CHILD AT RISK (CAR) AND CHILD IN CONFLICT WITH THE LAW (CICL)
DIVERSION PROGRAM

Whereas, the Barangay Council for the Protection of Children of Barangay Artacho,
Bautista, Pangansinan is hereby enjoined to adopt and utilize the “Barangay Protocol in
Managing Cases of Children at Risk and Children in Conflict with the Law” pursuant to
Department of Interior Local Government Memorandum Circular No, 2017-43 subject to
“Adoption of the Barangay Protocol in Managing Cases of Children at Risk and Children
in Conflict with the Law. That, the provided manual for the said Barangay Protocol has
been studied, placed and already implementing;

Whereas, Republic Act No. 9344 “An act establishing a comprehensive Juvenile Justice
and Welfare System, Creating the Juvenile Justice and Welfare Council under the
Department of Justice, Appropriating Funds and for other purposes” or known as the
“Juvenile Justice and Welfare Act,” states in Chapter 2, section 23 System of Diversion -
Children in conflict with the law shall undergo diversion programs without undergoing
court proceedings subject to the conditions provided in (a) (b);

Whereas, Section 24 of the Act or Stages Where Diversion May be conducted states that
Diversion may be conducted at the Katarungang Pambarangay, the police investigation
or the inquest or preliminary investigation stage and at all levels and phases of the
proceedings including judicial level;

Whereas, Section 27 of the said Act or Duty of the Punong Barangay When There is no
Diversion states that if the offense does not fall under Section 23 (a) (b), or if the child,
his/her parents or guardian does not consent to a diversion, the Punong Barangay
handling the case shall, within three (3) days from determination of the absence of
jurisdiction over the case or termination of the diversion;

Wherefore, there is a need to enhance the Protocol in Handling CAR and CICL cases in
Barangay through establishment of Barangay Diversion Program to effectively implement
the said protocol;

NOW THEREFORE, the Barangay Council for the Protection of Children with the
approval of Sangguniang Barangay of Artacho is now establishing
and effectively implement the following Diversion Program;

a. Restitution of Property
b. Reparation of the Damage Causes
c. Indemnification for Consequential Damages;
d. Written of Oral Apology;
e. Care, Guidance and Supervision Orders;

f. Counseling for the Child Conflict with the Law and the Child’s family;
g. Attendance in trainings, seminars and lectures on;
g.1. Anger management skills
g.2. Problem solving and/or conflict resolution skills
g.3. Values formation; and
g.4. Other skills which will aid the child in dealing with situations which lead to
repetition of the offense;
