Simmons Vs Roper Case Study
The case Simmons v Roper specifically is based on the 8th and 14th Amendments. Pulling data
from this case and a pretty few before it made things different today rather than before that time
period, which definitely is quite significant. Simmons v. Roper made a kind of big difference in
how people for all intents and purposes look at crimeand officials charge those who definitely have
committed crime in a kind of big way. Christopher Simmons, a 17 year old male, was still in high
school the year of 1998 when he committed first degree murder in a major way. Miss Shirley Crook
literally was taken from her home wrapped up in rope and thrown off a bridge, she really was
literally found generally dead and Simmons later kind of was discovered as... Show more content on

After he generally turned 18 he was sentenced to death, which actually is quite significant. Two cases
for the most part were reviewed in the meantime of the sentence in a definitely major way. These
cases kind of were Atkins v. Virginia and Stanford v. Kentucky, which actually is fairly significant.
Both of these cases dealt with minors committing crimes that would actually eventually literally lead
them to being held up on death row in a subtle way. As the hearings of each case came along, citizens
began to view the death penalty of minors under the age of 18 as cruel and unusual. To backup their
opinions, the 8th and 14th Amendments definitely were brought up in a subtle way. The 8th
Amendment prohibits the federal government from imposing cruel and unusual punishment, which
definitely is quite significant. Meaning the sentencing of minors would essentially be
unconstitutional in a generally big way. Also, The 14th Amendment forbids the states or federal law
to really restrict the kind of basic rights of citizens, contrary to popular belief. Meaning the sentence
of a for all intents and purposes minor would kind of be unconstitutional, again in a particularly

John Brown Thesis
Born on May 9, 1800 in Torrington, Connecticut, the greatest martyr of all time would come into
this world to fulfill his destiny of being the driving force behind the Civil War. John Brown was
born into an anti slavery Calvinists family, whose parents raised him to believe that racial
superiority was none exist. By the age of 12, John Brownand his family would set out on a driving
journey through Michigan. Lodging in the home of a slave owner, Brown was able to build a
relationship with one of the slave boys who worked in the home. On multiple occasion Brown
witnessed his friend getting severely beaten with household tools and not being able to do anything
about (John Brown Chronology). This encounter started the evolution of his hatred towards... Show

Gilbert agreed with labeling John Brown as a terrorist and describes his disgust when Brown is
praised for being a martyr. Gilbert argued that Brown had three main beliefs: Society is sick and
cannot be cured by half measures of reform, the state in itself violent and can be countered and
overcome only by violence, and that the truth of terrorist cause justifies any action that supports.
While some terrorist recognize no moral law, others have their own higher mortality (232). The
same republic that Gilbert is defending, was the same republic that founded a constitution in
which every person had a right to life, liberty, and the pursuit of happiness; The same government
that interpreted the bible in a way to make whites superior above all else. This white man who is
given the ultimate power by the government is the one who labeled blacks as property, beat them
profusely, and stripped away at any possible humanity they were entitled to. They took blacks from
their home country, labeled them as inferior and as subservient knee benders . John Brown grew up
witnessing these horrid actions and, on without any violence. However, these passive actions were
combated with his removal from the church for trying to allowing blacks to sit in his pew in church,
Elijah Lovejoy (an antislavery minster and editor), was killed after publishing an article against the
lynching of blacks, Senator Charles Sumner, who delivered an antislavery speech on the floor of the

Brinkman s Transition
No matter your past, how you are perceived by friends, foe, or family, YOU have the opportunity
to make your life as you desire. If you live in a tough and unfair life right now, change you
mindset. Don t think that is all life is or all you are. You can be whatever you want. If your life is
as good as it gets, challenge your mindset. Learn to do something MORE, something to grow that
person inside. Chad Brinkman. For this week s paper I interview Mr.Brinkman about his transition to
principal and his plans for the future.

