1. Reference: Spot Report re: Arrest of Suspect for Violation of Ususrpation of Authority
and R.A. 10591 dated October 04, 2015
2. This pertains to the arrest of S1- EDGAR ABENOJA Y TURING, 39 years old,married,
Former Police Officer, and presently residing at No. 376 Llana St., Tondo, Manila and S2-
GILBEYS NAVOA Y CUETO, 39 years old, married, former police Officer, presently residing
at No. 400-C Capulong St,. tondo, Manila for above captioned case by elements of delpan
PCP.
3. On October 4, 2015 the above-mentioned suspect including the recovered evidence
PNP ID# 10K180007 marked ETA, PNP issued firearms (9mm piettro Berreta/two tone
bearing serial number M29775Z market ETA-1) with (2) magazines marked ETA-2)
twenty four (24) live ammunitions marked ETA-3), and issued Motorola radio with serial no.
921TNW1617 marked ETA-4 were presented for inquest before Asst. Prosecutor Viven C.
Andino for disposition.
4. After verification conducted at the Clerk of Court, Manila S1 (Abenoja) hasa an
outstanding warrant of arrest before Regional trial court, Branch-11 Robbery under Criminal
case no. 15-312461 issued by Hon judge Cicero D. Jurado Jr., Likewise S2 (Navoa) Has an
Outstanding warrant of arrest before Regional Trial Court, Branch- 14 for Robbery under
criminal case no. 03-212190 issued by Hon Judge Cesar Solis.
5. A copy of warrant of arrest was turned to their court origin.
6. Request granting of commendation to the element of delpan PCP composed of PSINPS
ROMEL ANICETE, PINSP WILLIAM LOPEZ, PO3 Gilbert Doman, PO2 Dexter Dela Cruz,
PO1 Julius Ballesteros, PO2 Walter Depano, and P01 Eric Reyes.

II. MATTERS TO THE INVESTIGATED
3. To determine the existence or non existence of probable cause of criminal/
administrative and civil liability of PO1 Arvin A. Montero.
4. To ascertain the whereabouts of one (1) unit of Glock17 bearing
Serial number PNP09229 issued to po1 Arvin A. Montero.
5. To file appropriate action agaist PO1 Arvin A. Montero, if evidence so
warrants.
III. FACTS OF THE CASE
6. Culled from the records, PO1 Arvin A. Montero entered the Phillipine
National Police last July 02, 2012.
7. On August 09, 2013, the Phillipine National Police Logistics Support
Service (PNP-LSS) issued him one Glock17 bearing serial number PNP09229.
8. ICOW the above mentioned reference PO1 Arvin A. Montero lost his service
firearms during the arrest of an alleged MURDER suspect one Crisencieo Caaya, Jr y Katang-
Katang transpierd on August 18, 2014 at about 01:30 PM., at Purok-1 Isla putting Bato
Tondo, Manila and in the time of apprehension recovered from suspect possession one (1) .
38 caliber revolver and four (4) live ammunition. The suspect Crisencieo Caaya, Jr y Katang-
Katang was presented before prosecutor John Allen Farinas in the City of Manila.
IV. DISCUSSION:
9. On his submitted Joint Affidavit of Arrest dated August 18, 2014 admitted
that he lost his service firearm described as glock17 bearing serial number PNP09229 at
about 01:30 PM. During the scuffle with the suspect and without him knowing the said
service was missing in the holster of his pistol belt. That despite of his diligent effort niether
to locate the same nor to establish witness who could give any information proved in vain.
V. CONCLUSION
10. based on the foregoing circumstances, subject PNCO provided clear and
convincing evidence on how the subject firearm was lost in his possesion. The same
tantamount to civil and criminal liabilities sonsiderin the firearm was issued to him for his
use in performing his official duty as police officer.
11. However, considering that the subject PNCO lost his issued firearms in the
performance of his official duty, subject PNCO may be allowed to poy the fair Market Value of
his issued firearm.
VI. RECOMMENDATION
12. In the view of foregoing, this highly recomends that the subject PNCO be
allowed to settle his obligation by paying considerable amount or the fair Market Value of his
lost issued firearm and be absolved/cleard from his firearm accontability. Likewise, this office
further recomends the subject firearm be declared lost and dropped from the list of PNP
issued firearm and to determine the existence of probable cause if subject PNCO be held
liable for GRAVE MISCONDUCT (deliberately or, through gross negligence, destroy, damage,
or lose govement property entrusted to for official use).

BRIEF FACTS OF THE CASE:
At about 5:00 P.M this date herein complaint personally appeard to this office and
reported the above captioned incident for inident for investigation.
Complainant narrated that on the given date, and the time she walking at the said
placed purposely to meet her friend thereat upon arrival at the said location she notice her
carried shoulder bag having salashed promting, the same to search and further discovered
her passport was missing and now here to be found. Diligent effort exerted to locate rhe

chansis number MHFZR69G103059125, Company, and registered under one JUSTO MARINO
JR CAMMYO Y CAMAYO, 40 years of age, married, Doctor and residing at No. 2551 Rodriguez
St., Balut, Tondo, Manila, which was taken by the suspect.
3. As coordination has been made by said PNCOs to the office-in-charge of the
security Department of the said Building for futher verification and for the immediate
solution of the case, one Atty. Fe pigon arrived and declined the request of the said police
officer and further said that they connot entertain the police officers request.

Brief Facts of the:
Repotee personally apeared to this office and reported the case for investigation.
Fothwith, the under signed took cognizance of the case.
From the narration complaint sheet and written report of IRF signed and presented
by the reportee by it appears that, Mr, Valek was walking along said when a suspect from his
back asking for money for him. Mr Valek refused, then the suspect took a knife on his pocket
and pointing at him forcibly grabbed his camera bag containing the following losses. The
suspect run to his motorcycle and ran towards dark places. Immediately, he reported the
incident to Remedios PCP of PS-5 (Ermita) MPD and the policemen escorted him to said
place and locate the suspect and negative result obtained. Then the policeman referred him
to his office for proper disposition of the case and issued a police report.
This police report is being issued to reportee for whatever it may deem serve.
