1. I received a copy of my Extended Warranty plus Accidental Damage Service Certificate for Mobile and Portable Electrical
Devices No.4407123199 issued by Esquiretech Corp. (Esquire) thru HC Consumer Finance Philippines, Inc. (“Home
Credit”). This Device Protection covers for the cost of repair due to product failure as a result of mechanical and/or
electrical defects; or the cost of replacement if beyond economical repair, and for the cost of repair or replacement for any
damage to the Product while located at your address caused by an accident occurring between the Effective Date and
Expiry Date, subject to the terms and conditions of this Service Certificate.
2. I understand that monthly installments for my loan, including the Device Protection fee must always be paid on time and
the Device Protection fee is part of my loan. The total loan (including the Device Protection fee) can only be cancelled
without additional fees or penalties within fifteen (15) calendar days from the date of this Service Certificate, in accordance
with the provisions of the Loan Agreement.
3. By signing below, I hereby affirm enrollment to the Extended Warranty Service and I further consent that my name,
address, email address, mobile number, IMEI/serial number and other relevant details of my Home Credit Loan, can be
shared by Home Credit to Esquire for the purposes of carrying out the intent of the above-mentioned Extended Warranty

WELCOME

Thank you for choosing to register your Product, as described above, under the Extended Warranty + Accidental
Damage Service Certificate (“Service Certificate”).
What is Covered:
This Service Certificate covers:

A. Extended Warranty – for the cost of repair due to Product failure as a result of mechanical and/or electrical defects;
or the cost of replacement if beyond economical repair subject to the terms and conditions herein.

B. Accidental Damage – for cost of repair or replacement for any damage to the Product while located at your address
caused by an accident occurring between the Effective Date and Expiry Date. It does not cover damage due to your
negligence, omission or default in the use or care of the Product.

Please see below for full terms and conditions.

Both Extended Warranty and Accidental Damage apply only to repairs and replacements done in the Philippines and for
Products purchased and used in the Philippines. The repairs and replacements made to the Product shall not exceed
the Limit. We have the right and option to either repair or replace the Product with another of like kind, quality and
specifications. Due to technological advances, the replaced Product may be of a lower retail value than the faulty
Product. Replacement parts will be original manufacturer's parts that conform to factory specifications and shall be
determined at our sole discretion.
Coverage Term:
The Extended Warranty shall be for a period of one (1) year effective from the date of the expiry of manufacturer’s
Warranty Period until its expiry on the same date of the following year, unless coverage is no longer applicable or is
terminated as provided under the terms hereof.

Entitlement to services under this Service Certificate can no longer be availed once the period of extended warranty has
expired or is deemed otherwise void.

The Accidental Damage cover shall commence from the Purchase Date of the Product and expire one (1) year or two
(2) years from such date as above stated.

Registration:
You must register to the Service Certificate on the date you purchase the Product or within thirty (30) calendar days
from the purchase date. This shall not be valid unless and until the Service Certificate Fee has been fully paid. After
payment, the Product will become eligible for the Extended Warranty and Accidental Damage protection and benefits.
Exclusions for Extended Warranty:
We shall not be liable in respect of:

1. Non-operating and cosmetic defects, paint, color, or Product finish, accessories used in or with the Product, screen
protectors, external cables and cords, add-on options incorporated to the Product, and hardware that has been added
after the purchase of the original Product;

2. Software (including operating system and any stored data), defects resulting directly from software installation and/ or
removal, computer virus, virus prevention, and other peripherals;

3. Consumables such as vacuum cleaner belts, toner, print or ink cartridges, bulbs, compact discs, digital tapes, and the
like;

4. All batteries (including regular non-chargeable batteries and rechargeable batteries) unless otherwise specifically
covered under this Policy;

5. External faults such as wiring, electrical connection or plumbing, piping, trunking, fitting, realigning of signal receivers
(poor reception), and consequential loss of any kind;

6. Failure caused by a voltage converter and/or applying incorrect voltage to the Product;

7. Product(s) that are still covered by the manufacturer's original written warranty, repairer's warranty, or any other
warranty still in effect;

8. Any defects that are the subject of the manufacturer's recall;

9. Failure to follow manufacturer’s instructions on installation or operation of the Product(s) and repairs to any items not
affecting the function of the Product(s), and failure to comply with the manufacturer's recommendations on routine
maintenance, inspection, cleaning, lubrication, external adjustments and any other instructions relating to the use and/or
upkeep of the Product(s);

10. Commercial use (multi-user organisations), public rental, use for profit or communal use for multi-family housing;

11. Shipping charges, damage charges, express service charges, transportation damage, removal, installation or
reinstallation of the Product(s), Product(s) on loan during the repair process;

12. Any loss or damage due to burglary, theft, fire, flood, corrosion, animal and insect infestation, pet damage, sand,
water damage, excessive heat, battery leakage, improper environment (including lack of proper temperature or
humidity), cyber-attack, misuse, gross negligence or abuse, howsoever caused;

13. Any loss or damage to the Product(s) resulting from an Act of Terrorism and an act of God including without
limitation, events such as earthquake, war, invasion, act of foreign enemy, hostilities or warlike operations, civil war, civil
commotion; or

14. Diagnostic fees where no defect has been found or noted;

15. Defects and on-site service charges not covered by the manufacturer's original written warranty, unless specifically
covered in the Service Certificate;

