Schedule (6)

Commercial Complex conditions as per Municipal Council decree no. (172/7/2008/ ‫ر و‬/ ‫ )م ب‬dated
5/5/2008.

First: commercial complex inside and outside Kuwait:

Introduction: the buildings used commercially that can be leased or owned, they can be adjacent or a
building with many floors. The area specified for the complex inside Kuwait city shall not be less than
2000 m2 and outside by 3000 m2.

FAR:

The maximum total building area in the region where the complex is constructed in addition to the
following F.A.R:

 Inside Kuwait City:


To add 50% of the plot area in regard to the ratio applied in the area, while this ratio include all the
buildings including all services (the ground floor is 100%)
 Outside Kuwait City:
1) To add 30% of the plot area for the ratio applied in the area, such that the commercial
area for each floor does not exceed 50% of the plot area including all services.
2) The commercial area mentioned above is repeated in the basement and the basement area
is not included in the FAR.
3) The commercial area mentioned above is repeated in the mezzanine and the mezzanine
area is not included in the FAR.
4) The stairs and lobby area is not included in the FAR starting from the first floor and
above, conditioned it does not exceed 15% of the units area.
5) The spaces specified for the elevators, drainage services, mechanical, electrical and PH
services, and lobbies are not included within the FAR.
6) To provide WC for men and women suitable for the number of stores but shall not exceed
3% of the commercial area. To consider providing 1 bathroom for special needs.
7) It is possible to provide more than 1 basement such that the second one is used for car
parking, and if the first basement is sued for car parking, it is required to add a second
mezzanine that is not included in the total area.
8) To provide security room with it services and does not exceed 25 m2.

Second: Setting back inside and outside Kuwait City:

1) To construct the building on the land proposed conditioned providing a liwan on the commercial
street (3m, 4m width) as per specified by the municipality for the complexes inside Kuwait city,
and (3m width) for the complexes outside Kuwait city. As for the sideways (Othman and Ibn
Khaldoun streets) it is required to set back from the street with 3m. The liwan flooring height shall
not exceed 20cm from the pavement level.
2) To consider what is mentioned above, if the main street and sideway meets, it is possible to
provide stores conditioned providing liwan (3.0 m width).
3) To provide repeated floors starting from the first floor, while setting back shall not be less than
5.00m from other sides, (outside Kuwait city).
Third: Building Height:

The building height is calculated from the average pavement level surrounding the services streets:

A. Inside Kuwait:
o Maximum building height is (240 m2) for (60 floors) starting from the ground floor for the plots
(2000 m2) and less than 6000m2.
o Maximum building height is (320 m2) for (80 floors) starting from the ground floor for the plots
(6000 m2) and less than 9000m2.
o Maximum building height is (400 m2) for (100 floors) starting from the ground floor for the plots
9000 m2 and more.
B. Outside Kuwait:
o Maximum building height is (160m) for (40 floors).
o To obtain civil aviation approval for building heights.
o The ground floor and mezzanine are included in the heights as 1 floor and the liwan shall
be with the same height.
o Maximum height for the ground floor and mezzanine shall be 10m inside and outside
Kuwait city conditioned that the height of the ground floor only does not exceed 6.0m
and the mezzanine height does not exceed 4.0m.
o Minimum net height for each floor is 3m and maximum is 4.50m.
o It is allowed that the stairs exceed maximum building height, conditioned not exceeding
3.0m, including roof staircase.
o Maximum height of roof fence is 2.5m
o Maximum basement height over organizational level of the plot is 1.5m.
o Minimum net height for each basement is 2.75m and maximum is 4.50m.
o Water tanks and AC units on the roof shall be covered, as well as AC units located on
elevations in beautifying shape.
o Building height is the distance between pavement level averages for services roads that
are higher to last floor roof level.
o Each floor height is the distance between each floor tiling level to the level of floor tiling
that follows it.
o It is allowed for buildings of 20 floors or more, starting from first floor to specify 1 floor
for mechanical services, and add another services floor for other 10 floors.

Fourth Areas Distribution:


1) Minimum net area for the store is 12m2 and not less than 3.0m width.
2) Minimum net area for the office and its services shall not be less than 30m2.
3) Minimum net services passages width is 2.00m.

Fifth – stairs

Sixth – security stairs

Seventh – extensions

Eighth – opened balconies

Ninth - shafts

Tenth – canopies

Eleventh - mezzanine

Twelfth – ancillaries
Thirteenth – basement

Fourteenth – elevators

Fifteenth – special needs:

As per mentioned in schedule No. 3 specified for the conditions specified for commercial buildings inside
and outside Kuwait city.

Sixteenth – Car parking:

1) It is required to provide 1 car parking for each 50m2 (shops).


2) It is required to provide 1 car parking for each 60m2(offices) .
3) To provide 1 floor or more for car parking and are included in the FAR.
4) The dimensions (2.50m x 5.50m).
5) If the car parking area exceeds 100% of the estate area outside the city and no parking are
provided for the building, it is possible to use the government property after obtaining approval for
providing basement for this purpose. The client shall pay all fees and is responsible for
maintenance for 2 years as per the contract held with the government.
6) If the car parking area exceeds 200% of the estate area inside the city and no parking are provided
for the building, it is possible to use the government property after obtaining approval for
providing basement for this purpose. The client shall pay all fees and is responsible for
maintenance for 2 years as per the contract held with the government.
7) To obtain the concerned authorities approval.

Seventeenth – as per mentioned in the schedule N0. 3 specified for the conditions specified for commercial
buildings inside and outside Kuwait city.
