CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:
This CONTRACT, made and entered into by and between,
JUAN DELA CRUZ, of legal age, Filipino, married, and resident of 38
General Luna St., Naga City, hereinafter called the “Lessor”
ANTONIO LUNA representing WHEELERS PREMIUM AUTO SOLUTIONS,
with address, at Block 1 Lot 87 Aeroville Subdv., Zone 2, San Juan, Naga City,
hereinafter known as the “Lessee”.
WITNESSETH:
1) That the LESSOR hereby agrees to lease to the LESSEE a portion of
a parcel of land located at Jacob St., Naga City, to the extent of Two Hundred
Fifty (250) Square Meters.
2) That the LESSEE shall use the premises for the establishment and
operation of a Auto repair shop.
3) That the monthly rental of Ten Thousand Pesos, (P10,000.00) which
shall be paid on or before the 5th day of the month.
4) That the term of this lease is Three (3) years commencing from
January 1, 2019 and expiring on December 31, 2021 which shall be subject to
renewal under new terms and conditions as may be mutually agreed upon, in
writing, by both parties;
5) That the LESSEE shall deposit the amount equivalent to one (1)
month rental or Ten Thousand Pesos Only (P10,000.00) which shall be non-
refundable but will be applied to the last month of occupancy.
6) That the LESSEE shall pay the amount of PHP 10,000.00 covering
the first month of the lease upon signing of this contract.
7) That the LESSEE, shall pay for and defray at his own expense, the
application for connection and consumption of water, electric light, telephone or
other services in the leased premises;
8) That the LESSEE shall deposit the amount of PHP 5,000.00 as
security for the payment of electricity, water and other utilities which shall be
applied on the last bill after termination of this contract without prejudice to the
right of the LESSOR to collect from the LESSEE any amount due which cannot
be covered by the deposit. Any excess in the deposit after all outstanding bills
are paid shall be refunded to the LESSEE.
9) That the LESSEES, shall follow the rules and regulations as imposed
by the LESSOR.

10) Any replacement, restoration of any damages or breakage due to
ordinary wear and tear shall be at the expense of the LESSEE, Any painting,
renovation or improvement done in the leased premises shall be for the account
of the LESSEE;
11) That the LESSEE shall not directly or indirectly sublease, assign, or
transfer his right under this contract to the third party or parties;
12) That the LESSEES shall use the leased property exclusively for that
purpose as agreed upon with the LESSOR only and in no case shall the premises
be used for any immoral and illegal trade or activity;
13) That the LESSEES, knowing that the nature of the business they
engage in involve any inflammable or explosive goods or materials or any articles
which may expose the leased premises to fire or increase the fire hazards of the
building, must comply with all the necessary fire safety permits;
14) That the LESSEES hereby expressly acknowledge that the leased
premises are in good and tenantable condition and agrees to keep the same in
such good and tenantable condition complying with any and all laws, ordinances
and regulation of the City or National Government as regards the use, occupation
and sanitation of the leased premises, and failure to comply shall be at the risk
and expense of the LESSEES;
15) Any breach of any provisions of this contract shall result in the
termination of this contract and turnover of the unit to the LESSOR;
16) Improvements on the leased premises made by the LESSEE during
the period of this contract, excluding but not limited to removable items, such
as metal grills, frames, designs, etc.; shall be for the benefit of the LESSOR at
the termination of the lease agreement.
17) This contract cancels and supersedes all previous contracts or
agreements, if any, between the parties in connection with this contract, and it
shall not be amended, changed, modified, novated, or in any way altered by
repeated acts of tolerance by the OWNER or LESSOR, as any such amendments,
changes, modifications, novation or alterations shall be valid only if made in
writing and signed by both parties to this contract.
IN WITNESS WHEREOF, we have hereunto set our hands this __ day of
