RESOLUTION No. 10728
WHEREAS, Section 261 (q) of B.P. Blg. 881 or the Omnibus Election Code of
the Philippines, as amended, provides:
“Sec. 261. Prohibited Acts.~The following shall be guilty ofan election
offense:

(q) Carrying firearms outside residence or place of business. - Any
person who, although possessing a permit to carry firearms, carries any
firearm/s outside his residence or place of business during the election period,
unless authorized in writing by the Commission: Provided, That a motor
vehicle, water or air craft shall not be considered a residence or place of
business or extension hereof.
This prohibition shall not apply to cashiers and disbursing officers
while in the performance of their duties or to persons who by nature of their
official duties, profession, business or occupation habitually carry large sums
of money or valuables.”WHEREAS, Sections 32 and 33 of Republic Act No. 7166 provide:
“Sec. 32. Who May Bear Firearms. - During the election period, no
person shall bear, carry or transport firearms or other deadly weapons in
public places, including any building, street, park, private vehicle or public
conveyance, even if licensed to possess or carry the same, unless authorized
in writing by the Commission. The issuance of firearms license shall be
suspended during the election period.
Only regular members of the Philippine National Police, the Armed
Forces of the Philippines and other law enforcement agencies of the
Government who are duly deputized in writing by the Commission for
election duty may be authorized to carry and possess firearms during the
election period: Provided, That, when in the possession of firearms, the
deputized law enforcement officer must be: (a) in full uniform showing
clearly and legibly his name, rank and serial number, which shall remain
visible at all times, and (b) in the actual performance of his election duty in
the specific area designated by the Commission.”
“Sec, 33. Security Personnel and Bodyguards. ~ During the election
period, no candidate for public office, including incumbent public officers
seeking election to any public offices, shall employ, avail himself of or engage
the services of security personnel or bodyguards, whether or not such
bodyguards are regular members of the Philippine National Police, the
Armed Forces of the Philippines or other law enforcement agency of the
Government: Provided, That when circumstances warrant, including but
not limited to threats to life and security of a candidate, he may be assigned
by the Commission, upon due application, regular members of the Philippine
National Police, the Armed Forces of the Philippines or other law
enforcement agency who shall provide him security for the duration of the
election period. The officers assigned for security duty toa candidate shall be
subject to the same requirement as to wearing of uniforms prescribed in the
immediately preceding section unless exempted in writing by the
Commission.
If at any time during the election period, the ground for which the
authority to employ, avail or engage the services of security personnel has
been granted shall cease to exist or for any othervalid cause, the Commission
shall revoke the said authority.”
WHEREAS, itis the policy of the Commission to strictly enforce Section 261
(q) of the Omnibus Election Code, as well as Sections 32 and 33 of R.A. No. 7166
during the election period;
WHEREAS, following COMELEC Resolution No. 10695, the election period
and the period of prohibition against the bearing, carrying or transporting of
firearms and other deadly weapons, and the employment, availment or

January 9, 2022 to June 8, 2022;
NOW, THEREFORE, pursuant to the power vested) in it by
the Constitution, the Omnibus Election Code of the Philippines, Republic Act
Nos. 6646 and 7166, and other election laws, the Commission RESOLVED, as it
hereby RESOLVES, to promulgate the following rules and regulations to
implement Section 261 (q) of the Omnibus Election Code and Sections 32 and 33 of
Republic Act No. 7166 in connection with the May 9, 2022 National and Local
Elections (NLE)
RULEI
DEFINITION OF TERMS
SECTION 1. Definition of Terms. -As used in this Resolution:
a. Accessories refer to parts of a firearm which may enhance or increase the
operational efficiency or accuracy of a firearm but will not constitute any of
the major or minor internal parts thereof such as, but not limited to, laser
scope, telescopic sight and sound suppressor or silencer.
b. Ammunition refers to the material fired, scattered, dropped, or detonated
from any weapon, as bombs or rockets, and especially shot, shrapnel,
bullets, or shells fired by guns, including the components thereof referring
to the means of igniting or exploding such material, as primers, fuzes, and
gunpowder, as defined under R.A. No. 10591 or the Comprehensive
Firearms and Ammunition Regulation Act, asa complete unfixed/unfired!
unit consisting of a bullet, gunpowder, cartridge case and primer or loaded
shell for use in any firearm.
. Antique firearms refers to any: (1) firearm which was manufactured at least
seventy-five (75) years prior to the current date but not including replicas;
(2) firearm which was certified by the National Museum of the Philippines
to be curio or relic of museum interest; and (3) any other firearms which
derives a substantial part of its monetary value from the fact that it is novel,
rare, bizarre or because of its association with some historical figure, period
or event.
d. Certificate of Firearm Registration (CFR) refers to the certificate issued by
the PNP, particularly its Firearms and Explosives Office (FEO), as proof that
the firearm is lawfully registered and duly recorded.
e, Commission refers to the Commission on Elections.
£ Controlled Chemicals refer exclusively to chlorates, nitrates, nitric acid,
and such other chemicals categorized under Section 3.1 of the IRR on
‘The adjective “unfired” is found in Section 3.2 of the Implementing Rules and Regulations of R.A. No,
10591,
Page3 of 47Controlled Chemicals? that can be used for the manufacture of explosives
and explosive ingredients, where the explosive is capable or is intended to
be made capable of producing destructive effect on contiguous objects or
causing injury or death to any person.
g Deadly Weapon includes bladed instruments, hand grenades or other
explosives, except pyrotechnics; Provided, That, a bladed instrument is not
covered by the prohibition when possession of the bladed instrument is
necessary to the occupation of the possessor or when it is used as a tool for
legitimate activity, like gaffs used in lawful cockfighting,
h. Duty Detail Order (ODO) refers to a document issued to a person by the
juridical entity or employer wherein the details of the disposition of firearm
are spelled out, thus indicating the name of the employee, the firearm
information, the specific duration, and location of posting, or assignment
and the authorized bonded firearm custodian for the judicial entity to whom
such firearm is turned over after the lapse of the order.
i. Election Period refers to the period prescribed in the Commission’ s
Resolution No. 10695 which, for purposes of the May 9, 2022 National and
Local Elections, is from January 9, 2022 to June 8, 2022.
j. Explosive refers to an exploding substance or agent, including the
components and raw materials thereof, as defined under pertinent laws.
k. Firearm as defined in R.A. No. 10591 refers to any handheld or portable
weapon, whether a small arm or light weapon, that expels or is designed to
expel a bullet, shot, slug, missile or any projectile, which is discharged by
means of expansive force of gases from burning gunpowder or other form
of combustion or any similar instrument or implement, wherein the barrel,
frame or receiver is considered a firearm.
The term shall include airguns, airsoft guns, and replicas/imitations of
firearms in whatever form that can cause an ordinary person to believe that
they are real, including the parts thereof, as defined under pertinent laws.
The term shall also include antique firearms.
Imitation firearm, as defined under the same Act and as used herein, refers
to a replica of a firearm, or other device that is so substantially similar in
coloration and overall appearance to an existing firearm as to lead a
reasonable person to believe that such imitation firearm is a real firearm,
The term shalll include airsoft guns.
1. Joint Security Control Centers refer to the following units which are all
under the direct control and supervision of the CBFSC:

