A RESOLUTION ENACTING BARANGAY TAX ORDINANCE NO. 01 SERIES OF 2024 “AN ORDINANCE
COLLECTING FEES AND CHARGES ON THE ISSUANCE OF BARANGAY CLEARANCES,
CERTIFICATIONS, SERVICES AND OTHER BUSINESS AND OR ACTIVITIES LEGALLY OPERATED
AND CONDUCTED WITHIN THE TERRITORIAL JURISDICTION OF BARANGAY BUENAVISTA.
WHEREAS, one of the powers and duties of the Sangguniang Barangay is to enact Tax and Revenue Ordinances in the
exercise of its taxing powers as provided under Section 152 of RA 7160 known as the Local Government Code of 1991.
WHEREAS, Barangays may collect reasonable fees or charges for services rendered in connection with the regulations or
the use of Barangay owned properties or services facilities constructed using government funds such as Multi-Purpose
halls, Basketball Courts and other similar Facilities, including tourism related services;
WHEREAS, no license or permits can be issued by the City Government for any construction of buildings, business or
any activities operated or conducted within Barangay Buenavista without first obtaining a Barangay Clearance;
WHEREAS, enactment of an ordinance regulating the collection of fees and charges on the issuance of Clearance,
Certifications, Services rendered of the barangay owned properties that will result to generation of local income directly
benefits the constituents of Barangay Buenavista;
NOW THEREFORE, upon unanimous motion of all the members of the barangay council constituting the committee of
the whole, it was;

BARANGAY TAX ORDINANCE NO. 01


Series of 2024

ARTICLE I. AN ORDINANCE REGULATING THE COLLECTION OF FEES AND CHARGES OF


BARANGAY BUENAVISTA IN THE ISSUANCE OF BARANGAY CLEARANCE, CERTIFICATIONS,
SERVICES USING BARANGAY FACILITIES AND OTHER BUSINESS AND OR ACTIVITIES LEGALLY
OPERATED IN BARANGAY BUENAVISTA”

Section 1. This Ordinance shall be known as the Barangay Buenavista Tax Ordinances for the collection of fees
and charges on the issuance of Barangay Clearances, Certifications, and Services using barangay facilities. and other
business and or activities legally operated or conducted within the barangay.
ARTICLE II. AUTHORITY AND PURPOSE
Section 2. That there shall be fees or charges to be collected by the Barangay Government to all residents and non-
residents of Barangay Buenavista who are doing business or who intend to do business within the Barangay upon their
request for a Barangay Clearance or Barangay Certifications.
Section 3. PURPOSE, this Ordinance is enacted for the purpose of collecting reasonable fees or charges for the service
rendered and business or any activities operated legally in the barangay.
ARTICLE III. DEFINITION OF TERMS
Section 4. definition of terms shall defined as follow’s.
4.1 Obligation Barangay Clearance- refers to the fact that the concerned person is cleared of all obligations
he may incurred in the Barangay, as a result of fines, contributions and other financial liabilities lawfully
imposed by the Barangay or by the Lupon Tagapamayapa.
4.2 Business Barangay Clearances- refers to the fact that the applicant is allowed to engage in business in
the barangay pursuant to the Barangay Ordinances, existing Laws and Subject to the compliance of the
requirements compelled by the City Ordinance.
4.3 Water/Electric Connection Barangay Clearance- refers to the fact that the applicant for water and
electrical connection has complied with the requirements prior to the connection for water and electricity,
and that he is cleared from such requirements imposed by lawful authorities.
4.4 Building Barangay Clearance- refers to the fact that the applicant for building permit has complied with
the zoning Ordinance of the City of Surigao and that the building to be conducted does not endanger the
health and safety of the neighboring resident nor create adverse effect in the environment.
4.5 Fence Barangay Clearance- refers to the fact that the applicant for Fencing Permit has complied with
the requirements of the existing laws, does not create unnecessary hardship to the adjoining residents and
property owners.
4.6 Compliance Barangay Clearance- refers to the fact that the applicant has not violated any laws or
ordinance implemented by the duly constituted authorities. It is equivalent to “Certificate of Good Moral
Character”.
4.7 Certification of Economic Status- refers to the economic condition of a person so as to avail of any
favor, upon certificate by the Punong Barangay.
4.8 Certification of Civil Status- refers to the civil status of a person in any of the following conditions:
married, single, widow, widower, separated-in fact, separated by law.
4.9 Certification of Personal Identity- refers to the identity of a person in any of the following conditions;
genealogy, paternity, dead, missing, unknown, bad record, reputation, honor and any condition which
points a person’s identity.
4.10 Certification of Facts – refers to the veracity of fact(s) duly certified by the Punong Barangay as true and
correct.
4.11 Certification of Regulations- refers to the existence of barangay Ordinance, rules or regulations which shall be
complied or observed by the affected party.
4.12 Certificate of Compliance- refers to any certification which is required by the higher authority to be duly
confirmed by the Punong Barangay before the higher authority shall act any matters pending at his Office.

k. Peso Wifi Operator ₱ 600.00 per annum

m. Amusement/Recreation (Billiard) ₱ 500.00 per annum

Section 6. Barangay Certifications, and Agreement of Sale Fees are the following shall be;
a. Certification of Residency/Personal Identity ₱ 100.00 plus ₱30.00 doc. stamp
b. Certification of Compliance ₱ 100.00
c. Agreement/Deed of Sale and Similar Documents ₱ 100.00
d. Other Certification not mention ₱ 100.00
e. Filling Fee ₱ 300.00
Section 7. Services and Rentals of Government Facilities (Multipurpose Gym)
a. Burial for Non- Barangay Resident ₱ 1000.00
b. Burial for Barangay Resident ₱ 500.00
c. Rental for Barangay Floating Cottage ₱ 300.00 for 5 hrs
d. Cave Guide for 3 Guests and or fraction thereof ₱ 100.00 per cave guide
e. Use of Multi-Purpose Building by
private organization and outsiders
during no classes:
DAY TIME ₱ 50.00 per hour
NIGHT TIME ₱ 100.00 per hour
f. Tourist registration/entrance fee (Environmental Fee) ₱ 20.00 per person
g. Entering Buenavista Cave ₱ 20.00 per person

