1. Achievement of Project Milestones for Improvement Works: The progress of
Improvement Works (Schedule-B) is discussed in detail. Team Leader has
informed that none of the Project Milestones are achieved by the Concessionaire
except Incident Management. In this regard, IE has notified the Concessionaire
about slow progress from time to time and requested the Concessionaire to
augment the resources (Machinery, Manpower & Material) and submit revised
Work program. However, the Concessionaire has neither augmented the
resources nor submitted the revised Work Program as requested by the IE.

2. Submission of proposal & Consent for CoS items for Plantation & Black
Spots mitigation: The Project Director enquired about submission of proposals
and Consent for CoS items for Plantation and Black Spots Mitigation Measures
(Service Road & highway lighting, Traffic Blinkers) for which the Authority has
issued CoS notice to the Concessionaire in May, 2020. The EPC Contractor
Representative has informed that they are not willing to take up the additional
works under CoS and the Authority may go ahead with Open Competitive Bidding.
3. Upload of information in Datalake Project Management System: The Project
Director has directed the Concessionaire to upload the Project information
including all designs, approvals, Manual, RFIs, correspondence etc. as per the
NHAI Circular and as per the webinar training conducted in May, 2020. The
Concessionaire has informed that they have already started the uploading of
required Data and it will be completed by 30.06.2020.
4. Submission of Revalidation & Testing Reports of the Road Project: The Team
Leader has informed that according to Clause No. 4.1.8 of Schedule-F of
Concession Agreement, the Concessionaire shall carryout following Revalidation

& Testing on the Road Project in order to determine the Asset Performance
Parameters for the Base Year. This Revalidation & Testing shall be carried out 45
days before O&M Handover Date and the Concessionaire shall arrive at Base
Year Parameters within 45 days of the O&M Hand Over Date (i.e. by 15.01.2020).
However, the submission of reports is not yet completed till date as stated below:

The Concessionaire has informed that they will submit the balance reports and
Base Year Parameters by 15.07.2020.
5. Conducting Bi-Annual Tests (IRI, BI, Skid Resistance, Rutting, PCI, Other
Pavement Distress): The Team Leader has informed that the Concessionaire
shall conduct Bi-Annual Tests as per Schedule-F to confirm the maintenance
criteria is as per CA. These tests shall be conducted in May/June (Before
Monsoon). The Concessionaire has informed that they could not conduct tests in
May/June due to COVID-19. However, they will start conducting required tests
from 25.06.2020.
6. Submission of revised designs and drawings for balance junction
improvements: The Team Leader has informed that the Concessionaire has not
submitted 5 nos revised Junction Improvement drawings duly incorporating
comments communicated by the IE. The Concessionaire has informed that they
will submit balance Junction Improvement drawings by 30.06.2020.
7. Setting up Traffic Aid Post: The Team Leader has informed that as per Clause
17.2 of the CA, the Authority shall assist the Concessionaire in procuring the
Police assistance from the State Police Department for regulating the traffic on
Project Highway including setting up “Traffic Aid Post”. However, the
Concessionaire did not set up Traffic Aid Post. The Concessionaire has informed

that they will set up Traffic Aid Post in newly constructed Toll Plazas. Meanwhile,
they will set up temporary Traffic Aid Post at PIU Complex, Kokkirapalli.
8. Submission of compliance report to Site Inspection Reports issued by IE:
The Team Leader has informed that IE has issued Site Inspection Reports on
quality, safety and maintenance issues from time to time. However, the
Concessionaire has failed to submit compliance reports to such inspection reports
issued by the IE. The Project Director has directed the Concessionaire to submit
compliance reports to Site Inspection Reports issued by the IE. The
Concessionaire agreed for the same.
9. Submission of proposal for Slope Protection: The Team Leader has informed
that the Concessionaire shall submit proposal for Slope Protection works as per
Para-9 of Schedule-B, in accordance with IRC-SP-42. The Concessionaire has
informed that they will submit detailed proposal by 30.06.2020.
10. FAT of ATMS Equipment: The Team Leader has informed that as per Clause No.
7.9 of Schedule-B of CA, the Concessionaire shall design, install, operate and
maintain ATMS as per NHAI Policy Circular-Technical (214/2016), dated
15.09.2016. Further, Clause 2.5.2 of NHAI Circular stipulates that the Factory
Acceptance Test (FAT) shall be undertaken to ensure the ATMS equipment has
been completed to the required functionality, safety and quality and meets all the
contractual specifications. The FAT shall be undertaken before shipping to site to
ensure the equipment has been completed to the required quality and is fully
operational. However, FAT has been completed for only VMS, VAS and PTZ/VIDS
Poles till date. FAT report for VMS and VAS is still pending from the
Concessionaire as per observations communicated by IE. The Concessionaire
has informed that the FAT of balance equipment could not be completed due to
COVID-19. The revised dates will be communicated as soon as the situation
improves for factory inspection.
11. Provision of anti-glare screen over MBCB in median: The Team Leader has
brought to the notice of Concessionaire that the Concessionaire shall provide anti-
glare screens over both sides of MBCB in narrow medians as per specification
amended in Schedule-C. The Concessionaire has informed that the provision of
anti-glare screen is provided in Schedule-C(Specifications), but it is not provided in
Schedule-B(Scope). The Project Director has opined that they shall be provided
as per safety norms and as per Good Industry Practice.
12. Removal of unauthorized access & encroachments: The Project Director has
taken serious note that the Concessionaire is not taking any action to remove
unauthorized access/encroachments and preventing regular encroachments other
than issuing notices to the Party in some cases. As per Clause 10.5 of CA, the
Concessionaire shall protect the Site from all occupations, encroachments. The
Project Director has instructed the Concessionaire to take strict action to remove
unauthorized access/encroachments by taking local Police help, if required. The
Project Director further advised the Concessionaire to appoint an Estate

