Q) What are the Laws governing employment in Malaysia?


Give brief explanation for each of them.

 Pensions Act 1980


For the administration of pensions, gratuities and other benefits for officers in
the public service and their dependants

It is the management of money paid under given conditions to a person following


retirement or to surviving dependants and other payments for officers in the public
service and whoever relies on them financially.

 Employees Social Security Act 1969 (ESSA)


For social security protection to all employees and their dependants as well
as the employers. This Acts is administered by the Social Security
Organization (SOCSO)or Pertubuhan Keselamatan Social (PERKESO), Malaysia

This act aims to provide protection for employees and their families against
economic and social distress in situations where the employees sustain injury
or death.

 Employees Provident Fund Act 1951


For the provision of financial security to its members particularly after
retirement, through a compulsory savings scheme. This Act is administered
by the Employees Provident Fund (EPF) or Kumpulan Wang Simpanan Pekerja
(KWSP), Malaysia.

The main objective of this act is to provide financial relief or social security
protection for workers through compulsory savings.

 Occupational Safety and Health Act 1994 (OSHA)


For the safety, welfare and health of persons of workplaces or in the
operation of high risk machinery against risks to safety or health. This Act is
administered by the Department of Occupational Safety and Health or
Jabatan Keselamatan dan Kesihatan Pekerjaan, Malaysia.

It is an act which provides the legislative plan to secure the safety, health
and welfare among all Malaysian workforce to protect others against risks to
safety or health in connection with the activities of people at work.

 Private Employment Agencies Act 1981


This Act is administered by the Manpower Department, Ministry of Human
Resources or Jabatan Tenaga Rakyat, Kementerian Sumber Manusia,
Malaysia.

It demands that agencies should have a valid license to carry out registration,
recruitment and placement of employees.
 Human Resources Development Act 1992
This Act is administered by the Human Resources Development Council or
Majlis Pembangunan Sumber Manusia, Malaysia.

This is an act to provide for something that is imposed unfairly on someone


and collection of a human resource development levy for the purpose of
promoting the training of employees, the establishment of a human
resources development council and fund and for the matters connected
there.

 Factories and Machinery Act 1967


This Act is administered by the Department of Occupational Safety and
Health or Jabatan Keselamatan Dan Kesihatan Pekerjaan, Malaysia.

An Act which provides for the control of factories with respect to matters such
as safety, health and welfare of people in the environment, the registration
and inspection of machinery and for matters connected there.

 Petroleum (Safety Measure) Act 1984


This Act is administered by the Department of Occupational Safety and
Health or Jabatan Keselamatan Dan Kesihatan Pekerjaan, Malaysia.

This act provides laws about how to transport petroleum safely and the
customers should have and approved storage installation and facilities and
also valid storage license issued by the relevant licensing authority.

 Trade Unions Act 1959


This Act is administered by the Trade Union Affairs Department or Jabatan
Hal Ehwal Kesatuan Sekerja, Malaysia.

It is any association or combination of workmen or employers within any


particular establishment trade, occupation or industry or whether temporary
or permanent to promote good industrial relations between employees and
employers, improve employee working condition, or enhance their economic
and social well-being, or increase productivity.

 Workmen's Compensation Act 1952


For compensation to foreign workers injured in the course of their
employment and to worker's dependents in the event of fatal accident. This
Act is administered by the Department of Labour or Jabatan Buruh -
Peninsular Malaysia, Sabah and Sarawak.
This act is to provide financially to foreign workers who were injured during
their employment and to provide for the worker’s family whom are relying on
him in case of death.

 Industrial Relations Act 1967


An Act which governs the relationship between employers and workmen or
employees and their trade unions and generally deal with trade disputes. This
Act is administered by the Industrial Relations Department or Jabatan
Perhubungan Perusahaan, Malaysia

An Act to provide for the rules of the relations between employers and
workmen and their trade unions and the prevention and settlement of any
differences arising from their relationship.

 Wages Council Act 1947


This Act is administered by the Department of Labour or Jabatan Buruh -
Peninsular Malaysia, Sabah and Sarawak.

 An Act to provide for the establishment of Wages Councils, and otherwise for
the rules of the money paid for work or a service. and conditions of
employment of workers in certain circumstances.

 Employment Information Act 1953


This Act provides the Department of Labour with power to obtain and collect
information and data on employment, terms and conditions relating to an
employment, from any industries in the private sector. This Act is
administered by the Department of Labour or Jabatan Buruh - Peninsular
Malaysia, Sabah and Sarawak.

 This is an Act to simplify the collection of information regarding the terms of


service and conditions of work of employed persons.

 Employment (Restriction) Act 1968


This Act is administered by the Department of Labour or Jabatan Buruh
Peninsular Malaysia.
An Act to provide for the limitation of employment in certain business activities
for Malaysia it is of people not being citizens and the registration of such
people and for matters connected with it.

 Worker's Minimum Standards of Housing and Amenities Act 1990


This Act is administered by the Department of Labour or Jabatan Buruh
Peninsular Malaysia

 An Act to prescribe the minimum standards of housing and nurseries for


workers and their dependants, to require employers to assign land for
cultivation and grazing in a place of employment, to require employers to
provide health, hospital, medical and social comforts and to provide for
matters incidental.

 Weekly Holidays Act 1950


This Act is administered by the Department of Labour or Jabatan Buruh
Peninsular Malaysia.

This is an act to ensure that employed workers are provided with a weekly
holiday.

 Children and Young Persons (Employment) Act 1966


This Act is administered by the Department of Labour or Jabatan Buruh
Peninsular Malaysia.

 This is an act to ensure that no children and young people are employed to
do any labor.