Page 4 of a7LI City/Municipal Joint Security Control Center (C/MJSCC) which
shall be responsible for the implementation of the ban on the bearing,
carrying or transporting of firearms in their respective
cities/ municipalities;
1.2 Provincial Joint Security Control Center (PJSCC) which shall
exercise oversight functions over the C/MJSCC and shall be
responsible for implementation of the ban on the bearing, carrying or
transporting of firearms and the employment, availment or
engagement of security personnel within its respective provinces; and
13 Regional Joint Security Control Center (RJSCC) which shall
exercise oversight functions over the PJSCCs and shall be responsible
for the issuance of Temporary Authority for Security Detail (TA-SD)
and the implementation of the ban on the bearing, carrying or
transporting of firearms and the employment, availment or
engagement of security personnel within its respective regions.
m. Letter Order (LO) or Mission Order (MO) refers toa written directive or
order issued by authorized representatives of the PNP, AFP, and other Law
Enforcement Agencies (LEAs) allowing their respective members,
occupying regular plantilla positions and performing actual law
enforcement functions, to carry their government-issued firearms in
furtherance of official duties and functions within and outside their areas
of responsibility/ies (AOR), in lieu of a Permit to Carry Firearms Outside
Residence.
n. License to Own and Possess Firearms (LTOPF) refers to the written
authority granted by the Chief of the PNP, through FEO, to a qualified
individual for him/her to own and possess a firearm.
©. Light weapons are Class-A Light weapons which refer to self-loading
pistols, rifles and carbines, submachine guns, assault rifles, and light
machine guns not exceeding caliber 7.62mm which have fully automatic
mode; and Class-B Light weapons designed for use by (2) or more persons
serving asa crew, or rifles and machine guns exceeding caliber 7.62mm such
as heavy machine guns, handheld under barrel and mounted grenade
launchers, portable anti-aircraft guns, portable anti-tank guns, recoilless
rifles, portable launchers of anti-tank missile and rocket systems, portable
launchers of anti-aircraft missile system, and mortars of a caliber of less than
100mm,
p. Long Certificate of Registration (LCR) refers to licenses issued to
government agencies or offices, __ government-owned-controlled
corporations for firearms to be used by their officials and employees who
are qualified to possess firearms as provided in RA 10591, excluding security
guards.
Page of 47Major parts or components of a firearm refer to the barrel, slide, frame,
receiver, cylinder or the bolt assembly. The term also includes any part or
kit designed and intended for use in converting a semi-automatic burst to a
fully automatic firearm,
- Minor parts of a firearm refer to the parts of the firearm other than the major
parts which are necessary to effect and complete the action of expelling a
projectile by way of combustion, except those classified as accessories.
Permit to Carry Firearm Outside of Residence (PTCFOR) refers to the
written authority issued to a licensed citizen by the Chief, PNP, through the
PICFOR Secretariat, which entitles such person to carry his/her registered
or lawfully issued firearm outside of the residence for the duration and
purpose specified in the authority.
Private Security Service Provider (PSSP) refers to a Private Security,
Investigative and Protective Agency (PSIPA), Private Detective Agency
(PDA) or Company Guard Force (CGF).
Residence or Place of Business refers to the residence of the registered
owner of the firearm/s which shall be the location where the firearm/s shall
be kept and as indicated in the firearm registration card.
Small Arms refer to firearms intended to be primarily designed for
individual use or that which is generally considered to mean a weapon
intended to be fired from the hand or shoulder, which are not capable of
fully automatic bursts of discharge, such as’
1. Handgun is a firearm intended to be fired from the hand, which
includes:
i. Pistol is a hand-operated firearm having a chamber integral
with or permanently aligned with the bore which may be self-
loading; and
ii, Revolver is a hand-operated firearm with a revolving cylinder
containing chambers for individual cartridges;
2. Rifle is a shoulder firearm or designed to be fired from the shoulder
that can discharge a bullet through a rifled barrel by different actions
of loading, which may be classified as lever, bolt, or self-loading; and
3. Shotgun isa firearm designed, made and intended to firea number of
ball shots or a single projectile through a smooth bore by the action or
energy from burning gunpowder.
Temporary Authority-Security Detail (TA-SD) refers to the Temporary
Certificate of Authority to employ, avail or engage the services of security
personnel or bodyguard issued by the RJSCC to qualified public officials
and private individuals. It is valid for a period of thirty (30) days only.

