1. Name of the Contract: Dropping and Fitting of CBC, Draft Gear and Striker Casting on Wagon.
2. Location of Contract: Wagon Repair Shop, Kharagpur, S E Railway.
3. Consignee of the Contract: Dy. CME (Wagon)/KGPW/SER or his authorized representative.
4. Permit of Contract: The successful tenderer should apply and obtain necessary Railway permission
for entry/exit/operation of their labourers, deployment of M&P and T&P at the workshop area for
the execution of the work at WRS/KGPW. Successful tenderer has to submit necessary documents
like LOA, labour license, list of manpower, M&P and T&P to be deployed etc. with the application
for permit.
5. Tendered quantity for the Contract:
Dropping and Fitting of Dropping and Fitting of Dropping and Fitting of Striker

6. Scope of work:
Contractor has to do the followings-
A. Dropping and Fitting of CBC and Draft Gear on conventional wagon with riveting
(I) Dropping/Stripping of all CBC components & Draft Gear of all fresh offered wagons per
day which includes
Cutting of rivets of yoke pin support plate, Yoke support plates/anchor plate with
safety strap.
Dismantling and dropping of CBC assembly by dropping of yoke pin with yoke pin
support plate.
Dropping and Dismantling of Draft Gears by dropping of yoke support plates/
anchor plate with safety strap with use of scissor lifting trolley and puller for draft
gear removal.
Note: 1. Once offered wagons on any day can be re-offered on other day is not included in
fresh offered wagons.
2. Dropping of CBC assembly component shall be done using scissor lifting
trolley/suitable device to avoid any direct dropping of components on floors of
shop.
(II) To & Fro Movement/transportation of stripped out all CBC components from repair bay to
CBC section or to a place nominated by concerned SSE and overhauled/new components to
repair bay.
(III) Fitting of draft gear & front follower with yoke, yoke support plates/anchor plate with
safety strap using scissor lifting trolley.
(IV) Fitting of striker casting liner plate which will be bolted.
(V) Fitting of coupler body.
(VI) Fitting of yoke pin & yoke pin support plate.
(VII) Matching of hole of center sill with Yoke support plates/ anchor plate with safety strap,
yoke pin support plate through reaming.
(VIII) Riveting of all support plates with rivet holes of centre sill and ensure proper head
formation of rivets.

(IX) All work should be done in accordance with CAMTECH manual/ Maintenance Manual for
Wagons (latest revision)/G-80/RDSO technical pamphlet/latest guidelines of Railway
board, RDSO etc.
(X) To & fro movement of CBC components to nominated location for overhauling/checking
& movement of rejected components of CBC assembly to nominated place for scrap
disposal is involving work of manpower & associated M&Ps. Contractor must depute
sufficient/adequate nos. of manpower to keep the shop floor free of unused components of
CBC & its assembly.
B. Dropping and Fitting of CBC and Draft Gear on stainless steel wagon with lock bolt
(I) Dropping/Stripping of all CBC components & Draft Gear of all fresh offered wagons per
day which includes
Cutting of rivets/lock bolts of yoke pin support plate, Yoke support plates/anchor
plate with safety strap.
Dismantling and dropping of CBC assembly by dropping of yoke pin with yoke pin
support plate.

(VIII) Lock bolting of all support plates with holes of centre sill and breakage of lock bolt tail.
(IX) All work should be done in accordance with CAMTECH manual/ Maintenance Manual for
Wagons (latest revision)/G-80/RDSO technical pamphlet/latest guidelines of Railway
board, RDSO etc.
(X) To & fro movement of CBC components to nominated location for overhauling/checking
& movement of rejected components of CBC assembly to nominated place for scrap

