To specify the responsibility, authority and the relation between everyone in the Compay
who is related to the SMS&MLC.
2. SCOPE
To be implemented at all levels of the Company, both shore and ship based.

3.1.1 Board of managers


 The Board of managers directly manages the operation of the Company, both shore based
and ship based. The Board of managers is the person who gives the final decision to ensure
the safety of the personnel, ship and the environment.
 The Board of managers may request the ship owner to report to the Flag state all the details
about TAN BINH CO. LTD.
 The Board of managers is responsible for implementing the SMS&MLC effectively, which
includes:
(1) Providing the necessary resources and assistance for the DP to carry out his functions;
(2) Providing the necessary resources and assistance for the Master to perform his duties
safely;
(3) Selecting and arranging the appropriate personnel with ability and competence for the
implementation of the SMS&MLC;
(4) Ensure to solve the seafarers’ complaints concerning the rights and interests of
workers and violation of labour laws of the country and the provisions of the Maritime
Labour Convention, within the company, and move to the competent authority to deal.
(5) Hold meetings in relation to safety issues. All meetings related to safety issues must
be recorded in the “Record for safety management meeting”/ TB-02-01;
(6) Reviewing the SMS&MLC, find out the non-conformity, evaluate the effectiveness of
the SMS&MLC, simultaneously improve the SMS&MLC;
(7) Setting up and mobilising the Response Team;
(8) Setting up an effective process for exchanging information;
(9) Dealing with the Press with regards to major accidents;
3.1.2 Designated person (DP/CSO)
.1 Designated person (DP)
As nominated by the Director, the DP has the authority and responsibility for reviewing,
monitoring, maintaining and operating the SMS efficiently. The DP has the following
authority and responsibilities:
(1) Control the SMM&MLC;
(2) Report to the Director of the non-conformity (if any) in the SMS&MLC;
(3) Supervising the safety and prevention of pollution in the operation of the ship;
(4) Ensure the sufficient shore-based resources and support as required;
(5) Establish the plan for internal audit of the SMS&MLC, review the
management of the ships, prepare for external audit;
(6) Examine and confirm the corrective actions and non-conformities;
(7) Analyse the deficiencies, non-conformities, accidents to report the Director
and establish actions for avoiding similar accidents;
(8) Support the Masters in implementing and maintaining the SMS&MLC;

.2 Company security Officer


(1) Update security information for all ship
(2) Ensuring that ship security assessments are carried out
(3) Arranging for internal audits and reviews of security activities
(4) Ensuring that deficiencies and non-conformities identified during internal audits,
periodic reviews, security inspections and verifications of compliance are promptly
addressed and dealt with
(5) Ensuringthat any alternative or equivalent arrangements approved for a particular
ship or group of ships are implemented and maintained.
3.1.3 Technical Department
Manager of the Technical Department will assist the Company’s Board of Management to
improve the management and responsible for controlling the technical operation of the ships,
maintenance of the machineries, which include:
(1) Encourage the staff of the Technical Department and Master, Chief Engineers on
board the ship to implement and maintain the SMS&MLC effectively.
(2) Consult the technical and Classification Society related matter.
(3) Organise, execute and supervise the repairs and class surveys
(4) Ensure that the documents related to the machineries, repairs, transforms… of
the ships are ready and updated in time to aid the technical management of the fleet.
(5) Effectively develop and organise and system for maintaining and repairing the
fleet.
(6) Establish a system of written technical reports between the Technical and the
ships. Deal with all the technical reports from the ships, perform inspection on the
machineries, review and evaluate in order to provide preventive actions to ensure
safety and effective operation of the ships, to prevent of pollution and to meet the
requirements of the customer.
(7) Update on national, international regulations related to safety, maritime labour
management and pollution prevention for ships and employees of the Company.
(8) Evaluate and select the repair service providers.
Staff of the Technical Department carry out the specified tasks as assigned by the Manager.
3.1.4 Spare-part Department
Manager of the Spare-part Department assist the Company’s Board of Management in
improving the management and responsible for manage the spare parts, which include:
(1) Establish the material and spare part inventory standards.
(2) Supply and supervise the usage of the spare parts. Ensure the spare parts are ready in
terms of both quantity and quality for the ship to operate safely, effectively without
causing pollution.
(3) Procurement full of supplies, spare parts, fuels, lubricants, publications, ensure proper
category and good quality and provide timely ship.