SECTION 2. Prohibited Acts. - During the Election Period:
a. No person shall bear, carry or transport firearms or deadly weapons outside
his/her residence or place of business, and in all public places, including any
building, street, park, and in private vehicles or public conveyances, even if
he/she is licensed or authorized to possess or to carry the same, unless
authorized by the Commission, through the Committee on the Ban on
Firearms and Security Concerns (CBFSC), in accordance with the provisions of
this Resolution.
b. No person shall employ, avail him/herself or engage the services of security
personnel or bodyguards, whether or not such security personnel or
bodyguards are regular members or officers of the PNP, AFP, other law
enforcement agencies of the government or from a private security service
provider, unless authorized by the Commission, through the CBFSC or the
RJSCC in case of a TA-SD, in accordance with the provisions of this Resolution.
c. No person or entity shall transport and deliver firearms and/or its parts,
ammunition and/or its components, and explosives and/or its components,
unless authorized by the Commission, through the CBFSC in accordance with
the provisions of this Resolution.
SECTION 3. Suspension of PTCFORs and MOs/LOs. Any PICFOR, LO or MO
issued by the Chief, PNP, the Chief of Staff of the AFP, the Commanding General
or Flag Officer in Command of the Different Branches of the AFP and their sub-
units, or their duly authorized representatives, or any other head or duly
authorized official of government law enforcement agency are hereby declared
suspended, ineffective, and without force and effect during the Election
Period, unless properly covered by a Certificate of Authority duly issued by the
CBESC,
RULE II
THE COMMITTEE ON THE BAN ON FIREARMS AND SECURITY
CONCERNS
SECTION 4. The Committee on the Ban on Firearms and Security Concerns
(CBFSC) refers to the Committee in the Commission, which shall be responsible
for the implementation of the ban on the bearing, carrying or transporting of
firearms and other deadly weapons, and the employment, availment or
engagement of security personnel, among others, and the rules and regulations on
the application for exemption therefor. It has the sole and exclusive power to issue
Certificates of Authority.
Page 7 of 47It shall be composed of a member of the Commission en banc as Representative of
the Commission and CBFSC Chairperson, and one Senior Officer of the AFP and
one Senior Officer of the PNP, not lower than Officer Grade 07, Brigadier General
or Police Brigadier General, respectively, as CBFSC Members.
It shall be assisted by the CBFSC Director, Deputy Director, the Operations
Division and Secretariat Division composed of representatives from the
Commission, as may be authorized/designated by the Commission en bane, with
representatives from the AFP and the PNP as members.
SECTION 5. Powers of the CBFSC. - The Commission, through the CBFSC, and
in accordance with the provisions of this Resolution, shall have the sole and
exclusive authority to:
a. Issue Certificates of Authority authorizing the:
i. bearing, carrying or transporting of firearms or other deadly
weapons; or
ii. employment, availment or engagement of the services of
security personnel or bodyguards; or
iii, transport or delivery of firearms and/or its parts, ammunition
and/or its components, and, explosives and/or its
components;
b. Review all actions undertaken by the RJSCCs; and
c. Confirm, amend, modify or revoke the TA-SD granted by the RJSCC.
SECTION 6. The Evaluation Units (EU) refer to the group of personnel directed
by the Commission, the PNP and the AFP, to evaluate applications and make
recommendations thereon and assist the CBFSC, respectively, in the resolution
thereof.
For this purpose, the Commission EU shall be composed of the selected lawyers
and staff of the Commission’s Law Department to be supervised by the Overall
Supervising Evaluator.
On the other hand, the PNP EU shall be composed of the personnel duly
designated by the Chief, PNP, or by the PNP Representative in the CBFSC, to be
composed preferably by officers and personnel from the Directorate for
Operations (DO), the Civil Security Group (CSG), particularly from the Firearms
and Explosives Office (FEO) and the Supervisory Office for Security and
Investigative Agencies (SOSIA), the Secretariat of the Permit to Carry Firearms
Outside of Residence (PTCFOR Secretariat) and the Police Security and Protection
Group (PSPG). It shall be under the direct control and supervision of the PNP
Representative to the CBFSC, and shall be the sole custodian of all information
related to PICFORs, firearms registration and other gun ban-related licenses and
Pages of 47permits issued by the PNP, as well as all data/information in relation to the said
agency.
The AFP EU shall be composed of the commissioned officers and non-
commissioned officers of the AFP duly designated by the Chief of Staff, AFP, or
the Deputy Chief of Staff for Operations (Q)3), or the AFP Representative to the
CBESC and thereafter, be under the direct control and supervision of the AFP
Representative to the CBFSC. It shall be the sole custodian of all information
related to firearms and personnel of the AFP, as well as all data/information in
relation to the said agency.
The PNP EU and AFP EU shall have its respective Team Leaders who shall have
the duty of ensuring the efficient and accurate processing of applications indorsed
by the CBFSC Secretariat and timely accomplishment of assigned tasks. The Team
Leaders shall have direct supervision over the PNP/AEP personnel assigned at
the CBFSC and shall be responsible for the following:
a. Distribution for evaluation of the applications for CA as received by
the CBFSC Secretariat to the different component-units, as the case
may be in accordance with their areas of jurisdiction;
b. Monitoring the timely release of all evaluated applications from the
respective concerned component-units of the PNP EU to the CBFSC
Secretariat in compliance with R.A. No. 11032 or the Ease of Doing
Business and Efficient Government Service Delivery Act of 2018;
¢. Monitoring of the different units and the shifting of its personnel;
d. Custody and safekeeping of all applications received by the Unit; and
e. Compliance with R.A. No. 10173 or the Data Privacy Act of 2012, as
implemented by the Data Privacy Management Program (DPMP) of
the Commission.
RULEIV
CERTIFICATE OF AUTHORITYAND ITS CATEGORIES
SECTION 7. Certificate of Authority (CA). - It refers to a certificate issued by the
CBFSC to qualified applicants giving them the authority during the Election
Period to:
a. Bear, carry or transport firearms or other deadly weapons;
b. Employ, avail or engage the services of security personnel or
bodyguards; and
Transport or delivery of firearms and/or its parts, ammunition and/or
its components, and, explosives and/or its components.
Page9 of 47SECTION 8. Validity of CA. - Any CA duly issued by the CBFSC in accordance
with this Resolution for purposes of the May 9, 2022 National and Local Elections
shall be valid from the date of issuance until June 8, 2022, unless:
a Earlier revoked by the CBFSC for the following reasons:
i. For any misrepresentation or false statement in the application
or its attachments, or submission of falsified documents;
ii, When the ground/s for which the CA was issued cease/s to
exist; and
iii, For such other grounds deemed appropriate by the CBFSC.
b. Ipso facto deemed null and void if the grantee violates or fails to comply
with the conditions for carrying of firearms or for transporting firearms,
ammunitions, explosives, and/or their respective parts or components,
as the case may be;
©. Any license or permit issued by the PNP and used in support of the
application for the corresponding CA is revoked, cancelled or
suspended by the Chief, PNP or his authorized representative; or
d. A different period of validity is prescribed by the CBFSC such as those
in TA-SD, CA-TTs and CA-DM for Foreign Security Personnel
ACA shall automatically become ineffective upon the expiration of any of the
applicable licenses, registrations, permits, including, but not limited to LCR, CFR,
PICFOR, LTOPF, MR, LO, MO, Property Acknowledgment Receipt
(PAR)/Acknowledgment Receipt for Equipment (ARE) and other pertinent
firearms documents,
SECTION 9. Categories of Certificates of Authority. - CAs are categorized as
follows:
a Certificate of Authority-Law Enforcement Agencies (CA-LEA) refers
to the CA issued to the PNP, AFP and other government departments,
agencies, offices, bureaus, commissions and tribunals, specifically limited to
and covering only personnel in the active regular plantilla of the said agencies,
performing law enforcement and/or security functions and/or election
duties and are receiving regular compensation for the said services rendered
therein, excluding consultants, part-time, temporary, contractual, casual or
job-order employees, or confidential agents (CAs), employees or personnel,
as well as those under contracts of service, whether or not receiving
compensation from the Government of the Republic of the Philippines for
services rendered,
Page 10 of 47b. Certificate of Authority-Diplomatic Mission (CA-DM) refers to the
CA issued to the security personnel of Foreign Diplomatic Corps, Missions
and Establishments under international law, including Foreign Military
Personnel in the Philippines covered by existing treaties and international
agreements endorsed by the Secretary of Foreign Affairs and the Heads of
Missions of foreign countries in the Philippines.
Certificate of Authority-Security Agencies (CA-SA) refers to the CA
ued to Private Security, Investigative and Protective Agencies.
d. Certificate of Authority-Cashiers/Disbursing Officers (CA-C/DO)
refers to the CA issued to cashiers/disbursing. officers of privately-owned
corporations/companies.
e Certificate of Authority- High-Risk Individual (CA-HRI) refers to the
CA issued to:
i, qualified official of the Government of the Republic of the
Philippines, who by the nature of his/her person, position, duty,
profession and/or office, is performing law enforcement and/or
security functions and/or election duties, and is thus considered as
High-Risk Individual; or
ii, qualified individual, who: (1) by the nature of his/her official
duties, profession, business or occupation, or (2) is under the Witness
Protection, Security and Benefit Program of the Department of Justice
ora similar official program of the Government of the Republic of the
Philippines, and deemed by the CBFSC, the Commission, the Chief of
the Philippine National Police (PNP) or the Chief of Staffof the Armed
Forces of the Philippines (AFP) as a High-Risk Individual. Former
Public officials are included in this category.
f£. Certificate of Authority-Security Detail (CA-SD) refers to the CA
issued to security details for public officials and private individuals.
8& Certificate of Authority-Transport (CA-TT) refers to the CA issued
for the transport or delivery of firearms and/or its parts, ammunition and/or
its components, and explosives and/or its components.
h, Certificate of Authority-Sports Shooters (CA-SS) refers to the CA
issued for the competitive sport shooters, excluding alien citizens or
foreigners, who will be participating in international classifier and qualifier
matches scheduled prior to the Election Period, in representation of their duly
registered organizations and/or the Philippines.