16. Damages caused by repair work or failure to perform repair work by the Service Provider, its agents or employees,
or any other repair facility, its agents or employees;

17. Repairs performed by any repairer which is not authorized by the Company;

18. Liability to anyone other than the Policyholder or the Purchaser;

19. Any acts of fraud, or other dishonest or criminal acts of the Service Provider or its agents or employees;

20. Property & product liability insurance;

21. Use of the service in any illicit trade or transportation or in the commission of a felony;

22. Routine maintenance or cleaning;

23. Unauthorized modifications made to the Product and/or problems/defects arising from such unauthorized
modifications; altered serial/IMEI numbers; repairs performed by non-authorized repairer; any items not affecting the
function of the Product; image burn;

24. Any failure, malfunction, defect, inoperability, breakdown, disruption, or stoppage of the Product or any Product,
functions or the functions of any related to, directly or indirectly any design, planning or engineering incompatibility; or

25. Any applicable Service Fee stated in the Service Contract hereto.

Exclusions for Accidental Damage:

We shall not be liable in respect of:

1. any costs or charges for which the manufacturer, supplier or distributor of the Equipment are liable in accordance with
their standard warranty obligations;

2. any Damage to the Equipment caused by or attributable to:

i. Damage not reported to Us within seven (7) Days of discovery;

ii. any process of cleaning, servicing, inspection, maintenance, adjustment or repair not authorized by the Company;
or

iii. any Damage caused by breach of the manufacturer’s operating or guidance instructions

3. Equipment that has undergone unauthorized opening or modification;

4. breakdown attributable to or caused by:

i. the cost of repairing or replacing the Equipment as a result of breakdown (due to a sudden unforeseen internal
mechanical or electrical defect causing the actual breaking or burning out of a part) causing the failure of the Equipment
to operate as intended by the manufacturer;

ii. any malfunction resulting from incorrect use of electricity or the incorrect setting of controls or accessories or
equipment not approved by the manufacturer;

iii. any malfunction or accidental Damage resulting from incorrect installation or re-installation, faulty software or
programming;

iv. any willful act, misuse or negligent use of the Equipment; or

v. wear and tear or gradual deterioration of the Equipment.


5. the cost of:

(a) repairing Equipment with only cosmetic Damage that does not prevent its correct operation; or

(b) any costs which the Insured can recover under the conditions of any other guarantee, warranty or insurance.

6. loss of use or consequential losses incurred as a result of a claim, including but not limited to loss of profits, goodwill,
income or business, or incurring related expenses, or any other indirect or consequential loss or damage of any nature
whatsoever;

7. Damage directly or indirectly occasioned by:

(a) Natural calamity, war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war,
rebellion, revolution, insurrection or military or usurped power, nationalization, confiscation, requisition, seizure or
destruction by the government or any public authority;

(b) ionising radiations or contamination by the radioactivity from any nuclear waste from the combustion of nuclear
fuel or the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear
component thereof;

(c) pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speeds; or

(d) Damage due to leaving the Equipment on the roof, bonnet, boot or any exterior part of a vehicle.

Conditions:
1. Our designated Service Provider will perform the assessment of the faulty or damaged Product and will arrange for its
repair and/or replacement. The decision based on our designated Service Provider’s assessment shall be final and
conclusive and there shall be no right of appeal against such assessment.

2. You must have indicated the inclusion of this Service Certificate for the Product(s) purchased on the sales receipt/ tax
invoice issued by the merchant/retailer and have agreed to be bound by the terms and conditions of the same.

3. The Product must be new items purchased and the Service Certificate must be made on the date of such purchase or
within thirty (30) Days from the purchase date or delivery date of the Product (whichever is later).

4. Subject to the terms, conditions and exclusions of this Policy, it is also a condition of this Policy before any claim for
benefit will be admitted that there must be a valid Service Certificate between the Purchaser and the Policyholder; and
the Purchaser has not breached any terms and conditions of the Service Certificate which may render it invalid.

Limit of Liability:
The liability for the Product shall not exceed the original price (including any prevailing value added tax) paid for by you
for the Product (“Limit”).

We will replace the Product with one of like kind, quality and/or specification if the Product is not repairable or beyond
economical repair.

We reserve the right to pay you the original purchase price (including any prevailing value added tax) of the Product if
We are unable to give a replacement product that matches the quality and specifications of the faulty Product.

We shall not be liable under this Service Certificate if you:

a. do not report the damage or breakdown to us or our designated Service Provider before the expiry of this Service
Contract; do not report the damage or breakdown to us or our designated Service Provider within five (5) working days
from the expiry of the Service Contract; unless you are prevented from doing so due to reasons outside your control and
we shall review such request on case by case basis; and

b. do not submit the Product(s) to an authorized repairer arranged by our designated Service Provider for assessment or
repair before the expiry of this Service Contract. If your service request is accepted by us as described in point b above,
you will be given an additional five (5) working days to arrange for the repair or assessment.

Transfer of Ownership:
This service certificate may not be transferred to a new owner of the covered Product unless a notice of such transfer is

This Service Certificate is a service agreement between you and Esquiretech Corp. It is neither a guarantee nor a
promise relating to the nature of the material, workmanship or performance of the Product covered by this service
contract.
