On February 11th, 2023, the defendant Jane Doe was seen causing a nuisance in the public.
The
nuisance she participated in was damaging the private property of the landlord Jake Roe. Jak�
Roe owns a small business on 3050 Garden st, Whitby, ON, L1R2G7 in the same plaza as the
Town of Whitby bylaw enforcement services office. At 3pm on that very day, Jane Doe got into
an argument with the property owner and walked outside the property and began hitting the
property with a brick. It was around 3:30pm when she stopped because she saw the Bylaw
enforcement vehicle pull into the shared parking lot. I saw Jane Doe damaging the small
business and quickly made my way to the business. When I got out my vehicle there were many
witnesses taking videos and pictures of the scene, I talked to the defendant, and she gave me
her information and told me that she damaged the property because she was angry that the
owner of the small business had run out of muffins in the store. I let Jane Doe go home and
went and talked to the small business owner and he told me that Jane Doe was a regular
customer at the store and that she got angry because his shop ran out of muffins, he told me
that she was upset about that and began damaging the outside of his shop with a brick. I asked
the property owner if he had surveillance cameras at his property and he took me to the back
where I took copies of the video in which .lane Doe is seen damaging 1\/lr. Roe's property and is
seen arguing with him minutes prior to damaging his property. I also took his witness statement
and talked to another witness named Lily Gibbons from who I received an affidavit from in
regards to her witness of the incident. I then took some pictures of the scene for evidence. On
February 15th, I visited Mr. Roe's property again, where I asked him for his business license for
his small business, 1\/lr. Roe gave me the information I needed. After putting together all the
evidence, on Feb 17th, 2023, at 2pm, I issued Jane the certificate of offence

It is Saturday February nth'2023, the weather conditions outside are good, no rain or snow. At
15:30 I arrived at 3050 garden st Whitby, ON, L1R 2G7 in the Town vehicle where I witnessed
a woman actively causing damage to a small business shop. The lady noticed my vehicle pull into
the parking tot and stopped causing damage to the store. As I got outside my vehicle, I noticed a
Large crowd of people taking pictures and videos of the lady, I walked up to her and asked her
If everything was alright and why she was damaging the store. She dropped the brick she was
Using to damage the front windows and door of the property and walked over to me. I asked her
For her name and address and wrote that information down. She began telling me that at she was
very angry with the store owner because she was a regular customer at the shop, and they ran out
Of her favorite blueberry muffins. The store owner told her to come back tomorrow, and this made
her upset which resulted in her going outside and picking up a brick off the sidewalk of the store
And using that to hit and damage the property. She stated that she arrived around 15:00 and had
Started using the brick to damage the store sometime around 15:10.1 could tell Jane was very
Upset when she was telling me her story, so I told her that I had all the information I needed and
Sent her on her way home. I saw her walk to her vehicle which was parked right in front of the
Shop that she damaged. I took an image of her vehicle plate number and then went into the shop

To speak with the shop owner. The shop owner is Jake Roe, and he began telling me that around
15:00, Jane came into the store and was waiting in line. She did not seem bothered by anything.
When it was time to serve her, she asked for a blueberry muffin. Mr. Roe told Jane that they ran out
Of the blueberry muffins and she began screaming at him saying that she wants her muffin and he
Needs to go bake her one immediately. When Mr., Roe told Jane he was unable to do that, she
Became furious and stormed out of the store. He said before he knew it, she was standing outside
his store windows with a brick in her hands. Mr. Roe said she began hitting his windows and front
Door resulting in major damage to his property. He yelled at her to stop but he said she refused.
Mr. Roe said he was seconds away from calling the police for help when he saw me pull into the
Parking lot and Jane stopped causing damage to his property. I then asked Mr. Roe if he had any
Cameras at his property. He took me to his office where he showed me that he had two cameras
At his property, one inside the store and one outside the store. We looked through the surveillance
Footage together in which I saw Jane Doe arguing with Mr. Roe inside the shop at 15:00 and saw
her go outside and pick up a brick and start damaging his property at 15:11 until 15:30.1 asked
Mr. Roe for copies of the footage and he gave me two USBs with both footages. 1 footage of
Jane arguing with him in the store and the other of her causing the damage outside the store.

It was 16:05 when I asked Mr. Roe to sit down and please take a few minutes to provide me with
a witness statement as the incident is still fresh on his mind. He did so immediately, and I took that
With me. When I went back into the front of the store, I came across another witness named Lily
Gibbons, she told me she witnessed everything as she was present at the shop during the incident,
I asked her if she would like to give me a witness statement, but she said she would be unable to
Attend court or any kind of court procedure because she is unable to get time off work for it. I
Asked Lily if she had time to go to the court with me today and see if we can get her witness
Statement sworn before the courts. Lily agreed and so at 16:30, she met me at the courthouse
In Oshawa on 456 king street North, L10 5H7 and I got an affidavit from her that detailed what
She had witnessed at 3050 garden st in Whitby earlier that day between 15:00-15:30.1 thanked
Lily for her help and went back to the damaged property and took some images of the damage
Done to the property. It is Wednesday February 15th' 2023, the weather outside is windy, no rain
Or snow. I am driving the town vehicle to make a call with Jake Roe at 3050 garden st Whitby,
ON, L1R 2G7. It is 11:00 and I have finished talking to Jake Roe, my visit to him was because I
Needed a business license from him for his store that was damaged a couple of days ago on
February 11th, 2023. Mr. Roe provided me with the information I needed from him. It is now Friday

February 17th, 2023. I attended Jane Doe house at 123 Barn street
and I gave her the certificate of offence.

Today is Feb 11, 2023. At 15:00 i had a customer come to my store
located at 3050 Garden st, Whitby, ON. L1 R 2G7 and she ordered a
blueberry muffin. I told her that i did not have this item in stock and
she grew angry at me. She demanded that i make her a muffin
immediately and i told her that i could not at that time. She started
yelling at me and stormed out of the store, it was about 15:10 when i
noticed that she did not actually leave the parking lot, i witnessed her
from my cash register pick up a brick that was outside my store and
start hitting the door and windows of my property, she cracked the
windows of my store and did not stop until a bylaw enforcement officer
pulled into the parking lot in front of my store. This lady was a regular
customer and caused severe damage to my property. It was about
15:30 when she finally stopped hitting the brick against my property.
She left shortly after the bylaw enforcement officer arrived. I have
cameras at my store that captured all of the incident and because the
customer is a regular i know her identity as Jane Doe.