(IV) After completion of machining work, transportation of drilled striker casting to
repair bay.
(V) Movement of scrap from machining place to designated scrap bin or a place
nominated by concerned SSE.
2. Scope of work for Dropping and fitting of striker casting
(I) Cutting all the rivets/lock bolts of prescribed striker casting by gas cutter.
Note: Contractor must ensure that center sill or other parts of under frame should
not get tampered/ damaged while cutting of rivets/lock bolts.
(II) Dropping of prescribed striker casting by using rivet buster machine or any
advanced equipment fit for that purpose.
(III) Fitting of new drilled striker casting with bolts.
(IV) Reaming of holes to ensure smooth passage of rivets and lock bolts.
(V) Riveting/lock bolting of the striker casting with suitable size of rivet/lock bolt and
ensure proper head formation of rivets.
(VI) Movement of stripped out component from repair bay to designated scrap bin or a
place nominated by concerned SSE.
7. M&Ps & T&Ps to be provided by the Contractor

contractor to provide adequate numbers of M&P items on request of Railways without
any extra cost. This list of M&P items is provisional and may alter as per actual
requirement
8. Railway will supply the followings-
A. Required quantity of lock bolt for lock bolting.
B. Required quantity of rivets.
C. Overhauled/new CBC & Draft gear components.
D. Support plates.
E. New striker casting.
F. LPG and Oxygen for cutting.
G. Compressed air, electricity and water.
9. Manpower:
A. Contractor/firm has to deploy sufficient manpower for the subject work. The manpower
should have proper experience and skilled enough to accomplish the task.
B. Contractor/firm has to deploy one degree engineer for liaison with concerned SSE/Railway
officer for smooth execution of work. One copy of degree engineering pass certificate is to be
submitted to the concerned SSE at the starting of execution. Representative of Contractor/firm
should carry mobile phone at all times for easy communication. All communication through
wagon shop official e-mail id [email protected] should be treated as official.
C. All director indirect costs and obligations pertaining to employment of manpower shall be
borne by the contractor/firm.
D. The Contractor/firm shall furnish complete details of the personnel to be deployed with
engineer giving the working timings. The name/list of all the employees along with degree
engineer should be submitted to Consignee or his authorized representative, before starting the
actual work.
E. The contractor should issue identity badges/cards to all his labour engaged to carry out the
work, including the engineer. These identity badges/cards should be so carried that they can be
identified by Railway Security/Workshop staff and supervisors.
F. The persons so engaged by the contractor should be courteous, well-mannered and well
behaved. Railway reserves the right to ask the contractor to remove any person, if found to be
unsuitable for work or on any other ground like bad conduct, bad performance etc. In such
situation the contractor must remove or dismiss the concerned person and replace with a
suitable person forthwith. The person so removed, must not be entertained by the contractor at
the site of Railways.
G. The Contractor shall submit Two (02) Photographs & Aadhaar card for each of the worker
proposed to be employed by him.
H. No child labour should be entertained.
I. The Railway is not responsible to pay compensation/insurance in case the contractor’s staff,
gets injury/accident or in the event of death during working. It is total responsibility of the
contractor to take care and liability in such issues.
J. If more than one contract work awarded to same firm/contractor, different degree engineer
should be deployed for different contractor work.
K. One copy of labour license has to be submitted to the concerned SSE at the starting of
execution of work if applicable.
L. The contractor should comply with all labour laws as applicable.
M. In case of enhancement in Minimum Labour Wages by Central Government, Contractor has to
pay as per enhanced labour wages without any burden to Railways.

N. EPF, ESI has to be submitted by contractor to the respective authority and in time.
O. Contractor has to abide by the provisions of Payment of Wages Act & Minimum wages Act.
In order to ensure the same, an application has been developed and hosted on website
‘www.shramikkalyan.indianrailways.gov.in’. Contractor shall register his firm/company etc.
and upload requisite details of labour and their payment in this.
P. Statutory bonus to the labour engaged by the contractor should be given as per extant rules.
f) Wages register: This register will be maintained by the contractor to show the wages paid to
the labour. Labour deployed by contractor for the entire work must have individual bank
Account in their own name. Payment to the labour by contractor shall be made as per the latest
minimum wages and as per their skill level issued from Central Labour Commissioner through
bank account of individual Labour only. The tenderer should enclose the copy of bank
statement showing that payment has been made to bank account of the Labours for previous
month while submitting the bill. The tenderer should submit PF code numbers after the
acceptance of contract before submitting the bill. The tenderer has to deposit requisite PF and
ESI amount in respect of individual labours. The copy of remittance for PF and ESI should be
enclosed along with bill. Senior Section Engineer/wagon repair shop has to certify for the
amount shown in the wages register has been paid to the labour by the contractor. Monthly
bank payment details should be submitted and uploaded to shramikkalyan portal.
Additional records/ registers, if any required, should also be maintained and the details are to
be recorded as per the instructions of Dy.CME (Wagon)/KGPW or his representative.
The firm should follow the regular workshop timings of WRS/KGPW. The Railway administration
may extend the working hours of workers & engineer for any particular day to complete the work
assigned to the firm on request of the firm.

