TERMS AND CONDITIONS *

1. In the event of e-filling intending bidders may download the quotation document from the departmental
website directly by the help of Digital Signature Certificate. Man- Power deployed should be paid
minimum rates of wages under the Minimum Wages act, 1948 as applicable and the agency must
comply with the relevant rules of Labour Commissioner, Government of West Bengal, G.O. vide Memo.
No. 188/Stat/2RW/76/266/2000/LCS/JLC dated 22.06.2018 for engagement of personnel.

2. Act and Rules there under. EMD @ 2%(Two percent) of the total quoted amount by the successful
agency in Bank draft in drawn favour of Executive Engineer, South 24Pgs Division, PW
Directorate.
(The balance amount will be paid during execution of formal tender)

3. Necessary Earnest Money will be deposited by the bidder electronically: online - through his net banking
enabled bank account, maintained at any bank through any bank by generating NEFT/ RTGS challan
from the e-tendering portal. Intending Bidder will get the Beneficiary details from e- tender portal with
the help of
4. Digital Signature Certificate and may transfer the EMD from their respective Bank as per the Beneficiary
Name & Account No., Amount, Beneficiary Bank name (ICICI Bank) & IFSC Code and e-Proc Ref No.
Intending bidder who wants to transfer EMD through NEFT/RTGS must read the instruction of the
Challan generated from E-Procurement site.

5. Total Execution will be done as per direction of Police authority. Any type of alternation will be done as
per site condition and direction of concerned authority

6. Others criteria for participation in tender:

a) Current Income Tax return (for the assessment year 2024-2025) duly received along with PAN
Card, GST, Valid IS-digit Goods and Services Taxpayer Identification Number (GSTIN) under GST Act,
2017
Registration Certificate, Professional Tax acknowledgement receipt for the current year, Trade
License issued by Municipality/ Panchayet with acknowledgement receipt for the current year.

b) Registered Partnership Deed (for Partnership Firm only) along with Power of Attorney to sign on
the Tender documents (if required)

c) Declaration regarding Structure and Organization duly signed by the applicant.

d) Registered Labour Co – Operative Societies Ltd. are required to furnish valid Bye Law, Current
Audit Report, along with other relevant supporting papers.

e) Joint Ventures will not be allowed.

f) The partnership firm shall furnish the registered partnership deed and the company shall furnish
the Article of Association and Memorandum.

7. There shall be no provision of Arbitration. Hence Clause 25 of. 2911is hereby omitted vide notification
No. 558/SPW DT. 13.12.11 of Pr. Secretary, PW & PW (Roads) Deptt.

8. Constructional Labour Welfare Cess @ 1(one) % of cost of construction will be deducted from every
Bill of the selected agency, GST, Royalty & all other Statutory levy/ Cess will have to be borne by the
contractor & the rate in the schedule of rates inclusive of all the taxes & cess stated above.

9. Bids shall remain valid for a period of 120(One Hundred Twenty) days after the dead line date for
Financial Bid/ Sealed Bid submission. Bid valid for a shorter period shall be rejected by the ‘Executive
Engineer’ as non-responsive.

10. All materials are to be supplied by the Agency at his own cost.

11. Eligible criteria for participation in the tender:

i) Intending tenderers should produce credentials of a similar nature of work of the


minimum value of 40% of the Quoted amount put to tender during 7(seven) years prior to
the date of issue of this tender notice;
or,
ii) Intending tenderers should produce credentials of 2(two) similar nature of work, each of
the minimum value of 30% of the Quoted amount put to tender during 7(seven)years prior
to the date of issue of the tender notice,
or
iii) Intending tenders should produce credentials of one single running work of similar nature
which has been completed to the extent of 80% or more and value of which is not less than
the desired value at (i) above; In case of running works, only those tenderers who will
submit the certificate of satisfactory running work from the concerned Executive
Engineer, or equivalent
iv) competent authority will be eligible for the tender. In the required certificate it should be
clearly stated that the work is in progress satisfactorily and also that no penal action has
been initiated against the executed agency, i.e., the tenderer
v) No Bidders will be allowed without depositing the Earnest Money.
12. The executing agency (successful bidder) may not get a running payment unless the fund is received for
this particular purpose. Provisions in Clause (s) 7, 8 & 9 contained in W.B. Form No. 2911 so far as they
relate to quantum and frequencies of payment are to be treated as superseded.

