjusted
against Developer Application / Final Registration fee as the case may be.

NB: The validity of the Provisional Registration shall be six months from the date of
Registration. The Developer shall obtain the Development Permission (for Wind and Hybrid) /
Final Registration (for Solar) of proposed RE Project during the period mentioned above.
Failing which the Provisional Registration will stands cancelled and Provisional Registration
Fees of Rs. 50,000/- or Rs. 10,000/- submitted at the time of Provisional Registration will be
forfeited as the case may be.

3. Grid Connectivity:
The RE Project Developer shall get the Stage – 1 & Stage – 2 connectivity from GETCO or
connectivity from PGCIL or Technical Feasibility Report (TFR) from DISCOM as the case may
be, as per the norms and procedure specified by them. The same shall be uploaded on RE Portal
(at present physical copy of aforesaid approvals) shall be submitted to GEDA, Gandhinagar
office). Upon uploading of the same, the link / tab for applying the Development Application
(for Wind and Hybrid) / Final Registration (for Solar) shall be enabled.

In case of Wind-Solar Hybrid Projects, capacity of one resource (Solar or Wind) shall be as per
the National Wind-Solar Hybrid Policy notified by MNRE vide letter no. F. No. 238/78/2017-
Wind dated 14th May 2018 and its amendments from time to time.

4. Coordinates verification (for Wind and Hybrid):


Only upon obtaining the Stage – 1 connectivity, RE Project Developer (in case of Wind and
Hybrid Projects) shall apply for Pre-DP coordinates verification of Wind Turbine Generator
(WTG) locations at GEDA Gandhinagar office in the prescribed format along with the
verification charges @ Rs. 1000/- plus GST per WTG location (non-refundable) to GEDA. To
facilitate the RE Project Developers to obtain the land required for WTG locations, coordinates
verified by GEDA shall be freeze for the period of three months from the date of issuance of
coordinate verification report. Further, the locations clashing with other RE Project Developers
or not eligible as per the provisions of MNRE Guideline with amendments thereof, shall be
deleted from the GEDA’s records. During the validity period of coordinate verification report
(three months), RE Project Developer shall acquire legal possession of land and submit the same
to GEDA. Failing which, the freeze coordinates will automatically be cancelled without any
notice and the cancelled locations may reallocate to other RE Project Developers in queue.
However, extension of the time period beyond the time period mentioned above for reserved
locations for which the process of acquiring the land is in progress will be granted on request of
the RE Project Developer with adequate and genuine reasons for such extension, fifteen days
prior to the expiry date. GEDA reserves the right to reject / approve the extension of timeline.
The extension charges of Rs. 1000/- plus GST per location (non-refundable) shall be levied by
GEDA. All the above process will be on first come first serve basis.

5. Development Permission (for Wind & Hybrid):
i. Application Form

Having, Stage – 1 and Stage – 2 connectivity approved by GETCO or Technical


Feasibility Report (TFR) issued by DISCOM as the case may be and legal possession of
the land by way of Register Agreement to Lease with possession (ATL) / Register
Agreement to Sale with possession (ATS) / Register Sale Deed / Register Lease Deed for
the proposed project, RE Project Developer shall apply for Development Permission in
the prescribed Development Application form (Annexure-2). Upon development of RE
Portal, the same may be processed online. The Development Application form
(Annexure-2) shall be filled in all respect on GEDA RE portal. All relevant
evidences/documents, shall be uploaded with the application form and options applicable
shall be selected. All requisite fee/processing charges plus GST as per prevailing rate,
shall be paid online. At present, along with the Development Application, the fees /
processing charges shall be paid along with the application in the form of Demand Draft
drawn on a nationalized / scheduled bank in favor of Gujarat Energy Development
Agency payable at Gandhinagar. Incomplete application shall be processed after
furnishing of the residual information in stipulated time. The date of application shall be
reckoned from the date of the submission of the residual information / document.

Upon submission of application for Development permission on RE Portal, RE Project


Developer shall submit the physically printed copy of Development Application
(Annexure-2) along with the following requisite documents to GEDA, Gandhinagar
office after duly signed and sealed by an authorized signatory of the applicant Company /
organization / firm etc. The authorized signatory means the person authorized
appropriately under the applicable law / rules / regulations for signing all the documents,
legal deeds, declarations / undertakings and correspondence, pertaining to the proposed
Wind / Wind-Solar Hybrid project.

