RE: DEMAND LETTER OF THE FOOTBALL KENYA FEDRATION
CHIEF EXECUTIVE OFFICE MR. HAROLD NDEGE ILLEGAL
APPOINMENT.
Kindly take NOTE of the above captioned.
We are sovereign citizens under the auspices of INTEGRITY WATCH;
Integrity Watch is a network of whistle blowers, bloggers and activists
countrywide who seek to ensure public officer accountability, integrity and
fidelity to the law in execution/discharge of public duty
Further INTEGRITY WATCH is a collaboration of organizations and
individual anti-corruption crusaders who have come together with a firm
mandate to give full effect to chapter six of the constitution of Kenya 2010.
The Constitution of Kenya, 2010 provides, under Chapter 6, for leadership and
integrity of all public officers. The Chapter is predicated upon the assumption
that public officers are the nerve Centre of the Republic and carry the highest
level of responsibility in the management of state affairs and, therefore, their
conduct should be beyond reproach.
Further, the Constitution of Kenya 2010 sets a new mark and threshold for
public sector accountability and those public servants entrusted with public
office who do not want to meet and live by the new set standards should simply
quit public office. Under the Constitution Kenyans decreed that those whose
conduct does not bring honor, public confidence and integrity have no place in
the management of public affairs.
INTEGRITY WATCH intend to Promote Democratic Governance, Non-
Discrimination, Stop Ethnic Marginalization, Uphold the rule of law,
Constitutionalism, Defending Human Rights and Agitated for Sustainable
Economic Development for the prosperity and well being of our country Kenya.
Fidelity to the constitution is fundamental it keeps us all grounded to our
responsibility to build a just society. When Kenya overwhelmingly voted for the
new constitution in 2010, they laid down a fundamentally new vision for
transforming the country and Nation.
It was the desire of Kenyans of all walks of life to take charge of our collective
density, address the culture of impunity and confront the outright callousness
and unresponsive attitude
The undersigned are social justice and human rights activists and do hereby
request for your attention to the above captioned matter and require a response/
action to the same.
Take NOTE that recruitment exercise to fill a vacancy in a public office must be
done with due regard for public participation, fairness, transparency and
competitiveness as envisaged under Article 10, 27, 47, 232 and 235 of the
Constitution of Kenya, 2010 and Public Service Act, 2017.
The recruitment process, procedure and best practices include; declaration of a
vacancy and call for applications through an advert on leading dailies or
relevant websites, thorough capture of applicant’s data, short-listing of
candidates, publishing of short-listed candidates and interview schedules, call
for public participation and forwarding the first three best candidates to the
appointing authority for consideration.
The Public Service Commission (PSC), which is the benchmark institution for
any public recruitment, has set and adhered to the said standards more than
often.
We seek to take great exception at a surprising decision where Mr. Harold
Ndege was Pronounced as the substantive Chief Executive Officer The Football
Kenya Federation(FKF).
This pronouncement came as a surprise since there was no an advertisement for
vacancy.
The Football Kenya Federation National Executive Committee, by affirming
and confirming appointments’ of persons who have not undergone rigorous fair,
transparent, competitive, inclusive, and merit-based recruitment process open to
public participation is affirming impunity.
We OBSERVE and raise a RED FLAG on the following facts;
1. THAT those who hand-picked Mr. Harold Ndege may have a suspect
mission and Kenyans have fears that he can be manipulated because he is
not at the helm of The Football Kenya Federation deservedly.
2. THAT the appointment did not meet the constitutional threshold of being
competent, fair and transparent.
3. THAT the appointment is illegal, null and void.
4. THAT this is a classic demonstration of confounding heights of impunity
in public office should be swiftly and deeply investigated.
From the above a foregoing, we DEMAND as follows;
1. THAT the appointment of Mr. Harold Ndege be immediately
quashed/canceled and fresh recruitment of The Football Kenya
Federation Chief Executive Officer initiated.
2. THAT the Ethics & Anti-Corruption Commission (EACC) is
immediately invited to look into the sham appointment and whoever
found culpable of any impropriety be dealt with accordingly.
Kindly be Advice the Football Kenya Federation (FKF) is
considered a public entity in Kenya, as it is the governing body
for football in the country and manages the sport on a national
level, essentially acting as a representative for the public
interest in regards to football, and governed by sport Act 2013.
Take NOTICE that if the appointing authority fails to do so, we will move to
court to promptly and vigorously challenge this irregular and unconstitutional
decision in public interest.
The Football Kenya Federation National Executive Committee,
must itself act legally and constitutionally and within
the best practices in human resource management.
We caution that constitutional values for fair competition, equal opportunity
and fair administrative action have been subverted by the appointing
authority.
Sir, we seek to bring to your notice that the Constitution of Kenya 2010 sets a
new mark and threshold for public sector accountability and we have brought
this purely in the public interest under Article 22 and have acted in good faith,
in defense of the Constitution pursuant to Article 3(1) of the Constitution.
From the foregoing, it is obvious that our fears and concerns are serious, real
and founded.
Therefore, we expect feedback from you within seven days (7) failure to which
we will be forced to move to court, widely share the same concerns in social
media and refer the same to other relevant government agencies and human
rights organizations.
Your prompt response to this demand letter will go a long way in putting the
raised matters in this note to rest.