12. Safety:
a. All safety rules are to be followed by contractor.
b. All labourer engaged by the contractor should wear PPEs (safety shoe, safety helmet, hand
gloves etc.) while on duty. Engineer engaged by the contractor/firm will wear safety helmet
and safety shoe.
c. PPE (Personal Protective equipment) to be provided by the contractor to the contractual
labour.
d. In case of any accident of any contractual staff due to unsafe practice only contractor will be
responsible.
e. In the event of any accident or incident or near miss, this should be immediately
communicated to the Safety Cell of Wagon Repair Shop/KGP for taking further action.
f. In the event of fire noticed by contractor’s personnel, this should be communicated to the Sr.
Section Engineer of the nearest/adjacent shop for taking further action.

work of striker casting is to done and after completion of machining work, transportation of
drilled striker casting to repair bay. If all released material are not transported to the nominated
place by the contractor on time/same day of offered wagons then overhauled material from
CBC section/nominated place will not be provided on time to the contractor. So, it is a duty of
contractor to transport material on daily basis, failing which Railways will not take any
responsibility for not providing overhauled items due to contractor’s fault.
B. The transportation of the said items has to be carried out with the help of fork lifter. The work
shall not be delayed using manual material handling in presence of Fork Lifter. In case of
breakdown of fork lifter, the work shall not be left uncompleted. It shall be carried using
manual material handling. There shall be a clause of penalty applicable on non-completion of
work or if transportation of material is not done.
C. In case of situation when the firm takes offer for particular number of wagons in a day and
doesn’t transport the proportional components of CBC and draft gear at nominated place, after
dropping, for the same number of wagons on the same day, it will be treated as partial material
movement, then there shall be a penalty levied on contractor for non-compliance of this the
material handling clause.
16. Housekeeping:
A. Every precaution shall be taken by the contractor to protect his labour, materials & Railway
properties. Contractor shall adhere to relevant rules of Railway working (in yards/workshop)
such as putting stop Board, Clamping on points etc.
B. Contractor should also arrange round the clock guarding and security of its materials, tools,
machines etc. kept at the work site. Railways shall not be responsible for any loss of material
or stores belonging to the contractor.
C. In no case, Railway shall provide protected storage space or office space for use of contractors.
Contractor may prefer to arrange container with lock and key arrangements to keep the raw
materials and consumables and as office, for which Railway will provide the space. Contractor
has to display office boards, worksite board indicating all details of the contract work,
workmen engaged, period of contract etc.
D. The contractor should do regular housekeeping to keep work site free of scraps and litters.
E. All released components i.e. draft gear, yoke, coupler body, knuckle, support plates is to be
transported from repair bay to CBC section or a place nominated by concerned SSE and
repaired/new draft gear, yoke, coupler body, support plates is to be transported from CBC
section/section store to repair bay for fitment on the wagon by the contractor/firm on daily basis
without fail.
F. New striker casting is to be transported from store or nominated place of NWS to specified
place where machining work of striker casting is to done and after completion of machining
work, transportation of drilled striker casting to repair bay for fitment on the wagon by the
contractor/firm on daily basis without fail.
G. All scrap from machining place or repair bay is to be put on designated scrap bin or in a place
nominated by concerned SSE.
17. Warranty:
A. Tenderer should give warranty of workmanship till 1st ROH from the date of completion of
each wagon for dropping & fitting of CBC & draft gear with lock bolting on wagon.
B. Tenderer should give warranty of workmanship till 1st ROH from the date of completion work
of each wagon for dropping & fitting of CBC & draft gear with riveting on wagon.
C. Tenderer should give warranty of workmanship till 1st ROH from the date of completion work
of each wagon for dropping & fitting of striker casting.