1. Printed Developer Application Form duly sealed and signed on each page.
2. Copy of Board Resolution authorizing the signatory.
3. Undertaking on Rs. 300/- stamp paper regarding newness of the project machinery.
4. Any other legal documents / documents required to be submitted as per the
requirement of GEDA.

All correspondence regarding the Wind / Hybrid Project with GEDA shall be done, on
the letterhead of the applicant company in the name and designation of the above-referred
authorized signatory. All communications from GEDA will be addressed to the Company
at the address/email ID given of the Authorized signatory of the applicant company in the
application, and such communication sent by GEDA shall deemed to be have been
delivered to the applicant / company.

Development Permission granted to the RE Project Developer for setting up of Wind and
Wind-Solar Hybrid Project shall be governed by the provisions of Gujarat Renewable
Energy Policy – 2023 vide G.R. No. REN/e-file/20/2023/0476/B1 dated 04/10/2023,

relevant GERC order and any subsequent amendments regarding the same from time to
time, shall be abided to RE Project Developer.

In case of Wind-Solar Hybrid Projects, the capacity of one resource (Solar or Wind) in
the hybrid projects shall be as per guidelines notified for Wind-Solar Hybrid Projects by
MNRE and its amendment from time to time.

Development Permission granted to the RE Project Developer for setting up of Wind and
Wind-Solar Hybrid Projects connected to Inter State Transmission System (ISTS) shall
be governed by the provisions of applicable regulations, orders and guidelines as notified
by the Central Government and/or CERC from time to time.

ii. Development Application Processing Fees:

Capacity of the Project Charges in Rs. Plus GST extra


Up to 25 MW 3,00,000/- (Rupees Three lacs)
Above 25MW to 50 MW 6,00,000/- (Rupees Six lacs)
Above 50MW to 75 MW 9,00,000/- (Rupees Nine lacs)
Above 75MW to 100 MW 15,00,000/- (Rupees Fifteen lacs)
Above 100 MW 18,00,000/- (Rupees Eighteen lacs)

iii. Validity of Development Permission:

The validity of the Development Permission shall be as below from the date of
permission granted.

Up to 50 MW One year
Above 50 MW to 100 MW One year Six months
Above 100 MW Two years

iv. Extension of Development Permission:

Extension of the time period for the Development Permission, beyond the time period
mentioned above, will be granted on request of the RE Project Developer, with adequate
and genuine reasons for such extension along with the applicable extension fee of Rs.
50,000/- plus GST per application, fifteen days prior to the expiry date. GEDA reserves
the right to reject the extension of timeline, depending on the work progress achieved by
the Developer.

v. Reprocessing / Revision of Development Permission prior to commissioning of the


Wind / Hybrid Projects:

Revision of Development Permission like shifting of coordinates, change of WTG make


and / or model, change of location, change of SPV module make and / or capacity,
change of invertor make and / or capacity etc. shall be granted on request of the RE
Project Developer, with adequate and genuine reasons for such revision along with the

applicable revision fee of Rs. 50,000/- plus GST per application to GEDA. In case of
such revisions, RE Project Developer shall apply for re-verification of new coordinates
along with the applicable charges as mentioned in clause no. 4 of this guideline. The date
of application for coordinates verifications shall reckoned from the date of the submission
of revised coordinates.

Note: In case of Wind-Solar Hybrid Project, the Development Application


Processing Fees per MW shall be calculated on the basis of arithmetic sum of
proposed capacity of both wind and solar components.

vi. Deadlines for filing of application:

The Development Application complete in all respect, by the RE Project Developer for
obtaining Development Permission for setting up of Wind / Wind-Solar Hybrid Projects,
shall not be filed later than 30 days prior to completion of operative period of existing RE
Policy.

vii. Suitability of the Sites:

It is advised that the applicant ascertains the feasibility of the site, ascertain power
evacuation, shadow free area and also ascertain expected energy output from the Wind /
Hybrid Project, prior to finalization of the site with consideration of Environmental
Factors, CRZ Regulations, Mining restrictions, MOD Clearance, Clearance from Airport
Authority and restrictions / regulations applicable / imposed under any law or executive
order / direction / guidelines upon the area / site from time to time and from physical
point of view for arrangement of the Wind Turbine Generators, Array of Solar modules,
reflectors, collectors, generator etc. and all other peripherals of the Wind / Hybrid
Project.

Micro siting of Wind Turbine Generators should be as per the directives / guidelines as
declared by MNRE / GOG / GEDA with amendments from time to time.

