PROSECUTOR: Your Honor we are presenting Engr. CLENTON APILAR as our first witness.
CLERK CABANA: Please raise your right hand. Do you swear to tell the truth, the whole truth and
nothing but the truth before this Court?

COMPLAINANT JILMER: Ako si JILMER GENEALAO, 20 anyos, ulitawo ug residente sa Purok 1, Barangay
Bialong, Mlang, Cotabato. Nagtrabaho ko isip Head Engineer sa Gong Cha Construction.
INTERPRETER ARAUJO: I am Jimler Generalao, twenty years old, single, and I live in Purok 1, Barangay
Bialong, Mlang, Cotabato. I am the Head Engineer of Gong Cha Construction.
PRESENTATION OF PROSECUTION’S WITNESS: Jilmer Generalao//Direct Examination
PROSECUTOR RIKINA: May we proceed your honor?
JUDGE CARLA: Alright, you may proceed.
PROSECUTOR RIKINA: Your Honor, we offer the testimony of the complainant-witness Engr. Jilmer
Generalao to prove the allegation that herein accused, Mayor Franco Herera, committed a violation of
Section 3(b) of RA 3019. The witness also manifested beforehand that he wishes to give his testimony in
the English language.
JUDGE CARLA: All right.
PROSECUTOR RIKINA: Engr. JILMER, do you remember executing a judicial affidavit for this case?
WITNESS JILMER: Oh, Ma’am.
PROSECUTOR RIKINA: I am showing you a document which is entitled as Judicial Affidavit, is this the
same judicial affidavit you executed?
INTERPRETER ARAUJO: Gipakita nako kanimo ang usa ka dokumento nga nag-ulohang Judicial Affidavit,
parehas ba kini nga judicial affidavit nga imong gipatuman?
JILMER: Yes, Ma’am.
PROSECUTOR RIKINA: The Witness has positively identified the Judicial Affidavit marked as Exhibit “A”,
this serves as the direct testimony of Engr. Jilmer Generealao

on the affiant portion. Whose signature is that?

DEFENSE MAU: Mr. Witness, You are working as head engineer for Gong Cha Construction, is that
correct?
INTERPRETER ARAUJO: Mr. Witness, Nagtrabaho ka isip head engineer sa Gong Cha Construction, sakto
ba kana?
JILMER: sakto, attorney.
INTERPRETER ARAUJO: correct, atty.
DEFENSE MAU: How long have you been working as head engineer for Gong Cha Construction?
INTERPRETER ARAUJO: Unsa ka dugay ka nagtrabaho isip head engineer sa Gong Cha Construction?

INTERPRETER ARAUJO: 7 YEARS NOW, ATTY.
DEFENSE MAU: And out of the 7 years you’ve worked for Gong Cha, how many projects did the
company enter into with the Municipality of Mlang with you as Head engineer?
INTERPRETER ARAUJO: Ug sa 7 ka tuig nga nagtrabaho ka sa Gong Cha, pila ka proyekto ang nahimo sa
kompanya nga mosulod sa Munisipyo sa Mlang kauban nimo isip Head engineer?
JILMER: Kini ang among ika-3 nga proyekto kauban ang Munisipyo sa Mlang, atty. Ang una kay si Mr.
KOPRA pa ang mayor, niadto pang 2012, unya ang 2nd ubos na ni Mayor HERERA, para sa road
widening project niadtong 2015.
INTERPRETER ARAUJO: This is our 3rd project with the Municipality of Mlang, attorney. The first one
was when Mrs. kopra was still the mayor, back in 2012, then the 2nd one was already under Mayor
Herera, for a road widening project in 2015.
DEFENSE MAU: So is it safe to say, Mr. Witness, that this is not the first time that you’ve worked with
respondent?
INTERPRETER ARAUJO: Okay ra ba nga isulti, Mr. Witness, nga dili kini ang una nga higayon nga
nagtrabaho ka sa respondent?
JILMER: Oo, Dili kini ang unang higayon, atty.
INTERPRETER ARAUJO: Yes, it’s not the first time, attorney.
DEFENSE MAU: For the contracts entered into between Gong Cha and the Municipality, what role does
respondent Franco Herera play?
INTERPRETER ARAUJO: Alang sa mga kontrata nga gisudlan tali sa Gong Cha ug sa Munisipyo, unsa ang
papel sa respondent nga si Franco Herera?
JILMER: Siya ang nag-aprobar sa mga kontrata tungod kay siya ang mayor
INTERPRETER ARAUJO: He is the approving authority for the contracts because he is the mayor.
DEFENSE MAU: Okay, so you say respondent is the “approving authority” for contracts, in fact you also
mentioned it in your Judicial Affidavit. But what exactly do you mean when you say Mr. Witness, that
respondent is the “approving authority”?
INTERPRETER ARAUJO: mao nga giingon nimo nga ang respondent mao ang "pag-apruba sa awtoridad"
alang sa mga kontrata, sa tinuud nahisgutan usab nimo kini sa imong Judicial Affidavit. Apan unsa man
gyud ang imong ipasabot sa imong pag-ingon nga Mr. Witness, kanang respondent mao ang “approving
authority”?
JILMER: Buot ipasabot, attorney, nga kung wala ang iyang pirma, dili kami makasugod sa pagtukod.
INTERPRETER ARAUJO: he means, attorney, that without his signature, we could not start the
construction.
DEFENSE MAU: In the past road widening project between Gong Cha and the municipality, where
respondent Herera was mayor, how was your working relations?
INTERPRETER ARAUJO: Sa nangaging road widening project tali sa Gong Cha ug sa munisipyo, diin
mayor ang respondent nga si Herera, kumusta ang inyong relasyon sa pagtrabaho??
JILMER: Maayo ang among TAGAD SA TRAAHO niadtong miaging proyekto, attorney. Mao nga nakurat
gyud ko dihang nangayo si Mayor og grease money para niining proyekto karon.
INTERPRETER ARAUJO: Our working relations in that past project was good, attorney. That is why I was
really shocked when Mayor asked for grease money for this current project.
DEFENSE MAU: Wait, my question Ms. Witness, is what do you mean exactly by “Our working relations
in the past project was good”?
INTREPRETER ARAUJO: akong pangutana Ms. Witness, unsa man gyud ang imong gipasabot sa " Maayo

