AFFIDAVIT FILED BY THE 2ndRESPONDENT
Ch. Sai Prakash, S/o Venkata Rama Rao, aged about 57 years, Assistant
Secretary, in the Office of the Andhra Pradesh Public Service Commission, do
hereby solemnly and sincerely affirm and state on oath as follows:
1. I am the Assistant Secretary and Nodal Officer (Legal) in the Office of the
A.P. Public Service Commission. I am well acquainted with the facts of the case
and I am authorized to file this Counter Affidavit on behalf of the 2nd Respondent.
2. It is submitted that this respondent has issued Notifification.No.11/2023,
dt;07-12-2023 to fill up 899 (Executive-333 and Non-executive-566) vacancies as
per the indent given by various departments. It is pertinent to mention here that
Para.4 of the notification deals with reservations and Para.4.2 says that “There
shall be Reservation to Women horizontally to an extent of 33 1/3% in terms of
Rule 22, 22 (A) and 22 (B) of A.P. State and Subordinate Service Rules, 1996 as
amended vide G.O. Ms. No.77, GA(Ser-D) Dept., Dt:02.08.2023”. I submit that, in
the annexures to the Notification.No.11/2023 only the Vacancy Position as per
communal wise in respect of relevant post codes.

3. It is submitted that, this respondent has filed counter on 16-10-2024 denying
the allegations. I submit that, subsequent to filling counter, this respondent has
come to know that issuing the Notification No. 10/2025-RC, dated;06-05-2025 for
direct recruitment to the post of Office Subordinate under the A.P Judicial
Ministerial and Subordinate Service Rules,2019. Wherein, it was indicated about
the adequacy to be maintained in horizontal categories while filling up of the
vacancies. I submit that, this respondent intending to place the same on record by
filling Additional counter in continuation of the counter already filed in the case
for kind perusal of this Hon`ble court.
For the reasons stated above, it is therefore prayed that this Hon`ble court
may be pleased to grant leave to file additional counter affidavit in W.
P.No.15202/2024 in the interest of justice and pass such other order or orders as
this Hon`ble court may deem fit and just.