(4) Arrange to collect the spoiled spare parts from the ships (the Master is responsible for
dealing with household garbage on board the ship).
(5) Look for sources of spare parts, evaluate and select suppliers.
(6) Make plan for purchasing spare parts.
(7) Make principle contracts with spare parts suppliers.
Staff of the Supplying Department carry out the specified tasks as assigned by the Manager.
3.1.5 Personel Department:
The Manager of the Personel Department is responsible for the followings:
(1) Advise the organisation of personnel of the Company.
(2) Advise the management, employment and training of crew.
(3) Take part in recruiting crew, implement crew-hiring contracts. Prepare the
labour contract signed with the company to employees.
(4) Assign crew and ensure that all ships managed by the Company are manned
adequately with qualified and experienced crew.
(5) Manage records of all crew working on board and Company staff.
(6) Determine demand, organise the training of officiers and crew working on
board.
(7) All matters relating to the manning level of the ships. Assign ranks on board
the ships.
(8) Supply full of medications, recreational facilities, protective equipment for
seafarers, ensure proper category and good quality and timely supply for ships to
ensure the health, living condidions and convenient work on board.
(9) Ensure the timely and adequate salaries for all employees and seafarers of the
company.
(10) Ensure repatriation for seafarers.
(11) Ensure medical support for the seafarers.
(12) To receive complaints from crew members, transfer appropriate processing
department.
(13) Update the national and international regulations relating to maritime labour
management.
Staff of the Personnel Department carry out the specified tasks as assigned by the Manager.
3.1.6 Operating Department:
(1) Organise the operation of the ship.
(2) Manage and direct cargo operation of the ships
Staff of the Operation Department carry out the specified tasks as assigned by the Manager.
3.1.7 Financial Department
(1) Ensure the full and timely payment term for crews.
(2) Ensure financial security for repatriation, compensation and medical care for seafarers.

 The SMS Internal Audit Team of the ships and the Company consists of auditors suggested
by the Director. The auditors are responsible for checking whether persons conforms to the
procedures in the SMM&MLC, evaluate the appropriateness/ effectiveness of the
SMS&MLC, and implement improvement to the SMS&MLC.
 The DP is responsible for directing the Inter Audit Team/ or appointing the person who will
direct the internal audit. However, the auditors cannot audit their own department.
 The auditors must follows the “Procedure for internal audit”/TB-07.
3.1.9 Response Team
 The Director will decide the establishment of the Response Team in case incidents occurs
on board the ships, such as:
(1) Oil spill
(2) Sick seafarer emergency, seafarer severe accident, death and / or violating the rights of
seafarer
(3) Other serious incidents:
 Collision, fire on board, grounding, flooding, cargoes are moved, salvage is
required, abandonment, man overboard.
 Pirates.
 Steering gear failure, power failure, main engine failure.
 The Director, having the utmost authority in the Response Team, will immediately conduct
a meeting with the related personnel to coordinate measures in accodance with the
Emergency Response Plan.
 Those who carry out the tasks of the Response Team will establish the appropriate
emergency solutions and carry out these solutions under the guidance of the Director.
3.1.10 Company Labour Union
 To protect the legitimate, legitimate rights and interests of employees.
 To represent the company's employees sign collective labour agreements with the Director.

3.2.1 Authority and Responsibilities of the Master


The Master has the following responsibilities:
 Fully conversant with the Company’s SMS&MLC.
 Implementing and maintaining the safety and environmental protection policy of the
Company.
 Motivating the crew in observation of that policy.
 Issuing appropriate orders and instructions in a clear and simple manner.
 Verifying that specified requirements are observed.
 Reviewing the SMS&MLC and reporting its deficiencies to the Company. The Master must
understand thoroughly the conditions of the ship in all aspects including hull, machineries,
equipment and crew. Every month, the Master must check the conditions of the ship
according to the “Check list for ship safety” /TB-02-03 and send one such checklist to the
Company every three months. At the end of June and December, the Master must review
the SMS on board, effective review of cyber security system and report in the "Master’s
Review"/TB-02-02 in order to review and to recognize the non-conformities in the
SMM&MLC, evaluate the training on board and give recommendations.

