his Counsel T.Diwakar Reddy (22913), Sri Davala Ananda Rao,
Advocates, residing at D.No. 2/25, Tadepaill, Guntur District- 522501.
For the reasons stated in the accompanying affidavit, it is prayed
that this Hon'ble Court may be pleased to issue a writ, order or direction
more particularly jOne in the nature of Writ of Mandamus challenging the
illegal and arbitrary action of the respondents, more particularly
respondents No.2 and 4, in interfering with the petitioner’s construction
activity at the instance of the unofficial respondents No. 5 to 10 and
thereby threatening the petitioner not to construct any building and
forcefully taking out the construction material from the petitioner’s land
situated in old TS No. 436/4, RS No. 505/4 / New TS No. 454/1, RS No.

430-5 to an extent of 143.12 Sq. Yards and 208.63 Sq. Yards of


Pathasrikakulam Ward, Block No. 12 Arasavilli Road, Arasavilli,
Srikakulam City and District, as illegal, arbitrary, unconstitutional and
violative of principal of Natural Justice and contrary to Articles 14,21 and
300-A of Constitution of India and consequently direct the respondents
not to interfere and disturb the construction activity in the petitioner’s
subject land without following the due process of Law and pass such order

I, Peddina Kalldasu, S/o Peddina Ramanayya, aged about 54 years,


Resident of D.No. 176, Ramnagar, LBS Colony Road, Srikakulam Town
and District, Andhra Pradesh., having temporarily come down to
Amaravathi, do hereby solemnly affirm and state as follows: -

1) I am the deponent herein and petitioner in the above Writ Petition as


such, I am well acquainted with the facts of the case.

2) It is submitted that the present writ petition is filed challenging the illegal
and arbitrary action of the respondents, more particularly respondents
No.^ and 4, in interfering with the petitioner’s construction activity at the
instance of the unofficial respondents No. 5 to 10 and thereby threatening
the petitioner not to construct any building and forcefully taking out the
construction material from the petitioner’s land situated in old TS No.
436/4, RS No. 505/4 ! New tS No. 454/1, RS No. 430-5 to an extent of
143.12 Sq. Yards and 208.63 Sq. Yards of Pathasrikakulam Ward, Block
I

No. 12 Arasavilli Road, Arasavilli, Srikakulam City and District, as illegal,


arbitrary, unconstitutional and violative of principal of Natural Justice and
contrary to Articles 14,21 and 300-A of Constitution of India.

3) It is submitted that the Petitioner is an absolute owner and possessor of


the land to an extent of 143.12 Sq. Yards and 208.63 Sq. Yards in old TS
No. 436/4, RS No. 505/4 ! New TS No. 454/1, RS No. 430-5 of
Pathasrikakulam Ward, Block No. 12 Arasavilli Road, Arasavilli,
Srikakulam City and District, (herein after referred as the subject land). He
has purchased the subject land from his vendors through two registered
sale deeds, vide Doc No’s. 5779/2012 and 189 of 2012, for valuable sale
consideration. Since the date of purchase, the petitioner has been in
continuous and peaceful possession and enjoyment of the subject land.
The copies of registered sale deeds are filed hereunto as an annexure
and marked as Exhibit- PI

4) It is submitted that the subject land is purely a private property. Since the
date of purchase, there is no interference from any of the parties,
particularly from the respondents. While the matter stood thus, the
petitioner in order to construct a residential building in the subject land,
made an application dated 08-01-2024 to therespondent for building
permission arid approval along with necessary particulars and plan by
fulfilling all the necessary legal formalities and also paid the requisite fee.
Thereafter, the 2^ respondent granted the permission and issued building
permit order vide permit No. 1085/0004/B/SRI/ALI/2024, dated 11-04-
2024. Copy of building permission issued by the 2''^ respondent is filed
hereunto as an annexure and marked as Exhibit- P2