The Government of Gujarat / GEDA neither guarantees the generation of electricity nor
shall be responsible for sub-optimal performance of the Wind / Hybrid Project in any
manner whatsoever. Further, the Government of Gujarat / GEDA shall be absolved from
all the responsibilities / liabilities whatsoever arise in future due to non-compliance of
any of the above mentioned clearances / approvals.

viii. Land related responsibilities:

The land on which the Wind / Hybrid Project is proposed shall be in legal possession of
the RE Project Developer as transferor and / or RE Project Developer as a transferee by
way of Register Agreement to Lease with possession (ATL) / Register Agreement to Sale
with possession (ATS) / Register Sale Deed / Register Lease Deed for the proposed
project at the time of submission of the application. Moreover, the permission required

under the relevant / applicable tenancy / revenue laws shall be availed at least before
submission of the application to GEDA for commissioning.

Government of Gujarat / GEDA shall be absolved from all disputes and responsibilities
pertaining to the revenue land and /or private land matters those may arise.

ix. Micro siting of the Wind turbine generators:

Only new plant and machinery shall be eligible for installation under the present Gujarat
Renewable Energy Policy - 2023 of the Govt. of Gujarat. An undertaking to this effect
shall be given by the authorized signatory as per prescribed format.

Wind Turbines and Solar PV modules that are approved by the Ministry of New and
Renewable Energy, Government of India, under RLMM or ALMM, as applicable, shall
be eligible for commissioning of the respective projects. The guideline of Ministry of
New and Renewable Energy, Government of India and its amendment from time to time
for the same shall be applicable.

The solar PV cells, modules and Inverters shall be compliant with the BIS standards.

For optimum utilization of the land, the applicant is free to decide considering the MNRE
Guide Line dated: 22/10/2016 and amended from time to time:

(1) The location and the spacing between the WTGs within rows and between the rows.
(2) Similarly, for the location of the solar power project considering the shadow analysis.

GEDA shall merely endorse the proposed WTGs / solar power plant location, only for the
purpose of the identification of the Wind / Hybrid project and its location on the survey
number of the plot and the village. The endorsement of GEDA of the micro siting
proposed by the RE Project Developer, shall not be construed to be the best location for
the WTGs / Solar Power Plant performance and / or certifying the ownership of the land.
The RE Project Developer shall provide the latitude, longitude co-ordinates along with
the AMSL height (Average Mean Sea Level) of the proposed locations of the WTGs and
area for the Solar Power Plant as the case may be.

The RE Project Developer shall install the WTGs as per the MNRE’s guideline for
Development of Onshore Wind Power Projects dated: 22/10/2016 and amended from
time to time.

Each of the location of the WTG shall be given a unique number, which shall not be used
by the RE Project Developer in the subsequent Development Applications made to
GEDA. Scaled drawing for the wind turbine locations and solar power plant proposed to
be installed on the revenue land / private land shall be uploaded on GEDA RE Portal /
submitted to GEDA. All these copies should be signed by the authorized employee of the
company with the seal of the company.

The locations of the WTG / Solar Power Plant shown should be matching with the area of
the land allotted by revenue survey number / plot number and area of the land allotted /
purchased / leased for setting up of the Wind / Hybrid project.

In the event of two developers seeking permission for setting up of Wind / Hybrid project
with the locations of the WTGs in adjacent land area, it shall be mandatory that, the
distance between two WTGs within a row and between the adjacent rows shall be as per
the MNRE Guide line dated 22/10/2016 and amended from time to time. The locations of
such existing WTGs of the fellow RE Project Developer shall also be shown in the scaled
micro siting drawing, specifying the distances between the WTGs.

The scaled micro siting drawing shall be uploaded / submitted with following details
given in the right hand bottom corner.

1. Name of the RE Project Developer: Date:

Details of Wind Turbine Generators (WTG):

2. Name of the site: Village, Taluka, District.


3. Land Survey No. / Plot No., Land area in hectare
4. Wind / Hybrid Project Capacity in MW
5. Number of WTGs, Rating of WTG in MW
6. Make & Model of WTG,
7. Rotor diameter, Hub height in meters
8. UTM Coordinates

Similarly, for Solar Power Plant in case of Hybrid Project:

9. Name of the site: Village, Taluka, District.


10. Land Survey No. / Plot No., Land area in hectare
11. Solar Power Project Capacity in MW
12. Nos. of Solar Modules
13. Rating of Solar Modules with capacity
14. Make and Model of Solar Modules
15. Nos. of Invertors
16. Rating of Invertors with capacity
17. Make and Model of Invertors
18. UTM Coordinates.

