Criminal Bail Application of Applicant above named for bail U/s. 437 of the Cr.P.C.

MAY IT PLEASE YOUR HONOUR:

The Applicant above named most respectfully begs to submit is as under:-

1. That, the Applicant/Accused above named has been arrested in C.R. No. 49/2019.
That the Police Authorities had taken custody of the applicant for the offences
mentioned hereinabove, and was being produced before this Hon’ble Court and the
Hon’ble Court was pleased to grant Magisterial Custody.

2. That the Applicant most respectfully approaches before this Hon’ble Court for grant
of bail on the following amongst other grounds:-

a. That the offence is non-bailable in nature and but, the ration laid by the Hon’ble
Apex Court “Bail is a rule/Jail is an execption”squarely applies to this case. {AIR
1977 SC 2447 in State of Rajasthan Vs Balchand}

b. That the Applicant is innocent person and is falsely implicated in this case on
mere suspect and she is victim of circumstances and was unnecessarily linked
with the present case.
c. That there is no cogent or positive evidence against the present application as to
involve him in the present crime.

d. That nothing is recovered or discovered at the instance of the present applicant,


this fact goes to show that the present applicant has been falsely implicated in the
present crime.

e. That the matter is triable by this Hon’ble Court only.

f. That, the offence alleged against the applicant is neither punishable with death
nor with imprisonment for life.

g. That the Applicant shall not abscond from justice being permanent resident of the
given addresses as and when required.

h. That, the Applicant/Accused is ready and willing to abide by any terms and
conditions as this Hon’ble Court may deem fit to impose in the circumstances of
the case.

i. That, the Applicant/Accused will be available to prosecution as per the direction


of this Hon’ble Court.

Its is therefore most respectfully prays that:-

a. The application may pleased be allowed.

b. That, this Hon’ble Court may be pleased to enlarge the Applicant/Accused on bail on
such terms and conditions as this Hon’ble Court deem, fit and proper to impose in the
circumstances of the case in the interest of Justice;
And for this act of kindness and favour the Applicant/Accused as in duty bound
shall every pray.