 Keep the Certificates and important documents and is responsible for carrying the important
documents when abandonment of the ship is required.
 The Master can only leave the ship after transferring all the responsibilities to the Chief
Officer or after handing over to the on-signing Master.
 The Master is responsible for the safe navigation, safety of personnel, the ship, other
properties on board and the environment and create an convenient environment to live and
work onboard.
 By all means and at all times, the Master must pay attention to the benefits of the Company.
 Resolve complaints of crew within the ship or transfer the company.
 The Master must take care of the followings:
a) Before departure:
o Prepare voyage plan.
o Pay attention to the requirements of supplies such as: fuel oil, diesel oil, food, fresh
water and spare parts.
o Pay attention to the chart corrections, other relevant documents, notices to mariners,
tide tables and other navigational books.
o Pay attention to the conditions of the machines and other navigational and safety
equipment.
o Pay attention to the expiry date of the ship’s documents, certificates of officers and
crew’s certificates of competency, ...
o Pay attention to things that may be encountered during the voyage, such as: unsightly
object, narrow channels, heavy traffic,...
o Pay attention to the voyage instruction of the Company and Charterer.

b) During the voyage:


o Pay attention to the safety of navigation, personnel, property and the environment.
o Follow the charted route as instructed.
o Follow the instruction of the company in relation to daily reports and other reports as
required.
o Pay attention to the position and time when the Master must be in the bridge to assure
safety navigation.
o Ensure channel connecting medical advice on shore.
c) In port
o Arrival and departure checklist before entering the port.
o Pay attention to the loading and discharging of high value, super-weight and
dangerous cargoes.
o Pay attention to the prevention of pollution and safety in port.
o The Master must pay attention to the benefits of the Company.

o Ensure that medical care for seafarers in need.


Authority of the Master
 The Master has the overriding authority and responsibility to make decisions with respect to
the safety and security of the ship, and request the assistance of the Company when
necessary. If, in his professional judgement, a conflict between any safety and security
requirements applicable to this ship arises during his period of command, the Master will
give effect to those requirements necessary to maintain the safety of the ship, implement
temporary security measures to the highest possible degree, be appropriate to the prevailing
security level, and informing the relative persons.
 The Master is Company’s representative, responsible for commanding the ship.
 Oversee the crew carrying out the tasks givens according to the rules and mandatory
requirements.
3.2.2 Authority and Responsibilities of the Chief Officer:
 In charge of the deck department. Observe, maintain the machineries and equipment
managed by the deck department. Assign tasks for and deck officers and crew in the
navigation and maintenance of the ship.
 Before dry-dock or scheduled repairs, the Chief Officers must prepare list of deck repair
items and submit to the Master; after completion of repair, sign the work completion report
to confirm the quality of repair and work results.
 Keep the safety for all the works on board and prevention of oil pollution.
 Perform monthly inspection of living area, crew, kitchen, storage areas and food
preparation, food storage, medical cabinets, medical equipment, workwear.
 Twice a day, the Chief Officer must check the record book of fresh water, ballast water,
bilge water as recorded by the crew in charge.
 Manage the stores, spare parts of the deck department.
 Always keep the ship in a stable condition in terms of: stability, drafts, stress and balance.
 The Chief Officer is in charge of the cargo operations of the ship.
Before loading cargo
 Prepare cargo plan.
 Calculate ship’s stability and trim.
 Forecast the departure conditions and report to the Master for approval.
 Check the technical conditions of the cargo gears, cargo holds and other preparations for the
cargo operations.
 Instruct the Officer on duty carefully with regards to the loading plan.
Discharging and loading cargo
 The Chief Officer must be on board during the loading and discharging of cargoes.
 Supervise the loading/discharging of the high value, super-weight and dangerous cargoes
and make plan for loading/discharging and maintaining cargoes.
 By all means, suitably organise the work to speed up the cargo operation.

 Pay attention to the safety of crew, stevedores, condition of cargoes, fire prevention, and
prevention of pollution, etc. and possible damage to the ship.
 Make record to the documents relating to the cargo operation.
Before arrival and departure
 Report to the Master the condition of the ship
 Check the number of crew, search and find stowaways on board.
 When the ship is anchored, before the ship arrive/depart the port, the Chief Officer must be
at the ship’s bow.
During the voyage
 Watch keeping the bridge.
 Instruct and supervise the maintenance work of the Bosun, AB and OS according to the
"Maintenance plan for hull, machinery and equipment ".
 Maintain the cargo.
 Carefully check the conditions of the cargo gears, cargo holds and other preparations for the
cargo operations.
 Perform other tasks as ordered by the Master. The Chief Officer can only leave the ship
when the Master is on board.
3.2.3 Authority and Responsibilities of the Second Officer
 Perform the tasks ordered by the Master and the Chief Officer.
 Take part in watch keeping at sea and in berth, attend the stern of the ship when she is
berthing, de-berthing or shifting.
 Manage all the navigational equipment, charts and nautical publications; Maintain the fire-
fighting equipment on board.
 The Second Officer must perform the followings:
o Check and test periodically the working conditions of the safety equipment that he is in
charge.
o Receive navigational information and notices to mariner in order to correct and update
charts and nautical publication.
o Records the operation of the navigational equipment on board, determine errors, adjust
errors.
o Daily check all the navigational equipment, record the results in the log books and
report to the Master.
 At least three hours before the ship depart, report to the Master all the preparations for the
voyage that he is responsible for.
 To guide the implementation of complaints procedure on board.
 Manage the spare parts that he is in charge of.
3.2.4 Authority and Responsibilities of the Third Officer
 Manage and maintain the life-saving, fire-fighting appliances and the medical stores,
medical equipments and in charge of the medical care onboard.

