1. Brennan Inc. is the worldwide manufacturer of equipment used in forensic laboratories since
1950. They manufacture the glass equipment under the mark ADDYJACK, and the metal
equipment under the mark BOOTH. The company supplies to various laboratories in 53 countries
through its subsidiaries Carocam ltd. and AngelMon ltd. The marks have been registered in 40
out of 53 countries, is pending registration in 7, and have not yet been protected in 6. India is one
of the latter six countries.

Taffet Inc. was incorporated in 2015 and also manufactures laboratory equipment. They supply to
labs in SAARC countries only, and have recently come up with several improved designs of the
lab equipment, which they launched under the marks ZADDYJACK (glassware), and BOOTHS
(Metalware). The company has applied for the registration of these marks in India. Brennan Inc.
has filed a pre-grant opposition. All the relevant statements and counter statements have been
submitted.

You are the registrar of trade marks. Decide whether Taffet Inc.’s application should be accepted
or not. Support your decision with relevant sections and case laws.

Glenfiddich Pvt. Ltd. is a pharmaceutical company which owns the patent over the compound
Hydroxyfluorophosphosulphate, a compound used to treat AML, a rare type of cancer. The
compound is marketed under the brand name AMLITA. The patent expires in 2021. Glenfiddich
recently announced that their scientists have been successful in isolating the gamma form of
hydroxyfluorophosphosulphate, which has better absorption capacities. They have applied for a
patent over the gamma form of the compound, which they propose to market under the name
AMLITA-X. You are the Controller of Patents. Decide whether this application should be
granted or refused. Support your decision with the help of relevant sections and case laws.
