WHAT IS RA 9165 IN THE
PHILIPPINES?
Use of Dangerous Drugs – A person
apprehended or arrested, who is found to be
positive for use of any dangerous drug, after a
confirmatory test, shall be imposed a penalty of a
minimum of six (6) months rehabilitation in a
government center for the first offense, subject to the
provisions of Article VIII of this Act.

An Act instituting the Comprehensive


Dangerous Drugs Act of 2002, Repealing
Republic Act No. 6425, otherwise known as the
Dangerous Drugs Act of 1972, as Amended,
providing Funds therefore, and for other purposes.
WHAT IS THE DIFFERENCE
BETWEEN RA 9165 AND
RA 6425?

Republic Act 9165 or the “Comprehensive


Dangerous Drugs Act of 2002” repealed RA 6425.
The new law expanded the membership of the Board
to 17 members, streamlined its functions, and ushered
in new programs and initiatives. The Philippine Drug
Enforcement Agency (PDEA) was created.

COMPREHENSIVE
DANGEROUS DRUGS
ACT OF 2002
provides that:
“the State needs to enhance further the efficacy of the law against
dangerous drugs, it being one of today’s more serious social ills.
Towards this end, the government shall pursue an intensive and
unrelenting campaign against the trafficking and the use of the dangerous
drugs and other similar substances. The government however shall aim to
achieve a balance in the national drug control program so that people with
legitimate medical needs are not prevented from being treated with adequate
amounts of appropriate medications, which include the use of dangerous
drugs.
WHAT IS
VIOLATION OF
RA 9165?
Any person, who sells, trades, administers, dispenses, delivers
or gives away to another, on any terms whatsoever, or
distributes, dispatches in transit or transports dangerous
drugs or who acts as a broker in any of such transactions, in
violation of this Act.

IS RA 9165
BILLABLE?

For violation of Sec. 11, RA 9165 the prosecution submits


to the sound discretion of the Honorable Court. For
violation of Sec. RA 9165, No bail is recommended.
NATURE OF DRUGS
The nature of drugs relates to the physical or chemical properties
of drugs, in general. These properties including drug matter, drug
size, drug shape and drug bonds. Methamphetamine
Hydrochloride, commonly known as “Shabu” remains to be the
main drug of abuse comprising ninety-four percent (93.72%) of the
total admission. This is followed by Cannabis (Marijuana) at twenty-
three percent (22.59%) and Contact Cement (Rugby) with less than
one percent (0.73%).
WHAT IS THE NATURE
OF THE PROBLEM IN
DRUG ABUSE?
Drug addiction can lead to a range of both short-term and
long-term mental and physical health problems. These
depend on what drug is taken accidents. People who are
addicted to drugs are more likely to drive or do other
dangerous activities while under the influence.
WHAT IS THE CURRENT
STATUS OF DRUG USE IN
THE PHILIPPINES?
According to the Dangerous Drugs Board (DDB), there are:
• 1.8 million current drug users in the The Philippines,
• 4.8 million Filipinos report having used illegal drugs at least once in
their lives.
• More than three-quarters of drug users are (91%) Adults, (87%) Males,
(80%) high school
• More than two-thirds (67%), the most commonly used drug in the
Philippines is a variant of methamphetamine called shabu or “poor
man’s cocaine.
• Shabu (95.45%); Cannabis (Marijuana) (4.30%); Contact Cement
(Rugby) (0.25%)
WHAT IS THE CURRENT
STATUS OF DRUG USE IN
THE PHILIPPINES?
According to the Dangerous Drugs Board (DDB), there are:

• According to a 2012 United Nations report, the Philippines had the


highest rate of methamphetamine abuse among countries in East
Asia; about 2.2% of Filipinos between the ages 16–64 years were
methamphetamines users.
• The government has focused on implementing a policy, “war on
drugs,” that the Duterte government has utilized. Law enforcement
agents have engaged in extensive door-to-door operations. One such
operation in Manila in August 2017 aimed to “shock and awe” drug
dealers and resulted in the killing of 32 people by police in one night

Drug trafficking is the most prevalent illegal
drug activity dedicated for cultivation,
manufacture, distribution and sale of illegal
drugs.

WHAT IS PDEA
What is PDEA? Philippine Drug Enforcement Agency (PDEA) — is a government
agency in the Philippines responsible for enforcing laws and regulations related
to illegal drugs and controlled substances.

• Despite the fact that, in October 2017, Duterte ordered the police to end all
operations in the war on drugs, doubts remain as to whether the state-sanctioned
killings will stop. Duterte assigned the Philippine Drug Enforcement Agency
(PDEA) to be the sole anti-drug enforcement agency.
• During the first six months of the Duterte Presidency (July 2016–January 2017),
the PNP conducted 43,593 operations that covered 5.6 million houses, resulting in
the arrest of 53,025 “drug personalities,” and a reported 1,189,462 persons
“surrendering” to authorities, including 79,349 drug dealers and 1,110,113 drug
users

• Government figures indicate that over 7,000 individuals accused of drug involvement
were killed during the same period.
•Approximately 2,555 people suspected of drug involvement were killed in gun battles
with police in anti-drug operations.
• Community activists estimate the death toll to have reached 13,000, with suspicions
that some police killings are staged for cash rewards.
• Mass surrenders have overwhelmed the Philippine penal system, leading to
overcrowded and unsanitary conditions for detainees.

• The focus on youth in drug prevention and detection
efforts is grounded in a comprehensive understanding of
the challenges and risks they face. By addressing their
vulnerability, the long-term consequences of early drug
use, the developmental aspects of their brains, education,
and behavior. These aim to create a safer and healthier
future for young people and society as a whole.
•By focusing on prevention and early intervention, we can
mitigate these negative consequences and increase the
chances of young individuals leading healthier and more
productive lives.
HOW CAN ONE STOP THE
ADDICTION TO LEAD A
NORMAL PEACEFUL LIFE?
Half the problem is resolved when one shows
the desire to give up addictions. Support might
come from:

 Doctor/counsellors
 People who had the same problem but recovered

1. Awareness 》 Understanding and researching the concept of drug


addiction and it effect in an individual, being aware can help in
avoiding it and watching out for others.
2. Listen 》 Pay attention to the experiences of others who have
undergone the abuse and open up your mind with the knowledge of
the experts
3. Share 》 Talk and discuss the information that you have gained
about drugs, drug addiction and its effects to your classmates and
friends.
》 Share your knowledge and network in aiding others towards being informed
and recognizing their role in drug prevention.
》 Be concerned and responsible.

CAN PREVENT DRUG ABUSE
4. Encourage 》 Give your peers and family members a good push in the right
condition whether its prevention or rehabilitation.
5. Support 》 Participate in activities beneficial in the drug abuse prevention
initiate. Add your presence to the growing force tackling this issue.
》 Get involve in other activities like varsity teams, extra- curricular organizations to keep you
busy while at the same time develop your personality, talents and skills.
6. Organize 》 Drug addiction may be caused due to the feelings of isolation,
loneliness, anxiety and etc. hence, social service organization, and NGOs should
establish youth centers to overcome such feelings. Having a mutual goal, it is more
purposeful to combine efforts and sources to create a bigger impact about the
concern.
7. Inform 》 Approached appropriate government agencies regarding incidents and
cases of drug abuse.
