Sub: - Promotion to JAO cadre – case of Shri Y.S. Somayajulu, AOS, Andhra Pradesh circle - reg.
We wish to bring the following issue to your kind notice for favour of necessary action.
Shri Y.S. Somayajulu, has appeared in the JAO LICE, held on 17.07.2016, and has obtained first mark in the
combined Andhra Pradesh circle. However, he is denied JAO promotion, on the plea that he had acquired
M.Com qualification, without acquiring a Degree. In this connection, we would like to bring to your kind
notice that, Shri Y.S. Somayajulu, AOS, acquired his M.Com qualification from the reputed Madurai Kamaraj
University. It is very important to note that, this university has been created through an Act passed in the
Tamil Nadu Legislature. The official has been continuously representing to the authorities for declaring him
as qualified in the JAO LICE.
In this regard, we would like to draw your kind attention to the discussion held in the 38th National Council
meeting, held on 29.04.2019. On the item number 3 of the agenda, the Staff Side demanded that officials
who had acquired M.Com and MA qualifications directly, without completing their Degree, should also be
considered in the JAO LICE. This demand was raised on the analogy of an earlier case settled by the
Corporate Office, based on the judgment of the Hon'ble Andhra Pradesh High Court.
The judgement related to the candidates, who had acquired the qualification of Degree, without acquiring
the basic qualification of 10+2, required for appearing in the JE LICE. In that case, the Hon’ble Andhra
Pradesh High Court had directed the BSNL Management to promote the candidates to the cadre of JE, if
they were otherwise found to be eligible. The BSNL Management had implemented the judgement of the
Hon’ble High Court.
In the 38th National Council meeting, the Staff Side demanded that officials who had acquired M.Com and
MA qualifications directly, without completing their Degree, should also be considered in the JAO LICE, on
the analogy of the judgment given by the the Hon'ble Andhra Pradesh High Court. The Chairperson of the
National Council was kind enough to direct the official side, to study the judgement of the Hon’ble High
Court of the Andhra Pradesh and see if an analogy could be drawn. However, the direction of the
Chairperson of the National Council has not been implemented so far.
In view of the foregoing, we earnestly urge upon you to kindly consider the JAO promotion of Shri Y.S.
Somayajulu, who has acquired MA and M.Com qualification without acquiring Degree.