SPECIAL TERMS & CONDITIONS OF T HE CONTRACT:
1. This contract will be governed by IR Standard GCC for Works-April 2022 with
it’s latest correction slips.
2. The contractor must acquaint himself with the present system of working before
starting the work at worksite of Wagon Repair Shop, KGPW.
3. Contractor shall provide his official email id and mobile no. for communication. All
the communication to contractor’s mail id through railway mail id
[email protected] will be treated as official.
4. The work will be carried out under the supervision of authorized representative
of Dy.CME(Wagon)/KGPW. The contractor should ensure that the staff
deployed by him must abide by the instructions given by Authorized Rly.
Supervisors/Officers.
5. Uniforms, Safety Gears and Identity Cards - The contractor shall provide
identity cards with photographs pasted and attested by the contractor to all
labours engaged for the work. Contractor will also provide uniform having
name of the firm on the uniform and necessary safety gears, PPE like safety
helmet, safety shoes, Hand gloves, Safety goggles etc. for labour to his staff and
also ensure their use while working as per requirement of work.
6. If contractor’s staff fails to carry out the specified work as mentioned in the
scope of work due to any sort of discrepancy on the part of the contractor,
penalty will be imposed to the contractor.
7. The quality of work will be closely monitored and shall be inspected daily by
Railway Authorities. The contractor will not employ any unethical practices to
compromise the quality of work. Contractor or his men will not use any such
means, which will affect the quality of work and may cause damage to Railway
property/premises due to such practice, for which contractor will be solely
responsible. If any such incident takes place and the contractor is found
responsible, Railway will reserve the right to impose fines and/or terminate the
contract immediately.

9. Contractors must abide by and comply with the provisions and rules of the
contract labour (regulation and abolition) act, 1970 and general rules 1971” as
amended up to date.
10. Contractor should ensure that the person employed by him does not have any
criminal background & political affiliation. Police Verification Report of each
staff has to be submitted by the agency before commencement of the work.
11. Entry and exit of contractual workers and supervisors within workshop premises
will only be allowed after showing proper gate passed issued by competent
authority. Gate pass for the contractual workers and supervisors will only
be issued after submission of police verification certificate.
12. Contractor should remain responsible for the general conduct and discipline of
his labours. He should bear the cost of repair to any rolling stock, permanent
way or other property of the Railway Administration getting damaged due to
any deliberate work or otherwise on the part of him or his workers. He
should also remain responsible for any theft of any Railway Property by the
staff employed by him.
13. The Railway Administration shall not be liable to pay any extra charges except
rates as per LOA/contract agreement.
14. The total value of the tender shall include all taxes, levies, impositions, handling
charges etc. what so ever applicable including GST.
15. The Railway Administration reserves the right to terminate the contract at any
given point of time without assigning any reason, if it is noticed that the
contractor is unable to carry out the work as per terms and conditions of the
contract. In such case the security deposit & performance guarantee will be
forfeited by the Administration as per extant rule.
16. In case any deputed staffs by the contractor is being seriously injured/met an
accident while working, the contractor will be totally responsible to provide
medical assistance to such employee of the contractor immediately and if any
staff will meet with casualty while working, Railway authority will not be
responsible at any moment. Thus agency will be sole responsible for the
personal safety of the staff deputed by the agency.
17. If there is any item which is not covered by terms and conditions of contract or
by the term and condition mentioned elsewhere in the tender, the terms and
conditions mentioned in IR Standard GCC for Works-April 2022 with it’s latest
correction slips applicable to works contract of Indian Railway shall apply.