(CA-LEA)
SECTION 10.Who may Bear, Carry or Transport Firearms. - Regular officers,
members, and agents of the following agencies of the government who are
actually performing law enforcement and/or security functions and/or election
duties, may bear, carry or transport firearms during the election period:
a. The President of the Republic of the Philippines as the Commander-in-
Chief of the AFP and as Head of the Executive Department including the
PNP;
b. The Chairman, Commissioners, Executive Director, Deputy Executive
Directors, Directors and Lawyers employed by and holding office in the
Main Office of the Commission, Chiefs-of-Staff of the Offices of the
Chairman and Commissioners, Regional Election Directors, Assistant
Regional Election Directors, Provincial Election Supervisors, Regional
Election Attorneys and Election Officers, and Organic Security Officers
of the Commission;
¢. Officers and Non-Commissioned Officers of the PNP;
d. Commissioned Officers, Non-Commissioned Officers and Enlisted
Personnel of the AFP;
© Officers, Agents and Law Enforcement and Security Personnel of the
National Bureau of Investigation (NBI);
f. Officers and Members of the Bureau of Corrections (BuCor), Department
of Justice, and Provincial and City Jails;
8 Officers and Members of the Bureau of Jail Management and Penology
(BJMP);
h. Officers and Members of the (i) Intelligence Division, and (ii) Investigation
Division of the Intelligence and Investigation Service; and (iii) Customs
Police Division of the Enforcement and Security Service of the Bureau of
Customs (BoC);
i. Officers and Members of the Port Police Department, Philippine Ports
Authority (PPA);
j. Officers and Members of the Philippine Economic Zone Authority (PEZA)
Police Force;
k. Officers and Members of the Government Guard Units (GGUs) regulated
by the PNP under R.A. No. 5487;

Officers and Members of the Manila International Airport Authority
(MIAA) Police Force;
Officers and Members of the Law Enforcement Service of the Land
Transportation Office (LTO);
Officers and Members of the Philippine Coast Guard (PCG);
Officers and Members of the Internal Security Operations Group (IS0G) of
the Witness Protection, Security and Benefits Program of the Department

Members of the Internal Security Division of the Bureau of the Treasury
(BoT);
Officers and Members of the Internal Security of the Office of the Vice-
President; and
Other officers and members of departments /divisions/offices/units /
detachments performing law enforcement and/or security functions.
SECTION 11. Conditions for the CA-LEA. - The issuance or validity of the CA-
LEA shall be subject to the following conditions:
When in the possession of firearms, the members of the LEA are:
in the active regular plantilla of the said agencies and are receiving
regular compensation for the services rendered therein;
not consultants, part-time, temporary, contractual, casual or job-order
employees, or confidential agents (CAs), employees or personnel, as
well as those under contracts of service, whether or not receiving
compensation from the Government of the Republic of the Philippines
for services rendered;
if applicable, in the agency-prescribed uniform showing clearly and
legibly, at all times, his name, rank and serial number or, in case rank
and serial number are not applicable, displaying prominently the
agency-issued identification card showing clearly his name and
position, which shall remain visible at all times. However, in case of
officers or members of law enforcement agencies, the bearing and
carrying or transporting of firearms in civilian clothes shall be allowed
in the following circumstances:
(i) while conducting lawful intelligence or counter-intelligence
gathering activities;
(ii) during police emergencies;
(iii) in operations involving national security; and
(iv) in other similar legitimate covert police and/or security
operations requiring strict operational security and for reasons
of personnel safety.
Page 14 of a7d. duly authorized to possess firearm covered by a valid LTOPF, LCR, CER
or PAR/ARE and to carry the same outside of residence by virtue of a
valid, current and updated PTCFOR, LO or MO;
© in the actual performance of official law enforcement and/or security
duty and/or election duty, or are going to or returning from his/her
residence/dwelling/barracks or official station;
f bearing, carrying or transporting a maximum of two (2) firearms
indicated in his/her name in the Agency's Application Form and
List/Roster of Personnel; and
8 he/she must be in possession of the following
(i) Valid, updated and current LTOPF as may be applicable;
(ii) Valid, updated and current CFR and/or PAR/ARE, which
firearm is allowed under existing laws, rules and regulations
as assessed and evaluated by the Philippine National Police;
(iii) Valid, updated and current PTCFOR or LO or MO, as the case
may be; and
(iv) Other applicable/ pertinent firearms licenses/ registrations/
permits/ documents.
SECTION 12. Application Form and Documentary Requirements for CA-LEA. ~
Applicants for CA-LEA or their duly authorized representative must duly
accomplish and submit the following requirements:
a. CBESC Form No, 2022-01, signed by the Head of Agency;
b. CBFSC Form No, 2022A-01 indicating therein
i, the full names of the law enforcement or security personnel
with their corresponding rank/position;
ji, firearms description and registration data, including the
PAR/ARE with MO/LO for government issued firearms
and/or the CFR with PICFOR, for privately owned firearms;
and
¢ CBFSC Form No. 2022B-01with the colored 4”x5” picture and
description of the authorized uniform of the office, if applicable.
The Application Forms for Certificate of Authority, including the Data Privacy
Notice and Consent Form, must be duly accomplished, completely filled-up and
signed by the Applicant or the duly authorized Officer/Representative, and
properly Notarized, and filed in accordance with Rule XIV hereof.
SECTION 13. Law Enforcement Agencies as Custodian of the Pertinent
Information. - The above-mentioned law enforcement agencies, as custodian of
the pertinent information related to their office, shall maintain and keep a record

the Head of Agency or his duly authorized representative.
In the performance of its functions, the Law Department of this Commission may
officially request from the concerned agency a report related to the said list,

(CA-DM)
SECTION 14. Who may Bear, Carry or Transport Firearms. - Security Personnel
of Foreign Diplomatic Corps, Missions and Establishments under international
law, including Foreign Military Personnel in the Philippines covered by existing
treaties and international agreements endorsed by theSecretary of Foreign Affairs
and the Heads of Missions of foreign countries in the Philippines may bear, carry
or transport firearms during the election period
SECTION 15. Application Form and Documentary Requirements for CA-DM. -
Applicants for CA-DM or their duly authorized representative must duly
accomplish and submit the following requirements:
a CBFSC Form No. 2022-02 signed by Head/Lead of the Foreign
Diplomatic Corps, Missions and Establishments under international
law, and Foreign Military Personnel in the Philippines;
b. CBFSC Form No. 2022A-02 indicating therein
i, the full names of the security personnel with their
corresponding rank/ position;
ii. firearms description, and registration data, if applicable.
c. CBFSC Form No. 2022B-02with the colored 4”x5” picture and
description of the authorized uniform of the security personnel;
d. Letter of Endorsement from the Department of Foreign Affairs; and
©. Letter of Endorsement from the Head/Lead of the Foreign Diplomatic
Corps, Missions and Establishments under international law, and
Foreign Military Personnel in the Philippines.
The Application Forms for Certificate of Authority, including the Data
Privacy Notice and Consent Form, must be duly accomplished, completely filled-
up and signed by the Applicant or the duly authorized Officer/Representative,
and properly Notarized, and filed in accordance with Rule XIV hereof.
SECTION 16. Concerned Law Enforcement Agencies and Government/Foreign
Security Personnel Agencies as Custodian of the Pertinent Information. ~ The
concerned law enforcement and government/foreign security personnel agencies,

keep a record of the List of Officers and Personnel with theit Authorized Firearms
certified by the Head/Lead of the Foreign Diplomatic Corps, Missions and
Establishments under international law, and Foreign Military Personnel in the
Philippines or the duly authorized representative.
In the performance of its functions, the Law Department of this Commission may
officially request from theconcerned Head/Lead of the Foreign Diplomatic Corps,
Missions and Establishments under international law, and Foreign Military
Personnel in the Philippines report related to the said list.
RULEVIL
CERTIFICATE OF AUTHORITY-SECURITY AGENCIES (CA-SA)
SECTION 17. Who may Bear, Carry or Transport Firearms. - Members of the
Private Security Providers (PSSPs) may bear, carry or transport firearms, Provided,
‘That, when in the possession of firearms, they are:
a. active regular employees of the Agency and is receiving regular
compensation for the services rendered therein;
b. performing actual security functions, and not a consultant, part-time,
temporary, contractual, casual or job-order employee, or a confidential
agent, whether or not receiving compensation from the said agency for
services rendered;
c. in the agency-prescribed uniform, showing clearly and legibly, at all
times, his name, displaying prominently the _agency-issued
identification card, showing clearly the name and position, which shall
remain visible at all times;
d. _ in the exercise of their security functions and duties, are duly authorized
to possess the agency's firearm which must be covered by a valid,
current and updated Certificate of Firearm Registration (CFR) or
Property Acknowledgment Receipt (PAR)/Acknowledgment Receipt
for Equipment (ARE), as may be applicable, and other
applicable/pertinent firearms licenses/ _registrations/ _ permits/
documents as may be applicable;
e. in possession of a valid, updated and current License to Exercise
Security Profession (LESP) accompanied by a valid, updated and current
Duty Detail Order (DDO) or Special Duty Detail Order (SDDO) and/or
Monthly Disposition Report (MDR), as the case may be. Applicant is
obligated under this Resolution to update the CBPSC for any changes,
modifications, or amendments to the DDO, SDDO and MDR during the
validity of the issued CA;