 Subscribe to the validity of the health certificates of the crew on board.


 Take part in watch keeping at sea and in berth, attend the bridge when the ship is berthing,
de-berthing or shifting.
 Perform other tasks ordered by the Master and the Chief Officer.
3.2.5 Authority and Responsibilities of the Bosun
 The Bosun is in charge of the AB and OS and is totally responsible for carrying out the
tasks ordered by the Chief Officer.
 Direct the execution of the daily works plans approved and required by the Chief Officer.
 Check the areas, locations around the ship to have plan for maintenance or repair, cleaning-
up or recovering the working conditions of the equipment.
 When the ship arrive/depart or maneuver, the position of the Bosun is the bow of the ship.
 Take part in the works relating to the loading/discharging of cargo as required by the Chief
Officer or the Officer on duty.
 Every month, the Bosun must record the consumption of deck spare parts and report to the
Chief Officer.
 Check the level of the fresh water tank, ballast tank and cargo hold bilge twice a day.
 Carry out other tasks as required by the Chief Officer.
3.2.6 Authority and Responsibilities of AB
 The AB must take part in the work of the deck department as required by the Chief Officer,
Officer on duty and the Bosun.
 AB must take part in watch keeping at sea and in berth.
 AB must take part in watch keeping on the bridge when the ship is anchored.
 Attend at the bridge or at the stern of the ship when she is berthing, de-berthing, shifting or
starting the voyage.
 Carry out other tasks required by the Chief Officer, Officer on duty or the Bosun.
3.2.7 Authority and Responsibilities of OS
 OS must take part in the works of the deck department.
 Carry out the maintenance work as required by the Bosun.
 Take part in the loading/discharging of cargo in port.
 Attend at the bow or stern of the ship when berthing, de-berthing or shifting.
 Carry out the task of the AB in case the Chief Officer, Officer on duty or the Bosun
requires.
 Carry out other tasks required by the Bosun.
3.2.8 Authority and Responsibilities of the Radio Officer
 The Radio Officer is the assistant to the Master, head of the catering and Radio department.
Carry out the tasks required by the Master.
 Attend at the bridge when the ship berthing, de-berthing or shifting.
 Carry out the radio communication tasks.

 Daily check all the radio communication equipments, record the results in the log book and
report to the Master. Prepare spare part request and spare part consumption report for the
Master.
 Keep all the message and documents of the Radio department, prepare reports required by
the Master.
 Check the preparation of food for the voyage before the ship departs. Help the Master to
keep salary, keep the stores for the Master... check the daily works of the catering and the
Radio department.
 Prepare the documents and data in relation to immigration requirements.

3.2.9 Authority and Responsibilities of the Cook
 The duty of the Chief Steward is to take part in the work of the catering department.

 Assist the Chief Steward in preparing meals, rationing and washing up.

3.2.11 Authority and Responsibilities of the Chief Engineer
 Chief Engineer is the assistant to the Master and in charge of the Engine Department,
responsible for controlling all the management and implementation of the functions of the
Engine Department.
 Maintain, manage and operate all the machines of the Engine Department
 Must attend the engine room when maneuvering
 The Chief Engineer must take part in:
o Manage, arrange and assign tasks appropriately in order to complete the maintenance
plan and avoid excess work for crew of the engine department.
o Ensure safe operation of the engine, safety for people, for the environment and
prevention of pollution
o Require the Engine Officers to set up periodical and daily maintenance plans and assist
them to finish the plans.