Management Officer preferably a retired Revenue Officer to look after protection of
Site from encroachments and encumbrances. The Concessionaire has assured
that they will take necessary action immediately.
13. Rectification of highway lighting (Less than 50% working): The Team Leader
has informed that IE has identified the defects in highway lighting at some
locations in the project and intimated the Concessionaire vide IE letter dated
07.03.2020. However, there is no reply from the Concessionaire. The
Concessionaire has informed that the cables were totally damaged while taking
over the highway lighting from the BOT (A) Concessionaire. Hence, there are
frequent failures in highway lighting. Now, they have purchased new cables to
replace old cable and it is already dispatched from Pune. They will replace all old
cables as soon as they get new cables.
14. Removal of debris from shoulders & embankment slopes: The Team Leader
has brought to the Concessionaire that there is debris on the shoulders and
bushes on the high embankment slopes, which is not being cleared since many
days. The Concessionaire has assured that they will take up the matter
immediately and clean the Project Highway.
15. Pre-Monsoon Inspection of bridges and culverts: The Team Leader has
informed that as per Table:4 (Maintenance Criteria for Structures and Culverts) of
Schedule-F of CA, the Concessionaire shall inspect all structures and culverts as
per IRC:SP:35-1990 and record depth of silting and area of vegetation. The
Concessionaire shall ensure that 85% of culvert normal area to be made available
for water flow, 15 days before onset of the monsoon. However, the
Concessionaire did not undertake any inspection till date. The Concessionaire has
informed that the survey work is in progress. They will send compliance report for
all structures and culverts supported with photographs.
16. Cleaning of lined drains in built up area: The Team Leader has informed that
the Concessionaire shall clean all lined drains in built up areas before monsoon to
avoid water logging during monsoon. The Concessionaire has informed that they
will take up the cleaning work immediately.
17. Deficiency in HPV & Ambulance: The Team Leader has brought to the notice of
the Concessionaire that the deficiencies in HPV and Ambulance have been
notified by the IE on 17.03.2020. However, there is no compliance from the
Concessionaire. The Concessionaire has replied that they will comply with the
observations of IE and submit compliance report immediately.
18. Using Traffic Control Devices and other safety measures for Work Zone: The
Team Leader has informed that the Concessionaire is not following safety
measures in work zone as per the O&M manual approved by the IE. The Project
Director has also informed the Concessionaire that the reinforcement of RCC
drain is exposed open adjacent to traffic without any protection and he has
repeatedly brought to the notice of the Concessionaire. However, the

concessionaire has not taken adequate safety precautions, which will be viewed
seriously. The Team Leader has cautioned that any lapses in safety will become
breach of Concession Agreement and Damages will be recovered as per Clause
15.8.1 of CA. The Concessionaire has assured that they will take immediate action
to improve the safety of work zone as per prescribed standards.
19. Defects in Toll Plaza Equipment: The Team Leader has informed that the
defects/deficiencies in Toll Booth/Toll Plaza Equipment were notified to the
Concessionaire by the IE on monthly basis since 15.02.2020. However, there is no
compliance report submitted by the Concessionaire. The Concessionaire has
informed that earlier the maintenance of Toll Plaza was given to IHML. Now, the
maintenance is given to KENT. All defects/deficiencies will be rectified by
15.08.2020.