regulations as assessed and evaluated by the Philippine National Police;
8 deployed by Private Security Agencies (PSAs), Private Detective
Agencies (PDAs), Company Security Units (CSUs), Government Guard
Units (GGUs), Private Security Canine Service Providers, Private
Security Training Institutes (PSTIs), or Private Security Industry and
Training Organizations duly licensed, authorized, recognized and/or
accredited by the Philippine National Police;
h. in the actual performance of security duty, at his duly designated and
specified place or area of duty; and
i, bearing, carrying, or transporting only one (1) firearm as indicated in
his/her name in the Agency's Application Form and List/Roster of
Personnel, unless otherwise allowed under existing laws, rules and
regulations,
SECTION 18.- Application Form and Documentary Requirements for CA-
SA. Applicants for CA-SA or their duly authorized representative must duly
accomplish and submit the following requirements:
a. CBFSC Form No. 2022-03;
b. CBFSC Form No. 2022A-03 indicating therein:
i the full names of the security personnel with their
corresponding rank/position;
ii, firearms description and registration data; and
iii, thesecurity personnels respective LESPs and DDOs.
©. CBFSC Form No. 2022B-03 with the colored 4”x5” picture and
description of the authorized uniform of the Agency;
d. Copy of the Agency’s valid and existing LTO and corresponding, CFRs;
e. Copy of the Agency’s valid Long Regular Registration and Certificate of
License to Own and Possess Firearm for Juridical Entity;
f, In case the applicant is a juridical entity (corporation/
partnership/agency), a duly notarized Board Resolution must be
attached to the application form, certifying the authority given to the
head of agency or corporation, or authorized representative/s to apply
for a CA-SA, in behalf of the company.
Each and every page of the application, including attachments, must be
numbered consecutively at the bottom right side.
Page 18 of a7An administrative processing fee in the amount of Fifty Pesos (P50.00) for
each security personnel included in the list shall be paid in accordance with
Section 57, Rule XVIII hereof. However, in no case shall the administrative
processing fee exceed Five Thousand Pesos (P5,000.00)
All applications for CA-SA must be filed in accordance with Rule XIV
hereof.
SECTION 19. Additional Guidelines for Private Security Services Providers. ~
The following rules shall be strictly observed by PSAs, PDAs and CGFs which
have been issued CA-SA:
a. The Authority shall be valid during the prescribed period and strictly
under the terms and conditions specified therein and automatically
becomes ineffective upon the expiration of any of the applicable licenses,
registrations, permits, CFR, PICFOR, LTOPF], MR, DDO, LESPLO, MO,
PAR, ARE and other pertinent firearms documents;
b. For single posting, thesecurity guard assigned is prohibited to transport
his/her firearm from his/her duty area to his/her dwelling;
c. Firearms may be stationed in armored trucks provided these are duly
licensed agency-issued firearms used in the regular course of business
of the security agencies and included in the application; and
d. In case of new posting or termination of posting which entail the
transport of firearms to the duty area or return of firearms to the security
agency's office, the security agency may be authorized to transport the
firearms on a one-time, one-way basis only upon prior application.
In this regard, applicant is obligated under this Resolution to update the
CBFSC for any changes, modifications, or amendments to the DDO, SDDO
and MDR during the validity of the issued CA,
RULE VIII
CERTIFICATE OF AUTHORITY- CASHIER/DISBURSING OFFICER
(CA-C/DO)
SECTION 20. Who may Bear, Carry or Transport Firearms. - Cashier or
Disbursing Officer who by nature of his/her duty, profession, business or
occupation as a cashier or disbursing officer is authorized to bear, carry or
transport firearm; Provided that, when bearing, carrying or transporting firearms,
he/she must be in the actual performance of his/her official duties, specifically
when transporting deposits, disbursing payrolls, or carrying large sums of money
or valuables and in possession of the following:

Certificate of Employment stating that he/she is currently employed
under the conditions stated in his/her application;
Other pertinent documents such as but not limited to financial
statements and ITR of the company/employer;
Company- or office-issued identification card showing his/her
photograph, designation, and signature;
Valid, updated and current License to Own and Possess Firearm
(LTOPF);
Valid, updated and current Certificate of Firearm Registration (CFR)
which firearm is allowed under existing laws, rules and regulations as
assessed and evaluated by the Philippine National Police;
Valid, updated and current Permit to Carry Firearm Outside of
Residence (PTCFOR) for privately owned firearms; and
Other applicable/ pertinent firearms licenses/ registrations/ permits/
documents.
In no instance shall the cashier or disbursing officer bear, carry or transport more
than (
1) smalll arms limited to handgun which must either be a revolver or a pistol.
SECTION 21. Application Form and Documentary Requirements for CA-
(0. - Applicants for CA-C/DO or their duly authorized representative must
duly accomplish and submit the following requirements:
a.

CBFSC Form No. 2022-04, signed by the Applicant Cashier or Disbursing
Officer, indicating therein, among others, his/her full name and the office
where he/she is employed or connected, with one (1) piece of Applicant's
2x2 photograph;
Certification of the employer under oath that the applicant is an employee
of the company and designated as cashier or disbursing officer or a
Certificate of Employment stating that he/she is currently employed under
the conditions stated in his/her application;
Certified true copy of Applicant's latest Income Tax Return;
Certified true copy of Company’s/Employer's latest Income Tax Return;
Description of and proof that the nature of his/her official duties,
Profession, business or occupation requires him/her to carry large sums of
money or valuables;
Company: or office-issued identification card showing his/her photograph,
designation, and signature; and

data, including Applicant’s LTOPF, and/or the CFR with PTCFOR, for
privately owned firearms.
An administrative processing fee in the amount of Five Hundred Pesos (PhP