x. Metering arrangement and meter reading:

The RE Project Developer shall provide metering arrangement at the interconnection


point i.e. plant end / Pooling / Sending end Substation, CTU / STU substation / DISCOM
Network, as the case may be and shall conform to the Central Electricity Authority
(Installation and Operation of Meters) Regulations 2014 and amendments thereto, as
stipulated by CTU / STU / DISCOM, as the case may be. The RE Project Developer shall

provide ABT complaint meter as per the provision of the Gujarat Renewable Energy
Policy – 2023 and relevant GERC order and its amendment from time to time. For the
purpose of energy accounting, the ABT compliant meter, check meter and standby meter
shall be installed at the metering point, as per the provisions of applicable order /
regulations / codes from time to time.

For consumer having contract demand less than 1 MW metering arrangement may be as
per clause no 13.7 of GERC (Net Metering Rooftop Solar PV Grid Interactive Systems)
(Third Amendment) Regulation, 2022 which states that “In case of consumers having
contract load / sanctioned demand not exceeding 1 MW, Distribution licenses may allow
installation of non-ABT meters at consumer level reprogrammed at consumer’s cost as
per the energy accounting requirement”.

In case of Hybrid Project, RE Project Developer shall submit the approval for integration
of wind and solar component as well as the metering arrangement approved by GETCO /
DISCOM as applicable under clause no. 11.3.1 & 11.3.3 of the Gujarat Renewable
Energy Policy – 2023.

The RE Developers shall have to install Remote Terminal Unit (RTU) and
communication system at the RE project for transferring the real time data to concern
ALDC / SLDC.

xi. Work Progress:

The RE Project Developer shall submit a work progress report on quarterly basis as per
the clause no. 25.4 of the Gujarat Renewable Energy Policy – 2023, from the date of the
Development Permission granted, giving the important mile stones of the work
completed, viz; Civil Works, Electrical works of the Substation and the transmission line,
with relevant details of the work.

xii. Proto Type Wind Turbine Generator:

Development Permission for setting up of Proto Type Wind Turbine Generators shall be
granted as per the provision of Gujarat Renewable Energy Policy – 2023 vide G.R. No.
REN/e-file/20/2023/0476/B1 dated 04/10/2023 and applicable guideline, procedures,
orders and regulations as notified by MNRE, NIWE, CEA, GERC, or any other authority
from time to time.

6. Transfer Permission (for Wind & Hybrid):


The Wind / Hybrid Project Capacity permitted to the RE Project Developer (as a
Transferor) or part thereof can be transferred to its client(s) prior to its commissioning,
upon request of the Developer to transfer the Wind / Hybrid Project capacity along with
the application of the client on prescribed format. Upon processing of the Developer’s
request and client’s application, permission for transfer of capacity in the name of the
client (RE Project Developer as a Transferee) shall be granted by GEDA subject to the

terms and conditions stipulated in the Gujarat Renewable Energy Policy – 2023 vide
resolution No. REN/e-file/20/2023/0476/B1 dated 04/10/2023 and the relevant GERC
tariff orders with its amendments regarding the same from time to time.

i. Transfer Application Form:

Transferee shall apply for Transfer Permission in the prescribed Transfer Application
Form (Annexure-3). Upon development of RE Portal, the same may be processed online.
Transfer Application Form (Annexure-3) shall be filled in all respect on GEDA RE portal
All relevant information requested for, shall be uploaded with the application form and
options applicable shall be selected. All requisite fee/processing charges plus GST as per
prevailing rate, shall be paid online. At present, along with the Transfer Application, the
fees / processing charges shall be paid along with the application in the form of Demand

 Copy of Board Resolution authorizing the signatory.
 Undertaking on Rs. 300/- stamp paper regarding newness of the project machinery.
 Any other legal documents / documents required to be submitted as per the
requirement of GEDA.

All correspondence regarding the Wind / Hybrid project with GEDA shall be done, on
the letterhead of the Applicant Company / Client in the name and designation of the
above-referred authorized signatory. All communications from GEDA will be addressed
to the Applicant company at the address/email ID given of the Authorized signatory of
the applicant company in the application, and such communication sent by GEDA shall
deemed to be have been delivered to the applicant / company.

Transfer Permission granted to the Transferee for setting up of Wind / Hybrid Project
shall be governed by the provisions of Gujarat Renewable Energy Policy – 2023 vide
G.R. No. REN/e-file/20/2023/0476/B1 dated 04/10/2023, relevant GERC order and any
subsequent amendments regarding the same from time to time.