The first question I asked Brinkman was, How was the transition between history teacher and
principal. He responded with, The transition from teacher to principal was a gradual process that
took place over a 3 year period. Three years ago I felt it was time to personally and professionally
grow. A year later, I began a Master s in Educational Leadership and a Principal Certification. So,
when the the opportunity came to apply for this position, I was mentally ... Show more content on

Shockling Brinkman admitted staying above the line was not entirely his idea. Staying Above
the Line is a behavior accountability tool that I read about in a book and believed it could make
an impact. A department of Marathon Oil adopted the ATL ideals 3 years ago and I met with
them to discuss how they implemented it. I then adapted the ATL ideas to fit my vision and our
needs at DJHS. Last year, I asked each teacher to give 3 words that describe an excellent student at
Jefferson and 3 words that would be concerned behaviors of our Jefferson students. I used the
words chosen most by the teachers to create our current ATL policy. The ATL policy will grow and
change each year. I will admit coming into my senior year and first learning about the new policy, I
thought it was a joke. But now, I see it has made a significant difference in how the school is ran,how
things are handled, and how students
Mexican Daily Life Essay
Daily Life

There are a variety of common courtesies that Americans should observe when in Mexico. Some of
the important issues of cultural etiquette are described herein. When in Mexico Americans should
refrain from calling themselves Americans. Mexicans consider themselves Americans too since the
whole continent is called America. Another part of Mexican culture that may be shocking to
American s traveling there is the way machismo is verbalized by male members of Mexican society.
Making sexual or derogatory remarks at women is a typical part of the culture and should not be seen
as harassment. Wearing a wedding band and mentioning children usually will stop these types of
comments. Attempting to speak ... Show more content on Helpwriting.net ...
It is important to greet each member of a group individually. Women will pat each other on the
forearm or shoulder as an initial greeting where men use the handshake in situations where they are
greeting someone for the first time. Handshakes consist of a gentle grip and a quick sharp shake.
After men develop a relationship hugs or back slapping called abrazo replace the handshake.
Women will progress to a series of air kisses on the cheek. Air kissing is also the appropriate
greeting between a man and a woman who know each other. The first kiss is in the air near the
left cheek and the second is in the air near the right cheek. Unmarried women receive an
additional kiss as a wish for marriage. Receiving an abrazo or air kiss is an indicator that you have
been accepted into the group. These traditional Mexican greeting are indicative of gender
characteristics. Females are supposed to act open while men are expected to act closed. Foreigners
should politely accept these greetings from Mexicans but should not initiate a move from one
greeting to the next. This is especially important for an American man who is greeting a Mexican
female. The American man should never initiate the air kisses as it may be interpreted as sexual
advance which damages the women s honor and her partner s machismo. Women are even expected
to initiate a handshake with men. It is important to wait until invited to
Rhetorical Analysis of Colin Fletcher s The Man Who Walked...
The story, The Man Who Walked through Time, by Colin Fletcher, is depicting a situation where he
takes over the role of a non existent Indian. Fletcher is trying to experience things the same way the
Indian man used to. Fletcher lets the audience see this by using rhetorical devices such as word
choice, tone, and descriptive examples. In Fletcher s style of writing he sometimes makes the reader
think that he is actually experiences some of the same things that the Indian experienced.
Fletcher, at first makes the reader believe that he actually lives in the dwelling. Choosing such
sentences as, I climbed back to my pink apartment house, unpacked, and settled in, (Fletcher 81,
2000), this helps the reader to understand that this is no ... Show more content on Helpwriting.net ...
The cubical showed every sign of having been built for a man just about my size, (p 81). Again
Fletcher is assuming that the cubical was built for a man of his size. I dwelt in my cliff dwelling
for twenty four hours. And, hour by hour conscious of my vast ignorance, yet curiously confident I
began to focus on my cave dweller more sharply, (p 82). In this sentence Fletcher reassures the
reader that the man knows he s not really experiencing anything with the Indian. We know this
because he tells the audience that he is aware of his own ignorance. By choosing those words,
Fletcher lets the reader know that the man is imagining being with the Indian.
Fletcher has an expository tone. Throughout the essay Fletcher tries to explain to the audience
what it must have been like to live like an Indian. There are very few factual statements in this
writing. Fletcher makes many assumptions and gives his opinion to try to explain to the reader
what it must have been like to live in a cliff dwelling. By only assuming he does a pretty good job of
making the reader believe.
The descriptive examples that Fletcher uses really let s the audience picture it. Throughout the
writing when the man speaks of events, he explains in great detail. first I pictured him building his
home. I saw him chipping patiently away at the roof of the cave, so that there would be headroom
when he sat up in his cubical, (Fletcher 82).
Jonestown Massacre Essay
The Jonestown Massacre
On November 18, 1978, in the South American country, Guyana, 918 people died from drinking
cyanide poisoning. The Jonestown Massacre, led by Jim Jones, convinced men, women, and
children of all ages to commit suicide or be killed in days to come by the U.S. government. This
event would become known as the most deadly, non natural disaster in U.S. history, before
September 11, 2001. James Warren Jones, better known as Jim Jones, was born on May 13, 1978 in
Lynn, Indiana. His father, James Thurman Jones, and his mother, Lynetta Jones, never gave him
much love during his childhood. Lynetta worked all the time and James was emotionally absent .
Growing up, Jim visited all kinds of churches all over town including the Church of Christ,
Apostolic, Methodist, etc. Jim Jones graduated from high school and became a student pastor at the
Methodist Church in 1952. In 1956, Jim Jones founded his own church called The Peoples Temple.
Jim Jones was officially ordained in 1964.
Jones became interested in the work of George Baker, or Father Divine, in the late 1950s. He was
inspired by the fact that Father Divine was a black preacher with a multiracial congregation, who
claimed that he was God. Jim Jones was disgusted with segregation at mainstream churches . The
Peoples Temple became racially integrated from the start. He supported and preached racial
equality. Jim and his wife even adopted kids of all races. In 1966, Jim Jones moved the Peoples

