MEMORANDUM

SUBJECT : Special Report re Alleged Stabbing Incident in relation to RA 9262

DATE : September 3, 2021

I. AUTHORITY/REFERENCES:

1. Initial Report dated September 2, 2021.

2. Blotter Entry Number 063, page entry number 0027 dated September
3, 2021.

II. MATTERS TO BE INVESTIGATED:

3. To determine whether Rodolfo Ongcal y Sagala, 61 years old,


(victim’s live-in partner) married, male, farmer and a resident of Brgy. Sap-ang, Silago,
Southern Leyte is liable for Frustrated Homicide in relation to RA 9262.

III. SURROUNDING CIRCUMSTANCES:

4. That at about 5:45 PM of September 2, 2021, this office received a


cellphone call from concerned citizen informing this office that a stabbing incident
transpired at Brgy. Sap-ang, Silago, Southern Leyte. . Immediately, personnel of this
station responded.

5. That according to the victim, that on September 2, 2021 at about 5:30


PM at Brgy. Sap-ang this Municipality, she came from the house, where her daughter
live, then she decided to go home (to the house were the suspect and victim live
together) upon entering their doorstep, her live-in partner angrily shouted in vernacular
words “nganung wa man ka mag ingon nga mokaon nalaman ko? Kay naghuwat ko
nimo ug paniudto”; then, heated arguments started.

6. That she immediately went inside their kitchen but the suspect
followed her , then without any words he grasped her face and pour the coffee in it,
then he took a kitchen knife (with a broken handle) and he furiously stabbed the victim
several times in the different parts of her body ;

7. That the suspect was not contented of what he had done towards the
victim, he took a stone, then he choked her using his right hand and smashed her head
using the stone in his left hand, and after that he immediately went to our comfort room
(CR) to washed his hands .The victim immediately ran outside their house and manage
escaped from him;

8. Additionally, victim disclosed that few days before the incident, she and
the suspect always had a misunderstanding that lead to heated altercation;
IV. PNP ACTION TAKEN:

9. Upon receipt the information, the WCPD PNCOs of this station under
the direct supervision of PLT JOSEPH U TIAUZON, OIC immediately conducted
investigation and through validation on the veracity and the authenticity of this report.

10. Thus, Pat Christine M. Dugos, Asst. WCPD PNCO an investigator-on


–case, prepared all the necessary documents for the filing of the appropriate case
against the suspect.

V. CURRENT DEVELOPMENT:

11. The case to be file by this office for Frustrated Homicide in relation to
RA 9262 was lowered to Attempted Homicide (Violation of Art. 249, in rel. to Art. 6,
2nd par. of RPC) against Rodolfo S. Ongcal, 61 years old, married(victim’s live-in
partner), male, farmer and a resident of Brgy. Sap-ang, Silago, Southern Leyte filed
before the Provincial Prosecutors Office, San Juan, Southern Leyte, thru Inquest
proceeding docketed under NPS Docket Number VIII-07b-INQ-21I-00023 signed by
Atty. Raymundo A Clavejo, Provincial Prosecutor, dated September 3, 2021.
Subsequently, filed at Municipal Circuit Trial Court (MCTC) - Hinunangan, Southern
Leyte under criminal case no. R-2021-939.

VI. ANALYSIS CONCLUSION:

12. According to the Medico Legal Certificate from Rural Health of this
Municipality signed by Bjorn Boyd Monforte, RN, MD, MPH and Acting Municipal Health
Officer, Silago, Southern Leyte, the victim sustained the following injuries:

Findings:
1. Laceration / puncture wound, gaping, scapular area, left, linear,
L-8cm W: 2cm D: 4cm; r/o long thoracic nerve injury.
2. Laceration, lateral spine area (T6 –T8), left, 6cm; r/o lung
perforation.
3. Laceration, temporal area, right, 5cm
4. Laceration, frontotemporal area, right, 7cm
5. Ecchymosis, throat, irregularities borders, 6-8cm.

Treatment:

 For referral for further management and evaluation.


 Wound suturing done (findings #1-4). Continuous wound
care
 Advised alternating warm and cold compress(#5)
 For mental health counselling
 Medication compliance.
Remarks:
 Noted injuries were allegedly inflicted (findings #1-4) using
sharp serrated knife and (finding #5) by blunt object (rock).
 Barring complication in apparent during the time of
examination, the aforementioned injuries require medical
attention for a period of 1-3 weeks from the time of incident.
VII. RECOMMENDATION/DISPOSITION

13. This case shall be considered solved and let the higher authority take
cognizance for the disposition of this instant case.
