This petition came before this Court for final hearing today in the presence of
Thiru.A.James Ilango, learned Advocate for the petitioner and of Thiru.R.Udhayanithi, In-
Charge of learned Public Prosecutor for the respondent and heard either side and perusing
all the records, this Court delivered the following

ORDER

Petition filed u/s. 482 of BNSS 2023. Petitioner/A2 prays to grant him
anticipatory bail for the alleged offences punishable U/S. 294(b), 324, 506(ii) of IPC & 3(1)
of TNPPDL Act in Cr.No. 31/2014 of the respondent police. The alleged occurrence took
place on 26.1.2014.
Heard both sides.
The learned counsel for the petitioner submitted that the petitioner is an
innocent and he has not committed any offence as alleged, due to enmity, the defacto
complainant foisted this false complaint against this petitioners, that the investigation is over
and the case was taken on file in P.R.C.No.10/2019 on file by the learned Judicial
Magistrate No.III, Dindigul and is pending, that the injured was discharged from the
hospital, that the petitioner is ready to abide any condition imposed by this Hon’ble Court,
that the petitioner undertakes that he will not tamper or hamper with any witness, that the
petitioner has permanent abode, hence there is no chance for absconding, that the petitioner
apprehends arrest and he prays for anticipatory bail.

The learned Public Prosecutor submitted that on 26.1.2014 at about 8.30 p.m.,
the accused abused the defacto complainant in filthy languages, attacked him with knife and
caused injury to the right side hip, and damage the glass of the KSOP petrol bank office to
the value of Rs.6,000/-. Hence the case.

Rival contentions are taken into consideration. Records perused. The case was
registered against the accused for the alleged offences punishable U/S. 294(b), 324, 506(ii)
of IPC & 3(1) of TNPPDL Act. The learned Counsel for the petitioner argued that due to
enmity, the defacto complainant foisted this false complaint against this petitioners, that the
investigation is over and the case was taken on file in P.R.C.No.10/2019 on file by the
learned Judicial Magistrate No.III, Dindigul and is pending, that the injured was discharged
from the hospital and that the petitioner apprehends arrest and he prays for anticipatory bail.
The learned Public prosecutor has reported that the injured was discharged from the hospital
and that P.R.C.No.10/2019 is pending on the file of the learned Judicial Magistrate No.III,
Dindigul.

On perusal of records, it shows that occurrence have taken place on 26.1.2014.


The investigation is over and the case was taken on file in P.R.C.No.10/2019 on file by the
learned Judicial Magistrate No.III, Dindigul and is pending and that the injured was
discharged from the hospital as stated by the prosecution. Considering all these aspects,
investigation is over and case is pending for committal, the discharge of injured and the
facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the
petitioner/A2 on condition.

In the result in the event of arrest or on his surrendering before the concerned
Judicial Magistrate the petitioner/A2 is ordered to be enlarged on anticipatory bail on his
executing a bond for a sum of Rs.10,000/- with two sureties each for a like sum to the
satisfaction of learned Judicial Magistrate No.III, Dindigul subject to the following
conditions:-

1. The petitioner shall surrender before the Court concerned within 15 days from today
without fail.

2. After release the petitioner shall appear and sign before the learned Judicial
Magistrate No.III, Dindigul daily at 10.30 a.m. for a period of 30 days and shall also
appear before the learned Magistrate in each and every hearing of P.R.C. No.10/2019
and as and when required.
3. The petitioner shall not tamper with the witnesses or in any manner interfere with or
put obstacle to the smooth progress of trial.
4. If there is any violation of condition, the Investigation Officer is within his discretion
to approach the Court of the learned Judicial Magistrate, concerned for cancellation
of bail even though bail granted by the Sessions Court as per the ruling of the
Hon'ble Supreme Court reported in P.K.Shaji/Vs/State of Kerala, (2005) AIR
S.C.W.5560; and
(i) if the accused thereafter absconds, a fresh FIR can be registered .