18. The scope of work and all special conditions will be implemented by the contractor.
19. Applicable Taxes will be deducted as per schedule rate from contractor’s bill.
20. If the contractor fails to complete the work, as per contract agreement necessary
action will be initiated as per IR Standard GCC for Works-April 2022 with it’s
latest correction slips applicable to works contract of Indian Railway shall
apply.
21. The contractual labours engaged for the subject work are not liable to claim for
any sorts of employment in the Railways in future for the same.
22. The Contractor is responsible for ensuring Minimum Wages Act, ESI Act, EPF
Act, Bonus Act etc. and all other statutory Acts & Regulations for social security
of contractual labourer.
23. Contractor is to abide by the provisions of Payment of Wages act & Minimum
Wages act in terms of clause 54 and 55 of Indian Railways General Condition of
Contract. In order to ensure the same, an application has been developed and hosted
on website ‘www.shramikkalyan.indianrailways.gov.in’. Contractor shall register his
firm/company etc. and upload requisite details of labour and their payment in this
portal. These details shall be available in public domain. The Registration/ updation
of Portal shall be done as under:
a) Contractor shall apply for one time registration of his company/firm etc. In the
Shramikkalyan portal with requisite details subsequent to issue of Letter of
Acceptance. Engineer shall approve the contractor's registration on the portal
within 7 days of receipt of such request.
b) Contractor once approved by any Engineer, can create password with login ID
(PAN No.) for subsequent use of portal for all LoAs issued in his favor.
c) The contractor once registered on the portal, shall provide details of his Letter of
Acceptances (LoA) / Contract Agreements on shramikkalyan portal within 15
days of issue of any LoA for approval of concerned engineer. Engineer shall
update (if required) and approve the details of LoA filled by contractor within 7
days of receipt of such request.
d) After approval of LoA by Engineer, contractor shall fill the salient details of
contract labours engaged in the contract and ensure updating of each wage
payment to them on shramikkalyan portal on monthly basis.
e) It shall be mandatory upon the contractor to ensure correct and prompt uploading
of all salient details of engaged contractual labour & payments made thereof after
each wage period.
f) While processing payment of any ‘On Account bill’ or ‘Final bill’ or release of
‘Advances’ or ‘Performance Guarantee / Security deposit’, contractor shall submit
a certificate to the Engineer or Engineer's representatives that “I have uploaded the

correct details of contract labours engaged in connection with this contract and
payments made to them during the wage period in Railway's Shramikkalyan portal
at ‘www.shramikkalvan.indianrailways.gov.in’ till --- Month, __ Year.”
24. Conservancy cess at prescribed rate, as circulated by Railway Board from time to
time will be deducted from the contractor’s on account bill.
25. The contractor should apply for Registration to labour commission of the area in
form IV of contract labour (Regulation & abolition) central Rules, 1971. The
contractor must renew his license from time to time. Copy of registration certificates
received/renewed from time to time should be sent to Principal employer.
26. Daily labour Register: For each contract site, one register should be maintained
containing therein the number of labour deployed by the contractor. This register
should be singed jointly by the representative of the Principal employer and
contractor.
27. The inspection Register of wages: The authorized representative will verify the
register of wages or register of wages cum Muster Roll to see that the wages have
been paid to the labour. In terms of Railway board letter no. E(LL)2015/PNM/AIRF/I
Dated 20-10-2015 that payment to contract labourers should be made through bank /
cheques.

n) Trade Unions Act, 1926
o) Payment of Bonus Act, 1965
p) Payment of Gratuity Act, 1972
Violation of above legal obligations and of any other contract governing law for the
time being in force in the Republic of India may leads to termination of the contract.
30. Display at Worksites:
a) The contractor shall display the labour license prominently at the work
place.
b) Abstract of CLRA Act & Rules (Rule-79) the contractor shall display
an abstract of the act and rules in English, Hindi & local languages.
c) Notices showing the rates of wages, hours of work, wage period, dates
of payment of wages, names and address of labour inspector and date
of unpaid wages (Rule 81(1)” these should be displayed in English,
Hindi & local languages at the work sites.
32. Contractor must preserve all registers and other records in original for a period of
three calendar years.
33. The contractor will ensure to open bank accounts for each worker employed by him
and all the payment workers will be released through bank payments.
34. The contractor shall submit half yearly return in form XXIV (in duplicate) to reach
the licensing Officer not later than 30 days from the close of the half year (i.e. 1st
July and 1st Jan for the preceding half year). Contractor should send a copy of return
to principal employer.

