CLIENT INTERVIEW

Client: Hello Sir, Good morning

Advocate: Hello good morning take your seat, would you like to have anything tea or coffee?

Client: No thanks, will just have a glass of water.

Advocate: What is your name and how can I help you?

Client: My name is Shubham and I am here to discuss about how can I have a divorce with my
Wife and its relevant legal obligations.

Advocate: Of Course, I am here to help, I understand that this can be a difficult time. Can you tell
me a bit more about yourself and your spouse and about your marriage as well?

Client: Yes, my wife’s name is Deepika and we got married on 11th January, 2015 and she is a
Working mother.

Advocate: What is your wife Occupation?

Client: She is working with PWC as an auditor

Advocate: What is your Occupation and where do you reside?

Client: I am a businessman; I have a business of Export trade and I reside in Dlf city Gurgaon

Advocate: Do you have any kids? And who all lives together, can you pls tell me about your
Family a bit more.

Client: Yes, I have a son, who is four years Old and I live with my wife, My kid and My
Parents.
My Father is a Retired man now and my mother is a homemaker who takes care of my
family.

Advocate: Okay, I can understand, Shubham but divorce is never easy, it’s a challenging journey
And I am here to guide you through it. Can You tell me the issue which led you to
such
Decision.

Client: Well, Deepika and I have grown apart over the years. We used to be deeply in love but
now it feels like we are strangers living in the same house, she doesn’t treat my
parents well, When I travel due to my business commitments, she treats them
very badly behind my back by not letting them to eat as well Plus she forces me to
throw them out of my house and that she doesn’t want to live with them plus she
infact, forces me to not to talk to them. She doesn’t let my kid talk to his grandparents
Plus, now I am in a fear that she can falsely accuse my dad of harassing her.
There are many other incidents she usually comes late from office in night and she had
An extra marital affair in 2017, which we both have resolved the issue but now I
think she has again started meeting the same guy, he is her office colleague.

Advocate: What is your Parents age?

Client: My father is 70 years old and My mother is 69 Years old.

Advocate: I am sorry to hear that, it’s clear that you have put a lot of thought into this. Have you
discussed your feelings with Deepika?

Client: Yes, we have talked about it. She is ready for divorce but she has demanded 75% of
my
Fortune as settlement. That’s why I want you to negotiate with her counsel so that
With the mutual consent we can come to a conclusion.

Advocate: Yes, I recommend that you and Deepika try to work out as many details as possible
Through mediation or negotiation. It’s usually less adversarial and more amicable than
Going through a lengthy court battle. I can assist you in this process.

Client: Yes, that sounds perfect.

Advocate: Yes, The Hindu Marriage Act, 1955 enshrines the right to divorce by way of mutual
Consent under Section 13B. The spouses can jointly file a petition seeking divorce
Under Section 13B before the Family court, which possesses the jurisdiction to pass
Such a decree of divorce under Section 13B.

Client: Yes, Sir I don’t want a lengthy court battle plus I want the custody of my child as well.

Advocate: Yes, will fight our best for your child custody and reducing the amount of settlement
How much does your wife earn?

Client: Sir, she earns 3lac per month. She wanted one of the floor of my house to be registered
Under her name that’s why she started torturing my parents and the approx. cost of one
of my floor is 7cr.

Advocate: We will try to resolve it mutually, our first aim would be the child custody and second
Settlement amount or maintenance to be minimised.

Client: Yes, and its approx 12 months that she is living separately and comes for 2-5 days in a
Month to fight with me and my parents and now its time for us to move on.

Advocate: Do you have any proof that her extra marital affair has started again?

Client: Yes sir, I have her WhatsApp chats and the hotel booking confirmation of two of them,
Plus a cctv footage of her fighting with my parents regarding property and locking
them
Inside their room and other recordings of her of telling me to leave my parents.

Advocate: Okay, So we have our valid points and as stated under Section 13B divorce by mutual
Consent is granted and in your case getting it by a mutual consent in your favour is
Preferable and it’s good that she has agreed otherwise it would have turned into a
Lengthy case.
Client: Yes sir, we have both have finally decided , it’s just that the conditions are favourable
for
Me.

Advocate: Okay, I appreciate your approach, Shubham remember , I am here to support you and
Ensure your rights are protected. Divorce is a challenging journey, and I hope it can be
a
Step towards a brighter future for both you and Deepika.

Client: Yes sir, Hoping for the best and thanks for the consultation.

Advocate: Pleasure, Okay so will proceed with our next step and I am happy to help you Mr.
Shubham.

Thank You!
