DEED OF ASSIGNMENT
KNOW ALL MEN BY THESE PRESENTS:
This Deed of Assignment (Deed), made and entered into this
16th of October 2022, at Quezon City, Philippines, by and
between:
JUANITO S. FABILA, SR., of legal age, married, Filipino,
with residence and postal address at Block 7 Lot 6
Violago Subdivision, Bagong Silangan, Quezon City,
hereinafter referred to as “the ASSIGNOR”;
-and-
RIZALDE C. PEREZ, of legal age, Filipino, with residence
and postal address at _________________________
hereinafter referred to as “the ASSIGNEE”;
WITNESSETH that -
WHEREAS the ASSIGNOR is the owner of the following
personal property described to wit:
Ten (10) bars of 99.99% gold weighing 74.6 kilograms
each, valued at Php3,500.00 per gram
Ten (10) bars of 99.99% gold weighing 6.2 kilograms
each, valued at Php3,500.00 per gram
WHEREAS, the ASSIGNOR has offered to assign all his rights,
title and interest over the above-stated gold bars, and the
ASSIGNEE hereby accepts the assignment in accordance with
the terms herein set forth;
NOW, THEREFORE, for and in consideration of the foregoing
premises and the sum of Two Billion Eight Hundred Twenty
Eight Million PESOS (Php2,828,000,000.00), Philippine
Currency, which the ASSIGNOR hereby acknowledge to have
received from the ASSIGNEE, the ASSIGNOR
hereby ASSIGNS, TRANSFER and CONVEYS unto the
ASSIGNEE, all his rights, title and interest to the
aforementioned personal property and and appurtenant
interest and civil fruits in the said personal property pursuant
to this Deed.
The ASSIGNEE by these presents hereby accepts the
assignment and agrees to be bound by the terms and
conditions of this Deed and the rules and regulations, and
restrictions pertaining to the said personal property, it being
understood The ASSIGNEE shall have the full and absolute
control of said personal property and by virtue of this Deed is
fully authorized and empowered to enter into any legal
transactions, sign and/or execute documents involving the
said real property.
Except for gross negligence or conduct amounting to fraud,
the ASSIGNOR hereby undertakes to hold the ASSIGNEE free
and harmless from liability for any action taken on the basis of
and within the framework of this power of attorney, and
hereby ratifies and confirms all that the ASSIGNEE may do or
cause to be done pursuant thereto and hereto.
IN WITNESS WHEREOF, the parties have hereunto set their
hands on the date and place first above written.