13. No Mobilization Advance and Secured Advance will be allowed.

14. Bids shall remain valid for a period not less than 120 (One Hundred Twenty) days from the Last date of
Bid Submission. If the bidder withdraws the bid during the period of bid validity the earnest money as
deposited will be forfeited forthwith without assigning any reason thereof.

B. Location of Critical Events:

16. There shall be no provision of Arbitration. Hence Cl. 25 of 2911 is omitted vide notification no.
558/SPW dt. 13.12.11 of Secretary, to the Govt, of West Bengal

17. Earnest Money: The Earnest Money, in the shape of Bank Draft of any Nationalized Bank (to be
documented through e- filling)

18. The intending Bidders shall clearly understand that whatever may be the outcome of the present
invitation of Bids, no cost of Bidding shall be reimbursed by the Department. The Executive Engineer,
Bankura Highway Division, P.W.(Roads) reserves the right to reject Bid documents and to accept or
reject any offer without assigning any reason whatsoever and is not liable for any cost that might have
incurred by any Bidder at the stage of Bidding.

19. In case of requirement of quotation inviting Authority at any stage of quotation process or execution of
work, necessary registered irrevocable power of attorney is to be produced without any question.

20. No conditional / incomplete quotation will be accepted under any circumstances.


21. Prevailing safety norms has to be followed so that LTI (Loss of time due to injury) is zero.
In the event of acceptance of lowest quotationed rate no multiple lowest rales will be considered by the
Department.
22. The Executive Engineer, South 24Pgs Division, P.W.D reserves the right to cancel the N.I.Q. due to
unavoidable circumstances and no claim in this respect will be entertained.

23. During scrutiny, if it is come to the notice to quotation inviting authority that the credential or any other
papers found incorrect/manufactured/fabricated, that quotationer will not be allowed to participate in the
quotation and that application will be out rightly rejected without any prejudice with forfeiture of earnest
money forthwith.

24. Before issuance of the work order, the quotation inviting authority will verify the documents of the
lowest quotationer. After verification, if it is found that such documents submitted by the lowest
quotationer is either manufactured or false in that case, work order will not be issued in favour of the
quotationer under any circumstances & necessary penal action will have to be taken by the authority as
per existing Govt. Rules.

25. All the bidders must submit the rate analysis format in Financial Bid (In PDF. format in his own original
letter head) obeying minimum rates of wages act of Labour Department and other Govt, rules in force in
support of their quoted rate for verification.

26. CRITERIA REGARDING CREDENTIAL POLICY (REF NO-04-A/PW/0/10C-02/14, DATED:


18.03.2015 OF PRINCIPAL SECRETARY TO THE GOVT. OF WEST BENGAL, P.W.D.
Intending quotationers should produce credentials of similar service of this Government of West Bengal/
Undertaking of this Government or Government of West Bengal or any Govt, of State.
Other terms and conditions of the credentials:
i) Payment certificate will not be treated as credential;
ii) Credential certificate issued by the Executive Engineer or equivalent Officer of a State / Central
Government, State / Central Government undertaking, Statutory / Autonomous bodies constituted
under the Central / State statute, on the executed value of completed work will be taken as credential.

27. The applicant/Bidder must inspect the site of work and get acquainted with site conditions, facilities
available and problems to be faced during work and take into account all such factors before quoting rate.

28. Deduction of tax shall be as per provision of current rules in force.


29. All quotationers are requested to present during opening of Quotations positively. If considered
necessary, instant online bid may be conducted immediately after opening of Quotations to lower down
rates and in no case his/their absence will stand against holding the same.
30. The intending quotationer is required to quote the rate in figures as well as in words.