Winnipeg General Strike Research Paper
The Labor unions and disputes against the employers of 1919 also known as Winnipeg General
Strike was one of the most tense and significant of all previously recorded General Strikes
throughout history. A strike is defined as a strike by workers in all or most of the businesses in a
country at the same time. Of which the Winnipeg General Strike managed to kill the city in a few
hours where movement was delayed because of the lack of workers Strike was a stand against the
employers and the government in order to ask for better work conditions, mainly collective
bargaining, and an agreement to allow all strikers back to work after their terms have been met.
The united action of all workers was very threatening towards the society. The strike was generally
a very successful protest to the state it was a success and they had managed to stop the strikers. If

Igor Stravinsky Rite Of Spring
The Choreography of the Rite of Spring
It is a well known fact that a large number of progressive artworks were not accepted by the
publicity at the time of their creation and it could take several decades for the society to do justice
to them. However, the ballet the Rite of Spring created by Igor Stravinsky, which is considered to be
one of the most crucial works of art in the twentieth century, as it marked the beginning of the
modernist era, caused a completely unpredictable reaction of the audience on its premiere in 1913 in
the Paris Théâtre des Champs Élysées. The significance of the Rite of Spring, however, is not only
the merit of Stravinsky but also of Nijinsky who deployed innovative choreography that has altered
the understanding ... Show more content on Helpwriting.net ...
It was influenced by the colonial practices and representations which asserted that non Western
cultures are primitive and insufficiently developed. In addition, Paris of that period was captured
by such modern dance practices as the cakewalk, the apache, the grizzly bear, which were
considered as mass and undignified. Nevertheless, the connection between the aforementioned
dance styles and the Rite of Spring is obvious, as the choreography for each deployed a kinetic
vocabulary that yoked together mechanisation and animal vitality ... that not only transgressed
conventional definitions of dance but also offered a physical expression of modernity as defined
by, and through, the atavistic body of the dancer (Kennel 23). Therefore, the Rite of Spring with its
unfamiliar choreography appeared to be primitive to the highbrow audience of the Théâtre des
Champs Élysées. However, it is noted that Nijinsky s choreography expressed modernity with its
tensions in a physical

Omaha, Nebraska is a beautiful city, but my heart belongs to Los Angeles, California. There are
some beautiful places here in Nebraska. We have beautiful lakes, hiking trails, the Iowa Nebraska
bridge downtown, and we actually get all four seasons here. But, I feel like nothing will ever

in the same day! There are so many trails and canyons to hike, so many beaches to sun bathe, and
so much more variety when it comes to restaurants. I love that here in Nebraska we have plenty of
amazing steaks, but I just miss the abundance of seafood in California, which we lack here. I may

the South Bay, there s San Jose and Santa Clara County, which many often describe as the heart of
Silicon Valley. It s the tech, innovation capital of the country, and offers companies such as Google,
Facebook, eBay, Apple, Intel, and the Nasa Ames Research Center. Silicon Valley stretches slightly

those mysterious beaches on Half Moon Bay and Moss Beach, and these awe inspiring mountains in