5) It is submitted that after obtaining the building permission from the 2”“
respondent, the petitioner made necessary arrangements for construction
of the building in the said premises as per the plan, and commenced
cleaning of the subject land. However, in the 1®‘ week of February, 2025,
when the petitioner along with the workers, was engaged in clearing the
subject land, the officials from the 2'*' respondent office and the 4«’
respondent, at the behest of unofficial respondents No. 5 to 10, forcibly
Interfered with the clearing process arid ordered the petitioner not to
construct any building in the subject land and also took away the cleaning
material. In order to prevent the interference of the respondents, the
petitioner has maie a representation dated 26-02-2025, to the 2 to 4

respondents, demonstrating the possession of the petitioner and his legal


rights in the subject land and requested the authorities not to interfere with
the petitioner’s subject land and construction activity without following due
process of Law. The representation was duly served to the respondents
No. 2 to 4. Copies pf representation and postal receipts are filed herewith
for kind perusal of jhe Hon’ble Court and marked as Ex P3.

6) It Is to further submit that after receiving the representation, the


respondents remained silent for some period. However, again the officials
from the 2"'* respiondent office and the 4‘^ respondent resumed their
interference highhandedly at the instance of unofficial respondents. On
21-03-2025, they visited the subject land and interfered with the
petitioner’s possession, by disrupting the construction work and issuing
threats. To stop the highhandedness acts of the respondents, the
petitioner immediately approached the village elders and neighbours for
help. With great difficulty they withstood the blatant illegality.

7) It is submitted that the respondent authorities are acting without having
any authority over the subject land and the said action is nothing but
Illegal, arbitrary, unconstitutional and in violation principal of Natural
Justice and contrary to Articles 14,21 and 300-A of Constitution of India.

8) It is submitted that as stated supra, the petitioner after purchasing the land
for valuable consideration and after obtaining necessary permissions from
the 2"'* respondent started construction in the subject land strictly adhering
to the conditions laid by the respondent authorities. However, the
respondent authorities, without any authority over the subject land are
interfering, which is neither legal nor sustainable. The petitioner being a
common man, having no support in his locality, and not in a position to
resist the illegal acts of the respondents. The petitioner is now under a
bona-fide apprehension that the respondents herein at any stage may
again interfere and threaten the petitioner and may cause disturbance to
the construction activity and if the same is allowed to happen, the
petitioner and their entire family will be put to irreparable loss and hardship
which leads to unbearable suffering and agony. If the respondents are not
restrained from their unlawful actions over the above said land, the
petitioner would be put to suffer irreparable loss and injury. Thus, he is
constrained to file the present Writ Petition.

9) It is also submitted that the petitioner has no other alternative remedy


except to approach this Hon’ble court by way filing this writ petition under
Article 226 of the Constitution of India.

10) It is further submitted that Petitioner did not file any other suit or writ before
any court of law or forum seeking the same relief of this writ petition and
the same is pending adjudication.

It Is therefore prayed that this Hon’ble Court may be pleased to issue
a writ, order or direction more particularly one in the nature of Writ of
Mandamus challenging the illegal and arbitrary action of the respondents,
more particularly respondents No.2 and 4, in interfering with the
petitioner’s construction activity at the instance of the unofficial
respondents No. 5 to 10 and thereby threatening the petitioner not to

The Building permission Is sanctioned subject to fbllowlng conditions:
1. Hie permission accorded does not confer any ownership rights. Hie permission will be revoked at later stage, If It Is found that the documents or Information are

2. If constnKtlon Is not commenced within one year, building application shall be submitted afresh duly paying required building permit fees.
3. Sanctioned Plan shall be followed strictly while making the construction & shall be displayed at the site.

and for necessary action.
I submit that I have purchased two vacant sites covered under
two registered sale deeds to an extent of 143.12 sq.yards and 208.63 sq.yards
covered under T.S.No.436/4, RS No.505/4 Part (after re-survey TS No.454/1 RS
N.430-5 part near D.No.15-5-44) covered under registered sale deeds dated
09-01-2012 and 09-08-2012/document Nos.189/2012 and 5779/2012 for valuable
consideration, since then I am in peaceful possession and enjoyment of the
said property till to day.
I submit that after registration process, with an intention, to
construct a building In the above site, I applied for plan before the Srikakulam
municipal authorities and the same was approved and plan was issued to fee.
I submit that I am also paying vacant tax to the municipal
authorities.
While so, in the 1* week of February, 2025 when myself and my
men started site cleaning inorddr to construct a building as per municipal