31. The accepting authority reserves the right to reject any or all the Quotations without assigning any reason
whatsoever and he will not be bound to accept either the lowest Quotation or any of the Quotations.

32. i) Payment will depend on availability of fund and no claim whatsoever will be entertained for delay of
issuance of work order as well as payment, if any. Intending quotationers may consider this criterion
while quoting their rates.
ii) Bids shall remain valid for a period not less than 120 (One hundred twenty) days after the dead line
date for Bid submission.

33. Statutory deduction by STDS is liable to be deducted as per provision of GST Act, 2017. However no
STDS will be made until further order of the Govt, is issued.
Tax liability of the concerned works contract has to be borne as per prevailing GST Act, 2017 by the
agency.
34. Successful Quotationers will be required to obtain valid Registration Certificate & Labour License from
respective Regional Labour Offices where construction work by them are proposed to be carried out as
per Clauses u/s 7 of West Bengal Building & other Construction Works’ Act, 1996 and u/s 12 of
Contract Labour Act.
35. Successful Quotationer may be asked to produce all documents in original for verification prior to
issuance of Work Order.

36. Any intending Bidders who have failed to execute more than one works contract under any Directorate of
this Department and was terminated by any sub rule under clause 3 of Quotation Form No.2911 or
terminated under any clause of Standard Bidding Documents by the Engineer-in-charge / Employer
during last 3 (three) years will not be eligible to participate in any bid under any Directorate under this
Department for another 2 (two) years from the date of imposition of last termination notice by the
Engineer-in-Charge / Employer.

Special Terms & Conditions:


i) All liabilities towards compensation of damages of Government properties and theft of Government materials
due to negligence of the personnel engaged must be borne by the Agency whose quotations will be accepted.

ii) No extra cost towards any accident of the engaged personnel will be borne by the Department and any
compensation towards accident of the engaged personnel will be borne by the Agency.

iii) No claim for employment in Government Service will be accepted in any causes.

iv) No replacement will be allowed without any prior permission of the competent authority.

v) The list of personnel engaged for the duty shall have to be submitted along with photo ID proof to the
concerned Assistant Engineers three days before the actual deployment for the work and specific location of
duty.

vi) All the personnel will have to put on Uniform during duty hours, cost of Uniform or its washing charges will
be borne by the Agency and no charge of the same will be entertained.

vii) The personnel are to be engaged after observing Labour Act and should be paid as per prevailing Minimum
wages Act of West Bengal.

viii) In no cases the absence of duty will be entertained. The Agency will be competent enough to change the
personnel if objected by the Department Officers within 24 Hours.

ix) The undersigned or any authorized Officials reserve the right to instruct the Agency for withdrawal of
personnel without showing any reasons.

x) The undersigned reserve the right to modify any terms and conditions, if necessary, in the interest of the
Government which must be accepted by the Agency otherwise the work order will be cancelled forthwith
without showing any reasons. The undersigned also reserves the right to cancel the agreement by giving a
notice of 1 (one) month before cancellation to the agency without assigning any reason.

xi) The payment for the service will be made by the undersigned. The Bill in (triplicate) should be submitted
with attendance sheet to the concerned Assistant Engineer’s for payment. The payment will be released after
availability of fund.

xii) Accommodation with water electricity and lavatory facilities for the personnel should be arranged by the
successful quotationer at his own cost. The rate should be quoted inclusive of all taxes, GST and all other
incidental charges as applicable. Necessary deduction shall be made from bill as per existing Govt, rules in
force.

xiii) Payment of Wages to the personnel shall be made through Bank A/c transfer only. The respective A/c
statement shall have to be produced to the undersigned as and when necessary.

xiv) Washing, cleaning etc. to be done to the best possible extent. Any deviation will not be entertained and
action will be taken by way of reduce panel rate which will be binding and final.

