Contract Clause Remarks

Contractor shall perform, build, furnish,


undertake, procure and provide or
cause to be performed, furnished,
undertaken, procured and provided, all
work as described in this Scope of Work
for the engineering, procurement
construction, installation,
interconnection, testing, start-up and
commissioning of the Project

ERECTION OF POST - EBATECH

The medium voltage and low voltage


electrical system shall strictly be in
accordance with the single line diagram,
lay out and specification given by the
Supply Chain Engineering Services
Team.

Contractor shall guarantee that the


electrical system is free from all
defective workmanship and materials
will remain so for a period of one (1)
year from issuance of the
Certificate of Completion (COC)
The Client may make changes in the
Contractor’s Scope of Services per
Annex A.
Similarly, the Contractor shall notify the
Owner of changes brought about by the
following
conditions that shall increase or
decrease the Contractor’s
compensation or the duration of
the Contractor’s Scope of Services or
both:
1. Variation orders with cost and time
implications
2. Increase in manpower requirements
mutually agreed upon between the
Client and
Contractor
3. Extension of Contract time

The Client shall release to the


Contractor a downpayment equivalent
to Thirty Percent (30%) of the contract
amount upon signing of the Purchase
Order and upon submission of Surety
Bond

Balance of the contract amount shall be


paid in progress payments based on
actual works completed. Requests for
progress payments shall be submitted
by the Contractor request to be based
on completed work progress for a
specific period.

Contractor’s performance of work and


deliverables are subject for evaluation /
inspection and approval of the Supply
Chain Engineering Services Team
Client shall have the right to request that
such testing and commissioning for such
part of the Works be repeated on the same
terms and conditions at the sole cost of the
Contractor. The Client shall
have the right to provide and update the
Testing and Commissioning procedures and
success
criteria based on new Client’s standards If
any part of the Works has failed to pass the
testing
and commissioning on the repetition
thereof, the Client shall be entitled to order
further
repetition of the testing and commissioning
under the same provisions as set forth
above, until
such time as the testing and commissioning
for such part of the Works are passed