Transfer Permission granted to the Transferee for setting up of Wind / Hybrid Projects
connected to Inter State Transmission System (ISTS) shall be governed by the provisions

of applicable regulations, orders and guidelines as notified by the Central Government
and/or CERC from time to time.

ii. Transfer Application Processing Fees plus GST:

Transfer Application processing fees shall be Rs. 25,000 / MW (Min. Rs. 50,000, Max.
Rs. 5.00 lacs) plus GST

Note: In case of Wind-Solar Hybrid Project, the Transfer Application Processing


Fees per MW shall be calculated on the basis of arithmetic sum of proposed capacity
of both wind and solar components.
iii. Validity of Transfer Permission:

The validity of the Transfer Permission shall be as below from the date of permission
granted or up to the period that the Gujarat Renewable Energy Policy – 2023 is in force,
whichever is earlier, within which the project is to be commissioned:

Up to 25 MW Six Months
Above 25 MW One year

iv. Extension of Transfer Permission:

Extension of the time period for the Transfer Permission, beyond the time period
mentioned above, will be granted on request of the Transferee, with adequate and
genuine reasons for such extension along with the applicable extension fee of Rs.
50,000/- plus GST per application, fifteen days prior to the expiry date. GEDA reserves
the right to reject the extension of timeline, depending on the work progress achieved by
the Transferee or by any other reason thereof.

v. Reprocessing / Revision of Transfer Permission prior to commissioning of the Wind


/ Hybrid Projects:

Revision of Transfer Permission shall be granted on request of the Transferee, with


adequate and genuine reasons for such revision along with the applicable revision fee of
Rs. 50,000/- plus GST per application to GEDA.

vi. Deadlines for filing of application:

The application for transfer of the Wind / Hybrid Power Project capacity from the
Developer to the transferee shall be filed, at least fifteen days prior to the date of
commissioning.

vii. Land related responsibilities:


The land on which the Wind / Hybrid Project is proposed shall be in legal possession of
the RE Project Developer as a transferee by way of Register Sale Deed / Register Lease
Deed for the proposed project at the time of submission of the application.

It shall be the sole responsibility of the applicant to ensure that all the statutory
permissions/terms and conditions, required pertaining to the use of revenue land and/or
private land for the setting up of Wind / Hybrid Project are obtained/fulfilled with, from
the concerned authorities. Government of Gujarat / GEDA shall be absolved from all
disputes and responsibilities pertaining to the revenue land and /or private land matters
those may arise.

The transferee shall also ascertain the compliance of all the statutory clearances /
approvals as mentioned in Clause No 5 (vii) of this guideline. The Government of Gujarat
/ GEDA shall be absolved from all the responsibilities / liabilities whatsoever arise in
future due to non-compliance of the same.

viii. Ownership of the RE Project Developer as a Transferee:

At the time of application for Transfer Permission the following documents related to
ownership of the project shall be required to upload / submit by the transferee:

1. The notarized copy of purchase contract / work order for sale of Wind / Hybrid
Power Plant.
2. CA certificate regarding the ownership of the proposed Wind / Hybrid Power
Plant.
3. Copy of invoice with GST or any other ownership proof for purchase of the
proposed Wind / Hybrid Power Plant.
4. The notarized undertaking on Rs. 300/- stamp paper showing that the equity of the
proposed Wind / Hybrid Power Plant is owned by the transferee.
5. Transferee shall submit the Share Subscription & Share Holding Agreement
between RE Generator and Consumer Holder along with the CA certificate
certifying the equity holding of the proposed Wind / Hybrid Power Plant for
captive use as per the definition no. 6 of clause no. 5 of Gujarat Renewable
Energy Policy -2023.

