1. The Mortgagor/s admitted, acknowledged and confirmed the creation of
mortgage by deposit of title deeds relating to the mortgaged properties
on 30.01.2015 at RASMEC , Shivamogga (Date of original deposit).
2. The Mortgagor/s has further declared that the benefit of the aforesaid
mortgage shall also continue and be available and secured for the afore-
mentioned enhanced portion of the limits / additional facility/s comprising
the enhanced mortgaged debt and for discharge of all indebtedness and
liabilities of the Borrower to the Bank together with all interest, discount,
commission, costs, charges, and expenses until the same shall have been
paid and satisfied in full.
3. The Mortgagor/s on…………….(date of deposit of additional property)
have also delivered to and deposited with the Bank's authorised officer
the additional title deeds relating to Schedule B properties with intent to
create security by way of equitable mortgage in favour of the Bank not
only for securing the due repayment of the original mortgage debt but
also for the due repayment of the enhanced limits and/or the additional
facilities comprised in the enhanced mortgage debt granted or agreed to
be granted by the Bank and for all interest, costs, charges, expenses until
the same shall have been paid and satisfied in full by the Borrower/s.
4. Consequent to the grant of above enhanced mortgage debt, the Mort-
gagor/s have further confirmed that the benefit of the mortgage/s on the
Schedule A and B properties shall also apply for, stand extended to and
cover the enhanced mortgage debt and also for discharge of all other lia-
bilities and indebtedness together with all interest, discount, commission,
costs, charges by the Borrowers to the Bank.
5.The Mortgagor/s confirmed that the mortgage/s shall subsist notwith-
standing the granting of totally new limits, facilities or account/s coming
into credit or inter-changeability of limits, cancellation of certain limits,
etc.
6.The Mortgagor/s confirmed that no proceedings for recovery of any
statutory dues, taxes, etc. are being initiated nor were initiated in the past
nor any proceeding or levy or tax is pending against the Mortgagor/s un-
der the Income Tax Act, 1961 or the Sales Tax Laws, and that no notice
has been issued / or served on the Mortgagor/s under Rules 2, 16 or 51 or
any other Rules of the Second Schedule to the Income Tax Act, 1961, or
under any other law for the time being in force.

MEMORANDUM RELATING TO DEPOSIT OF TITLE DEEDS
This Memorandum executed on this Twenty first day of September
Two Thousand Twenty Four (21.09.2024), by Sri Khaleel UR Ra-
haman T F s/o s/o Fazallur Rahaman Turnur (PAN : BBZPK6159H
),situated at Plot no E 103 , Gopalagowda Badavane , Shivamogga -
577205
(hereinafter called as the “Mortgagor/s” which term shall include his/her/
their heirs, executors, legal representatives and administrators or succes-
sors and assigns or each of the partners from time to time and their re-
spective heirs, executors, legal representatives, administrators and as-
signs, as the case may be)
IN FAVOUR OF STATE BANK OF INDIA, constituted under State Bank
of India Act, 1955 having one of its Local head office at # 65, St.Mark’s
Road, Bangalore 560001 and carrying on business in banking among
other places at Gopal Gowda Extension Branch (hereinafter called as
“Mortgagee” which expression include its successors and assigns.
The Mortgagors have deposited on 30.01.2015 at RASMEC ,
Shivamogga , the documents of title mentioned in the Schedule-I
hereunder relating to his / her / their / firm’s / company’s property /
properties described in Schedule –II (hereinafter referred to as the
“Schedule property”) with the Mortgagee with intent to create
security/mortgage by deposit of title deeds in favour of Mortgagee over
the title deeds of the Schedule property for the purpose of securing
repayment to the Mortgagee of all the amounts owing to the Mortgagee
under advances made and to be made from time to time to the Mortgagor
/s by the by way of any loan / cash credit / overdraft / any other credit
facilities not exceeding / aggregating to Rs.75,00,000 (Rupees Seventy
five lakhs only ) together with interest, costs, charges thereon and also
to secure all other indebtedness of the Mortgagor/s to the Mortgagee that
may arise in the future and shall remain deposited with the mortgagee till
such indebtedness remains due and payable.
The Mortgagor/s agree whenever requested by the Mortgagee at
his/her/their own cost to execute in favour of the Mortgagee a legal
equitable mortgage of Schedule property in such form and manner the
Mortgagee may require for securing repayment of all monies secured by
the aforesaid mortgage by deposit of Title Deeds.
The borrower confirms that no proceedings for recovery of taxes are
pending against the Borrower under the Income-tax Act 281 or any other
law in force for the time being and that no notice has been issued and/or
served on the Borrower under Rules 2, 16 or 51 or any other Rules of the
Second Schedule to the Income-tax Act 1961 or under any other law for
the proposed mortgage properties.
The Mortgagor confirmed that the maximum amount intended to be
secured by the mortgage was for the purpose of Section 79 of the
Transfer of Property Act, 1882, and for no other purpose.
While making the deposit, the Mortgagor stated that the title deeds so
deposited were the only title deeds in the possession, power and control
of the Mortgagor in respect of the mortgaged properties.
The Mortgagor further stated that the property is in his actual possession
and he has a clear and marketable title thereto, free from all
encumbrances and save the charge/s created in favor of the Bank, there
are no mortgages, charges, lien, lease or other encumbrances or
attachments thereon nor such encumbrances shall be created in
whatsoever manner or attachment allowed to be levied on the mortgaged
properties, so long as the Borrower continues to be indebted or liable to
the Bank.
The Mortgagor confirmed that if more than one property has been
mortgaged, then each of the properties shall be liable as joint and several
charge for the satisfaction of the mortgaged debt.
The mortgagor confirmed that no proceedings for recovery of any
statutory dues, taxes, etc. was initiated in the past nor any proceeding or
levy or tax is pending against the Mortgagor under the Income Tax Act,
1961 or the Sales Tax Laws, and that no notice has been issued / or
served on the Borrower under Rules 2, 16 or 51 or any other Rules of the
Second Schedule to the Income Tax Act, 1961, or under any other law for
the time being in force.
The Mortgagor/s declare/s that the documents mentioned in Schedule-I,
which are deposited with the Mortgagee are the only documents of title of
the Mortgagor/s relating to his / her / their Schedule property and that
there are no other documents of title to the Schedule property. The
Mortgagor/s further declares that the Schedule property is not charged or
encumbered in any way whatsoever. There are no claims / arrears of
Revenue. The mortgagor(s) is / are in actual and peaceful possession of
the Schedule property and is not subject to any litigation or agreement for
sale or otherwise.