All applications for CA-C/DO must be filed in accordance with Rule XIV hereof.
RULE IX
CERTIFICATE OF A UTHORITY-HIGH RISK INDIVIDUAL
(CA-HRI)
SECTION 22. Who may Bear, Carry or Transport Firearms. ~ The following are
considered as High-Risk Individuals and, thus, may bear, carry, or transport
firearms during election period:
a. Qualified official of the Government of the Republic of the Philippines,
who by the nature of his/her person, position, duty, profession and/or
office, is performing law enforcement and/or security functions and/or
election duties, to wi
i. The Vice-President of the Republic of the Philippines;
li, The Senate President and the Senators of the Republic of the
Philippines;
ili. The Speaker and Members of the House of Representatives;
iv. The Chief Justice of the Republic of the Philippines and the
Justices of the Supreme Court, the Court of Appeals, the
Sandiganbayan, and the Court of Tax Appeals; and the Judges
of the Regional Trial Courts and Municipal/ Metropolitan
/Circuit Trial Courts;
v. The Ombudsman and Deputy Ombudsmen;
vi. The Chairpersons and Commissioners of the Civil Service
Commission (CSC) and the Commission on Audit (COA);
vii, The Chairperson and Commissioners of the Commission on
Human Rights;
viii. (a) Commissioner and Deputy Commissioners; (b) Officers
and Members of the Law and Investigation Division; and (c)
Officers and Members of the Intelligence Division, Bureau of
Immigration (BI);
Page 21 of 47ix. (a) The Secretary, Undersecretaries, Assistant Secretaries of
the Department of the Interior and Local Government and the
(b) Internal Security of the Office of the Secretary of the
Interior and Local Government;
x. (a) The Secretary, Undersecretaries, Assistant Secretaries of the
Department of National Defense and (b) Internal Security of the
Office of the Secretary of National Defense;
xi, The Secretary, Undersecretaries, Assistant Secretaries,
Prosecutor General, Chief State Prosecutor, State Prosecutors,
and Prosecutors mentioned under R.A. No. 10071 of the
National Prosecution Service of the Department of Justice
(DO);
xii. Cabinet Secretaries;
xiii. The Solicitor-General of the Philippines;
xiv. The Investigators and Prosecutors of the Office of the
Ombudsman; and
xv. The Chief Public Attorney.
In no instance shall the government officials mentioned above bear,
carry or transport more than two (2) firearms.
Other qualified individuals, who by the nature of their official duties,
profession, business or occupation, or who are under the Witness
Protection, Security and Benefit Program of the Department of Justice or
a similar official program of the Government of the Republic of the
Philippines, and deemed by the CBFSC, the Commission, the Chief of
the Philippine National Police (PNP) or the Chief of Staff of the Armed
Forces of the Philippines (AFP) as High-Risk Individual. Former public
officials are included in this category.
The other qualified individuals or former public officials must be in
possession of the following when bearing, carrying or transporting
firearms:
i, Threat Assessment issued and certified by the Directorate for
Intelligence for the national level or the Regional Director of
the Police Regional Offices for the local level;
ii, Endorsement and/or Certification of the Chief, Philippine
National Police, stating that the Applicant is considered as
High-Risk;
iii, Valid, updated and current LTOPF;
iv. Valid, updated and current CFR which firearm is allowed
under existing laws, rules and regulations as assessed and
evaluated by the Philippine National Police;
Page 22 of 47v. Valid, updated and current PTCFOR for privately owned
firearms; and
vi, Other applicable/pertinent firearms —_licenses/
registrations/permits/ documents
In no instance shall the individuals under the category HRI (B) bear,
carry or transport more than (1) small arms limited to handgun which
must either be a revolver or a pistol.
SECTION 23. Application Form and Documentary Requirements for CA-HRI
under Section 22 (a). - Applicants for CA-HRI or their duly authorized
representative under Section 22 (a) must duly accomplish and submit the
following requirements:
a. For the Public Officials mentioned in Section 22 (a) (i-vii, except item iv):
i, CBFSC Form No. 2022-05PO, indicating therein, among others,
his/her full name, his/her position in the Government, and his/her
office and home address, email address, and his/her official
telephone/mobile phone numbers;
ii, One (1) piece 2x2 photograph of the applicant, affixed to the CBFSC
form;
iii, Certified true copy of Certificate of Appointment (for appointive
officials); and
iv. CBFSC Form 2022A-05PO with the firearms description and
registration data, including the PAR/ARE with MO/LO. for
government issued firearms and/or the CFR with PTCFOR, for
privately owned firearms.
For Justices and Judges mentioned in Section 22 (a) (iv), in lieu of the above
documentary requirements, the Office of the Court Administrator (OCA)
shall endorse to the CBFSC a certified list of justices and judges who wish to
apply for aCA (Annex “ A”). Thereafter, the CBFSC shall transmit to the OCA
all issued CAs for distribution to the concerned Justices and Judges.
b. For the Public Officials mentioned under Section 22 (a) (viii-xv, except
item xi):
a, CBFSC Form No. 2022-05PO2, signed by the applicant public
official, indicating therein, among others, his full name, his position
in the government, and his office and home address;
b, One (1) piece 2x2 photograph of the applicant attached to the
CBESC form;

officials);
d. CBESC Form No. 2022A-05PO2 with the firearms description and
registration data, including the PAR/ARE with MO/LO for
government issued firearms and/or the CFR with PTCFOR, for
privately owned firearms; and
©. Copies of the other applicable registrations, licenses and permits as
may be applicable.
For Section 22 (a) (xi), in lieu of the above documentary requirements, the
DOJ, through its authorized officers, shall endorse to the CBFSC a certified
list of Public Prosecutors who intend to apply for a CA (attach with the
Application as Annex “ A”). Thereafter, the CBFSC shall transmit to the DO},
through its authorized officers, all issued CAs for distribution to the
concerned prosecutors
SECTION 24. Application Form and Documentary Requirements for CA-HRI
under Section 22 (b). - Applicants for CA-HRI or their duly authorized
representative under Section 22 (b) must duly accomplish and submit the
following requirements:
a, CBFSC Form No. 2022-050QI, signed by the Applicant, indicating
therein, among others, his/her full name and the office where he/she is.
employed or connected, with one (1) piece of Applicant's 2x2
photograph;
b. Certificate of Employment stating that he/she is currently employed
under the conditions stated in his application;
¢. Description of and proof that the nature of his official duties, profession,
business or occupation putting Applicant at high-risk;
d. Company or office-issued identification card showing his photograph,
designation, and signature, if any;
e. CBFSC Form No. 2022A-050QI with the firearms description and
registration data, including Applicant’s LTOPF, the LCR with MO/LO
for government issued firearms and/or the CFR with PTCFOR, for
privately owned firearms;
f, Threat Assessment issued and certified by the Directorate for
Intelligence for the national level or the Regional Director of the Police
Regional Offices for the local level; and
& Endorsement and/or Certification of the Chief, Philippine National
Police, stating that the Applicant is considered under High-Risk.