xv) All the personnel involved to be supplied by the agency as per agreed rate without fail.
xvi) Validity of contract 365 (three hundred sixty-five) days and may be extended if desired.
xvii) All others terms and conditions will remain same as per existing Govt, rules.
xviii) Extreme care shall be exercised during the handling, transportation and driving of the Sheet Piles to avoid
any damage to the Piles.
xix) Any damages of the existing roads, structures, premises etc. is to be repaired by the contractor at his own
cost.
xx) All the safety with high precision to be maintained as per prevailing safety rules and Indian Code of
Practices.
INSTRUCTION TO BIDDERS
SECTION - A
General guidance for e-Quotationing

Instructions/ Guidelines for Quotations for electronic submission of the Quotations online have been annexed
for assisting the contractors to participate in e-_quotationing.

1. Registration of Contractor
Any contractor willing to take part in the process of e-tendering will have to be enrolled & registered with
the Government e-Procurement system, through logging on to https://etender.wb.nic.in (the web portal of
public works department). The contractor is to click on the link for e-tendering site as given on the web
portal.

2. Digital Signature certificate (DSC) i;


Each contractor is required to obtain a (class -I, class-II, Class-Ill and bonafied resourceful outsiders) Digital
Signature Certificate (DSC) for submission of Quotations, from the approved service provider of the
National Information’s Centre (NIC) on payment of requisite amount details are available at the Web Site
stated in Clause-2 of Guideline to Bidder DSC is given as a USB e- Token.

3. The contractor can search & download NIQ & Quotation Documents electronically from computer once he
logs on to the website mentioned in Clause 2 using the Digital Signature Certificate. This is the only mode
of collection of Quotation Documents.
4. Modalities regarding participation of a bidder in different works under PWD & modification of certificate in
the declaration proforma attached with the Memorandum No.797-W(C)/lM-24/15 dated 06.12.2017 [Ref.
N0.8O-W (C) /1 M-24 /15 dated 25.01.2018 of Additional Chief Secretary, Public Works Department.)

(a) In a particular N.I.T. /N.I.Q. having multiple works, a bidder can participate in more than one work
provided the bidder is capable to arrange and deploy separate set of required personnel for multiple works
and complete the work in specified time.

5. Submission of Quotations:
General process of submission: Quotations are to be submitted through online to the website stated in Cl. 2 in
two folders at a time for each work, one in Technical Proposal & the other in Financial Proposal before the
prescribed date &time using the Digital Signature Certificate (DSC) The documents are to be uploaded (virus
scanned copy) duly Digitally Signed. The documents will get encrypted (transformed into non readable
formats).

A. Technical proposal The Technical proposal should contain scanned copies of the following in two covers
(folders).
A-l. Statutory Cover file Containing
i. Scan copy of earnest money (EMD) as prescribed in the NIQ against the serial of work as applied for, in
favour of Executive Engineer, South 24Pgs Division, P.W.D. needs to be furnished.
ii. Tender form No. 2911_ & NIQ (Properly uploaded and Digitally Signed).
The rate will be quoted in the BOQ. Quoted rate will be encrypted in the B.O.Q. under Financial Bid.
A-2. Non statutory / Technical Documents
i. Professional Tax Clearance Certificate / Professional Tax (PT) deposit receipt challan for the current
financial year.
ii. Pan Card
iii. Registered Deed of partnership Firm
iv. Trade License from the respective Municipality / Panchayet etc.
v. Certificate of Registration’ from the respective Assistant Registrar of Co - operative Societies & valid By
Law (for Regd. Unemployed Engineer’s Co - Operative Society Ltd. & Labour Cooperative Society Ltd.)
and Current Audit Report.
vi. GST Certificate & Return.
Note: - Failure of submission of any of the above mentioned documents will render the Quotation liable to be
rejected for both statutory & non statutory cover.

ii. Only downloaded copies of the above documents are to be uploaded virus scanned & Digitally Signed by the
contractor.