Note: If transferee is unable to produce the document mentioned above at point no.
3 at the time of application, notarized undertaking on Rs. 300/- stamp paper shall be
required by the applicant, to submit the same prior to the commissioning of the
project.

ix. Additional compliance for Transfer Permission of Wind / Hybrid Project:

While granting transfer permission in name of applicant / client, it shall be ensured that:

a. In accordance with the provisions of Gujarat Renewable Energy Policy - 2023 the
applicant (client) shall submit valid documentary proof in support of equity
investment / holding in the Wind / Hybrid Power Project for which transfer
permission is sought.

b. The transferred project capacity shall be clearly demarcated / separated and there
shall be no possibility of inter se electrical interconnection between the project of
different client, in case projects of more than one client is developed by the project
developer at same location.

c. In case of pooling of generated electricity from projects of individual clients at


pooling Sub-station, the integration of wind and solar components of a wind-solar
hybrid project shall be allowed at the plant end or at the pooling / sending station
depending upon the feasibility issued by DISCOM / GETCO in accordance with the
connectivity regulations of GERC / CERC, Safety regulations issued by CEA and
all other applicable regulations / standards / code. Provided further that a separate
set of main and back up ABT Compliant metering systems for the purpose of
apportioning of energy shall be installed at the generating terminal / turbine output
of each WTG with necessary communication facility to the GEDA / GETCO
System and the energy accounting shall be undertaken accordingly. Further suitable
control equipment shall be deployed for controlling the power output of the hybrid
project.

d. The Single Line Diagram (SLD) of the internal electrical network explaining
metering locations & metering philosophy and project layout plan showing project
boundary for demarcation / separation of the project.

7. Commissioning of Wind / Hybrid Project:


The RE Project Developer / Transferee shall get the Wind turbine generators with their
allied electrical installations for wind projects OR Wind turbine generators, Solar
Modules, Invertors and their allied electrical installations for Hybrid Projects, inspected
by the Chief Electrical Inspector, Govt. of Gujarat / Chief Electricity Authority (CEA),
Government of India and the certificate of such inspection and permission for charging of
the installation as the case may be, with the unique WTG/s number defined earlier and the
Solar Power Project capacity, shall be submitted to GEDA. Further, the developer shall
also comply with the conditions / documents requirement as stipulated in clause no. 6(ix)
above and shall demonstrate the same with by uploading / submission of required
supporting documents.

Only after submission of the copy of transmission agreement with GETCO, wheeling
agreement with DISCOM or PPA with DISCOM, certificate from the Chief Electrical
Inspector, Govt. of Gujarat for charging of the electrical installation, accompanied by
Certification Charges @ Rs. 10,000/- per MW per year plus GST and requisition for
commissioning by the Wind / Hybrid Project owner (client) and compliance of conditions
stipulated at clause no. 6(ix) of this guideline, the commissioning of the Wind / Hybrid
Project shall be taken up by GEDA. The representative of the Wind / Hybrid Project
owner (Client), GEDA and concerned DISCOM shall remain present during the
commissioning of the Wind / Hybrid Project. The requisition for Commissioning
(Annexure – 4) / online request on RE Portal shall be submitted minimum seven days
ahead of the proposed date of Commissioning. Commissioning Certificate shall be issued

to the applicant within 15 days of the Commissioning of the Wind / Hybrid Project upon
submission of all the requisite documents.

8. Energy Accounting of Wind / Hybrid Project:


The RE Project Developer shall furnish a weekly statement of the generation of
electricity from all the Windfarms / Hybrid Project, as per prescribed format to GEDA,
for its onward submission to SLDC, as per the requirements of the GERC for the purpose
of the energy accounting.

For the purpose of the commercial accounting, the individual Windfarm wise generation
figures and in case of Hybrid Project generation figures of wind and solar component
separately shall be furnished by the RE Project Developer, to the field offices of GEDA.

GEDA and GETCO on the last day of the month, if required by SLDC (on the basis of
SLDC report) jointly record the active and reactive energy exported and consumed
respectively, at the Windfarm Pooling Substation / Hybrid Pooling Substation and
GETCO receiving substations. GEDA shall apportion the energy, to the individual
Windfarm owners / Hybrid Project Owners, upon deduction of the transmission loss.

Certification Charges @ Rs. 10,000/- per MW per year plus GST shall be charged
for carrying out the above activities.

9. Name Change - Post Commissioning:


The request for change of the name of the Wind / Hybrid Project owning Company
subsequent to its commissioning shall be considered on submission of the following
documents along with the processing fee of Rs. 50,000/- plus GST per application to
GEDA.

Further, NoC from concerned DISCOM in whose area the recipient unit is located shall
be submitted.

A. In case of change of Name or status of the company: Documents to be submitted


as per Annexure–5A.

B. In case of sale of Wind / Hybrid Project: Documents to be submitted as per


Annexure – 5B.

C. In case of merging of company or transfer of business to own subsidiaries owning


the Wind / Hybrid Project: Documents to be submitted as per Annexure – 5C.