o Approve “Bunker receiving plan” from the Second Engineers and pay particular
attention to the quality, quantity and volume of the tanks. Estimate measurements of the
tank after receiving bunkers, requires the bunkering company to fill the correct tanks.
Arrange oil pollution preventing equipment.
o Report immediately to the Master when there is problem that may affect ship’s
schedule.
 Require and approve estimates for spare parts that will be used by the Engine Officers.
Require the Engine Officers to report on the management and consumption of spare parts.
 Supervise the daily consumption of the fuel and report the ROB to the Master.
 Be responsible for the operation of the engines, recording and reporting as company
requirement.
 Keep the important documents of the Engine Department, except the documents that the
Master keeps. Be responsible to carry the important documents when the ship is abandoned.
 When carrying out the repair items on drydock as scheduled, the Chief Engineer must
report list of repair items, including items that the crew will carry out, to the Master. On
completion of repairs, the Chief Engineer must sign the work completion report, certifying
the quality and result of the repairs.
3.2.12 Authority and Responsibilities of the Second Engineer
 Second Engineer is the assistant to the Chief Engineer and must command and direct his
subordinates to carry out the duties of the Engine department.
 Take part in watch keeping at sea and in berth, attend the Engine room to prepare for and
operate main engine when berthing/de-berthing, shifting or starting sailing.
 Direct the operation of the Engine department. Implement and supervise the maintenance
plan. Appropriately arrange and assign labour to fulfil the requirements of the Chief
Engineer.
 Have constructive actions in order to keep the engine room operating safely, cleanly and
does not cause pollution.
 The First Engineer must pay attention to:
o Main engine and other related engines/equipment.
o Propulsion system, propeller, stern tube.
o Ventilation system, lubrication system.
o Equipment of cargo gear , Emergency engines.
 Manage the provision of lubrication oil and other oils, records the daily oil consumption and
report to the Chief Engineer.
 At the request of the Chief Engineer, prepare order for spare parts that he manages.
 Keep important documents, official certificates, record books, except for documents kept by
the Chief Engineer. Prepare reports relating to the working condition of the engines at the
request of the Chief Engineer.
 Report to the Chief Engineer all the preparation for the voyage that the First Engineer is in
charge of at least 3 hours before ship departure.
 Responsible of personal protective equipment on board.

3.2.13 Authority and Responsibilities of the Third Engineer
 Assist the First Engineer in operating and maintaining engines.
 Take part in watch keeping at sea and in berth, attend the Engine room to prepare for and
operate main engine when berthing/de-berthing, shifting or starting sailing.
 The Second Engineer must pay attention to the following equipment:
o Generator engines and related machines/equipment.
o Air compressor system and related machines.
o Fuel oil system and related system.
o Fuel oil purifier and related machines.
o Make plan for receiving bunkers.
 Be responsible for receiving bunkers, manage and measure oil daily, make records and
reports the ROB to the Chief Engineer.
 At the request of the Chief Engineer, prepare order for spare parts that the Second Engineer
manage. Make records and report the usage of spare parts to the Chief Engineer.
 Report the preparation for the voyage that he is in charge of to the Chief Engineer at least 03
hours before ship’s departure.
 Carry out other tasks requested by the Chief Engineer.
3.2.14 Authority and Responsibilities of the Fourth Engineer:
 Assist the First Engineers in operating and maintaining the engines.
● Take part in watch keeping at sea and in berth, attend the engine room to prepare for and
. operate main engine when berthing/de-berthing, shifting or starting sailing
 The Third Engineer must pay attention to the following equipment:
o Boiler and related system.
o Systems of fresh water, ballast water, toilet water, bilge engine room and cargo hold,
which include pumps, pipes and valves of the systems. Refrigerator room, air
conditioner and ventilation system
o Engines of life boat
 At the request of the Chief Engineer, prepare order for spare parts. Make records on the
usage of spare parts, report to the Chief Engineer.
 Report the perpatation of the voyage that he is in charge of to the Chief Engineer at least 03
hours before ship’s departure.
 Carry out other tasks requested by the Chief Engineer.

3.2.15 Authority and Responsibilities of the Electrical Officer.


 Take part in the work of the Engine department as an assistant to the Chief Engineer.

reefer containers, except for equipment managed by the Radio Officer.
3.2.16 Authority and Responsibilities of the Electrician:
 Take part in the works of the Engine department as an assistant to the Chief Engineer and
Chief Electrician.
 Carry out the tasks requested by the Chief Engineer.
3.2.17 Authority and Responsibilities of the Fitter
 Fitter is the leader of the team of oilers and take part in the works of the Engine department.
 Be responsible for maintaining, repairing the equipment on board as requested by the
Master, Chief Engineer or First Engineer.
 Maintain the motors, engines according to the maintenance plan approved by the First
Engineer.
 Attend the engine room when the ship is berthing/de-berthing, shifting, starting sailing or
arriving ports.
 Keep and maintain the equipment, tools, effects, stores of the Engine department tidy and in
order.
3.2.18 Authority and Responsibilities of the Oiler
 The oiler take part in the works of the Engine department as requested by the First Engineer,
Engine Officers and Fitter.
 Take part in keep watching at sea and in berth.
 Assist the Engine Officers in maintaining the engines so that they are always in good
working condition.