Section 8. EXEMPTION- the following persons or individuals shall be exempted from payment of Barangay Clearance
and Certification Fee.
a. Certification of Indigency/Economic Status
b. Request for Medical, Hospitalization, Burial Assistance and Financial Assistance
c. Physically Handicapped/Person with Impairment or Disability
d. Temporary Connection of Electricity of house made by light materials
Section 9. CONDITION PRECEDENT- the issuance of Barangay Clearance shall be used as a condition precedent prior
to the issuance of license, permits, or other purpose sought by the applicant.
Section 10. STEPS- the following shall be the steps in the issuance of barangay Clearance:
a. Oral manifestation of intent to the Punong Barangay or the Barangay Secretary for him to determine what kind of
Barangay Clearance is to be issued depending on the kind purposes, as enumerated above.
b. The Punong Barangay shall mobilize his elective or appointive officials concerned to verify as to authenticity of
the purpose of applicant.
c. The concerned Barangay Officials shall conduct research or ocular inspection to prove the certainty or veracity of
a certain matter/fact, and report the same to the Punong Barangay.
d. The Punong Barangay shall direct the applicant to pay to the barangay Treasurer the prescribed fee.
e. The barangay Treasurer shall issue a receipt as proof payment.
f. The barangay Secretary shall prepare the barangay Clearance and attach therein the receipt for signature of the
Punong Barangay.
g. The Punong Barangay shall sign the Clearances and Certifications.
Section 11.. GROUND FOR NON-ISSUANCE – any of the following are the ground for non-issuance of the Barangay
Clearances/certifications:
a. Previous Violation of any ordinance or regulations related to the granting of clearance or permits.
b. Violation of any prescribed zoning, safety and health regulations and other requirements.
c. Unsettled tax obligations, debts or liabilities to the barangay government under any Law or regulation;
d. Ineligibility under any provision of law or regulation tom establish or operate business applied for;
e. Abuse privilege to do business or pursue an activity to the injury of public morals and peace;
f. When the place of business becomes a nuisance or is allowed to be used by this orderly characters, criminals or
women of ill-repute;
g. Non-payments of fines, non-compliance to the service impose as penalty for violating the revenue or regulatory
barangay Ordinance.
h. Non-appearance of an individual to a summon called by the Punong Barangay or the Lupon Tagapamayapa for
amicable settlement for a certain complaint filed against him/her by a complainant.
Section 12. Separately Clause. If any reason, any Provision Section part of this Ordinance, is declare not valid by the
court of competent jurisdiction or suspended or revoke by the Sangguniang Panlungsod, such judgment shall not
affect or impair the remaining provisions, sections or parts thereof which shall be remain or continue to be in full
force and effect:
Section 13. APPICABILITY CLAUSE. All other matters relating to the imposition. in this Ordinances shall be
governed by pertinent provisions of existing laws and other Ordinances.
Section 14. REPEALING CLAUSE. All Ordinances rules and regulations, or part thereof , in conflict with, or
inconsistent with any provisions of this ordinances are hereby repealed, amended or modified accordingly.

Section 15. EFFECTIVITY- the enacted Ordinances shall take effect after ten (10) days from the date a copy
thereof is posted in a bulletin board in front of the Barangay Hall or in any two (2) conspicuous places in the
Barangay. The barangay secretary shall cause the posting of the said ordinance in two (2) conspicuous places not
later than five(5) days upon approval thereof.

A RESOLUTION REQUESTING THE REPRESENTATIVE OF THE SECOND CONGRESSIONAL DISTRICT, THE
HONRABLE ROBERT “ACE” S. BARBERS FOR APPROPRIATION OF FUNDS FOR THE CONSTRUCTION OF
NEW REINFORCED, CONCRETE PORT AT BARANGAY BUENAVISTA, SURIGAO CITY.

WHEREAS, the old wooden port was the only facility/utility of Barangay Buenavista where vessels and
small watercrafts was being moored, used to load and unload passengers, cargoes, basic commodities
and local marine products and agricultural harvests from Barangay Buenavista bound for Surigao City
and other neighboring Barangays/municipality and vice versa;

WHEREAS, in December 16, 2022 the port/wharf was hit by severe typhoon Odette marking a
significant damage by 100 percent, give hardship to the majority of the people usually depends on
marine resource being living in a coastal barangay;

WHEREAS, the absence of such facility is also a big problem of the National Power Corporation
(NAPOCOR) whose power plant is stationed at Barangay Buenavista, generating power through a
generator set of engines using crude oil to supply the nine (9) Barangays of Hikdop Island, thus
delivery of crude oil by hundred of barrels and other heavy accessory equipments is very hard and
risky;

WHEREAS, Barangay Buenavista through the new composition the Council identified a new site
suitable for the proposed project since the new location as identified will not be directly hit by the
northwest moonson (HABAGAT) which we considered the most damaging course of wind;

WHEREFORE, upon a motion of Kag. Noel A. Llesis and duly seconded by the majority of the members
of Barangay Council;

BARBERS, REPRESENTATIVE OF THE SECOND CONGRESSIONAL DISTRICT OF SURIGAO DEL NORTE TO