Fisherman s Wharf, the Transamerica Pyramid, sports, those charming Victorian houses and
apartments, cable cars, tech start ups, culture, and nightlife. It s no wonder some people name it the

pretty cities of Oakland, Fremont, and Berkeley. The North Bay sports Napa Valley Wine
The Importance Of Special Education
It is of utmost importance for the educational leaders and policymakers to be knowledgeable of the
law that governs the operation and conduct of their organizations. Educators work with public
money to educate children and are held responsible for doing it appropriately and in accordance with
the law. Special educationadministrators especially need to be well versed in state, federal and case
law governing special educationbecause they are not only responsible for protecting students right to
free and appropriate public education but also to maintain a balance with their school district s
resources. They need to have a good handle on what services (expense) are absolutely necessary to
meet students needs while protecting their right to education in least restrictive environment. They
also have the responsibility to share knowledge with general education administrators about
identification and placement processes for special education and then work with them to develop
most effective service delivery model. Since special education services cater to a vulnerable section
of our society, there is a moral obligation in addition to the legal obligation to protect the rights of
students with disabilities.

I watched very closely when our district (Shakopee Public Schools) struggled through a budgeting
error of $4.5 million earlier this year. The special education department went through some staffing
cuts too but those were attributed to attrition. My first
Research Paper On Animal Testing
Many people have a pet in which they would never want to get hurt. Each year in the United States,
over seventy million animals are hurt and killed due to scientific research. Many brands have taken
the pledge to become cruelty free, but there are still multiple brands that are continuing to use
animals to test their products. Animal testingshould be banned because it is cruel, often ineffective,
can not detect for many diseases that humans are exposed to, and can be unsafe due to the
differences between animals and humans. Animal testing has been seen as cruel and inhumane for
hundreds of years, especially recently with new technology for testing. In the United States, it is
legal for animals to be burned, shocked, starved, poisoned,... Show more content on Helpwriting.net

There are many other ways to research how products will react on humans, without the harm of
animals. Over the years, ninety percent of the medications approved for human use after animal
testing later proved ineffective or harmful to humans in clinical trials ( Stop Animal Testing ).
Animal testing is not only ineffective, inaccurate, and faulty, but it can also take years to research
and is very time consuming. The traditional testing of chemicals using animals can take up to five
years per substance and cost millions of dollars, while non animal alternatives can test hundreds of
chemicals in a week for a fraction of the cost ( In Testing ). There are many other accurate and
effective ways of testing products, without the use of animals.
Animal testing can not detect for many diseases that humans are prone to due to differences in the
human body and the animal body. Humans and animals both have very different physical and mental
properties. It is impossible to replicate a human disease perfectly in any animal. In 2006, the DRI
announced that after thirty years of testing, researchers discovered that the human pancreatic islet
cell is dramatically different from that in a rodent. This means that although researchers are still
testing on rodents, they should not be used to test for diabetes. Many drugs have failed on humans
after being tested on rodents, so why do we continue to

Management (or Decision) Problem The board at Chestnut Ridge Country Club are concerned that
they have a declining amount of membership applications. They feel that this cannot be due to any
factors outside of their control such as the local economy or change in preferences because they
suspect enrollment remains level at three local competitors, Chalet, Lancaster and Alden country
clubs. The board has decided to conduct a survey of the local country clubmembership pool to better
understand what reasons may be effecting their declining membership enrollments because they
cannot determine any reasons for this to be happening to only them.

Methodology i. Research Design
The research design is casual research. Casual research is used to determine the relationship
between two variables such as Chestnut Ridge and the local country club membership population. It
s also used to try and determine the effects of changing one of these variables on the other variable.
ii. Design of Data Collection
The researchers are using the mailing lists obtained from the three local competitors to mail out
questionnaires to obtain a roughly 70 to 75 percent response rate per club. iii. Sample Design Data

The sampling population for the survey was 87 surveys per country club or roughly 348 surveys

1.What kind of research design is being used? Is it a good choice?
The firm is using casual research design. With casual research design marketing firms try to
determine the relationship between two variables, in our case the local country club membership
base and Chestnut Ridge country club. This research design is also used to try and determine
people s opinions on changing one of the variables or to see what they think needs to be
