The Criminalization of Marital Rape in India - A Distant Dream:
"FORCED CONSENT IS NOT CONSENT, EVEN IN MARRIAGE".
Introduction

• Section 375 of the Indian Penal Code defines rape as "sexual


intercourse with a woman against her will, without her consent, by
coercion, misrepresentation or fraud or at a time when she has been
intoxicated or duped, or is of unsound mental health and in any case
if she is under 18 years of age."

• Marital rape is the henious sexual act commited against any married
person without their consent by the person they marry to.

• It is seen as a form of domestic violence and sexual abuse.

• India is amongst the 36 countries that still not have criminalized


marital rape- Traditionally, coitus within a marriage was regulated as
the right of the husbands, without their respective wife's consent.
Though, women do suffer through marital rape the most, there are
still some few cases of marital rape of men as well.
Rationale of the study

• Section 375 of IPC states that "non- consensual sexual act


by a man with his wife, if she is over 15 years, does not
amount to rape. On Oct 2017, the supreme court of India
increased the age to 18 years.

• It has been presumed that the wife give her consent forever
to her husband by the act of marriage for any sexual related
activity.

• Protection of women from Domestic Violence Act, 2005


does not consider marital rape a crime but do consider it a
form of domestic violence.