10. Correspondence - Reference:

Each of the WTG shall be given a unique ID number, and the name of the Pooling
Substation to which the Wind / Hybrid Power Plant is connected. All correspondence by

the owner of the Wind / Hybrid Project shall exclusively mention the name of the Wind /
Hybrid Project owning Company, Unique ID number and the name of the Substation to
which the Wind / Hybrid Project is connected.

11. Declaration/ Undertaking:


The authorized signatory of the Transferee shall, on a Rs. 300/- non judicial Stamp paper,
sign a declaration/ undertaking, as per the contents and format enclosed. (Annexure-6).

12. Repowering of Wind Project:


With an objective to re-energize the old, small-sized and inefficient wind turbines and
replace with bigger and more efficient wind turbines with better technology (improved
rotor diameters, larger blades, taller towers and pole lengths, increased hub heights, etc.)
so as to optimally utilize the existing land and infrastructure, the repowering of wind
turbine generators shall have to be done by the RE Project Developers on or before the
completion of 25 years from the date of commissioning of the project or extended term of
the agreement.

Further, the RE Project Developers whose wind turbine generators have completed the 25
years from the date of commissioning of the project and agreement with GETCO and
DISCOM are either extended or expired within one year from the date of declaration of
Gujarat Renewable Energy Policy – 2023 have to repower the aforesaid wind projects
within six months from the date of issuance of Gujarat Renewable Energy Policy – 2023.

As per the clause no. 29.3 of the Gujarat Renewable Energy Policy – 2023, if the Wind
Project developer fails to repower its wind turbine generator at the expiry of the project's
life / term of agreement / extended terms of agreement, as the case may be, such RE
Project Developers shall have to decommission the wind power project and surrender the
connectivity, and if the WTG is set up on leased land, they shall also have to surrender
their leasehold rights to Government.

RE Project Developer whose wind farm has completed the life span of 25 years or on
verge of completing the 25 years from the date of commissioning of the project shall
apply to GEDA in prescribed format for Repowering of Wind Project along with the
details viz. capacity and make of wind turbine generator, rotor diameter, hub height and
nos. of new WTGs proposed to be installed against old WTGs with final project capacity
etc.

The Documents to be submitted along with the request for Repowering of Wind Project:

1. Prescribed Application Form duly signed and sealed.


2. Copy of Developer Permission / Transfer Permission issued by GEDA for the
existing old wind project.

3. Copy of Certificate of Commissioning issued by GEDA for the existing old wind
project.
4. Existing land lease / ownership documents.
5. Copy of existing LTOA / BPTA signed with GETCO.
6. Copy of existing PPA / Wheeling Agreement signed with GUVNL / DISCOM.
7. Document confirming to Type Test Approval of MNRE in RLLM list for the new
WTGs to be installed against old WTGs.
8. Applicable Application Processing Fees as per the clause no. 6 (ii) of this
Guideline.

Upon submission of Application for Repowering of Wind Projects, GEDA shall issue the
consent for Repowering of Wind Projects under the provision of Gujarat Renewable
Energy Policy – 2023. RE Project Developers obtain the stage – I, stage – II connectivity
from GETCO for repowered capacity and subsequently signed the PPA / wheeling
agreement with DISCOM.

Commissioning procedure of Repowered Wind Projects shall be as per the clause no. 7 of
this guidelines.

13. Registration of Open Access Solar Projects:
i. Application Form:

Eligible entity shall apply for registration in the prescribed Application Form. Upon
development of RE Portal, the same may be processed online. Application Form shall be
filled in all respect on GEDA RE portal All relevant information requested for, shall be
uploaded with the application form and options applicable shall be selected. All requisite
fee/processing charges plus GST as per prevailing rate, shall be paid online. At present,
along with the Application, the fees / processing charges shall be paid along with the
application in the form of Demand Draft drawn on a nationalized / scheduled bank in
favor of Gujarat Energy Development Agency payable at Gandhinagar. Incomplete
application shall be processed after furnishing of the residual information in stipulated
time. The date of application shall be reckoned from the date of the submission of the
residual information / documents.

Upon submission of Application on RE Portal, applicant shall submit the physically


printed copy along with the following requisite documents to GEDA, Gandhinagar office
after due signed and sealed by an authorized signatory of the applicant Company /
organization / firm etc. The authorized signatory means the person authorized
appropriately under the applicable law / rules / regulations for signing all the documents,
legal deeds, declarations / undertakings and correspondence, pertaining to the proposed
Solar project

 Printed Application Form duly sealed and signed on each page.