CERTIFICATE OF AUTHORITY-SECURITY DETAIL
(CA-SD)
SECTION 25. Revocation of Authority Granting Security Personnel. ~ All existing
authority granting security personnel or bodyguards are hereby automatically
revoked at the start of the Election Period.
SECTION 26. Retention of Services of Security Personnel or Bodyguards. ~ The
authority granted to or the services of those constituting the duly engaged or
appointed regular security personnel or complement of the President, Vice
President, Senate President, Speaker of the House of Representatives, Chief Justice
of the Supreme Court, Secretary of National Defense, Secretary of the Interior and
Local Government, Chairman and Commissioners of the Commission on
Elections, Chief of Staff of the AFP and AFP Major Service Commanders, and Chief
and Senior Officers of the PNP, shall subsist pursuant to their respective existing
authorizations or engagements.
Senators, Members of the House of Representatives, Provincial Governor, and
Justices, Judges and Cabinet Secretaries, whose regular security complement have
been provided by the PNP, AFP, NBI or other government law enforcement
agencies for at least one (1) year at the time of the promulgation of this Resolution,
may be allowed to retain the services of their currently detailed officers or
members of said government law enforcement agencies, with a maximum of two
(2) security details accompanying the said public officers at any given time.
When issued with a CA, the holder shall secure endorsement and approval of the
exemption from the appropriate law enforcement agency such as the Police
Security and Protection Group (PSPG).
SECTION 27. Augmentation of Security Personnel or Bodyguards. -
Notwithstanding the immediately preceding, section, the public officials or
persons mentioned therein, and when the circumstances warrant, may apply with
the CBFSC for CA-SD for two (2) additional security personnel or bodyguards, or
such additional number of security personnel or bodyguards as the CBESC may
deem appropriate under the circumstances, from a duly licensed private security
service provider. In such a case, applicant shall comply with the documentary
requirements enumerated in this Resolution for applications for CA-SD with
respect to the additional security personnel or bodyguard.
Page 25 of 47SECTION 28.Who May Employ, Avail or Engage the Services of Security
Personnel or Bodyguards. - When circumstances warrant, including but not
limited to threats to their life and security, the following persons who are not
mentioned in Section 26 of this Resolution and allowed to employ, avail or engage
the services of two (2) or more officers or members of the PNP/AFP; Provided, That,
the PNP/AFP allowed or authorized the same, or two (2) private security
Personnel or bodyguards during the Election Period from duly licensed private
security service providers:
a. Incumbent publie officials, whether elected or appointed; and
b. Private individuals.
The limit notwithstanding, an application for additional private security personnel
may be approved by the CBFSC when the circumstances warrant
SECTION 29. Documentary Requirements for Authority to Employ, Avail or
Engage Services of Security Personnel or Bodyguards. - For Applications for CA-
SD, the following documents, duly accomplished, completely filled-up and signed
and properly notarized, or certified as true copy of the original on file, are
required:
a. CBFSC Form No. 2022-06, signed by the applicant and stating therein,
among others, his full name, his position in the Government if he is a
public officer, and his address;
b. One (1) piece 2x2 photograph of the applicant attached to the CBFSC
form;
¢. Threat assessment or such document to support the existence of threat,
ifany;
d. Either CBFSC Form No. 2022A-06SPas certified by the Agency
intending to provide the security detail/s, indicating therein:
i. The name and contact number of the private security service
provider which the proposed private security personnel is
affiliated;
ii, The names of at most two proposed qualified private security
personnel with their corresponding rank/position, their
respective Licenses to Exercise Security Profession (LESPs)
and DDO/SDDO, as may be appropriate;
iii, Description of the firearms and firearms registration data;
iv. Copy of the CA-SA of the private security service provider
where the proposed private security personnel is/are
affiliated and the names of the security personnel are included
in the roster of personnel submitted to the CBFSC.
Page 26 of a7or CBFSC Form No. 2022A-06DA as certified by the concerned
government Agency, i.e. PNP through the PSPG, intending to provide
the security detail/s, indicating therein:
1 The name and contact number of concerned government
agency where the proposed protective security personnel
(PSP) is assigned;
ii, The names of proposed PSP with corresponding ranks, if
known to the applicant;
iii, Description of the firearms and firearms registration data of
the proposed PSP;
iv. Copy of the CA-LEA where the proposed PSP is/are a:
signed
b. CBFSC Form No. 2022B-06with the colored 4”x5” picture and
description of the authorized uniform of the Agency.
Each and every page of the application, including attachments, must be numbered
consecutively at the bottom right side.
An administrative processing fee in the amount of Five Hundred Pesos (PhP
500.00) shall be paid in accordance with Section 57, Rule XVIII hereof, Additional
security shall be assessed an additional administrative processing fee of Five
Hundred Pesos (P 500.00) for every application.
SECTION 30. Who May File the Application and the Documentary Requirements
for Authority to Employ, Avail or Engage the Services of Security Personnel. - The
applicant personally or his duly authorized representative may submit the duly
accomplished application form and documentary requirements for a CA-SD.
SECTION 31. Electronic Filing of Applications and Submission of Documentary
Requirements for Authority to Employ, Avail or Engage the Services of Security
Personnel or Bodyguards. - All applications for CA-SD must be filed in accordance
with Rule XIV hereof.
SECTION 32. Temporary Authority to employ, avail or engage the Services of
Security Detail, Personnel or Bodyguards (TA-SD). ~ Applicants for CA-SD may,
at the same time, request for the issuance of a Temporary Authority to employ,
avail or engage the Services of Security Detail, Personnel or Bodyguards (TA-SD)
SECTION 33. Procedure and guidelines for processing applications for Issuance of
Temporary Authority to employ, avail or engage the Services of Security Detail,
Personnel or Bodyguards. - The following guidelines and procedure shall be
observed in the processing of applications for CA-SD with request for TA-SD:
Page 27 of 47a, Immediately upon receipt of the application for CA-SD with
request for the issuance of a TA-SD, the CBFSC Secretariat shall
notify thru email the RISCC concerned regarding the request.
b. The RJSCC shall, within three (3) days from receipt of the email
from the CBFSC Secretariat informing that such request has been
filed, act on the request taking into consideration the documents
submitted. Based on its evaluation/assessment, the RJSCC, may
issue, for one-time only, a thirty (30)-day Temporary Authority for
Security Detail (TA-SD).
¢. In issuing a TA-SD, the RJSCC shall, as far as practicable, ensure
that the security personnel assigned to the applicant shall be from
@ unit, agency, company or office based in the city, municipality,
district, or province where the applicant resides or works, as
indicated in his application.
d. The personnel assigned as security personnel or bodyguard to an
applicant under @ TA-SD shall be subject to the same requirements
and conditions with respect to the wearing of uniforms and
carrying of Firearms or Deadly Weapons imposed in this
Resolution.
©. The processing of the request for TA-SD by the RJSCC shall not toll
the processing and evaluation of the main application for CA-SD
by CBFSC,
f, Incase no CA-SD is issued by the CBFSC after the expiration of the
TA-SD or if the application is denied by the CBFSC within the 30-
day validity of the TA-SD, all security personnel temporarily
detailed to the applicant shall be deemed recalled.
8 No request for extension of validity of TA-SD shall be
entertained. The RJSCC has no authority to extend the validity of
the TA-SD, or grant another TA-SD for the same applicant.
Administrative charges shall be filed against those found
violating this provision.
h. Ifatany time the ground/s for which the TA-SD was issued cease/s
to exist, or for other just cause, the RISCC may revoke the TA-SD.
SECTION 34. Guiding Principles for the Employment, Availment or Engagement
of Services of Security Personnel or Bodyguards. ~The following rules must be
Page 28 of 47strictly observed by the security personnel or bodyguards, whether those retained
under Section 26 of this Resolution or engaged under a duly issued CA-SD:
a.
an active regular employee of the said agency and is receiving regular
compensation for the services rendered therein;
not a consultant, part-time, temporary, contractual, casual or job-order
employee, or a confidential agent, whether or not receiving
compensation from the said agency for services rendered;
if applicable, in the Agency's prescribed uniform showing clearly and
legibly, atall times, his name, displaying prominently the agency-issued