JILMER: kuan attorney nga, kada katapusan sa buwan, moadto ko sa iyang opisina ug mohatag niya ug

Sama sa gisulti ni Mayor kanako mga usa ka bulan ang milabay nga gusto niya manghulam og kuwarta
kanako aron maproseso ang iyang Australian visa.
INTERPRETER ARAUJO: He means attorney that, at the end of every month, I would go to her office and
give her updates about the status of the construction. During these times, sometimes we would talk
about our respective families, sometimes we would share problems. Things like that. Like Mayor told me
about a month ago that she wanted to borrow money from me to process her Australian visa.
DEFENSE MAU: So respondent once asked to borrow money from you last month? So are we talking
here about a loan agreement?
INTERPRETER ARAUJO: Busa ang respondent kausa mihangyo nga manghulam og kuwarta kanimo sa
miaging buwan? Busa naghisgot ba kita dinhi mahitungod sa usa ka loan agreement?
JILMER: Oo, ug kadto usa ka pautang.
INTERPRETER ARAUJO: Yes, it was a loan.
DEFENSE MAU: For how much was the loan?
INTERPRETER ARAUJO: Pila ang pautang?
JILMER: 200,000, atty.
INTERPRETER ARAUJO: For P200,000, attorney.
DEFENSE MAU: And did you let the respondent borrow the money?
INTERPRETER ARAUJO: Ug gipasagdan ba nimo nga manghulam ang respondent sa kuwarta?
JILMER: Giingnan nako si Mayor nga wala koy ingon niana nga kuwarta. Giingnan nako siya nga basin
makahangyo ko kang Sir APILAR nga pautangon niya ang kuwarta.
INTERPRETER ARAUJO: I told Mayor that I didn’t have that kind of money. I told her that maybe I can
ask Sir APILAR to let her borrow the money.
DEFENSE MAU: And who is this Sir APILAR you are talking about?
INTERPRETER ARAUJO: Ug kinsa man kining si Sir APILAR nga imong gihisgutan?
JILMER: Akong amo nga si Sir APILAR Gong Cha, ang tag-iya sa Gong Cha Construction.
INTERPRETER ARAUJO: My boss Sir APILAR Gong Cha, the owner of Gong Cha Construction.
DEFENSE MAU: And did your boss lend the respondent money?
INTERPRETER ARAUJO: Ug gipahulam ba sa imong amo ang gitubag nga kuwarta?
JILMER: oo, tatty. Gipahulam ni Sir Ryan si Mayor og P200,000. Milihok ko isip garantiya sa maong loan
agreement.
INTERPRETER ARAUJO: Yes attorney, Sir Ryan lent Mayor the P200,000. I acted as the guarantor for that
loan agreement.
