This Construction Contract Agreement ("Contract") is made and entered into on

this ___ day of __________, 20, by and between:

WHEREAS, the Employer wishes to engage the Contractor to construct a Double-


Story Block (“the Works”) as per the agreed design, drawings, and specifications.

NOW, THEREFORE, in consideration of the mutual covenants and agreements


contained herein, the parties agree as follows:
1. CONTRACT DOCUMENTS

The following documents shall form part of this Contract:

1.1 The NJPC 2000 Standard Form of Contract

1.2 The Employer’s Requirements and Drawings

1.3 The Contractor’s Proposal

1.4 The Priced Bill of Quantities (BOQ)

1.5 The Project Timeline and Schedule

1.6 Any other document mutually agreed upon in writing

2. SCOPE OF WORKS

The Contractor shall provide all materials, labor, tools, equipment, and services
necessary to construct the double-story block in accordance with the contract
documents. The work includes but is not limited to:

Site preparation and foundation works

Structural framework and masonry work

Roofing, windows, and doors

Electrical, plumbing, and mechanical installations

Internal and external finishes

Landscaping and any external works

3. CONTRACT PRICE AND PAYMENT TERMS

3.1 The total contract price shall be $_________ (inclusive/exclusive of VAT).


3.2 Payments shall be made in the following manner:

Mobilization advance: __% of the contract sum

Interim payments based on work progress (e.g., monthly valuations)

Final payment upon completion and certification of works

3.3 Retention: __% of the contract sum shall be retained and released after the
defect liability period.

4. TIME FOR COMPLETION

4.2 The Contractor shall commence work on [Start Date] and achieve practical
completion by [Completion Date].

4.3 In the event of delays caused by unforeseen circumstances, the Contractor may
apply for an extension of time, subject to the Employer’s approval and in
accordance with the NJPC 2000 provisions.

4.4 Liquidated damages for delay shall be charged at $___ per day/week for failure
to complete the works within the agreed time unless an extension of time has been
granted.

5. VARIATIONS AND CHANGES

5.1 The Employer may instruct variations to the works in writing, including
changes to design, materials, or scope.
5.2 The Contractor shall provide a cost and time assessment for any variation
within __ days of receiving instructions.

5.3 No variation shall be carried out unless agreed in writing by both parties,
except in emergency cases where the Contractor must act to prevent damage or
safety risks.

6. QUALITY AND MATERIALS

6.1 All materials and workmanship shall conform to the contract specifications,
approved drawings, and industry standards.

6.2 The Employer and/or appointed consultant shall have the right to inspect and
test materials at any stage of construction.

6.3 If any work is found to be defective or non-compliant, the Contractor shall


rectify it at their own expense within a reasonable timeframe.

7. HEALTH, SAFETY AND ENVIRONMENT

7.1 The Contractor shall comply with all applicable health, safety and
environmental regulations.

7.2 The Contractor shall implement appropriate safety measures, including


providing protective equipment and training for workers.

7.3 Any accident or incident on-site must be reported to the Employer within 24
hours.

8. INSURANCE AND LIABILITY


8.1 The Contractor shall maintain the following insurance policies throughout the
contract period:

Contractor’s all-risk insurance

Public liability insurance

Workers’ compensation insurance

8.2 The Employer shall be named as a beneficiary under relevant policies where
applicable.

8.3 The Contractor shall indemnify the Employer against any claims, damages or
losses resulting from negligence or failure to comply with the contract.

9. DEFECTS LIABILITY PERIOD

9.1 The defects liability period shall be __ months from the date of practical
completion.

9.2 The Contractor shall be responsible for rectifying any defects arising from poor
workmanship or materials at no additional cost during this period.

9.3 The final retention payment shall only be released after satisfactory
rectification of defects and issuance of the Final Completion Certificate.

10. TERMINATION

10.1 The Employer may terminate the contract if the Contractor:

Fails to complete the works within the agreed timeline (subject to extensions)

Breaches contract terms and fails to remedy within __ days of written notice

Becomes insolvent or ceases operations


10.2 The Contractor may terminate the contract if:

The Employer fails to make payments as agreed

The works are suspended for more than __ days due to reasons beyond the
Contractor’s control

10.3 In the event of termination, the Contractor shall be paid for work completed
up to the termination date, minus any applicable deductions.

11. DISPUTE RESOLUTION

11.1 Any dispute arising from this contract shall first be resolved through mutual
negotiation.

11.2 If the dispute is not resolved within __ days, it shall be referred to


mediation/arbitration in accordance with the NJPC 2000 provisions.

11.3 The decision of the arbitrator shall be final and binding on both parties.

12. GOVERNING LAW