identification card, showing clearly the name and position, which shall
remain visible at all times. However, in case of members of law
enforcement agencies, they may be exempted from wearing the agency's
prescribed uniform in accordance with the conditions set in this
Resolution;
in possession of a valid, updated and current License to Exercise
Security Profession (LESP) accompanied by a valid, updated and current
Duty Detail Order (DDO) or Special Duty Detail Order (SDDO) or
License to Own and Possess Firearm (LTOPE) as the case may be;
duly authorized to possess the agency's firearm covered by a valid,
current and updated Certificate of Firearm Registration (CFR) or
Property Acknowledgment Receipt (PAR)/Acknowledgment Receipt
for Equipment (ARE) and to carry the same outside of residence by
virtue of a valid, updated and current Permit to Carry Firearms Outside
of Residence (PTCFOR)/Letter Order (LO)/Mission Order (MO), and
Other applicable/pertinent firearms licenses/ registrations/ permits/
documents as may be applicable;
in the possession of one (1) small firearm as indicated in his/her name
in the Agency's Application Form and List/Roster of Personnel, and
allowed under existing laws, rules and regulations as assessed and
evaluated by the Philippine National Police;
deployed by Private Security Agencies (PSAs), Private Detective
Agencies (PDAs), Company Security Units (CSUs), Government Guard
Units (GGUs), Private Security Canine Service Providers, Private
Security Training Institutes (PSTIs), or Private Security Industry and
Training Organizations duly licensed, authorized, recognized and/or
accredited by the Philippine National Police, which must have first
secured its own Certificate of Authority-Security Agency (CA-SA) from
the CBFSC prior to the said deployment;
in the actual performance of law enforcement or security duties;
Page 29 of 47i. the security personnel or bodyguard must be employed by a duly
licensed private security service provider and is qualified to perform or
provide personal security protection to private persons or individuals
entitled to protection and in possession of the appropriate licenses,
certifications and authorities as may be applicable;
j when the security personnel is/are provided by the PNP, AFP, NBL, or
other law enforcement agencies, the application must be endorsed by
the PNP Regional Director and approved by the Police Security and
Protection Group (PSPG), or by the proper office or agency. When
applicable, the retained security personnel/ bodyguard/ protection
agent from government law enforcement agencies has been detailed to
the applicant a year before the 2022NLE, or not later than May 9, 2021;
and
k. when issued with a CA, the security personnel or bodyguards, whether
those retained under Section 26 of this Rule or engaged under a duly
issued CA-SD shall secure valid and existing applicable permits and
licenses.
The CA-SD automatically becomes ineffective upon the expiration of any of the
applicable licenses, registrations, permits, CFR, PTCFOR, LTOPE, MR, LO, MO,
Property Acknowledgment Receipt/ Acknowledgment Receipt for Equipment (as
may be applicable) and other pertinent firearms documents.
The Authority shall be automatically revoked when the ground for which the
authority to engage the services of security personnel ceases to exist or for any
lawful and valid cause, as may be determined by CBFSC; and
The Authority shall be valid during the prescribed period, strictly under these
foregoing terms and conditions.
RULE XI
CERTIFICATE OF AUTHORITY-TRANSPORT
(CA-TT)
SECTION 35. Who May be Allowed to Transport or Deliver Firearms and/or its
Parts, Ammunitions andor its Components, or Explosives and/or its Components
or Controlled Chemicals. - Entities engaged in, and duly licensed by the
appropriate government agency to, transport, manufacture, import, export,
Purchase, deal in or sell firearms, ammunitions, explosives and/or their respective
parts or components, and other qualified individuals may be issued a CA-TT and
allowed to transport or deliver firearms and/or its parts, ammunition and/or its
components or explosives and/or its components during the Election Period.
Page 30 of 47As regards firearms, only its major parts as defined under Rule 1, Section 1 (@
hereof shall be covered under this Rule.
SECTION 36. Accreditation of duly registered entities engaged in, and duly
licensed by the appropriate Government agency to, transport, manufacture,
import, export, purchase, deal in or sell Firearms, Ammunitions, Explosives and
the Creation of an Official Registry therefor. - To facilitate and more effectively
Process applications and reduce the repetitive submission of documentary
requirements, duly licensed/accredited/registered ENTITIES engaged in, and
duly licensed by the appropriate Government agency to, transport, manufacture,
import, export, purchase, deal in or sell Firearms, Ammunitions, Explosives
and/or their respective parts or components may apply for accreditation before
the CBFSC by proving their qualifications of large-scale frequent operation and/or
status as major industry stakeholder through the one-time submission. of
documents competent, including, but not limited to the following;
a. Certified True Copies of License/s to Operate and other Licenses,
Registrations, Certifications and Certifications in relation thereto as
issued by the PNP;
b. Certified True Copy of Security and Exchange Registration (SEC) for
corporations or the Department of Trade and Industry (DTI) for sole
proprietorships;
© Certified True Copy of Business Permit (or equivalent document) issued
by the Local Government Unit having jurisdiction of the principal place
of business of the Company;
d. Certified True Copies of Audited Financial Statements (AFS) and
Income Tax Returns (ITR) for 2020 and 2019 stamped received by the
Bureau of Internal Revenue (BIR);
©. Certified True Copy of a valid Tax Clearance per E.O. No. 398, Series of
2005;
f Certified True Copies of Government or Private Contracts evidencing
the large/ frequent operation of the entity;
8 Endorsement and Certification as a large-scale frequent operation
and/or status as major industry stakeholder from the FEO;
h. Certificate of no past or pending case with FEO;
i. Affidavit of no involvement on pending investigations or cases in other
government agencies; and
Page 31 of a7j. Duly notarized Board Resolution certifying the authority given to the
head of agency, corporation or the authorized representative/s to apply
for a CA-TT, in behalf of the company.
An accreditation fee in the amount of One Thousand Pesos (PhP 1,000.00) shall be
paid.
Given the exigencies of public service, the schedule of the CBFSC permitting, and
strictly subject to the due submission of all the requirements and valid documents
by the applicant, preferential attention shall be accorded to applications for
Certificate of Authority concerning deliveries of firearms & its parts, ammunitions
& its components and/or explosives & its components to government agencies
and instrumentalities procured under the Government Procurement Reform Act
SECTION 37. Documentary Requirements for the Issuance of CA-TT. - All
Applications for CA-TT or authority to transport or deliver firearms and/or its
Parts, ammunition and/or its components, or explosives and/or its components
during the Blection Period shall include the following documents, duly
accomplished, completely-filled-up and signed and properly notarized, or
certified true copy of the original on file, as the case may be:
a. CBFSC Form No. 2022-07 stating therein, among others, the full name of
the applicant and its principal office address, and the name of its duly
authorized representative;
b. CBESC Form No. 2022A-07 roster;
© Incase the applicant is a juridical entity (corporation/ partnership, etc)
and if not accredited in accordance with Section 36 hereof, a duly
notarized Board Resolution must be attached to the application form,
certifying the authority given to the head of agency, corporation or the
authorized representative/s to apply for a CA-IT in behalf of the
company,
For sole proprietorship, applicant should submit a copy of the DTI
Certification or Mayor's Permit.
d. Original Permit to Transport (PTT) issued by the FEO, CSG, PNP, with
Indorsement from the appropriate officer of the FEO;
©. Copy of radio message, if applicable; and
f. Copy of SBR from the PNP.

SECTION 39. Electronic Filing of Applications and Documentary Requirements

SECTION 40. Conditions of CA-TT. -
ns for CA-TT must be filed in accordance with Rule XIV
The following are conditions for the
issuance of a CA-TT during the Election Period:
a. The CA-TT shalll be valid during the prescribed period and shall provide
the terms and conditions of its grant, strictly on a one-way basis. The
validity of the Authority may be extended for a period equal to the
period reflected in the new permit issued by the PNP after submission
of the following:
i, Letter-request stating the reasons thereof;
ii, Original copy of the new permit issued by the PNP; and
iii, Payment of fee for extension of validity of CA-TT.
b. In the case of explosives and/or its components, the same shall be
immediately transported with a police escort by the applicant/grantee
or its representative, directly to the explosives magazine/storage facility
of the licensed requesting party;
c. In the case of firearms and/or its parts, and ammunition and/or its
components, the same shall be immediately transported by the