 Copy of Board Resolution authorizing the signatory.
 Land documents in favor of the applicant.
 Undertaking on Rs. 300/- stamp paper regarding newness of the project
machinery.
 Any other legal documents required to be submitted as per the requirement of
GEDA.
 Details of Solar Power Project to be submitted as follows:

I. Name of the site: Village, Taluka, District.

All correspondence regarding the Solar project with GEDA shall be done, on the
letterhead of the Applicant Company / Client in the name and designation of the above-

referred authorized signatory. All communications from GEDA will be addressed to the
Applicant company at the address/fax/email ID given of the Authorized signatory of the
applicant company in the application, and such communication sent by GEDA shall
deemed to be have been delivered to the applicant / company.

registration granted to the eligible entity for setting up of Solar Project shall be governed
by the provisions of Gujarat Renewable Energy Policy – 2023 vide G.R. No. REN/e-
file/20/2023/0476/B1 dated 04/10/2023, relevant GERC order and any subsequent
amendments regarding the same from time to time.

Registration granted to the applicant for setting up of Solar Projects connected to Inter
State Transmission System (ISTS) shall be governed by the provisions of applicable
regulations, orders and guidelines as notified by the Central Government and/or CERC
from time to time.

ii. Validity of Registration:

The validity of the registration shall be as below from the date of permission granted or
up to the period that the Solar Power Policy is in force, whichever is earlier, within which
the project is to be commissioned:

Up to 4 MW One year
4 MW to 50 MW One year Six months
Above 50 MW Two years

iii. Work Progress:

The applicant shall submit a work progress report on quarterly basis from the date of the
registration permission granted, giving the important mile stones of the work completed,
viz; Civil Works, Electrical works of the Substation and the transmission line, with
relevant details of the work.

iv. Extension of Registration:

Registration of the time period for the registration Permission, beyond the time period
mentioned above, will be granted on request of the applicant, with adequate and genuine
reasons for such extension along with the applicable extension fee of Rs. 10000/- plus
GST per application, fifteen days prior to the expiry date. GEDA reserves the right to
reject the extension of timeline, depending on the work progress achieved by the
Transferee.

v. Registration Application Processing Fees plus GST:

Note: The above registration application processing fees shall be non-refundable.

vi. Land related responsibilities:

It shall be the sole responsibility of the applicant to ensure that all the statutory
permissions/terms and conditions, required pertaining to the use of revenue land and/or
private land for the setting up of Solar Project are obtained/fulfilled with, from the
concerned authorities. GEDA/Government of Gujarat shall be absolved from all such
disputes and responsibilities pertaining to the revenue land and /or private land matters
those may arise.

14. Commissioning of Solar Project:


The Solar Power Generator (SPG) shall get the Solar Modules, Invertors and their allied
electrical installations inspected by the Chief Electrical Inspector, Govt. of Gujarat /
Chief Electricity Authority (CEA), Government of India and the certificate of such
inspection and permission for charging of the installation as the case may be, with the
Solar Power Project capacity, shall be submitted to GEDA. Further, the SPG shall also
comply with the conditions / documents requirement and shall demonstrate the same by
submission of required supporting documents.

Only after the submission of the copy of the Wheeling agreement/ Bulk Power
Transmission Agreement (LTOA/MTOA/STOA), Meter sealing report/ Charging Report,
Certificate from the Chief Electrical Inspector, Govt. of Gujarat for charging of the
electrical installation, accompanied by requisition for commissioning by the Solar Project
owner (client), the witness of the commissioning of the Solar Project shall be taken up by
GEDA. The representative of the Solar Project owner (Client), GEDA and concerned
DISCOM (in case of GUVNL Bid Project) in whose area plant is set up shall also remain
present during the commissioning of the Solar Project. The requisition for
Commissioning / online request on RE Portal shall be submitted minimum seven days
ahead of the proposed date of Commissioning. Commissioning Certificate shall be issued
to the applicant within 15 days of the Commissioning of the Solar Project upon
submission of all the requisite documents along with legal possession of the land with
NA / Deemed NA Permission.

Note: This is executive guideline / instructions for processing the application by GEDA. It is
further clarified that these guidelines / instructions neither enlarge nor curtail the scope of
Gujarat Renewable Energy Policy - 2023 issued by Energy and Petrochemical Department,
Govt. of Gujarat. If any part/s of these guidelines / instructions are not in accordance with the
aforesaid policy, the Gujarat Renewable Energy Policy - 2023 shall be prevailed.