PAYMENT CLAUSE
A. Payment shall be made for completed wagons on a monthly basis after satisfactory
completion of work, jointly certified by the authorized representative of Dy. CME
(Wagon)/KGPW and the representative of firm after submission of bill.
B. Nominated officer/authorized representative of consignee will operate the M.B. (to be
kept with him only) by visiting the worksite and note the progress of work
periodically. M.B. shall be signed jointly by authorized representative of consignee
and contractor/firm, based on which payment will be made.
C. On account payments can be made on a monthly basis. For this purpose, Measurement
Book, Bills, etc. shall be prepared & submitted by consignee to Dy. FA &
CAO/KGPW.
D. Manner of payment: Payments to the contractor will be made by RTGS/ NEFT.
E. Payment to the tenderer shall be made subject to deduction of taxes (which are
applicable) and penalties.
F. The contractor shall be responsible for deposition of applicable GST to the concerned
authority.
G. Depositing of EPF and ESI of contractor’s labours & all other Taxes with concerned
authorities is the liability of contractor. This also to be uploaded in I.R. Shramik
Kalyan portal as applicable.
H. No interest shall be payable on any amount which is payable to contractor for delayed
payment or any other cause.
I. Price Variation Clause (PVC) will be applicable for this contract as per extant rule.
NOTE- For all tenders having advertised cost of Rs. 10 lakh and above, the contractor shall
have the option to take payment from Railways through a letter of credit (LC) arrangement
as per Railway Board letter No. 2018/CE-I/CT/9 dated 04.06.2018.

Penalty
1. The work of Dropping & Fitting of CBC & Draft Gear except striker casting on wagon should be
completed on the same day of offer of the work, delay on which will attract a penalty of Rs.500/-
per wagon per day.
2. The work of all offered dropping and fitting of striker casting along with CBC work on wagon as
per scope of work should be completed within 01 working day besides the day of offer for striker
casting work (total 02 days including day of offer).Delay on which will attract a penalty of
Rs.1200 per wagon per day.
3. In the situation of delayed offer of wagon to the firm, a JOINT NOTE will be signed between the
representative of consignee and the representative of firm indicating the reason for the late offer
of work and the assurance to complete the work of that day by the firm. In such case, the penalty
of Srl No.1 & Srl No.2 will not be applicable for the leftover wagon for that day. But the leftover
work should be completed on the next working day (grace period) along with the regular
assigned work, otherwise penalty for the leftover wagons will be applicable after the grace
period as per Srl No.1 & Srl No.2.
4. The contractor has to mandatorily accept the offer of the subject work of minimum 32 wagons in
a day, if available. Failure to accept the offered number of wagons will lead to a penalty of
Rs.500 per wagon per day.
5. Non-compliance of to & fro movement/transportation of components/scrap as per point no.
16(E), 16(F) & 16(G) of Scope of Work will attract penalty of Rs.1000/- per section per day.
(Note: There are 05 sections namely AB Body section, CD Body section, Shop 40, Shop 48 &
SS fitting section.)
6. In case of situation when the firm takes offer for particular number of wagons in a day and
doesn’t transport the proportional components of CBC and draft gear at nominated place, after
dropping, for the same number of wagons on the same day, it will be treated as partial material
movement and will attract a penalty of Rs.200/- per wagon per day for the number of wagons for
which material movement work not done.
8. If Contractor doesn’t provide minimum 02 fork lifter with operator and fuel in working
condition (including power pack, installation tool with nose assembly and relevant concomitant
accessories) on any day, a penalty of Rs.1500 per machine per day will be levied on the
contractor.
9. Failure to maintain the Outturn register, Labour Register, Wages register, M&P and T&P
register, Engineer’s register & Material handling register will attract a penalty of
Rs.500/register/month.
10. During inspection by any Railway officer, if the work or any other provision is found
unsatisfactory as per scope of work, penalty will be imposed by the nominated Railway officer
on the firm/contractor and the amount of penalty will be decided by the nominated Railway
officer as per the severity of occasion at the time of inspection.
11. Non-wearing of PPEs by the contactor’s labourer or engineer will attract a penalty of Rs.50/-
per person per occasion.

12. Railway reserves the right to carry out the left over/unattended job of offered wagon by the
contractor for which no payment will be made to the contractor for that particular wagon.
13. In case contractor fails to deploy qualified gradute engineer for the job, he, in terms of
provisions of Rly Bd letter no. 2012/CE-I/CT/O/20 dt. 10.05.2013, shall be liable to pay an
amount of Rs.40,000/- for each month or part thereof for the default period.
14. On any working day if the contractor doesn’t deploy any manpower, there will be penalty of
Rs.5000 per day.
15. Penalties will be deducted from the running bills, if any. In case of no running bills, deduction
shall be recovered from PG and or SD/EMD.
16. Above penalties will however be over and above the penalty imposed under clause 17-B of GCC
April 2022 (Page no.-51-52).
